6:00 am
hoffman. >> the name and the address. >> the address of the building. 3367 21st street. >> ok. >> it is my adjacent neighbor. >> ok, thank you. >> i have been to the dbi and to the department of housing, and there was a permit issued, but it did not go to the housing division to be reviewed again. a number of other things were at fault, or slipped through the cracks, and i'm wondering if the neighbor simply got preferential
6:01 am
treatment. apparently, the permit may have been issued in error. i'm asking that the board to th do a review of the project ad that the issue be put on the agenda. the inspector has been really helpful in making some of the terminationdeterminations that o to housing. >> maybe we can get an update in the director's report, rather than putting it on our agenda. if we need to, we can, after we get a report back. >> director, the you know anything about this? >> yes, this is about a possible -- it was citisited about six
6:02 am
months or one year ago. >> i think it was done in july. >> ok, it was done in july. the two women that owned the building came to me because they bought the building that way and they ask for some relief in the fines. within the san francisco building dbi code building, the director, or her designee can revise it based on the fact that they bought it in that condition. i helped the two women fill out the forms and send them to the fifth floor. unfortunately, it was not reviewed by planning. i believe they were going to legalize the rooms down minus the kitchen, which they would remove. we will make them go back to planning. the >> is still in planning?
6:03 am
>> no, they normally signed a job like that over. we will go back to planning. >> i believe it needs to go back to housing as well. >> we will have a determination from our staff. they will review this and update us. we cannot take any action at the moment. >> what is the status of the permit at the moment? >> with all due respect, you came to my office friday. i think i give you pretty good service. you were back on monday and tuesday. there's a process that we follow. this is quite common. we're looking into your concerns and we will address your concerns, but we will do it in a timely fashion. >> it sounds like dbi are on. >> and you can track the progress of the permit online. >> will they send some sort of a notice?
6:04 am
>> no. we will get an update on this address in the director's report next month. there is sf gov and the building department. you can check this address under are permitting system. you are always free to call the department to get updates. >> thank you. >> thank you. >> is there any construction activity occurring at this site? >> and the only activity i've been seeing is that there are a number of things being thrown away. i have not seen any construction. >> i've talked to housing. it would appear that these rooms have been there for a number of years, possibly as many as 40 years. >> we are not really supposed to get into a discussion on this because it is not on the agenda. >> ok, thank you. ok. thank you very much.
6:05 am
next speaker, please. seeing none. >> if there is no further public comment on item four, item 5 is discussion of possible action to adopt administrative bulletin ab-035 regarding procedure for assigning and/or changing street numbers. >> i'm the manager of the technical services division. what is in front of you is an administrative bulletin that has gone through the co-advisory committee last week. it was amended from the regional with some grammatical changes and some clarifications on our
6:06 am
regional proposed versions. my understanding is what is before this commission -- the changes that were amended by the cac was changed to renumbering on page 3. the first statement that a adding a new address or change to an existing street #number -- that has been added on. also, in the second paragraph of the renumbering, the second line
6:07 am
says -- or tenant. this added -- who may be affected of the changes have been notified. these are material changes from the previous version that was in front of the commission. >> do we have a process to deal with that, if somebody wants to change in address or needs a new address? do we have a department to deal with that? >> currently, the process has been in place. my understanding is that the additional items are just for clarification, to get the process more clear. this has been the upper function.
6:08 am
>> i know that someone came in recently for an address change and nobody had any idea how to go about doing that. it ended up in the director's office. i have no idea where went from there. >> commissioner, we had one employee, a longtime employee, and she did all of the address changes. anita retired kind of abruptly. it did not leave behind anyone who knew how to do this. basically, it was the director and the director only. the director is in the process of training staff on the first floor to do that. i believe when she comes back from vacation, she will be assigning someone full time to oversee that. >> i feel very uncomfortable.
6:09 am
i'm sure that is in place. it is going to cause more confusion. >> commissioner walker. >> i know that this whole thing came about because of some of the issues -- i see a member of the public hear that ran into some issues about an address change request that was confusing at the very least. one of the issues we wanted to address was to make sure tenants, in addition to a process that makes more sense, that tenants are notified when there's an application to change in address because they could be negatively impacted. this process has revealed that we do not have any sort of process that we as a department understand about this, much less the public. i tend to agree with president
6:10 am
murphy. what we were hoping to see is not just an administrative bulletin, but a staff assigned, and how the public connects with this process -- not just the applicant, but also the people who might be affected. i think this is in the right direction and certainly gives us the foundation upon which to have a process. until we have some sort -- how it applies when you walk and the front of the building, i think i agree with president murphy. >> at this time, they submit applications to change the address. that process has been there for many years. i think this effort by the director is really trying to address the tenant's
6:11 am
notification. this will provide some teeth in putting the process in place. >> it is one of those things. we have had a process that was clearly not understood by our own staff, except maybe one person, and also the public. this goes a long way toward putting down our process on paper. it would be great to see these other issues dealt with at the same time. i do not know we have to wait to approve this until we do that. >> that is how you get things done. >> all gone to the paper. >> i think you are doing a great job with this. mr. sweeney has said there in the process of training staff to do this quickl an easy process.
