taking that away will hurt many, someone speak in favor for keeping it in open for that reason. on a practical level, the port has made public statements that this is a public safety issue. i don't think it's the port's responsibility to take vengeance upon this tragic death. joey's in a very expansive area. i would say it provides more security now than anybody else. you know, there's no people patroling the parking lot. it can't be responsible for every bit of area around it. it is in a fairly separated

area. joey's did provide the security and that was validated also by the entertainment commission when they spoke with the bay view police. the entertainment commission removed joey's permits. they have every right to take it away. i think now they have even even have the power to shut down the club. but they went through 17 items with the police department, and joey's, who had a very old permit, was in compliance with 14 of them, even though that joey's original permit only had three stipulations. and the other three joey's was committed to doing. if the police department is satisfied with the public safety efforts made by joey's, then i have to insist that the port should be satisfied as well. thank you. >> david henderson? >> wow, what a day. congratulations to the commander

and all of you for doing a great job. my name is dan henderson. i reviewed the very fers lease here 16 years ago. i've been doing commercial real estate for about 25 years in east bay. also over here out of state. it's horrible when anybody gets shot. there's no doubt about that. but my understanding is i was there the day after, and the place was tagged. it was my understanding, people recognized the symbols that were spread on the trash cans. i'm not here to make any judgments on anybody. any time someone gets hurt, that's something. i haven't gone to joey's. you want to talk about tragedy, she lost her parents when she was 12 years old. she and her three sisters are lawyers, they're the people that are the fabric of this community for generations. there's probably 20 people that are in her family with all her sisters that work or have worked at joey's.

these people are san francisco. just like the giants season ticket holders. these people have been here. she has run clubs. she made all five of bill graham's clubs. hired and fired every waitress. every time i've got to joey's, there's two guys standing outside. she has had a lease one year at a time for 16 years. and yet she spent over a half million dollars on your property. i'm in commercial real estate. we can all do the math. divide it by 12%. that's the money. i don't know about the types. i'm not aware of all that. but certainly i'll review it. and no doubt, tragedy is tragedy. but that has nothing to do.

that's outside. we go and walk over and see giants, whatever venues, whatever is going on with the venue. when you have that big of an expansion, what are you going to shoot? the people are going to come to an open area. they said two guys showed up, a guy was drawn out, so he had nothing to do. they don't recognize -- they didn't recognize who the guy was. it wasn't like he was a regular there. they have nothing to do with joey's. an incident happened in their restaurant bar. so i know san francisco. they have a place in the mission.

they took a shot down there. it provides a good, safe environment. a bad incident happened. >> we're talking about the builder? >> i came from sacramento. actually, part of sacramento. we have a strong and salsa-type music following. so a lot of us came down here in san francisco to joey's specifically on sunday's. so i know as far as all my companions from sacramento that we really enjoy jelly's. and we'll certainly regret it. all of us have felt safe at joey's, it advocated a clean, healthy, fun environment. i'm not aware of the details.

waterfront. secondly, last night my son called me to say, gone to berlin. go outside and see how it's turning around. this is not right, especially with the historic ferry building. i tell you when you're right most of the times in waterfront. they've done a beautiful job. all these renovations got done. this is so badly flawed. it's not what the people want. so please go back and review this and see that it's not right. especially with the waterfront plants with the bay.

2010. the legal action filed against the city was precipitated in our view by the violation of ceqa. our attorney's legal interpretation of the coalition lawsuit is described in the following paragraph, and i quote. ceqa applies to any action that may have a significant environmental impact. it is important that environmental review occur as early as possible. it's not just a prow forma rubber stamp of a project that was already approved. the california supreme court recently ruled that actions short of an official project may be illegal if they move the project momentum significantly forward. the city of san francisco has, in my view, violated ceqa and allowing the planning commission to adopt a resolution that

"recognizes the design principles and recommendations of the northeast embark der row study for new development in this area." without first satisfying an a.i.r., it has guidelines for site design, articulation and quality materials based on the planning commission's "recognition" of the study. the port of san francisco to consider the principles and recommendations in the study as part of its review of proposals and improvements. after that happened, a revised application for the eight washington project incorporated increased heights recommended by the study. the lawsuit requests that the san francisco superior court issue a mandate ordering the planning commission to rescind its action taken relating to the study and to refrain from

