6:30 am
become compliant for a while. commissioner joseph: so we do not know if they applied for a permit. >> most of them do not. commissioner joseph: commissioner meko? commissioner meko: four were handled by the police department, meaning 40 of them were handled by you, correct? >> correct. : : -- commissioner joseph: anybody else? commissioner newlin? commissioner newlin: you have
6:31 am
them done by date right now, and i am wondering, arranging them by district stations, -- commissioner joseph: anybody else? >> just briefly regarding the notice of violation, i want to get a general sense. do these rise to the occasion of paying a visit to these venues? when they rise to the occasion if and when we receive a
6:32 am
fraction ability, subject to an infraction. i am looking at something that staff sees. >> i understand. most is on a second visit. but often, we will find that we were there because of -- or we are in the area, and when we do that, there is some kind of verbal warning. if we go back and the situation has changed, then they're given a written notice of violation. sometimes, depending violation, that is not the case.
6:33 am
it is serious enough that they should be given something right then and there. .acting director kane, most of what we feel is what would be a stepping stone or a milestone and if the situation is not changed, we go to something else. and as acting director stated, under our per view, that is important. unless this is something serious. outside of that, we really try to work with the individuals.
6:34 am
if that is, however, not working, then we need to take steps. commissioner: than just a follow-up question on the karaoke. when the legislation was passed, there was no supplemental in our budget or any additional funding to bring these venues into compliance. perhaps there is time to present this to the board of supervisors if this is beyond our ability so i would just look for your nod as to whether or not we need to start lobbying for that, because the ordinances
6:35 am
passed with no understanding about affecting staff. >> if i were to stop all current projects i was working, i would be busy just doing the karaoke situation. bringing them into compliance and also investigation and enforcement. commissioner: then i would suggest a very simple letter be sent to the board of supervisors to instantly help us get this legislation passed, making them aware of what this is about. let's call this a treasure
6:36 am
trove. in order to do our mediation at outreach, we are not able to do it with our current funding. that puts the board on notice that we are not ignoring our job. i think that could be easily done in a couple paragraph letter. commissioner joseph: could you please take a seat, sir? there is a seat back there. commissioner meko? commissioner meko: along the same lines that commissioner alan was just talking about, i think it is the first reading, but there is not a lot of room to include -- with regard to
6:37 am
suspension there is the issue of the city attorney. if we go into the new fiscal year, and things continue as they are, we are going to be out of money for the city attorney well before the next fiscal year begins. so we will have to go back to the board of supervisors. commissioner joseph: i love your idea, commissioner alan, but let me say that they may have some discretionary funds that they could allocate from time to time. commissioner alan: korea talking
6:38 am
about a very small percent, but that might be a debit between us being able to exercise that or not. then we need a little backup and support. commissioner joseph: any other discussion, commissioners? i'm opening up the floor to public comment. seeing no public comment, public comment is closed. next item on the agenda. to review and change eight permit for manner west, on harrison street -- manor west. is someone here? >> if i could call your attention to a couple of pages.
6:39 am
we warned them seriously about the sound violations. there were complaints we were getting from the neighborhood. hopefully we will have better news. commissioner joseph: please state your name. >> i am a manager. we previously handed out a letter demonstrating some of the things we have done. they passed around a document, which is an email, and there was
6:40 am
also an issue. in reviewing the tape of the last meeting, it would shunted aside, but i want to give them a little bit of background. noise control, there are one of the best contractors. you have that before you. the manor west performed a sound with the officer. i do not see him tonight, unfortunately. i think mr. granelli was at the
6:41 am
end of that particular sound test. they were asked if they could crank it up. this was about 20% above what they had the day before. they did a sound tests. also in an apartment and up on a roof. knock on wood, i think we have done a successful job here, and we think the residents, because there were windows that were open, and we pitcher feud with their quiet enjoyment, so we apologize. -- in we interfered with their quiet enjoyment. -- and we did. >> we did another test unknown
6:42 am
to the club again later that night. unfortunately, i was hoping to have a report for you guys. i do not have it. talking on the telephone, he seemed very satisfied with both what the club has done as far as soundproofing and changing the sound system and also with talking to some of the residence. they seem pretty satisfied, as well, with the results. both on the roof and the side of the building. any kind of sound was well within legal and standard limits. so we are pretty happy with what we found.
