supervisor kim for introducing this legislation that is important to us. we will strongly support the legislation. we believe that this revitalization effort with the government should benefit everyone, not only corporate business. it only happens when those stakeholders are addressed. that is why our organization is supporting this legislation. this will create the mechanism in which we can afford the partnership in revitalizing the community. of like to ask the support of the supervisors to please vote and approve this legislation.

>> supervisors, the leadership council that is a grassroots non-partisan organization that was formed in 2001 that voted unanimously to support this legislation. there has been talk about the mid market project area committee fulfilling this role. let me point out it was last elected in 1997. vacancies since then have been filled by the project area committee itself and it is dominated the downtown development interests. the community has been noticeably absent in the dialogue are around the twitter deal until now.

thank you. supervisor kim: thank you. >> good afternoon, supervisors. before i speak, i wanted the coalition on homelessness -- in support of this resolution. i used to say in the stabilization fund committee, the different impact of justification and the south of market, we feel that the area will also ensure that there is going to be mitigation for the impact on the small businesses

and nonprofits in the area, along with the city voices and the vision of how the central market should be revitalized. we wanted to make sure that residents have the opportunity to really speak and also have control over how the future of the city will look. we hope you will consider this resolution. please vote yes. >> the afternoon. i am the executive director of the north of market committee benefit district. i'm also a 12-year residence. any government sponsored revitalization effort will raise concerns about displacement of residents and small businesses. when our organization was forming, we saw a lot of the same concerns from the community.

he felt the best way to address the concerns was to invite the community to guide us with their advice. it wasn't always pretty or easy. but in the end, the organization is better for it and the services reflect the needs of the community. in the same way the citizen's advisory committee allows the community to give guidance and help with strategies that would address their specific concerns, for this reason, i ask the support the creation of a citizens advisory committee for the south of market tenderloin area. >> and the executive director of the american development foundation. thank you, supervisor for introducing this legislation to provide the citizen's advisory

coming out today, speaking on this item. it was a challenging process as we try to figure out how to address a job creation, making sure that we don't have consequences like displacement. and also that these benefits come to our neighborhoods and residents as well. our office has been working with many of the advocates. the also want to thank the office for spending time with the attorney's office to put together an advisory council that will work with the city administrator on the community benefits agreements. they would also come and give advice and recommendations to the board in terms of what policies to continue to pass to protect residents in the fabric of our neighborhood. thank you so much for coming

out. some of the amendments that were suggested to us that we have incorporated is that we want to have more members on the committee that could also represent small business. folks that work in jobs for creation, as well as expertise on commercial leasing, who have incorporated that along with members of the senior and disabled family homeless communities. and the 2nd the more significant amendment is that all members would not benefit from any of the benefits. those are probably the more significant amendments in this ordinance. are there any questions? supervisor farrell: i am just curious about the genesis of this year. my understanding was that it was around the mid market and tenderloin debate.

there were negotiations around that. is there anything more than that? gosh the body would advise the administrator's office that would be leading the negotiations with companies that want to come to mid market. they also wanted to host a public hearing to get feedback from members of the community. the others is a policy focus for potential legislation or policies that we may want to an act to ensure that we don't have displacement with job growth and creation. supervisor farrell: creating a body to provide policy guidance to the board of supervisors, the mayor's office, it sounds like you work with them.

i am questioning -- i get the cba. that was part of the discussion. with regard to advising the board of supervisors on policy, other district supervisor's having this appointment authority on this. i guess i have questions around that. i am creating a body that has that authority. supervisor kim: about the number of task force committees that we have in the city, i was careful to process that this committee would sense that with the legislation. we would be around the body of the actual exclusion. their role would be to advise us during this time. the board would take under

consideration, as we move forward with the legislative priorities. supervisor elsbernd: the one question i have in-house, this would be the first committee taskforce commission. where respectfully, one supervisor nominates everybody. if you look at all the others, we don't have another one. this is so much stabilization. those folks have to come to the board of supervisors. the treasure island, everybody has to come to the board. we have district 6 appointing three, but 20 of them are appointed through the rules process or eastern neighborhood. there are some district appointees. not everybody. the other kind of neighborhood

