california has an estimated 200,000 domestic workers, comprised of housekeepers, nannies, and care givers for children, care givers for the elderly and disabled. the work in private households to care for the health and safety and well-being of many families and homes. domestic workers have historically been excluded from basic labor laws which serve to protect workers. the fair labor standards act of 1938, which congress enacted to ensure a fair day's pay for a fair day paperwork excluded domestic workers from its protection. domestic workers are the backbone of california's economy. they do hard work that makes all our work possible and are entitled to the same basic protections as other members of the workforce. domestic workers work alone, behind closed doors, and out of the public eye, leaving them

vulnerable to abuse and exploitation and unable to abdicate collectively for better working conditions. domestic workers often labor under harsh conditions for long hours and low wages, without benefits of job security, and face termination without notice or severance pay, leaving many suddenly without jobs or a home. the vast majority of domestic workers are women of color, who because of discrimination and fear of deportation are particularly vulnerable to unlawful employment practices and abuses. most domestic worker support children and family of their own. more than half our primary income earners. two-thirds earn wages below the poverty line. the passage of this bill to protect this valuable work force and to provide equilibrium -- equal labor rights is essential and would make sure that we can provide quality care

in the state of california into a place that serves alcohol? and if you are and you legally acquired a license or permit to carry a concealed weapon, how's it going to contradict with that? i don't know the laws here. but i do have a permit to carry a concealed weapon when i was living in pittsburgh, pennsylvania. i just got out of the marine corps and it was a dangerous place to live. would i be permitted to go with a might club with my .380 davis in my purse if i was allowed to legally carry the weapon? these are issues that would need to be looked into by u.s. council. i work in theater. i work in concerts. would i be able to go to a nightclub to see peter murphy the mess anyone after i do a 16-hour call because i want to

see him. would i be able to get in with my tools on my back? there is a lot of definitions to be considered. so thank you very much. >> thank you very much. [applause] >> hi, my name is melissa miyara. a.k.a. core leelionne. i typically work in the 300 person range. i want to go on record by saying that these proposed new regulations would be far too onerous for us that throw events the way i thrown. we don't have the budgets or the man power or really the desire to enforce something of this level. i also believe that it would -- i would effectively wipe out events like mine from the cultural map of san francisco. and while i do feel some twinge

of disappointment of this not being resolved today. i can only hope this can be kicked back to the mayor's office because this is a highly disproportioned response to the very real concerns that are out there. thank you. >> thank you. [applause] >> good evening, commissioners, members of the public. >> my name is star child. past candidate for school board and other offices. we strongly oppose the increased regulations and i am asking you tonight to choose freedom over power. according to the san francisco cam ner here, the entertainment commission was threatened with disbanment and is under pressure to make significant changes to sfop the bloodshed. i know you're under pressure but this commission was started by lobbying by the late night

coalition several years ago. i was a steering committee member of this group and we pressed for the creation of this commission in order to get the power of controlling night life out of the hands of the police because the police has an obvious bias that continues to this day. there's a strong flement this town which is this whole nembism. that we don't want it happening in our backyard and the moral prejudice. we had the head of park and reck department saying there is nothing good happening at 4:00 a.m. in the the park. you know, this is the kind of sentiment. i'm asking you guys not to sell out. choose freedom over power. choose protection of people's rights to be innocent until proven guilty. this is a constitutional right. and there's a whole recent violence in the middle east you know with three dictators now with two, possibly a third all

started because of fruit vendor was being hassled in tunisia. unnecessary regulation by a small business. don't think it can't happen here. if this economy keeps getting worse and people keep getting angry, you know, we could see major unrest. and you don't know where it's going to start. but i'm here speaking for people who are tired of being oppressed. and we have put up for this for years an years and you don't know what the breaking point is. >> thank you. >> thank you. i love evolution, love fest, just seeing that tremendous support, free sub public event in the middle of the public center. you don't see that anywhere. san diego, please, that would never happen. and that's one reason why i gravitated to this city and to see this -- this, you know, these sentiments of, you know, -- the stuff that, you know, basically the limiting of our -- of our voice and our freedom to dance and to revel and to be happy and to be good citizens is really being diminished. i have to say that i've worked for security companies, house of blues specifically and we frisk and i.d. people and people still got in with weapons and drugs. so it's not the end-all. you know, it's not the solution. it does help to diminish those

situations but it's not the, you know, -- still gets in. and i really wanted to say also that in the last form that i attended we were recommended to -- i still haven't received response. so i thank you guys for giving us this moment to speak and shine and tools have the mayor support really means a lot. i think san francisco has to be looked at as a place of fun and destination and not of fearful, you know, yeah. fear is not the answer. >> thank you. years, i have a sense that most of these speakers are really preaching to the quire. nonetheless i think it's good that their concerns are on the record. i echo many of them. i'm particularly uncomfortable with having my i.d. scanned. that seems just especially draconian. i went to a club in vancouver and they scanned my i.d. and made very sure that i looked into a camera so that they could have a record that i was there. and it made me wonder what happened that place that they have such onerous security just to get into the place? i don't know if they frisked me or not. but in any case, i think that this would just be chilling to permit an establishment and i have a hard time seeing it pass as is. so thank you. >> good evening, exigsners. my name is casey proud. i'm a recent transplant to san francisco from hawaii. i moved here in part because of the night life. i'm an aspiring d.j. and this was a location that i felt that i could express my art as best that i could. and this -- this particular measure, i think is particularly unsettling and is is a bit oppressive in my opinion and would if passed, i think, would deter me or basically would make me not want to live here as much. and i know there are other people coming from where i'm from and other outer -- other places outside of -- or outside

