singing waiter. the restaurant is specifically crafted so that because of the broad definition of entertainment it specifically ask for opera singers and singing waiters and nothing else, so that is going to be heard on november 18 of the planning commission. right now they have gotten tremendous support, and hopefully we will be able to come before you. there is an increased presence of the fire department. the concern is the doorways, which are sometimes wrote off. the fire department is concerned about locking exit's of the doorway -- blocking the exits

client on the planning commission common which is the preservation jazz hall -- commission, which is the jazz hall. it started in 1957. they have been approached by new york city and chicago, and they decided to do the first outpost out of new orleans in san francisco, said that is coming before us. this is an exciting project i am hoping we will see that the application in the spring, but i do know we are bringing in three applications on friday. what that means is people are doing deals, building new businesses, and i think that is a hopeful sign.

>> you could. >> this will be continued. item #3. >> good evening, commissioners. we are going to go in order of my subtitle headings. the first item is a policy of state. i want to reiterate that the promoter legislation will be scheduled for public safety committee on november 18. i do not have an updated version. we may not see any revisions until the date of the hearing at the board of supervisors, but i just wanted to update you on that progress.

i wanted to give you an update on halloween. we worked closely to create a list of the events happening all over the city during that weekend. we believe we came up with a comprehensive list and have not received any reports about surprises in the one our stock -- anyone on our staff came across. staff received two reports of fights at hotel parties. i think he might be able to give a little more details. halloween proper was on sunday night. the streets remained open to all vehicles all night. staff has had no reports of problems on broadway through the weekend, and i think the world

series may have something to do with it, but the think we can confidently say halloween weekend was a big success. i wanted to present to you the beginnings of the discussion regarding an entertainment commission retreat in january of 2011. i know it is fairly general. staff proposed have friday at the location outside of city hall, but it is something that would be helpful for staff to know what the direction of this commission should be. this is a very different commission from the last it is a

very different makeup and different for us on staff, and i think it would be something i would ask you to discuss and maybe find an appropriate, and i can do the legwork but also think about fleshing out some kind of agenda. i wanted to report to you that as of october 30, 2010, bob davis has submitted retirement. those details have to be determined based on his ability to come back down from out of state. it is up to the entertainment commission as to how to proceed with a new director, so i did attach a legal opinion written

by the city attorney dated february 12 regarding this matter. it is also regarding a few matters on how you operate. the would ask the to take it out of the binder. page nine has specific information about how you appoint an executive director in concert with the mayor's office. also, there is other information in that memo, so it would be useful to keep that with few and referred to it as necessary. the update on the citation issued is that we continue to issue citations, which is good news. he began issuing citations

during the weekend of october 23, and he issued five citations to date. it does not sound like much, but it was a hard one to get there. i kept a list, and i will keep a list of ongoing permanence as a matter of information. we finished october just behind september with 57 of these in along month. the board of supervisors appointed us a new commissioner. some of you may not have noticed a new face. he was appointed november 22 and sworn in the same day. he was given a short orientation by staff on friday, november 5.

please join me in welcoming him to the entertainment commission. he might want to say a few words if he is comfortable, and lastly, under the heading of corrective actions on permits, on monday, november 1, there was a homicide with a gun located on scott street. i think it was 2002. you have a copy of it with some information. staff owners on tuesday, november 2, and it affected a seven-day suspension from 5:00 p.m. that day extending through the weekend until today the club ownership agreed to new conditions submitted to them formally on tuesday november 22

to take effect on november 16, 2010. all this information, including the suspension and the order, were sent to command staff in the northern station, and i also am copying a number of documents, starting with a letter to the venue, so you can see what these look-alike. -- look-alike. i gave you what these look- alike as well as the order to provide security plans, so you can see what i am sending everywhere. that concludes my report we could do questions now, or we can move on.

