president mazzucco: thank you, commissioner hammer. line-item number four. >> reports and announcements. crime statistics and review of recent activities. >> i will give you a report that is current through march 12. we are finding that hard-line crimes are flat. a violent crime continues to trend down. we are down 11% from where we were in 2010. comparing the last four weeks, the violent crime is down 20%. overall, crimes are down 12%. 17 versus 9.

rest still exceed year to date. the number of shooting victims is 41 this year vs. 47 last year. >> thank you. any questions. commissioner marshall: and do you know what the shooting the other night was about? do you have any early ideas about what that was? >> there has been a fair amount of speculation that it was getting involved, but it is still being investigated. commissioner marshall: not any real information you can share about what the motive might have been? >> it might come after the investigation. commissioner marshall: on my way home from the boy's club. >> i was going to ask you about

that, too. so many kids and children, other people in the neighborhood. people want to go there. my son has class there. >> i am sure that he could echo what i said, there have been significant increase in patrols in the area to suppress any violent activity in those areas, with the plainclothes units. he has the other members of the police department to have a very high visibility to suppress any inclination. commissioner hammer: chief, and good evening, captain. we talked about city-wide rates.

there are certain spots that suffers crime more. folks that live there. right now, the mission seems to be on fire. can you give the public an honest look about how violence is in the mission? >> captain? >> good evening, thank you for coming tonight. >> for the last couple of years, gang violence has pretty much been very subdued until last november we had a spike in gang violence for about a two-week period. six weeks ago, we started having a series of violent

interactions that were clearly gang-related. we have had three weeks without a violent gang incidents. the shooting two nights ago, it is an easy conclusion to reach that it was gang retaliation, but we really don't have any information to corroborate that. four of the five victims' were not affiliated with a gang whatsoever. the fifth the victim might have been a gang associates, but he wasn't a hardcore gang-banger. as the chief said, we have tremendous police presence in the mission district. we have doubled assignments and scheduling so that we have the number of uniformed and plain- clothes officers saturating

specific areas that are known for gangs to frequent. the shooting two nights ago was -- if it was gang-related, they might perceive that as an attack on them. we are in anticipation [unintelligible] there is the thought that one of these criminals might have come back and shot the place up.

there is nothing to corroborate that. we are hoping that it was something personal as opposed to an increase in gang activity. we have been three weeks without any gang activity. the focus of the shooting was in front of the bar. an errant round went into the restaurant. >> do you know, numerically, the number of shootings in the mission? >> we had six homicides in the mission district. maybe one or two were gang related. domestic violence and that sort

of thing. it was clearly gang connected. >> have you asked for additional resources for your district? >> i have not. my position is that the officers can make the district safe. the police administration has sent a gang task force, which is always welcome. several of the other units are also complimenting her the officers. >> are you short? we keep hearing officers leaving in shortfalls. >> commissioner, it is my responsibility to get the job done with the resources that we have. we will continue to do that. president mazzucco: any further

questions for the chief? >> the last years that the department has had, the violence reduction, the fact that this year, we are still 11% last -- and behind last year, we can get those statistics free for next week. >> people should know that the numbers would be helpful. >> of the department received an actual word for the safe streets initiative because of the success we had in bringing down the violent crime rate. president mazzucco: please call

line item 4b. >> the monthly comprehensive statistical report for january 1, 2011 to february 28, 2011. president mazzucco: welcome and good evening. >> good evening, president mazzucco, members of the public. i will discuss complaints and cased statistics. the city charter requires and that i provide a monthly case statistic and you have a copy of those in your packet. in february, the occ received 41 complaints and closed 75. we needed seven cases. -- mediated seven cases. as of today, the occ has

opened 150 cases, closing 178. we are close in more than we are opening. we sustain the 10 cases and we have mediated 7% of the cases we've closed. 398 pending cases. that concludes my report. president mazzucco: any questions? commissioner kingsley: thank you for your report. i notice that 2010 had 149 cases open as of the first two months. and 2011 is down to 119. a pretty substantial percentage difference. any comment in terms of why that might be? >> it would be only speculation at this point, but that is correct.

a 20% less cases filed. with the office of citizen complaints compared to the same two-month period last year. the cases last year were down from the cases in the prior year. also it should be noted the arrest rate last year was down 6%. there are many things to discuss it before -- not to discuss before. -- there are many things to discuss before. the outer reaches largely done -- outreach is largely done by the investigative staff. we are down the 12 investigators

at this point in time because we have to that are out on long- term -- two that are out on long term leave. it could be greater satisfaction between the public and the police department. i can't verify that because i don't believe a survey has been done recently in terms of customer satisfaction. commissioner kingsley: thank you for your speculation. president mazzucco: other questions? let's move to line-item 4c. >> commissioner's reports. president mazzucco: just a small report. the commission has reached the decision, you met at about 6:00, the names we have already forwarded to ed lee.

