have panic hardware so they can open from the inside? is that how you are going to secure them? >> i will look into that. i am really -- i believe what we're going after and what we are going to essentially, this is not what gravity is going after. we will make the changes any way shaw security wants is to. >> commisioner joseph: when do you think you'll open? >> the sound test, we're not wearing this place with -- wiring this place with amps, this is acoustic. we're not having an in-house amplifier, like somebody wants to come in with an amplifier, there will do a sound check.
4:31 pm
we're not going out the neighborhood. >> commisioner joseph: say you have no performer. for tuesday night, you're having a cocktail hour, are you having used -- music? >> yes. off recorded music. >> commisioner joseph: a cd. is it going to come through speakers? >> that is correct. >> commisioner joseph: is it going to an amplifier so will go through the speakers? >> it will go through that amplifier. >> commisioner joseph: you're going to do with sound test. -- do a sound test. your sound will be set in a certain range and even if you change that, what you are doing, it has to remain within the parameters of how our sound off has to sound. if you're going to tell him you
4:32 pm
have soft lounge music and you bring in a band, and they want to rocket out -- rock it out, that will not be within the sound parameters. i am not clear on what you are doing, that is all. >> it is a talent -- high end cocktail lounge. the entertainment would not be the predominant thing. of the business. i will give you an example. the fillmore is based as a standard place of entertainment that draws people in. that is not going to be the focus of this thing. >> commisioner joseph: thank you. >> president newlin: any other questions? >> commissioner roja: i was wondering what i reach you had done with the neighbors. >> the tragedy that happened
4:33 pm
there before stirred things up. i have got to talk to the neighbors. i am coming from trying to do the right thing. i have been in business -- >> did you do this verbally or did you send out mailers? >> i talked to the shop owners and i am their all-time. i know a lot of the neighbors and they have been, they are excited. >> ok. >> it would be nice if we had letters from neighbors or someone were here to speak on your behalf. that is always really a plus. kasay there is not going to be a dance floor. previously there was. there is no dance floor.
4:34 pm
>> the dance floor has been removed. >> what is in its place now? >> pool tables i have put in in that place. i am having a pool table permit also. you walk in, and high and cocktail lounge, two pool tables, a shuffleboard table. you cannot move the pool tables out. you cannot move the 900 pound shuffle puck out. we are going with a high and bar with entertainment. -- end bar with entertainment. commissioner meko: good luck.
4:35 pm
>> i hope you come by. >> can you walk me through the four plan -- for plan? if you bring in a band, i am trying to figure this out. >> we have elevated -- a broad iron fence which is open in three locations with couches and tables up there. you go up 20 feet from there and there is a communal table which is about 9 feet -- 8 feet wide and 4 feet. it will work well for a trio or something like that. on the other side, on the left side, there is going to be a couch. >> is this around here, where
4:36 pm
4:37 pm
set up would be here. we would take the communal table and break it down. on this side of the year, there is going to be a couch. there is not much space. we're not going after -- i understand you are concerned, youi do not want to have those problems. >> the only reason why i'm asking is because we have to treat you, if you are going to apply for permits, we have to ask you were these areas are going to become aware the sound is bouncing off of the walls.
4:38 pm
the inspection will know where it is. it cannot tell where you are supposed to be putting the band -- you cannot tell where you are supposed to be putting the ban. there it is. >> it does not fit anywhere else in the location. >> thank you. >> all these issues about sound and stuff are important. the application is for two pool tables. >> i want to see a couple things here. first of all, you say the chestnut street neighbors and district police. you spoke to some neighbors and put your name in the window, somebody walked by, they can
4:39 pm
see. that is your neighborhood outreach? >> i talked to local merchants. >> what about the residence? >> i spoke to the residents. >> i mean, you have got no push back. considering what gravity was in the neighborhood, i find it hard to believe he did not get pushed back from anybody. >> i have really, having that said, you are 100% right. having all those problems to really see how many people showed up tonight, that is how hard i've worked to make sure that people believe i am going to do the right thing. i am sure that if people took -- if there was no communication which i have heard communication is the important thing around here, and i did not communicate,
4:40 pm
i would bet you would have 100 people here in a lynch mob. i have gone out and worked for this. commisioner joseph: every other application that comes before us is a high and bar. every believes they are a high and bar. i do not know how many high end bars [inaudible] i want to say that it may be your intention to do that, and you may have the greatest intentions in the world. i feel like the application was filled out in a way that, for instance, 50% of our patrons will probably arrive by car. will your patrons -- your parking, you will contact a cab
4:41 pm
company to disperse her patrons afterwards? >> i have talked to a few people. there is a new company called scooter boys. they show up on scooters and that is the latest transportation around. >> commisioner joseph: they carry one person? >> they can drive them home. it is a class act. i have been in contact with them. just constantly trying to appease the neighbors. back to the high end market concept. everyone says i am a high end bar. most of you guys are in -- san francisco residents.
4:42 pm
this will be a cross between the big four restaurant and the hotel. and i really nice place. nobody in this room could potentially call it anything but a high end cocteau. if you do, i will surrender my license tomorrow. that is how positive i am. >> commisioner joseph: i wish you the best. >> i have investors who want to see a high end. >> commisioner joseph: i want you to know where i am coming from. just so that you stick to what you say. >> i can assure you when you walk through the door, you will see where i'm going with this. you'll be let in, i promise. >> did you already hire shaw
4:43 pm
security? >> we walked through it. the security, this is not going to be the focus of this place. we aren o not planning on seven nights a week having a different bj or banned. on thursday, do this or saturday, do that. we are not a band or dj peña. i do not want to walk out -- i am applying for it now and i would love your support. >> commissioner roja: do you have a copy of the security plan? >> i think we do.