6:12 am
that's a step in the right direction. commissioner hechanova. >> is there a connection to the department of real estate board ? what is then sent to the property owner of this address change so that any notification for future tax purposes will be consistent, that they receive the billing and/or tax requirement accordingly? >> i believe our permit data it is connected. as far as the department of real estate, they're dealing with city property. that's my understanding. unless the part of the city property is being changed. they would be the applicant.
6:13 am
otherwise, they would be the office dealing with address changes. >> we do connect? >> i think they have our information regarding assessment record because any renovations would have to reassess the properties for property value. >> how about in the case of a changed address? do we notify the rent board? i'm not familiar enough to tell you about the process. >> that is one of the issues that gave rise to this, the fact that the history of tennessancy was lost when the address was
6:14 am
changed. that's a big deal with the rent control. i want to make sure that the enforcement body on rent issues is notified in the case of this, too. not just the tenant, but the rent board and anybody u.s. control of these buildings. -- anybody who has control of these buildings. >> it will go out automatically. >> i hope so. that is one of the things with our rfp and our data system. we have to make sure the people who need the information from our data system get this. yes, if the rent board has access. if -- they don't >> it is not just dbi's online system. is everybody else in the city. i can see public works addresseing it.
6:15 am
they need to have an accurate list of apartments and addresses. >> it is a statement regarding the responsibility of the building officials. the building officials also provide the property owner with the permit. that is in the implementation process, which is being introduced. that is something to work on, to provide the necessary notification process. >> it also applies in the temporary retention of old numbers where we retain it and essentially dropped it after 60 days. i just want to make sure that the history, if there is a
6:16 am
change of address, is brought forward and not just dropped. i think that's one of the situations that happened here. there was a history of occupancy. there was an address change. the old history was gone. that makes a difference in some of these buildings. i hope that when we say temporary retention of old numbers that there is some process for tracking the old addresses history within the new address. i do not know. that's a technical issue within our system, but it is important. . it is really. >> i just had another thought. i have experience in trying to extract our mailing list. how about commercial properties? does this apply to commercial
6:17 am
properties? >> i know one of the things the director has been working on diligently -- for instance, we had a case a few months back about where notices go for condos. when you come for your condo maps, yes, you have an address for every unit, but you have one for the h.o.a., so you can't avoid those problems. same thing for commercial property, if you want to subdivide the space. >> our system has historic we let you put in addresses that do not necessarily exist. hopefully our new system will flow from recorded addresses. if you apply for a permit, it has to be with a legal address.
6:18 am
>> at this point in time, it checks for a legal addresses. >> public comments on this now. any public comments? mr. morales, three minutes. >> you have to speak into the microphone, please.
6:19 am
[inaudible] >> i can not hear. [inaudible] >> please speak into the microphone. >> please speaking to the microphone. otherwise, we cannot hear you. i'm starting your time. >> [inaudible] >> you have three minutes, jose.
6:20 am
>> stop playing games with us. i will give you three minutes starting now. >> those two here are the units where i lived for 43 years. the upper flat where i lived for 43 years. the low were flat -- they were always these numbers. how did this number come up? i remember every day of my life. i will remember. this number, 534, was the number of the unit that the landlord wanted to build on the third floor, but it was true that this
6:21 am
was a defacto demolition. the sad part -- it went to the planning commission. it was canceled because it does not comply with proposition m to affect affordable housing. it was canceled. cancelled. canceled. why that unit is not there, the building is the same -- why are they using the number, 57 in the lower unit? what is the main reason? the court has decided it can not use the number. what they had was not a permit.
6:22 am
it was an application to do this project. how can you not understand that this is illegal, what do we have in place to protect the tenants? if we have a,b, c, then why don't we use it? it clearly says it has to be done. it is a crime. it is fraud. a penalty has been committed. the notification to the tenant, not to the landlord, the notification has to be done to the district attorney to comply with ab-035.
6:23 am
i really want to request that vivian day. [inaudible] >> ok. i will be writing you a letter. >> thank you. we're doing our utmost to get a system in place so this does not happen again. any further public comments? seeing none. >> does someone want to make a motion? >> i mean, i like the changes that have been made in this document, but i do want to have some of the issues around staffing and the process within the department coming along with it. i would like to continue this to
6:24 am
the next meeting. >> i will second that. >> thank you. >> all in favor? >> a motion to continue. >> all in favor? >> aye. >> those opposed? this item is continued until the next meeting. item six, the discussion of possible action regarding a request for extension of capss program. >> deputy director administrative services. in the absence of other staff, i want to just remind the commission that the item that was here last meeting was to extend the contract to the end of december. the action that was taken was to
6:25 am
extend it to today's meeting and to discuss it further. we have processed a the amendment to the contracts to extend it to today. and absent any other action on your part, we will not pay anything that has not already been finished as of today. i think the contractor has some comments to make, if you want to entertain those. >> yes, we would like to hear those. >> i will turn it over. thank you. >> thank you, pam. >> mr. president, members of the commission, i would like to reiterate that the contractor has requested an extension through december 31 for the
6:26 am
contract.