6:43 am
i do not see this becoming a problem. commissioner joseph: commissioner meko? commissioner meko: with regard to the letters or the emails that you just passed around, i am not exactly clear what your point is. we discussed this two weeks ago. she just stated that she had never heard any noise. the second email just reiterates that. in your letter to the entertainment commission, you make reference to the fact that
6:44 am
there would be a sound test, and then you point out only one resident -- i am not sure. is this an attempt to pit one resident against another? the resident has been appointed to represent the residence of the building. if i am seeing something there that is not, i apologize. bringing on the most knowledgeable attorney that they could.
6:45 am
let's just be clear. there clearly were problems. the venue has addressed many of them. it's not, that is wonderful, and maybe we should just move on. >> again, commissioner, thinking for the comments. i have been doing this a long time. do not get into a fight with the neighbors because you will lose. this is a no-win deal. you take them very seriously.
6:46 am
you correct the issue. i think he will tell you that is exactly what i said. we as an industry have to deal with the fact that there is new construction, new residences. and the best way to do that is -- the way they have shown they have done this is to work their tails off, and do not pick anybody against anybody. commissioner meko: it should not be easy to open a nightclub, and, clearly, it is not. there is a potential threat the
6:47 am
neighborhood. but it should be fair. if you do the right thing, you should be rewarded. you should not have to drop through hoops after the fact. i really appreciate your remarks. particularly the advice and of giving your clients. it -- >> good evening, but commissioners. he has been very instrumental in addressing the sound problem. we understand it is impossible to resolve. he has our contact information.
6:48 am
we will be addressing more problems if there is any. we like him there. he is a great resident. commissioner joseph: thank you. any other questions? >> no, i was just going to ask if he was going to speak. : : -- commissioner joseph: why do you not have a seat, and will open it up? >> thanks for everything you have done and the direction. a lot of sound work has been done at the club. we know each other better.
6:49 am
i feel we are on the right path to becoming good neighbors. i will continue to follow throat to let you know how progress is going. there was a sound test on saturday. it went well. mano west mentions that the sound was turned up. i did not hear anything if anything in all. and the sound the war rest of the evening -- this down the rest of the evening -- the sound the rest of the evening, i
6:50 am
am happy with the progress that has been made. there were three other sound tests. they all went well. but then, the preceding night, and this last sound test was a success. i am happy with that. we'll be working with the neighborhood. commissioner joseph: thank you. public comment for manor west?
6:51 am
an action item, i am not quite sure what our action would be. commissioner alan: i would like to move that we accept the testimony that has been given to us and that we pass until further notice the need to follow manor west with regard to their sound and that they will main diligent so they come off of our radar. if it is an action item, " we can accept these recommendations. commissioner joseph: ok, thank you. next item. item no. 5. commissioner alan: i think it is
6:52 am
important at a moment like this when everyone comes together with a solution to the problem. i think it is important to pat everyone on back because it is all too often that they have less care for their neighborhood. they have work to be a good neighbor. " commissioner joseph: so noted. commissioner meko: and can i add to that that we have a reasonable neighbor, as well? commissioner joseph: so noted. commissioners, i would like to entertain a motion to continue this item for the fact that
6:53 am
present -- present -- president roja is not here. i have a motion and a second to continue this. any public comment? seeing none, public comment is closed. [reading roll] item number six, review and possible action for the place of entertainment permit, including but not limited to the security plan of the good neighbor policy. are they here? and i just want to note -- i see from some of your speaker cards that they want to speak of posen be even action.
6:54 am
nothing we are doing tonight is going to be closing jelly's, and i also want to ask how many people are here to speak? a show of hands. all right. when we begin comment, you will have two minutes to speak. >> i apologize, this is number five, but it is actually no. 6.
6:55 am
this is the purpose for educating everyone here who might be listening. there was a suspension of the place of entertainment permit. there was a homicide that at 1:00 in the morning. the suspension was effective from july 12 until july 19 at 5:00 p.m. this did not impact the fee or beverage service. ilc required a permit review -- i also required a permit review.
6:56 am
so it was really important that we brought the owners into compliance. this is also an opportunity for the public to express their concern. and there was an eviction notice. a permit review remains relevant.
6:57 am
they are recommending a set of conditions. others impose conditions, as well, yesterday. some of them are very similar to staff recommendations. i am not entirely sure whether the owner of jelly 's got these. kind of following along and for the purposes of the audience here, i want to read these.
6:58 am
this is how they will be operating. commissioner joseph: in this memorandum, there are 14 conditions. and there are 17 conditions. and while you are doing this, once they go into effect, they will become part of the permit.
6:59 am
part of the permit, and you must operate under these conditions. >> the operators are here. i had not reviewed the plan you put together. they do not have a problem with putting -- implementing these conditions. i understand they made a point that the suspension is not something before the commissions, but one of the issues we want to address is the commission's hav
