forwarded to the board, because what we have is something that strikes the right balance in terms of addressing a number of interests. supporting existing businesses on the corridor, minimizing the environmental impact, including the issue of traffic congestion and also bringing businesses that are committed to providing local jobs for residents of the bayview and neighboring communities. so i really don't have anything beyond that to add, other than to say that my office certainly is very proud of the work we've done and, again, grateful to you and your office for helping to make that happen. supervisor maxwell: thank you so much. why don't we hear from planning or >> good afternoon, supervisors.

i'm on the planning department staff. last thursday the planning commission recommended approval of the bayshore boulevard project unanimously. that was as an amendment to the [inaudible] the legislation covered planning code, map and -- i'll briefly go over the map first. [inaudible] a few industrial parcels down there. you'll talk about them first.

this is a total of eight parcels that are currently zoned c.m., which is heavy commercial. that's one of the older commercial and industrial zoning districts that the planning department is trying to phase out citywide. it's very permissive. these parcels are zoned heavy commercial and industrial protection zone, which takes away the possibility of housing and offices there. and what we're suggesting here is very simple rezoning. again, this is from c.m. heavy commercial. to pdr-1g. the zoning already prohibits housing and restricts office, so the industrial protections on overlay is not necessary anymore. and we've done a lot of

outreach here to make sure that the existing thriving businesses there can proceed with their plans, etc. and we're really thinking of this just as a cleanup. the larger portion -- so going back to bayshore boulevard itself, currently it's zoned m-1, which is light industrial. and, again, the yellow line here is this industrial protection zone, which is an overlay. again, the light industrial m-1 zoning is one that is very permissive, and citywide there's been an effort to change that to the p.d.r. zonings, which are tailored to today's needs for industrial areas. as you can see, most of the bayview industrial areas have already been zoned pdr-2, and

there was a desire to leave the rezoning along bayshore boulevard from when this economic development framework is in place. so the current proposal for rezoning really ties into the desire for a home improvement sustainable district. and very simply, what the proposal is is to extend the p.d.r. 2, which is the core production distribution and repair area, over to the parcels, all the way to highway 101, and then adjust that with a new special use district. the new special use district has some specifically tailored provisions to support the economic development action plan. let me just go over just some of the highlights. first of all, the biggest highlight is that retail will be allowed here.

p.d.r. 2 does not allow -- does restrict retail and here we're going to lift most of those restrictions on retail. there will still be conditional use authorizations for very large retail. we'll also introduce -- and that's over 50,000 square feet. sorry. the formula retail, anything over 10,000 square feet, will need to get conditional use authorization. it will also have to abide with local employment agreements that are part of the redevelopment agencies procedures for the area. again, everything on this side of 101 is a redevelopment agency area. there are a few other tweaks that are in this special use district. for example, automotive businesses, will need to have conditional use authorization,

and then miscellaneous things like, for instance, we have fringe financial, stuff like that, will also require conditional use authorization. there's design guidelines, which the commission adopted also unanimously on thursday, that control how the buildings will look and how they interact, particularly around parking. there's a lot of material in there. you were given copies of that, and i can answer questions later. but that's not something that's before you today. and the last tweak is it removes minimums. so it simply removes the requirement for parking. that was a high-level description and i can answer any exess. supervisor chiu: i forgot to add a couple of points. as was indicated, there have been some recommendations for the planning commission, and it is my hope that those

recommendations will be adopted, including the language that emphasizes the special use district's local hiring intentions. i know it's a priority for all of us, including that formula retail that uses 10,000 square feet and above to comply with the bay view hunters employment. oh, that's already in there? ok, my apologies. lastly, just t make sure that that happens. supervisor maxwell: thank you. anybody else? planning or the other departments that have been involved? no? all right. then why don't we open this up for public comment. >> my name is francisco dekosta.

as one of you know, i'm very familiar with this area. in this economic times, we have to be very careful to look at this area in a holistic way. most of this area is where the small businesses are, and i do not know if the businesses and some of the homes that are in this area were brought together as a focus group to address the concerns. in all the development that's going to happen over here, if you have eyes to see, you see a freeway.

and whenever you have a free way -- freeway, you have the issue of particulates. now, i didn't hear anybody speak about this, but the area around silva is a hot spot for saturated particulates. and so the area from silva on old bayshore going down, we need to get some testing. we need to get some air testing. and some of you are sitting on this board know about the requirements because you represent the bay area and quality management. i'm bringing this because i'm the director of environmental justice advocacy. you can look at development, and development is good, but

more than development, quality of life issues. and in quality of life issues, we need to garner some empirical data and find out if people who are living on that corridor that is targeted, if we have asked them if they need this. maybe they need it. but we also need to find out about the health issues. right there at silva and old bayshore, there are about 20 or 24 units. and everybody who lives in that building is adversely affected and has asthma problems. and there has been a lot of them who started living in that building and got out of that building. so we need to find out about it. now, you ought to know that because of lowe's, it's going to be a big benefit. and lowe's did a good thing,

because they not only addressed that, but they addressed the parking. so i just bring that to your attention, that we need to do some testing on the air. people should get that empirical data. exoy next speaker, please. >> supervisors, joseph smith. i'm here to speak in favor of the rezoning proposal in front of you. they spent a tremendous amount of time on this effort. when home depot proposed the development on bay shore, they exploited the fact that it was bordering two neighborhoods. boundaries can be opportunities for breaking down barriers so we can work together towards a just and equitable community

