if you are going after light, you have to be there with the window scraper and clean everything off. i would like to know because i have never been able to get from the police department and any of the district's what your criteria is when you support or oppose other entertainment, the liquor license, or anything else. does your statement actually have criteria that we can see that you can make a judgment on? >> i apologize but i am not the permit officer. i don't know what to the criteria is. >> than we have the wrong people represented the department, is that correct?
5:31 am
>> no, that is not correct but i'm here representing the central statement. >> the believe that there is a written criteria? >> i believe there is but i am not familiar. >> you are not the permit officer because i would like to know whether or not everyone of the restaurants and other businesses in north beach area in particular that have on their premises what falls other the -- under the other entertainment division are actually licensed to do so and whether your station has that type of control documents to know that when your officers go out on patrol and they here lies amplified music
5:32 am
coming from someplace, they have some reference as to know whether or not they are licensed to do so. is there such a control? >> i believe that we have documentation on how to control that. >> it is my belief that i hear and they hear music emanating from many of the doorways and windows in north beach and some have never gone through any permitting process. i'm wondering if that has ever been checked? >> i know that steve has gone out there on the evenings and weekends. i know that he has done checks as far as amplified music.
5:33 am
>> would you tell mr. mathias, anyone above him, and i, we would like the city police department criteria for when they come before us. without that, it is impossible to take the police department seriously. >> certainly. >> thank-you, a gentleman testified about the three and dinners for $13. if someone else joins me, we have more. this reminds me when it was a new peace. i cannot go back quite as far. i don't know if they did any
5:34 am
karaoke but they did something because they heading year-old with the new york yankees coming over on ships. they have the menu up on the wall, it was $8 or $7 and you got soup, salad, wine,'s the. in regards to the entertainment issue, red of the street from my office, there is a silver clouds and they have karaoke there. i don't know if they have any problems. they do serve food and they also do the karaoke later in the evening. it seems to be okay. i would be supportive. i would be supportive under the following circumstances. i think we should have something
5:35 am
that says other and entertainment use consisting of or exclusively karaoke machines on the ground floor and they would already be in the conditions. certainly, if this is an issue, the project's sponsors will work with the police and others on the signs. it does not hurt to cooperate and the hours terminate at 12:15 p.m.. maybe they are already in the notion. this is supported by the entertainment commission. i think the noise should be mostly within the place unlike a lot of the establishments. i believe that we have that language already in here to some degree.
5:36 am
>> second. i've had friends car broken into. i was walking on thursday of last week and all the broken glass from cars broken into. the number one climb in the city is related to property. i am frustrated by this because the number 1 in the crime in this city, we are not doing anything about this. we are doing karaoke machines.
5:37 am
where was that our neighborhood night out? where is the police activities league? plan really struggling when i read this in my local newspaper, my neighborhood community newspaper because this is a real true issue. maybe you are only the entertainment police. that is my frustration here. for me, this is always about
5:38 am
fairness. that is the number one thing about my life when i got to play. i want to know that things are fair. how is it that every single business that would like to do something are associated with that things just because they are in an area where these things happen. guilt by association does not work for me. hong my people are often racial profiled. this is the same kind of thing. i have to understand the basis by which you make the decision. they don't need four of the criteria and therefore we don't support you, that makes sense to me. when i only hear one or two
5:39 am
voices of opposition, i have a hard time understanding what was the criteria or why. i'm wondering if they have an entertainment permit? i see many places in north beach blasting music. i have spent more nice than i'd care to remember at the silver clouds. they advertise on tv, they have ads in the paper, they have surf and turf in addition to karaoke.
5:40 am
i was at a tavern next week. he owns a lot of high-end restaurants. karaoke does not lead to an atmosphere an informant in a nightclub. if you spent any time, it is completely the opposite. this is not the atmosphere where people dead and up. there's nothing really compatible with karaoke in a nightclub because this antithetical to what you want to create print the. i went to some of these places about a year ago.