focus is split up. and even the power plant taskforce, that is largely 0 split up. i am very concerned about the notion of creating taskforce is where an additional supervisor nominates everybody. if you look at the planning task force, that is a perfect example of the tremendous difference that is shown. that is the standard that is in place, let's say we created a task force there, i would not be comfortable with them making all the appointments. the issues they are talking about, this is a citywide issue. it is a city wide concern. you have very good parameters for the seats. you will get people from

district 6 on the committee. i think that initial step of being adjusted district 6 frankly put a little too much. i think it is going too far. i would be much more comfortable if these folks had to come through rules committee and get approved in this way. >> would you feel comfortable if the office was able to nominate and it will come through rules committee. >> that is the way you have it set up now. it is an open the application process. the rules committee and the board approves. supervisor kim: of pay. supervisor farrell: i am sure his concerns -- in regard to my prior comments, did not

understand that this was potentially to advise the board of supervisors on economic policy positions. that is something i am comfortable with. i don't have a perspective on what happens throughout the city. it is the first time really thinking about it. i am not there yet on the part of it. supervisor kim: they don't have a vote on the board of supervisors. they still have to get introduced by a elected member and to go through the full legislative process. i am not sure this group would be hijacking the economic policy agenda for mid market. but advising just based on their experiences, these are the suggestions that they might have. it would be up to individual board members. >> alike to understand what that looks like.

again, very happy to consider it. without hard makes me nervous and i am not there yet. supervisor kim: understanding is that we modeled this half of the stabilization fund. my understanding is that all of those seats are appointed by a district 6 supervisor. >> i have the document of on the laptop. nowhere in the qualifications does it say they are appointed by the board of supervisors. even if there was one, am eastern neighborhoods is not the case. the western that we just had here, and of those had one

district supervisor appointing horn dominating all of the members. it is a very unique thing that i don't think is appropriate. supervisor kim: ok. i am still committed to the legislation as written just because we have spent so much time working with community advocates on the legislation. i am more than happy to split its foreword to the full board. one that has the board of supervisors >> maybe you can convince me. the history of that, there was never a problem. the of these other committees, there was never a problem with the district supervisor. i don't think is appropriate that the home district supervisor guess the ticket to choose their friends. it should be a more open

process. maybe you can give me a justification about why the district 6 supervisor should be the sole nominating person. that way everyone feels like they have got a shot. supervisor kim: i understand that. i think that maybe the group felt comfortable with having our office nominate members of this committee, and we really tried to make this legislation has tight as possible, making sure it was around for a limited number of years in terms of providing a device, feedback, and holding public hearings. it would not actually have any decision making power over legislation and policy moving forward. >> we are setting up a world cup -- rules committee hearing where

you have what, seven people? there might be one or two or three or 10 people that are interested in that. the answer is a you'll have been dominated by a supervisor. what was the district 6 supervisor process? what kind of process will they have for who they will nominee? you're setting this up for a bit of a black market, and it could look like it is not necessarily the most open of government processes. and if you have an open process where anybody who wants to convince these qualifications and appropriately apply to the rules committee and be on the public record, the rules committee can go forward. when this happens initially, you will be the share of the committee. it is very deferential.

and if you're thinking beyond that time, we had her supervisor campos make a recommendation and we are very deferential. i just don't think you want to set up this process for the district 6 supervisor makes the additional nominations. supervisor kim: supervisor farrell, d share the same concerns? supervisor farrell: i never thought about it in that way, but -- >> we based this completely off of the language of the stabilization fund. i don't believe there is an open application process for that. they are split. can we potentially amend it to model that exactly? would you be open to that?

supervisor elsbernd: again, i am relying on the address here that says it is nominated to the board of supervisors. if you would like to continue at, we can pull out the exact. >> it reflected a mix. it encompasses a larger area. the language is taken partially from the neighborhood, the part of the appointment process through the district supervisor. and the confirmation by the board. supervisor elsbernd: but it has a legislative and executive splits. it is just pure legislative.

if you wanted to add more seats so there was an executive legislative split, hot -- and that might make a little bit more sense. >> there were originally seven members, but they did not have to appoint them. i like the suggestion that we go into closed session and we are able to pull oup -- >> not closed session on this. supervisor kim: actual litigation and we can spend some time crafting language around the nomination that would work for all three of us. we have a motion to move into closed session. and reconvene. we will continue this item after the closed session. thank you.
