and welcome to the board of supervisors meeting for tuesday, january 11, 2011, and i want to welcome all of the new members. madam clerk, could you read the roll? clerk: [readionng roll] mr. president, all members are present. president chiu: thank you. ladies and gentlemen, could you please join me in the pledge of allegiance?

madam clerk, are there any communications? clerk: yes, i have one, a charter section, submitted by former mayor gavin newsom, indicating the transfer between departments of eight personnel supporting the justice trafficking information system project, operations which will be transferred from the department of technology to the department of administrative services. this reorganization will become effective 30 days after unless approved by the board of supervisors. this was dated 2011. president chiu: if we can go to item number one? clerk: item number one, a public works code, about banners on the path of gold.

madam clerk, if we can now go to roll call for introductions? clerk: supervisor farrell, you are first on the list of roll call for introductions. supervisor farrell: thank you very much, and, president chiu, i wanted to take a moment to reiterate how happy and honored i am to be here in front of you, first of all honored by the residents of district two to represent you at the board of supervisors, and we want to focus on gideon back to work for the residents of san francisco. it is an honor. i am excited. i look forward to working with each and every one of you. clerk: think you, supervisor --

thank you, supervisor farrell. supervisor chu? supervisor chu: submit. clerk: [reading names] supervisor: the right for women to vote across the united states. i am excited to celebrate this milestone and recognize how far we have, over the past century, particularly year in the city and the state, with so many great leaders. there are are two senators in congress and our past speaker of the house, and dianne feinstein

will serve well, and lastly, i am proud to have the co sponsorship of the three women whose sole -- serve on this board. clerk: thank you, supervisor cohen. supervisor mirkarimi? supervisor mirkarimi: there are three things that i want to submit, including the market octavia. there are things we need to submit. the market octavia plan was submitted in 2008, the force large desk scale land use plan produced by the city -- the first large-scale land use plan produced by the city in a while. economic backgrounds and ethnicities, they could call it home to try to make it less cost prohibitive than the direction the city is certainly going and to be sensitive to our transit

first policy. the plan in committed -- including an innovative rezoning of parcels to establish two new zoning categories known as mct and rto. recently, it was discovered that there was administrative error for the market octavia plan. in implementing the zoning map amendments, they used documents that still continue to be 450 parcels, and they clearly show that the 450 parcels were rezoned, though they were not legally rezoned. next, this legislation will correct this oversight by implementing the zoning, and all 450 parcels, some in the western area where i supervise, parts largely in between the western addition, district 5, and district 8, and with this section, the city can resume the pace they articulated in the adopted vision for this maybin.

next, i am submitting an ordinance for the save drug disposal take back program. federal guidelines designed by president obama said that people should call your city or county government household trash and recycling service and ask if a drug take back program is available without cost to the consumer. informing the public but the point of sale how to dispose of their unused prescriptions is a productive and efficient way to disseminate the information. beginning september 1, 2011, the measure will require pharmacies to post a provision describing where and how persons may lawfully dispose of prescription drugs, as we agree concerns about their leaching into our which water system coming into our landfills, and certainly being abused by various populations, in particular the young and teenagers. this will be prescribed by july

1, 2011, by the department of the environment here in san francisco after a public hearing. material will be required in english, in spanish, and in chinese. we look forward to moving the federal guidelines, and this will be a companion piece of legislation that will be up for consideration before the second reading of our federal guidelines, i mean of our take back drug program. next, it saddens me that i am submitting in -- an in memoriam already this year for someone who was murdered this weekend. he was a " -- a student at a high school locally. he played at the recreation center and graduated, where he received training to become licensed carpenter.

he was currently working on a renovation project as a carpenter, something we worked very hard to help implement. he now leads behind a loving family with three brothers -- leaves behind a loving family with three brothers, sisters, and a daughter. i was at a community meeting last night to talk about this because the western area has enjoyed what has probably been its greatest respite of violent crime since tracked over the last 20 years. needless to say, this rocked our community considerably. there were also representatives from the district attorney's office, suggesting that residents send letters to the board of supervisors and a press release asking that we approve and support the d.a.'s budget. i had never seen that before, so i thought that was an interesting strategy to ask at a

community meeting to in order -- in order to shore up budget support, capitalizing on the idea that we were there to talk about certainly the murder and the community being upset. the rest i will submit. clerk: thank you, supervisor mirkarimi. supervisor chiu? president chiu: the asian art museum. i think everyone knows that they have recently had extremely challenged finances. it is an incredible city treasurer. it holds the largest city collection of asian art in the western hemisphere that depicts 6000 years of age and history through 17,000 artifacts. this legislation would preserve the continuation of the museum, continue to enrich the education of school children and tourists from arab world, and allow them to serve as both a resource for our community in the asian community again throughout the