5:41 am
all local guide says that this places kid friendly. takeout is available. there's quite a bit of evidence that this place is functioning as a restaurant. i have said food there. in terms of the signs, the planning code does not prohibit people from getting the signs in the windows. if there is a problem, then we can deal with that. if this is not in the code, people cannot get in trouble for something that is not illegal. i have a hard time understanding about this. if anyone has been in a karaoke
5:42 am
establishment, and not the private rooms, but in a place for you have a storefront and where you have food and this is a completely different kind of environment. this restaurant is open late and it is cheap food. this is what people really want. every single restaurant, even the high-end, are offering drink specials. when i was 21 and making $18,000 a year, i aid exclusively from happy hour. if you don't have a lot of money, that is how you eat. if you get food and drinks and this is per -- perfect.
5:43 am
5:44 am
>> i will vote against the motion. there is already testimony here. this is being advertised as a sports bar and not a restaurant. there is a direction disestablish mistaking. -- this establishment is making. there is a continual assault on the neighborhood character. north beach has been a place for people have lived and worked. over the years and decades that north beach has had this particular characteristic, this is catering to a number of different types of people,
5:45 am
people with different interests, people who live there, they have always been able to maintain a balance. the problem with various requests we have been getting is the balance is going away from this neighborhood character. we don't have any information from planning staff with respect to other entertainment facilities in the area. we don't have information from the planning staff that says that there are other machines in the area. we don't have been for permission -- information or a floor plan that shows where the tables, chairs, stools, and everything is with respect to this establishment. we don't have any information that tells me whether the merger of the two storefronts are in excess of the square footage for
5:46 am
use in this area. maybe you got back to me, mr. crawford, and i apologize because i did not read the last e-mail. this is not in my pack it. i think that necessary and desirable terms not just on one particular establishment but also a pattern of development going on. all would have to agree with the police department that based on this bringing to broadway, this is a very delicate area. we are not up on grand avenue. we are right next to the entertainment zone. anything else that continues to increase the possibility, we are already looking at this.
5:47 am
>> i have some questions for you. the sergeant fisher, a couple of questions to ask you about. the issue here with you is that you believe that have been this will increase the likelihood of crime. is that correct? >> the problem is that we will be coming up to broadway and columbus and people hanging out in front of the clubs and going out and drinking and becoming drunk.
5:48 am
>> are you willing to ban all new liquor licenses. courts have come you have not banned this? >> i don't know. >> you to stated to me that alcohol is the number-one issue. >> you will be singing karaoke, this could increase the possibility of crime. the police department has supported some liquor licenses which is beyond me from a logical perspective that if the alcohol is the number one issue, why has the department supported
5:49 am
the liquor licenses. in district 3, and that quarter, the police have not supported this or remained neutral. brown came here last time. this is a fairness issue. if the alcohol is a major issue, shouldn't you come out and say, no more news alcohol? >> we are not able to stop businesses and the path prevent
5:50 am
businesses from thriving. when we get a license change, we can set conditions. >> with crime, alcohol, if this is the number one issue, how come you are not stopping the liquor license. >> we are asking for a karaoke machine, singing, whatever. both of you come out here and you are guilty until you prove you're not guilty.
5:51 am
5:52 am
5:53 am
if you are not hiding anything, where is the information. i am only asking what you have supported, not supported, and remain neutral. i would like fairness. i want to tell you that the karaoke machine will lead to more crime. if you will study that, i want the police to show the evidence that in the castro, south the market, we have problems because we have all call and karaoke machine. can you give me one case where you found this to be a problem.

the signs on the building. >> and the north beach district, the code leaves out requirements for definitions for the wall signs. for the window signs, they should not exceed 1/3 of the area. the wall signs, there is a calculation that it shall not exceed two square feet per foot of the the street frontage occupied by the use.
5:58 am
>> if anyone has compared these buildings is a their locations, i would say that there are many signs on this. i think that in and of itself the values the building. on -- devalues the building. i would ask that that is being changed. others are not quite as important as the corner building. othe land concerned about the

possibility of the disturbance. >> could i call your attention to the conditions of approval. number 8 speaks to ensuring future exterior alterations are consistent with standards. those can be modified >> any comment consequential permitting? what is the next thing we are not going to permit to on this particular establishment?