for all. this rezoning is about local hiring, it's about public process. we know the goodmans are here for special consideration. they asked for that at the planning commission. we feel like that disrespectful. out's disrespectful to what we've worked on with our bayview neighbors, and what we see is that this rezoning, what's in front of you, represents progress. we don't want to go backwards. as supervisor maxwell recalls, the home depot proposal would never have gone through any kind of public hearings if the neighborhood hadn't appealed the declaration of environmental impact. as a result, what we got from home depot is a smiment for local hire, a commitment for a program, traffic mitigations and other project improvements. and that was worked on not just by the burnell heights neighbors, but others.

we don't want to go through that process again. that was a divisive process, and that only entrenches deeper divides. what we have here is a proposal for neighborhoods to work together and came through a process of neighborhoods working together. i like i said, we don't want to go backwards. want to make sure we go forward and honor the work that's come out of our communities. there are so many supervisors here, supervisor dufty and supervisor campos for sitting in, and i urge you to support the proposal. thank you. >> next speaker. >> i'm from the land ♪ i was born in this old town there was time for gin and some fame and all along i wanted some good city change. it is my home ♪ it is my home

family, one of whom is here today. i don't think that we're here asking for special treatment. in fact, we're here supporting this ordinance moving forward. the one thing that land overs need in an area is definition. and when we go out and talk to tenants and there's a rezoning in process, it's very, very hard to get their attention. so having something passed is very much in the interest of the goodman family. what was shown to the planning commission -- i'd like to show it to you and talk about what it is that we're referring to when supervisor maxwell suggested the potential of an ongoing process. what we're looking at is obviously the lowe's site which is owned by the goodman family. and everything that you see on here, except the public streets, and that building, is

also owned by the goodman family, which makes it kind of a imagine cal opportunity to do something. because when things are under one ownership, you can do a coordinated development. this is just a mock-up of a potential for a neighborhood shopping district in this area, which we've been thinking about for a long time, and frankly, took longer than we should have to come and show it to the supervisor. supervisor, but we do think it has some merit. what we do have is a bank, a pharmacy, neighborhood-serving retail. if we can abandon this street, we can put in a lot more neighbor-serving retail and very importantly a large supermarket on been -- the loomis lots, which is part of the rezoning, which is what we want to talk about, and the goodman family

members are committed to continuing the process, including with the vernal heights neighbors korea these are now zoned pdr-2, and it could become a shopping district. the loomis lots are vacant. i think the consensus is doing this to build pdr's is not going to happen. this is, with a single ownership. they'd you very much. please pass what is before you. supervisor maxwel: i am intrigued by this possibility, and it is something we should be open to and talk about, and, again, better late than never, and it really is an opportunity that i think we really should take advantage of, so, again, thank you for coming, and think you for your support. >> good afternoon or good

morning. my name is nancy. i am not necessarily against this planning and upgrading note -- upgrading bayshore boulevard. i went to another one of these, and there were not very many people there, in my concern is that this is a huge change to -- and my concern is that this is a huge change to bayshore. a few thousand people, doorknob and, to let them know what is coming back is going to so greatly affect the bordering community -- door nocking. a door knocking situation, to

let them know that there is something coming up the pike. the other is the emergency evacuation process right there where the freeway is for the bay bridge, coming in and out. i do not think the city is prepared. there was a fire where the fumes consumed a portion. many said they did not know. that is just a few small hours of meeting to go indoors. also, i would hate for something so big to become another selling of dreams-type of project, which is very possible, as we note -- know. it seems to me that at this

stage, there are many who are already involved in this process, and there are problems with the big changes that you do not see the little people involved. i would hope for those of you who remain after jan. that as you see displacement happening because of this project on a -- on bayshore, with the exception of the goodman-0 note -- goodman-owned property. this is definitely what happens over and over. we say "community," win maybe there were 10 people. there may have been five people, and five people, and it is just unacceptable, and if i were sitting in your seat, it would be personally unacceptable to

me, and i would be knocking on those doors. they are talking about the park, and one of the planning commissioners said something about the connection. we need to have a connection between live and the hollywood -- a little hollywood, executive park, wrote -- executive park, that they have child care in supermarkets. it is a long time for the supermarkets to be in place, and that is all i am saying. to get the documentation to see whatever is being deliberated here is done in a good way. i know people, and give

point concerning executive park. -- bayview hunters point concerning executive park. when they changed it to 34, one person was able to get alone because the bank was not giving loans at that time. what is going on now is that these developers are being demanded to do a fee, but all the money that is being demanded is going to visitation valley, where the city planner -- it went across six lanes of highway of bay shore -- bayshore,

highway 101, and the claim was executive park, and that is not a fact. executive park is not in visitation valley, but what the sitting planet -- city planning did do is that $1 million would go to a little hollywood and 1,000,002 visitation valley, but when it came to your full board, no one got $3 million. this is an unfair thing that is going on here, and it needs to be stopped. and the planner that drew the line after this work was done in bayview hunters point, he became haute a supervisor -- he became
