gate there -- we plan on putting it in with your permission into one of the conditions of the permit so that he doesn't have to feel like a month from now or two years from now things start changing. and i believe that those are the issues. and i'm hoping to leave myself available to any questions that the commission might have, the individual commissioners, police officer, any neighbors and perhaps be given an opportunity to respond to anything that will come up. >> mr. whitaker, i have some questions and i'm sure other commissioners do. do you normally accept deliveries through the back door? >> no. >> no beer, no sound equipment? everything goes through the front door. so that would not be an issue the back door deliveries? >> that has never happened. you'd have to build a large
7:01 pm
ramp. what we're trying to do is alleviate a concern that the neighbor might have for the future. >> and then you're not dumping bottles but do you have a recycling person that comes and separates your trash? why don't you come up so we can ask the owner? are you with the club? are you with 26 mix? [inaudible] >> ok. so come on up. ok. so do you employ -- do you have a recycling person that separates the trash and pulls out bottles. would you come up and state your name, please? >> my name's jesus torrez and yes, we do have somebody that does the recycling. >> ok. what time of day does that
7:02 pm
yes. >> ok. >> we would not do anything prior to 11:00 a.m.. from 11 a.m. until 6:00 p.m., we have the flexibility. >> do you understand how the recycling was? >> mcnaught. >> bartenders are behind the bar and they have a trash can and they throw everything in it. the bottles are the heaviest and then make the largest noise. this separates trash and
7:03 pm
bottles. that makes a huge amount of noise. they do it for free, they comply with recycling. that is how it works. this is a very noisy proposition. if he comes out to do the reciting and it takes him three hours to recycle a heavy night, and they will have to change the time. if you will do that, maybe we should write in what time you will do bottle recycling. >> it used to be at 9:00 a.m.. we tried to find a time where things could be an on site. we tried to get things done somewhere around lunch.
7:04 pm
why don't we put this into the conditions of the time frame. >> on your back door, there are two doors. how much space between the two doors. >> may be about six or 7 feet. >> what happens in that space? what is there? >> not much. >> why would you have either door open? >> i am trying to alleviate any concern that a neighbor might have. a door that remains closed, what we're trying to do is to have this, then the other one is closed. >> ok. great.
7:05 pm
7:06 pm
entertainment is offered. >> i don't think i have been clear. the two doors are not adjacent to each other. there is one door that is behind another door. >> the door needs to be closed. >> the inside door should be used if there is any traffic. something will come through the door and closed it behind him and go through the outside door and closed it behind them so you don't get that last of music. >> one of the practical concerns is that as it is now, the exterior door closes, you are in essence locked out. that could encourage a staff member to prop it opened and
7:07 pm
leaves it a jar. we are purchasing a new push bar that allows someone to open the door from the exterior said that you are not even encouraged to close it. >> are you having this on the inside or outside? >> no, just on the way out. >> i am pushing the outside door open through the firebreak handles. the door closes behind me. how do i get in? >> you have a handle that you can pool. if you wanted to not have this cloak to end. -- hooked in. >> fighter crashed bars can be adjusted to lock or not locked? >> i don't think that they can. >> you can put a device in there
7:08 pm
and you can turn it said they don't lock and they will lock the door from the outside. you are not looking for the handle trying to hit the handle. we will put a handle outside and unlocked the crash bar. >> even if someone was outside, you could come in through an alley way. >> i want to know how he is going to train his employees to do that. >> this is very important to the new owner. there is a large area that is very large for san francisco. they will not even be dumped or
7:09 pm
brought outside until 11:00 a.m.. >> got you. >> the owners should provide a neighbor's the information that they need. if in fact one of these security issues comes up, we have that? >> we have the direct line, the manager, the head of security who was also here. >> great. >> are there any other questions? >> it is this like a dumpster? is this will lead -- is this
7:10 pm
where we will be doing the recycling? >> this is not on bartlett or on mission, there is an area that is cemented. that is where it will all take place. >> i was wondering if it is in the building or the mission street which is busy and loud. >> no, it is not busy. in the back, these are almost a right angle. this is actually ran near the garbage. we come to this practice solution. we will not even dump the garbage. we would like to be able to drag it out side so we've brought plastic garbage cans. >> are you doing entertainment
7:11 pm
now to this venue? we got an e-mail from a resident that says that they hear music outside. >> we have been hearing music. we have sound abatement. it is not moving as fast as we want. >> it just another question, the other alternative is to get a recycling dumpster. you can do that. this is just a suggestion. this is up to your sanitation company. >> i want to open the door to public comment.
