cap. we will continue to cite them, but i will leave that to the commission whether or not you want to bring them before you or if you want us to continue to cite them. i have been meeting with the city attorney. we met with them today and we are waiting for a little bit more information to come from the city attorney. with non-payment of citations, we learned a lot today and we will hopefully have more information on that particular subject by tomorrow. i bring this up because they have come before this commission, there are past problems with incidence of ground control.
10:31 pm
they are -- so far, they have done a few of these. at least one of those events, they are working with us and we are working with them. we have also been working with some of the promoters that are doing these events had come to the staff who let us know that they are doing the event and the steps they are taking to make sure the events go off safely. we have had no problems, but i want to put this commission on the know that it is actively and bringing in outside promoters. in the past, i mentioned working with the state agency and the bureau that licensed security guards in the state of california.
10:32 pm
we met with them and have been working through e-mail. we are looking to the next stage where they are talking about bringing us ain for site inspections. it would give us the ability to work with the state agency much closer. making sure that all of the security guards are guard carded. as you know, it is not only a state law, but a city law as well. finally, there have been lots of comments about trends. i bring up my last point here, one of the trends i am seeing recently is a swing from non- permanent venues using dj's to
10:33 pm
non-permanent venues using live music. now we find more where house parties -- warehouse parties with live music. not only an underground parties but in the city overall. they are exploring live music as a possible option. we are seeing it from little places that have been doing live music a long time to restaurants that have done a few sound tests. they're wanting a deejay for happy hour. the other trend, unfortunately, galleries are bringing in live bands as well.
10:34 pm
we tried our best to educate with a warning and explore other options with sfpd if we've had to go back. that is the trend. you will see under distance, we've changed the layout a little bit. sorry for the misspelling. we have one incident worth noting. at the cliff hotel. it is a lounge located inside of the hotel. you have to walk through the lobby of the hotel which presents unique situations. it is not like a street where you can do pat downs.
10:35 pm
it is a little bit different than that. it should be worth noting that of the suspect in this incident was carrying a concealed firearm, security reacted properly. the police came and security was able to do the proper thing, who unfortunately, they had to engage this individual. they assisted the police and crowd control and the police had to wrestle this individual out. no one was hurt. that is also a very positive thing. the situation is slightly unique. it is something that we have talked about, also talking about how we can work with those that work on best practices.
10:36 pm
it is the same, but it is slightly different. i believe that is it at this time unless there are questions from commissioners. >> i have just one. those that came here were originally operating without a license and said they did all of the soundproofing, and subsequent to that, i assume you did a sound test. the past that sound test? >> in the past -- they passed that sound test with a very low sound cap. the only way they could was with a very low dba. which they acknowledged. and we helped them set their system. every time we have gone and,
10:37 pm
they have been above the sound cap. we've cited them for it. and yes, that is them. >> how did the one-day event at the art institute go? >> we have received no complaints. >> we got a report from one of the neighbors that was the mailing back and forth prior to the event -- e-mailing back-and- forth prior to the event that it went off very well. there were very few attendees which made her happy. she did not mention about the sound, and the levels were fine. overall, they -- from the standpoint of the neighbors, it
10:38 pm
was a successful event. >> they did not have many attendees. and the bad news was they did not have many attendees did i am curious, did they distribute the letter that we requested? >> i believe that they did. >> i am curious what the response by staff would have been. as i was walking up, i was thinking that we put well- meaning conditions on these things, and if we don't follow up on that or find out and it was not taken seriously, what do not we do? >> the consequence would be to make some sort of consequences if they were ever to come back
10:39 pm
to us for an additional permits. >> i don't mean after the fact, i mean at the last minute. would we be in a position where we could revoke the permit? >> i suppose that is true. i would have to find out the proper way to do that and the way that it does not infringe upon the process. it was not on the agenda, but i am glad to follow up with you. >> i wanted to follow up on the directors' report. it was the first time that the commission is organizing. i am excited to be working with the director. we hope to make this the beginning of a series of
10:40 pm
meetings. we hope to be very informative and productive. we hope to nurture her hobby relationship between the commission and the neighborhoods. and we can meet and exchange ideas and explore opportunity for collaboration. it will foster a healthy, safe, and a vibrant neighborhood. we have been asking our applicants to reach out to the community all the time. president newlin: any public comment on the director's report? we will go to the next item, the police department's comments and questions. inspector. welcome. >> good evening, commissioners.