world. i want to think the hard work of our former mayor and the staff as well as the city comptroller, our director of public finance, and our city attorney for their efforts in crafting a solution to allow the museum to regain its financial footing. i am also introducing a resolution today to extend the statute of limitation regarding the 49ers at candlestick park. as many of you know, the city and our football team have been in negotiations over a settlement of various issues between the two of the parties. i recently spoke to folks from the city. everyone believes we are close to a final settlement, and my resolution would extend the statute of limitations for another four months to allow for a little more time for that agreement to be settled. the last thing i'm introducing is an ordinance that would amend the campaigned of government conduct code to allow an appointed former mayor to obtain full-time city employment within one year of leaving city

office. this is an ordinance that is obviously to assist ed lee to step up in his future role as interim mayor. this is a way to ensure that it only applies to successor mayors who do not stand for election. i want to think supervisors elsbernd and others, and i do have one in memoriam, and that is to adjourn today in the honor of the victims of the arizona shooting. clerk: think you, supervisor chiu. supervisor mar? supervisor mar: i am joined by six of my colleagues in recognition of one for his work for civil rights and civil liberties. he was an inspiration to me and i think a significant u.s. historical figure who fought for

civil liberties and civil rights for all of us. he was a japanese-american who was ordered to report to the internment camps as a result of beat massive -- of the mass of incorporation of japanese- americans, many of the men, women, and children caught -- of the mass incarceration of japanese-americans, many of them men, women, and children. i want to thank some supervisors, including mirkarimi, and supervisor jane kim in joining me on this. there is a movement that really fought for his acknowledgment, and the the book is kind of would not have been successful without a grass-roots campaign, and then finally, in 1983, the petition to vacate his conviction for refusing to obey

the military orders was set aside, along with his conviction being set aside, due to the corruption of the judicial process, and lastly, he was awarded the presidential medal of freedom by president clinton in 1998 for his advocacy on behalf of all americans and their constitutional rights and civil liberties. i think he is a symbol of courage and dignity, not just for the asian an asian-pacific islander and japanese-american communities, but everyone. my resolution asks that the board of supervisors declared january 30 as his day of civil liberties. also, i am saddened by the loss of the richmond district resident. she passed away. she taught english to immigrants

and was an active chinatown social worker and served on numerous boards. she was also a supervisor to help the elderly, but in her work included working with the ymca, where she served on the national board, and she traveled extensively. june always remained involved in social causes, and she is survived by her husband jack, who is an engineer with the city of san francisco, and her children, and her grandchildren. the celebration of her life will be held in oakland on january 22 at 11:00 a.m.. the rest i will submit. thank you. clerk: thank you, supervisor mar. supervisor elsbernd? supervisor elsbernd: thank you, madam clerk.

in terms of my role as a member of the san francisco retirement system. just today, the board of trustees established for the next fiscal year the employer contributions. it was unanimous, and the rate was set at 18.09% of payroll. achy take away from that last year at this time, we established it at around 13.5%, so it is an increase of about 4.5%. roughly speaking, each 1% is equivalent to about 30,000 -- $30 million, $35 million. you can mathematics. the takeaway for me is that last year, the actuaries predicted that this point today, the 2010-200011 contributions would only be 17%, and i remember very well at the gao committee

hearing we had, where one speaker, it typically representing our employee groups vilified the grand jury for using numbers that they claimed were hyperbolic, where a doomsday scenario. that in no way would be correct. well, to some extent, they were right. the numbers the grand jury you were wrong, but rather than being inflated, they were deflated. the grand jury did not state the number accurately because they used the retirement system numbers, and the retirement system did not get the number right. they were actually too low. next year's contribution is going to be at least $30 million more. and we ran a couple of scenarios of the retirement system earlier this morning. a sitting massive investment gains over the next few years, no matter how mass of our investment gains are, that number in the next three years

will go up to 26%, 26% of payroll. it will be the equivalent of seven two san francisco general hospital budgets on our books. that is $657 million on the books, where just five years ago, it was 0, so to a lot of the naysayers said the grand jury was using numbers that were exaggerated, not even close. they were using numbers that did not even hit the mark. so i use the roll call today to send a letter to the controller's office. we have been told we have got approximately an approximate budget deficit of over $360 billion as we are over. i would like to know what this new employer contribution does to a projected budget deficit.