the report tonight is i want to thank the commission for their hard work. this time, we had a three large community meetings. we met with the officers. we talked to the latino community. we talked to anybody that would call us. there were a few hundred calls, maybe a few thousand. i spoke to the longest standing member of the police department that has been through 18 chiefs. we heard from anybody that would talk to us. we put together a profile. the commission worked very hard to reach the selection that was forwarded this morning. it was a great experience for me. it is an incredible body with different opinions. based upon experience working

with law enforcement, at some point in their career. it was an incredible process and we afforded some very strong candidates. i wanted to thank the commissioners. i wanted to share that with you. commissioner kingsley: we would like to thank you as our president. you took the largest portion of this workload on yourself and we appreicate yo -- appreciate your leadership. commissioner marshall: i just wanted to say -- can i think you from all of the commissioners that also had to do that?

it is a deliberative body. i want to thank all of us -- you from all of us. president mazzucco: any other reports? announcements? >> none at this time. >> scheduling of future items. >> identified for consideration at the future commission meeting. commissioner chan: i will let you know that next week will be gone. it is the second meeting i have missed. the reason i will be in memphis is because of the 14 mental health stakeholders and the department. the only way to get it done is to see it happen over there.

we will have several doctors on the trip. i would like to ask that we schedule the report back on the timeline, the crisis intervention unit timeline for april 6. it is a little bit later. i already have a detailed timeline. does that work? the community policing resolution. i will make sure it is included in the packet to support the public safety committee cosy discussion -- committee's discussion. commissioner kingsley: i would like to confirm the date that we are going to discuss the commission's priorities. we started to initially discuss it at our retreat last october.

mazzucco know. president mazzucco: i understand you are in the writing process. >> we have accepted all the changes that were offered by coalitions of san francisco, so it is just going through the process. that is where that is added. for my purposes, it is a done deal. there are different stakeholders in our department. we are very close to it. we can certainly set a date to talk about it. >> there are certain stakeholders in the community that are waiting to see where the department is. commissioner hammer: thank you, president mazzucco. as a commission, we spend a lot of time on the dna backlog. i worked with supervisor alioto-pier.

it has been a couple of months, so i would like to hear an update to see if that is happening now. yet the department was instructed to come up with regulations regarding the testing of other sexual assault cases. the deadline was march. if the chiefs could report to the commission on what is the status of dna testing. what have they done to fulfill the legislative mandate to set a time lines for other testing and dna samples? if march 30 is available, it would be a relatively short report. some months ago, before we got sidetracked by the election, we were working on a special issue. we owe it to them. and others, i think they have filed a response with the police commission. it has been around for a while.

we can take a day in april. i am open to whatever they -- date. president mazzucco: we have been working on that issue for quite awhile. what is a good day for us to talk about it? who is now working with us or monitoring the patrol specials? who do you have assigned? >> i will get back to you tomorrow, i am not sure who the liaison is. part of his responsibilities is to see the reserves. president mazzucco: if we can have him meet with us and come to the commission, what is a good time for us to do -- >> any date in april. so they are not surprised. i have the 13th if people are

amenable. president mazzucco: april 13 it is. commissioner hammer: i have one last item. at the direction of the rest of the commission, to update our rules on hearing officers. i have a draft ready to go. commissioner kingsley has a much bigger project she is starting on. those are ready to go. those are good tweaks. we met with boa a few months ago. i think march 30 is essentially a consent item. perhaps we can look at those. >> under the charter, you will need to do 10 days notice. i just wanted to make sure. >> today is -- so it's 14 days

san francisco opened government. just two comments. actually, three. the director's comments on the decrease in the number of investigators is obviously on spot. if you have 17 and you go down to 12, they are not going to be beating the bushes to get more cases because it will be hard for them to handle the cases they have. unfortunately, the other comment i would like to make, i faililed a complaint. six months later, i got a letter that was rather sloppy. it basically said that the charges are sustained. that was the total involvement. the only purpose of going through occ is if you plan on

filing a lawsuit. it is required of you go through occ first. i would never go through it just to go through it. if you watch the increasing statistics, 2009 is greater than 2010. that is an ongoing trend. the whole process of the selection of the chief, i am not concerned about it at this point. the new mayor, they will have a chance to select a new chief i january. -- in january. they wanted to make sure they were fully ready to deal with

the problems, and what was cited were the 600 cases plus. having to do with the drug testing lab and the cases this messed relating to warrantless searches taken over by the fbi. if there is anything that speaks for keeping these hearings good and open, if you don't do it sooner or later, the feds will get involved. when they do, it is a real ball of wax. i speak from experience having to work for the commander in chief in charge of all armed forces in the pacific side of the world. lastly, i have gone through the documentation from your retreat. public comment? >> commissioners, good evening. i am a resident of the city and county of san francisco. i have spoken to you before. i only have a couple of items to speak about in relation to the points that were made earlier. i have, on record with this department and with the occ the request for documents based on the racial makeup of the police officers. going back a number of years. they have refused to turn that information over to me. it relates to off sir -- officer ortega. to put it before you, when you don't have detectives to solve crimes, you are wasting time on

charges against mr. ortega. it is not clear where the gray line is, and i can tell you as a taxi driver, all of the bars south of market are oral sex bars. why don't you put a policemen in each of those and waste yoru ur time. you waste your time on stuff that is not fit to put on paper. the charges that i filed with this mess -- would dismiss.