10:41 pm
i hope you're all well tonight. we have had a few projects that we have been working on that we want to update you on. the first thing the director spoke to was the club's training. that will be happening this month. okay. just want to make that clear. anyway, that will be happening this month . we have two dates in mind, we are deciding on one of them. we should know by the latest, next monday, when that will be happening. another issue that has been on the burner again, we recognize a as causing some confusion to some of the industry people, the
10:42 pm
availability of clubs. this is a priority to the department, how we are working diligently on it. as soon as we have more to share, we will. we recognize that we need to come up with some solutions rathesooner rather than later. if it has not come up in the past, it is important to the knowledge that when we created the alu unit, we started having monthly permit meetings. i want to make sure the commission recognizes that they are welcome and attend almost every single meeting. it shows that it gives them a great opportunity to meet with them as a group and give them a sense of all of the issues we are dealing with. they go beyond the scope of entertainment, everything is
10:43 pm
kind of interweaved. >> i have one comment. i apologize that has not happened sooner, but i have been working to agendaize recommendations you made. it fits with the inspector's schedule. >> we were going to do it on march 22, but we could do it on february 22. or we can do it on march 8. i will not be here, but the commission -- >> i would rather do it when you are here.
10:44 pm
are we still going to have a meeting with the city attorney? >> we did not get a response. i will go back. >> of the most productive for all of us, we are on the same page. >> it will not happen before the twenty second. >> if it does not work with the city attorney, we will reschedule it again. >> i have a question for you. at public comment, someone asked about the property of permits, and i wanted to ask you a question, and correct me if i am wrong. abc license is a piece of property whose owner can be transferred if it goes through and remains with the original owner, but an entertainment permit is not a piece of real property and cannot be owned.
10:45 pm
once the business end, the permit no longer exists. is that right? >> kind of. there are a few issues that we should point out. for the viewers at home, it was public comment, but i think we have to recognize that the person bringing the question up is actually an expediter. the scope of questions were beyond the scope of the entertainment commission, but i am happy to explain in great detail. he is raising questions that he should clearly understand. the way he framed it was so beyond the scope of accuracy that it is alarming to me and extremely misleading. certain types are an asset. you own it and it is
10:46 pm
transferable. it is also a privilege. he played by the rules and you meet the qualification, you can have it. if you disobey the rules, you can lose that privilege. if you're confused about owning the license, i am repeating what the laws are. certain types of licenses, another important part that we need to address, we have 3800 active retail liquor licenses in the city and county of san francisco. that is the highest concentration in the state is not the country. there are a couple of issues that we have to come to, who recommendation to the state.
10:47 pm
the state makes the final determination. it is not accurate to represent the police department making determinations. it is quite accessible. it is important to recognize that the entertainment permit is a city and county permits. it has exclusive authority over the laws, and we can't even restrict. many have done moratoriums on the liquor components. it is beyond the scope of local government. to go right back to your question, there a certain types of liquor licenses because you cannot get an original. a simple analogy is that it can be used for a simple piece of real estate.
10:48 pm
we have a fixed inventory in the city. if you close your business, your license is no longer active. it has to be attached to an address. you can select. these are private party sales or that are beyond the scope of government. once you buy it, you transfer it to your name and it is at that point that the low law enforcement has the right to review it and give recommendations. i could go on for a long time. >> i appreciate it. it is like a driver's license. you can have a if it is yours, if you abuse it, it can be revoked.
