units versus four. there could be in the other project we approved, they didn't spread the units out across the street, frontage, they sent it back and took advantage of the lot in a different approach than the design of three units in that case. and think we shouldn't just dismiss six units on this lot because i think they could be designed such that it could accommodate what the program has and more. i'm not real enamored with two-car parking and would like to voice my objection to that. in public and also i think if staff is going to be continuing to work, they should include

whatever standards we're looking at for obscure glass that are going to be used for balcony railings. president olague: i wanted to comment and applaud the staff for having the courage to make this type of recommendation because that seems to be the direction at least i hear the city sort of encouraging which is densifying, you know, what they call it, density equity is the buzzword that everyone should be doing their fair share to increase density throughout the city. so i really think that what i see here -- it's really an overparked project, two parking spaces for each single family home which i think is excessive amounts of parking, it's two to one given -- before with was a one to one parking i think was

a single family home with one parking, so we'll see an increase in that here, and yet, you know, we're supposed to be a transit city, looking at sustainability and greenhouse gas emissions and all the above, and yet we don't necessarily see staff making recommendations that line up with that view. that i think the city seems to be taking. i applaud new your courage to make this recommendation. the only concern i have is that is sounds like the project sponsor was a little down the road and there were changes in advice he was given. that's why the main reason why i'm sympathizing somewhat with the project sponsor because sometimes there's always a disconnect, too, sometimes we hear a lot that project sponsor

had certain expectations and then the expectations were changed midstream. so it's the process that i have problems with. but i really appreciate the recommendation of staff because i think it is forward thinking and it's appropriate for this site. so i think in principle, it's an excellent recommendation, actually. but my only concern is because the project sponsor had already been working on this project and whatever. somewhat along in their planning and outreach and whatnot and discussion with neighbors that i'm not sure how that plays out here. but that's kind of -- i think it's overparked. i think other than that, it's good to see four units as opposed to one single family dwelling that would be sizable for families. but that's my conflict i have

is the process rather than the recommendation because i think it's an excellent recommendation. commissioner antonini? commissioner antonini: i think this is a good project for the west side and we talked about the west side doing their part and this is a good use of some space that was very underutilized. and one other thing in regards to the project around the corner on gold mine was a deeper lot. you were able to flip those around. this is a pretty shallow lot. there's a big grade change and you have to allow so much space between the houses in the back so you really don't have that luxury here i don't think. it would be very difficult to try to design them in facing the other direction. and as far as the parking thing, i think at the price point that these are going to be, these are people who are going to have at least two cars, i would think, you know. and they're going to have the cars anyway. it's just whether we allow them to put their cars in a garage or whether we have to put them on the street.

and we're competing for the market for people who might choose to buy outside of the city where they can get as far as the parking an other things and need the citizens there because they contribute to san francisco and we need that market, too. i think it's a good project and years ago we would have built maybe one very large home on this lot with a lot of exterior space so i think we are making it denser even with the four units. president olague: and finally, i want to say i think it is overparked and i'm going to reluctantly support project sponsor only because -- based on the comments i made earlier and i do really hope that staff uses this for further recommendation because i think a lot of thought and analysis went into this and i appreciate

for conditional use authorization. on may 19, 2011 following public testimony, the commission continued this item to july 7, 2011, to allow continued conversations with the community. public hearing remains open. >> good afternoon, president olague, members of the commission, tom wem, planning staff, reporting the proposeed exception at 2124 mission street. the reason for the continuing this from may 19 was because a member from outer mission merchants and the residents association expressed some concerns to the project because they alluded to an independent, erotic massage website that advertised another massage franchise operated by the project sponsor in citrus heights, california. and after the initial hearing, the project sponsor made their

due diligence and contacted the aforementioned website and requested a clarification about such business advertisement without their knowledge. the website only responded to the project sponsor that the massage franchise in citrus heights is reporting as nonerotic on its website and there was no other responses to the project sponsor. project sponsor presented this information during a recent outer mission merchants and resident association meeting and project sponsor also reported that website to citrus heights police department. and also based upon the discussion between staff and a member from outer mission m&r

association, there had been communication between engleside police department in the city which is in charge of the project area. and citrus heights police department and the citrus heights police department reported that after their inspection, they found no -- they were not aware or found anything illicit at that franchise in citrus heights. and that's what happened after they had the first meeting. and otherwise staff still believe this is current proposal, proposed massage establishment at mission street meets all the applicable provisions of the planning code and also the general plan provisions and therefore we would recommend approval with conditions. last thing is that according to outer mission m&r association, they would like to request that

group leader by allen demesia conducted a neighborhood meeting to talk about my proposed business. the meeting went fairly well. with most attending in favor to allow me to set up in this. and a few days later, attendee from the june meeting did search and found one of my business in such a sight was a listing on the erotic website. but i have to say, in this situation, i really don't know of the information listed on those kind of websites because i provide my information to the neighborhood. if i did anything bad, i won't

provide my information. so after the website owner was contacted, she said the website -- [inaudible] has a way to solicit membership. she also contact my current business at such time and received only positive information and feedback. you can see the document attached on letter j. i in turn send three email and the one registered letter to the website owner asking question about when it was posted and who posted it without my permission. i also asked whether or not it was free to post or if someone

paid to post and all i can go about removing my business listing from the website. but the only response i received from the website observer -- owner was your massage was on your website. so i filed a report with the police department on june 6 asking them to how the website operates. i did not approve listing my place of business on any website. so i have attached three reports, pictures of my previous and current business letter of the recommendation, email in the supporting