>> in this fabulously beautiful persidio national park and near golden gate and running like a scar is this ugly highway. that was built in 1936 at the same time as the bridge and at that time the presidio was an army and they didn't want civilians on their turf. and the road was built high. >> we need access and you have a 70 year-old facility that's inadequate for today's transportation needs. and in addition to that, you have the problem that it wasn't

for site extenders. >> the rating for the high viaduct is a higher rating than that collapsed. and it was sapped quite a while before used and it was rusty before installed. >> a state highway through a federal national park connecting an independently managed bridge to city streets. this is a prescription for complication. >> it became clear unless there was one catalyst organization that took it on as a challenge, it wouldn't happen and we did that and for people to advocate. and the project has a

structural rating of 2 out of 100. >> you can see the rusting reinforcing in the concrete when you look at the edges now. the deck has steel reinforcing that's corroded and lost 2/3's of its strength. >> this was accelerated in 1989 when the earthquake hit and cal came in and strengthened but can't bring to standards. to fix this road will cost more than to replace. and for the last 18 years, we have been working on a design to replace the road way, but to do in a way that makes it appropriate to be in a national park and not army post. >> i would say it's one of the

most ugly structure, and it's a barrier between the mar sh and presidio. and this is a place and i brought my dogs and grandchildren and had a picnic lunch and it was memorable to use them when we come here. what would it look like when the design and development is completed. and we are not sure we want an eight lane highway going through this town. and it's a beautiful area in a national seaport area on the planet. >> the road is going to be so different. it's really a park way, and it's a parkway through the

national park. and they make the road disapeer to the national park. >> and the road is about 20 feet lower, normally midday, you go through it in two minutes. looking back from the golden gate bridge to presidio, you are more aware of the park land and less of the roads. and the viaduct will parallel the existing one and to the south and can be built while the existing one remains in operation. and the two bridges there with open space between them and your views constantly change and not aware of the traffic in the opposite direction and notice the views more. and the lanes of course are a

foot wider than they are today. and they will be shoulders and if your car is disabled, you can pull off to the edge. and the next area, the tunnel portal will have a view centered on the palace of fine arts and as you come out, you can see alkatrez island and bay. and the next area is about 1,000 feet long. and when you come into one, you can see through the other end. it's almost like driving through a building than through a tunnel. and noise from the roadway will be sheltered. and the traffic will be out of view. >> when you come out of the last sort tunnel and as you look forward, you see the golden dome of the palace of

fine arts and what more perfect way to come to san francisco through that gateway. >> it will be an amazing transformation. now you read it as one section, the road is a major barrier and then a wonderful strip along the water. all of those things are going to mesh together. >> right now the road really cuts off this area from public access. and with the new road, we will be able to open up the opportunity in a new way. >> this bunker that we see now is out of access for the general public. we are excited to completely rework this side and to open up the magnificent views. and what we want to do is add

to this wonderful amenity and restore this coastal bluff area and respect its military history and the doyle drive project is allowing us to do that recorrection. and this area is not splintered off. >> and we can see how dramatic a change it will be when doyle drive is suppressd and you have a cover that connects the cemetery to this project. it's historic on the statewide and national basis, but you could rush the project or put thought and time to create something of lasting public benefit. >> we really want this, for everyone to feel like it's a win situation. whether you are a neighbor that

and the fire department. i just wanted to talk about two items today, specifically a letter that was submitted from the office of labor standards enforcement concerning electrical work and solar jobs here in the city. it is an understatement to say there is a little bit of drama going on with some of the solar jobs in san francisco, but as an industry person, i would like to take this chance to get on the record as saying these are electricity producing solar panels, and it is in the best interests of everyone to have responsible contractors using trained electricians. every panel is an electricity- generating device, and these panels can generate upwards of 600 volts, which is extremely dangerous, so we are looking out for a person here.

i have a packet of letters i submitted to the sfpuc regarding in city hall job. i have more copies if you need them. basically looking at the scope of work that is defined through the state, and i would be happy to answer any questions after my time. but we are in corroboration of the letter submitted from the sunset reservoir for the wage determination on these projects. i cannot get into jurisdictional issues. those are between contractors and labor unions, but legally, this work needs to be paid at a specific rate, and that is dictated by these factual documents. once again, the office of labor standards enforcement has, in our opinion, for our industry, done a great job