10:49 pm
and entertainment permit ceases to exist when the business closes the transfer. it is not an asset. >> it is similar to your permit and that the business goes out of business, the liquor license is no longer active. you still own it. once you go out of business, you lose that entertainment permit indeed go back and refile again. you still on that license, but it is in limbo. even the buyer is at risk. they might not be able to get it licenced the way they wanted to. >> you can complete a sale, but not necessarily a transfer. >> it is all about communication. these issues are best solved
10:50 pm
when we are working together. that transpires across. president newlin: any other questions foor public comment? >> can i add one more thing? president newlin: too late. [laughter] >> i wanted to share an e-mail with you guys. this is mainly for commissioner meko, because he is asking me the most questions about this. i received an e-mail this morning from a club owner that has not been a little frustrated with some of the police department's lack of decisions. i bought my first id scanner. no one complained. it is a great deterrent for
10:51 pm
crime that. i thought i would share that. he did that on his own. president newlin: wonderful. any public comment? none? nothing? on to item number five. haring - - hearing and possible action under the entertainment commission. action item. south town arcade, mechanical amusement devices. >> this one and only permitee requested a continuance for two weeks. i am requesting that continuance of you.
10:52 pm
>> move to continue. let me fix that. i move to honor the request of the applicant and continue the permit. >> a well-stated motion. >> seconded? [roll call vote] president newlin: i think we should have had public comment on that. is there any public comment? we will continue the vote. >> [roll call vote] okay. great. president newlin: okay. item number six. comments and questions?
10:53 pm
>> we have a full commission and not a lot of business. >> that is why everyone is here. president newlin: i don't have the date in front of me, but the executive director and myself attended a luncheon. it was well attended, a lot of the citizens were there and it was lively conversation. i think she did a stellar job in presenting the commission, i would like to request if any of my fellow commissioners are involved in anything or have any recommendations with the commission can reach to the public on our own or you as a guest, i think it would be a good way to outreach to the
10:54 pm
community. i can't say i enough about how well i thought it came off or how well she did. one of the concerns was out reached to the various commissions -- outreach to the various commissions for overlooked or -- any ideas dealing with the budget deficit. no date was set, but i would love to have your input. if you have any ideas you would like to bring forward in terms of resolving the budget deficit. anybody else? >> i just want to thank the supervisor, i am sure we are
10:55 pm
ecstatic you're going to be doing this report. should we be forming an ad hoc committee to send e-mails or advice? [chime] >> not yet. based on the beginning, we are in the early stages of developing the scope of this. i certainly think that any ideas or feedback hoare information that is relevant -- or feedback or information that is relevant is welcome. what it really is, at the base of it, the attempt to counter
10:56 pm
what we are and what it is in terms of money and jobs. and kind of been deeper and get more -- dig deeper and get more granular. again, it is counting what the value is in san francisco initially without the political charge one way or the other. it is an objective look of who are we and how are we. if you send it through staff, it will be the easiest way to do it. >> this is kind of late in the meeting to be suggesting this or asking this of staff, but there was no discussion after your presentation. they were featured prominently at the last meeting.
10:57 pm
i was wondering if there was any prior discussion? they did not appear on the notice of violations, that is excellent. and >> and the director will speak more prominently to the issue. they have been issued an additional citations, and because it wasn't really agendized, i'm not sure how much i can speak about it. but i would expect some motion forward. why there was nothing in my report tonight, there were additional conversations from the city attorney. but we do expect corrective
10:58 pm
action in the future. i think that is the best i can do for you. president newlin: that it? all right. yes? are you waving? [laughter] don't wan tto miss - -want to miss -- want to miss any body. any public comment? the final item is for future agenda items? do we have any? do we have any public comment on no requests? that will conclude the tuesday, february 8 meeting of the san francisco entertainment commission. thank you very much.