[applause] >> mr. president, commissioner, mark redding one more time. i concur with pretty much everything that has been said. i would point out that article one section one of the california constitution guarantees the right to privacy. i think when you start i.d. scanning, you're certainly violating the california constitution. now, i think that we have to look at the society. are we trying to desensitized the kids because if they're used to getting their i.d. scans going into clubs, maybe it will be that you can't go anywhere or do anything without an i.d. scan or maybe they'll put a chip in your hand and when you walk down the street it sends an rfid signal to the

tower. that said, i think it's good that they keep -- the sfpd keeps bringing these things up because i have quite a bit of knowledge of what goes on in a nightclub. it is getsing more and more dangerous. there are more an more shootings. it's not going to be the i.d. scanners that take out the club or the police or the entertainment commission. it's going the be the insurance companys that cancel the insurance because of shooting, and this and that. we as club owners and club goers have to look at security and how do we balance the right of privacy and whatever but keep it safe because if not the insurance companys will take it all out. thank you. >> make it quick. what? it's quite all right. it's ok. >> thank you for that splendid report. >> let me just say that -- no. >> ok. >> are we losing our -- we still have a forum. i will run through this. there are some stuff that i really want to get to and i want to start with it. i think it's unfortunate that some people, everybody did leave based on the fact that -- there are many people that go to clubs and come and go quite safely. but that is not always the case. and it is a serious floob we deal with at the entertainment commission and you know, you get to hear about these things. so i need to reiterate them for the record. so i'm just going to go right to the corrective actions and report to you that we did a

public safety suspension which is a 72 suspension at 2700 16th street in early march. this report was not made to you at the last hearing because of a preupon rans of folks on a different y time but we did that suspension between the fifth and seventh of march. a party began on friday march 4th at el rin con and it ended with a report stabbing sunday morning. the victim was treated and released. based on previous corrective action and the possibility of retaliation, staff began a safety suspension that began and ended. this report wasn't made at the last minute that el rin con was evicted of their premises on wednesday april 6.

the landlord, i think effected them on the basis of nonpayment of rent. there had been a consistent problem. we had been moving towards the 30th day suspension -- 30-day suspension. they were unable to maintain any kind of order at all. so at this point, staff has been in contact with them regarding with their surrender of their entertainment permit. >> an executive order for miss nightclub 2009 january and march of 2011. there were seven separate instances in orthopaedic around club miss that resulted in police reports. many of which also resulted in injury. they had a meeting on march 29 to discuss reports of security preaches. additional securities were imposed pursuant to police code

1060. particularly a director's order was given his space by barnabel on march 26. police reported a weapon being fired inside the nightclub from the stage. shell casings were found although no one was reported wounded. the incident occurred outdoor. the staff and the manager had a meet ling on march 29 to discuss the incident and again the security breach to try to locate how and why that weapon got inside a nightclub. the conditions were imposed again by the security plan. we have also requested an entire new security plan because their permit is quite old and was issued well before this commission was in place. so we expect to see that. i think their deadline is the 15th of april to give you that.

so that is just an example as you know of the problems that we have out there and so -- while everyone wants freedom and we appreciate that, this is the world we live in. so i will go back and quickly report on the neighborhood submit and the commissioner might want to do that. we had our first neighbor submit based on the hard work of commissioner perez. staffwise discussion with neighbors from the entire city regarding the commission and the work of the entertainment commission. it took place from 6:00 to 8:00 p.m. at the gene fran reck center. and we had about 100 people, i think. -- enjoying lively discussion and question and answers. great food was provided by t

mac. i know there were pictures were taken ad nozz yum. i expect them to show up on our website and facebook as well. i wanted to report that we had gun to accept the possibility of credit cards in the entertainment commission which was never done. it seems outrageous that it's 2011 and we can't take credit cards. but we hopefully will be on our way shortly to doing that without cost to the department. the cost ideally would be born in a small fee the person using their credit card based on a percentage. so we will continue to update the commission in that regard. also wanted to up date you on the promoter redge ration. i know the promoter issue comes up quite a bit and the use of promoters. having the ability to know who's where is part of why

these calendars are being requested by the police department as well as our staff every month at venues. so we know where this is happening and where promoters that we know or don't know is showing up. so the registration will be called ff promote. it will be really simple. it will be easy to get on there. it will be free to register. and we expect to launch that this summer. i'm working with david to up staff to make sure the messaging going around is appropriate. as you can see there are issues with respect to that so even just having a list will be helpful. i don't this all this other stuff is important based on this late hour.

so if you are so inclined to take these home and read them through, you might learn a little more what we do in the office and with that i will hand over the >> -- commissioners again with the late hour if you look at my report, i'll just hit the high notes. you'll see the list of administrative citations and notice to the board that we've given so far. first citation appeal, i bring it up with a little bit of irony. this is a citation that was issued to the club surfalo basically for violation of the security plan and resulting in an area of them losing control of an area, blocking of traffic and myself and sfpd units having to clear the side walks. the