building that was previously occupied by a contractor where he stored his materials and had a small office. the layout of the motorcycle shop is for a small office at the front and retail at the front for storage behind and then the repair operation at the back. it's a concrete building and it's a narrow long tendency. the primary point i'd like to make is a proposed repair shop is compatible with the immediate neighborhood and it is not controversial. we're here because the planning code mandates any vehicle lear related use in this n.c.t. district, neighborhood commercial transit, requires commission approval. before the zoning for this district changed to n.c.t. a few years ago, vehicle lear repair -- vehicular repair

shops were a use in the right. the immediate neighborhood is now filled with repair shops of all stripes and have been in this area for years. within a three-block radius, i counted a total of 23 different businesses that service cars and motorcycles. this number includes five other motorcycle repair shops, seven automobile service centers. there's also a collision shop, a muscler shop, and several shops that replace glass for automobiles as well as four major car dealerships that sell and repair cars and two other businesses that specifically sell motorcycle clothing and accessories, so the point is that there's a very high concentration of businesses catering to vehicular use. i'd also like to mention there's been no opposition to

this project from any of the neighbors. this is not a controversial use. it's compatible with other uses in the neighborhood. for example, next door there is a sheet metal shop and next door to that there is a collision repair or car repair shop. and next door to that is a glass repair shop for autos. and across the street is a car rental agency and around the corner is a car wash with gas service station. so the motorcycle shop both fits in and is compatible with the surrounding uses. the last point i'd like to make is that the owner is a professional. he worked for 14 years as a motorcycle mechanic in other repair shops. he has a large following. he is quite well known and is now time for him to go out on his own. he's interested in the good

will of the neighborhood and in doing a good job. and i'm convinced he is sensitive to noise issues and he's committed to keeping the area clean and tidy. and in crung man deserves some support. we appreciate your time and your consideration in this matter. thank you very much. president olague: thank you. is there any public comment on this item? >> good afternoon, commissioners, jeremy paul. i had an office in that space or adjacent to that space for 15 years until this past year and for the first 10 years of that occupancy, 50 otis, i was in 60 otis which is like a sliver cut off of it. 50 otis is a car stereo installation shop back when we used car stereo installation shops. so the layout is almost exactly the way the motorcycle shop is using it now.

authorization to add other entertainment to an existing l.c.u. authorized as a bar in an rm-1 zoning district. currently the bar is authorized to remain open until 2:00 a.m. staff recommends approval with conditions, and the basis for this recommendation is that it promotes a continued operation of an established locally owned and operated business which contributes to servicing the neighborhood. the proposal would not displace existing retail tenants and it would provide convenience goods and services to the neighbors. it would not result in a net increase in the number of bars in the area. it would offer local residents and opportunity for entertainment within walking distance for many residential homes. it's a high density residential area. and the project meets all

applicable code requirements. it's compatible with the surrounding neighborhood. and it is not a formula retail. we plan to limit the hours to ensure that the use would not be detrimental to the adjacent properties. after the report was submitted to the commission, staff received one letter and one phone call in opposition which stated concerns that the bar would become more of a destination location by adding entertainment than a local neighborhood bar. the neighbors were concerned it would also increase creation of a nuisance in the neighborhood and the department believes that by limiting the hours of operation in conjunction with all the conditions of approval we've set forth, one which include as monitoring fee for the conditions of approval that we have addressed these concerns.

the project sponsor has some additional signatures and letters of support which came in today as well. that's my presentation and i'm here if you have any questions. president olague: thank you. project sponsor. >> thank you, commissioners. my name is debbie cone and i own the bar at 2730 21st street. i brought three copies of the letters, emails and additional signatures and now have a total of 184 signatures, all of the properties that are on the 311 mailing have signed my -- in support of my entertainment license. since 1981, it's been a bar but it's been a nightclub so actually when i went into a lease was a nightclub. it had after hours, it had d.j.'s until 2:00 a.m. i'm from the south bay and originally it was a destination place when it was the monkey club, the owners are from san jose.

i came from san jose and how i found out about this place. the deejay goes until 2:00 a.m. and there's never been a problem in eight years and there was one complaint and the gentleman is in the room now to support me. he doesn't want to be pointed out but is here to support me. each of the businesses operated with their entertainment until 2:00 a.m. all the businesses that were there before. imagine my surprise when i went to the entertainment commission to see about transferring the entertainment license and they said oh, that's not a licensed facility. we know it's been a nightclub but it wasn't licensed. so as demonstrated by the fact there were never any complaints and that the neighbors were -- if he had didn't support it they would have complained before because it was not a neighborhood crowd. i changed it into a neighborhood bar with food and we -- and i cater to the local people, about 0% of my clientele does walk there -- 90% of my clientele does walk there and want to have birthday parties and they say we have a

deejay, great, $300 because we have to get a night of entertainment permit. i've had multiple night of entertainment's permits and paid the fee and they went until 2:00 a.m. and had no complaints. i provide jobs for local community members. everybody rides their bike or takes -- they ride their bike or walk to the bar. there's been less vandalism and issues in the area. i live across the street and three doors down. i own the home and have been for five years. i am in the neighborhood. i spoke with the neighborhood people, one woman who is the only woman that actually the entertainment commission has a letter on file from her speaking out against the last time they went for something like this. i spoke with her, her name is alana, i spoke with her a couple nights ago and she wrote me a note, give me a call. i sat down with her and she says now any daughter goes to your bar and my tenants go to your bar and say how wonderful it is and i'm not allowed to