7:12 pm
>> ayman nurse at kaiser sector but joe. -- i a and interest. i would like to clarify the situation. -- i am a nurse. this is the view for my unit and this is the door in question. when i first moved in, this was a very quiet cantina. this opened as a very loud at night club. i have had excellent experience to come up with solutions, i have to let you know that for several months to throughout the night about every 45 minutes, the store would open and bottles would be dumped into the alleyway.
7:13 pm
this spigot was used for doing cleanup throughout the night. during the day, this door would remain propped open. the entire courtyard was flooded with high-voltage noise from the interior. this store is really what is in question. just a couple of other photos to show you, this is the exterior door from the ground level. as you can see, there is no handle or way to open it from the outside. this shows the crash bar on the inside. from the interior of the building, you can see that this is the exterior door.
7:14 pm
together, if there was commercial soundproof doors installed here and here, each with day crash bar, each with a mechanism. each with the way of opening the doors for both sides. we have a sound lot that will fix this problem. as to the conveyance of deliveries and things like that, my concern is that this was looking north and there is a parking lot. i am concerned that in the future there might be tour buses or whatever part here and there showing performers and this equipment a through the back door. this is a concern for the residence that we don't see this type of situation developed.
7:15 pm
>> there were three conditions that i had written that pretty much parallels what eric had written. >> we have them. thank you. >> is a any other public comment? seeing none, public comment disclosed. the bonds is closed. >> i would like to talk about more and all doors and windows must be closed any time entertainment is present. another part of that is that there must be adequate ventilation installed in the club so that both doors and windows can be closed any time.
7:16 pm
that will be the biggest problem that you face is that you get a very hot night and if you don't have adequate ventilation, someone will prop open the door. and you don't need to answer this, mr. whitaker, you just need to build this into the business itself. if stores are propped open, that is a possible violation which can issue a citation. this will endanger your permit. keep that in mind. >> i just want to say that security is not an issue. if a security person was placed at that internal door with instructions that other employees could not leave it a
7:17 pm
jar and patrons cannot exit unless there was an emergency and that would really help to solve the problem as well. anything else, commissioners? >> i used to have one question. with respect to the posers gosh to the proposal, he suggested that some of you are ready planning on a new door. would that satisfy the concerns? >> >> i sure hope so. >> can someone offer up a motion? >> i would move that we approve
7:18 pm
this permit. is this final approval? >> conditional. >> with the extra -- the good neighbor policy is always a test. with the additional conditions agreed to, with conditions number 1, would this be commissioner joseph? to be replaced with the language that we always attached regarding the windows. >> right now it reads, bottles will not be dumped which went 6:00 p.m. and 11:00 p.m.. that would be no dumping of any kind. >> i was certainly except that. >> are you seconding the motion?
7:19 pm
>> yes. >> we have a motion. >> what is there any further discussion? >> yes. i just wanted to see if that is reasonable to do. i applaud you pointing that out. is it possible to do on a busy night when there is -- happening and it is pack for that day. they have bottles to the brim, will you just let them leave these bottles in the club and stacked them on the walls until 6:00 p.m. hits? >> i think that they have lots of new garbage can and they have a kitchen space. they will use them to store garbage cans.