meet with them and serve them their suspension within 12 hours, so the last few instances we have been able to act that quickly and even quicker, which is good. i am working with the city attorney on a complaint out of mission, which we have had as a nuisance complaint for a while, but we had an issue of violence. the city attorney is contacted, and we are doing most of the investigative work for them on that case. we have gotten a new security plan. it has been reviewed. everything looks good. it is important in that this is the first security plan we have on record, so that is due news.

we will be meeting with the city comptroller office about the process. they're pulling together administrative citations in the city and will be going through the process of when payments come in, how we will be notified, and so forth. how we went off pretty well this year. i think a lot of it had to do with the giants. halloween at the castro los crowded. if you move one block past 18th street, the crowd thinned to the point of being non-existent for

the first time ever. over the whole weekend, i was able to travel. commissioner joseph traveled with me for a little bit. because the crowds were not as thick, we were able to cover more of the city. we're looking into the following complaints -- the seller, jays galleria. we have been in contact with management, and the 300 block of the fillmore area. i have been in touch with people, and there's a lot going on there, but the bad news is

there is a lot of people in the area during the weekends. we will be dealing with a small section of it. the following venue's received citations -- mighty. we have a minor incident list. we have an incident at the westin hotel. the major incident was a shooting and aggravated assaults, and we also hadn't two assaults about a week apart out in mission, which we are also looking into.

we are trying to do a little more research on that. one thing we are coming across more and more -- we are doing events without permits. we found a decisive event. no permits were involved. we are working with how we deal with those situations. when we find those venues having un-permanent the events, we are working with the units. they are being given notice of those venues because they are in violation, so they are looking into it as well. that is how it is going to occur. >> i just have a comment.

i received an e-mail, and they have put together a plan, and they have applied for occupancy permit of their sidewalk during hours of operation, and i think they were granted the. i think the cause is $5,800 for the year, and i did not write them back, but i think someone should contact them, and if they have an occupancy permit for the sidewalk, they should forward a copy of it to us. i think applying for the permit was a result of the citation. >> that is noted.

the response to the shooting, and it showed some proactive movements. >> when you were discussing the new conditions, where metal detectors ever discussed? >> i think they were. if you look behind the memo -- did you find those conditions? >> there are metal detectors on there? >> if there is, then yes. we go through each of these. we have a longer list common -- a longer list, and we talk through them with the owner. >> i do not seem metal detectors listed as one of the conditions. >> if it is not here, then it was not listed.

>> we did talk to them about metal detectors. i do not think metal detectors made it on to that list. one of the bigger issues was access in and out of the club, which this particular incident directly relates to, and also really good comprehensive having of patrons as they come down. -- box patting -- good patting down the of patrons as they come down. metal detectors work, but they only do work with someone who knows how to pat them down. it is generally good on its own.

i have had metal detectors very easily. we are much more focused on controlling entrance into the space and making sure people are getting patted down. >> if i could add to that, we are searching for the breach in security. we have a situation where a gun was inside the venue. the end result was the worst possible end, but when a gun gets inside of the venue, we want to try to crack a condition so we do not have the problem again. there was pat downs and reiteration of that, but not of women.

they admitted they were cutting down just men. no. 14, we put in specifically asking that the site is monitored by video surveillance, because if that is the breach, that is one way to handle it, and the pad down is something the needs to be addressed in the securities plan, and we expect to see attached downs of men and women with appropriate security guards trying to cover the breach. >> how does it affect their confidence? if there is ever a time it might

be appropriate? >> one way would be to make sure they are hiring licensed and insured securities trader a good security company would know what they are doing. they have the experience to do it accurately. we see venues and they say, who is doing your security? a friend of mine. he has been doing it for a long time. that does not mean anything to us. another issue is that the security they had been using -- we really could not attest to their qualifications and/or experience. a security company was brought in, and they have a good

reputation. they have been able to come in to that particular location, which i observed this weekend, and i watched them have people down. >> this was brought up before in our collaboration with the police department. they actually have security personnel made with the police, and the police demonstrate of proper pad down. maybe staff can think about opening discussions again with the police department to see if there would be willing to do a demonstration.