4:44 pm
>> i would like to remind commissioner joseph off that we granted [inaudible] >> commisioner joseph: because gravity was such an issue in this area. >> i do not have one. >> you said this is jazz and dj's. are they running through your house system? >> ok. have a seat. members of the public wish to address this item, they are
4:45 pm
allowed three minutes. >> no meetings were called with the neighborhood. we were told it was going to be a piano only at the time. we knothe notice of this meetinn saturday. no one saw the sign. before the applicant and -- bars caused problems. drugs, federal and state rates, midget parties, noseise, vomit n sidewalks. we want mr. owens to be successful but we would request the fire -- following conditions. amplified music and singing to stop at 10:00 p.m. on sunday through thursday. friday and saturday, amplified
4:46 pm
music until midnight. all is must be closed at the time of the amplified music -- doors must be closed at the time of the amplified music. must have licensed security guards at all times and they must have patrons where they are not just hanging out to outside. must have a dedicated telephone line picked up at all times for complaints. no upstairs room shall be used for office only. no customers and friends allowed in the office on those steps. because there is no necessity for the customers and friends to be upstairs, that was a big problem with gravity. i have no seen a plan of how the emergency exit in the alley is.
4:47 pm
cleanup crew must clean and hose down the front yard after the building closes. not at 7:00 a.m. because patrons have come out repeatedly and stepped on bonnett. this has been a problem with this building. nothing against mr. owens. we want to have a working situation with him. when the neighbors found out recently that this hearing was happening, they called me and we came up with these conditions. i think they are fair and i would like to work with mr. allen's more. thank you. >> good evening. i may legislative aide to the district to supervisor. we like to ask that you continue
4:48 pm
this because we have not heard from the owner, we have not heard anything about this until recently. there has been little neighborhood outreach in our opinion. the neighborhood associations have not had a chance to meet with mr. aowen. mr. feldman has not sat down and met with him. when patrisha was meeting with him, they met casually but did not have a meeting. also, our office has never been contacted and as commissioner joseph stated, the past owner created a serious situation for the neighborhood. and past owners created serious situations for the neighborhood. it is a bone of contention and neighborhood outreach, a good
4:49 pm
neighborhood outreach is what is required when moving forward. i would note that given the fact that we are discussing the board of supervisors limited life permit, may be an accessory use is more appropriate for this location. that needs to be discussed also. my boss would love to discuss what mr. owens sees for this location. it is important to the neighborhood. i was in mr. caen's office, concerned about what happened there. i have not heard anything since. eight months later and all of a sudden this comes up. we want an opportunity to work with mr. owens and make sure
4:50 pm
those type of activities do not occur and the neighbors are heard. patricia is one of the people who informed me. if we could have time to discuss this or pursue something like the limited live informant -- performance permit, we would appreciate that. >> thank you. any other members of the public? this would not fall under the umbrella of the limited live entertainment, right? >> as he has applied and to go past ten, it would not be limited live performance, as he revised the application. >> ok. >> commisioner joseph: i make a motion at this point. before i do, i wanted to make my
4:51 pm
feelings really clear. i do believe that some things are going to open in that space, whatever it is. having something without a dance for is a far better cry then having another gravitate type club opened in that space but -- gravity type club opened in that space. opinions of what his sound is going to be like is unrealistic. he cannot have in-house system and put a dj through it and bands. it would make our sound enforcement impossible. that is not realistic to me. i also think that his neighborhood outreach was somewhat lacking. although i am reticent to continue it because we continue it, we can only continue it for how long?
4:52 pm
the next meeting would be when we could continue it to, is that right? if the applicant asks for a continuation. >> we do have an issue that the commissioners are aware of. if there is a continuance. it might be 45 days. we do have to be careful. there is a clause in 1060 but that does not trigger if it is a request from the applicant. >> commisioner joseph: i am not sure if the applicant would request the continuance.
4:53 pm
mr. owens. would you consider requesting a continuance until our meeting in august? there is no second meeting. august 9 is not enough time? >> we can push it back for a month or so. is that fine? >> commisioner joseph: when is the next meeting in september? >> that is fine for me. is it ok if i have the pool tables in their bacere? >> i think you can. >> just the pool tables. >> a motion for staff ith
4:54 pm
respect -- with respect for a request for continuance. but not the pool tables. >> you can coordinate -- she has a list of community groups in the neighborhood. i certainly suggest that you speak to the supervisor's office as well. and make sure the community groups they are concerned with as well that you reach out to. >> that is fine. >> make sure you get the security plan to us. >> it is ok with the president, i would like to make a motion we continue for discussion.
4:55 pm
if i can request to make it clear, a motion for the staff to direct us with respect to the request for a continuance on the place of entertainment. >> that is fine. >> you can coordinate with joycelyn. >> make sure you get the security plan. >> if it is a depressant, i would like to make a motion and we can move it forward. >> does want to say that i talk to -- and i know that he is
4:56 pm
concerned about entertainment in his neighborhood. one of the things that i would like to do is volunteer some time. i would really like to have you help contact the neighbors. >> i live two blocks from this place. i know that has the potential to be a positive feature. i know this is our standard procedure. we treat everyone the same. i don't want to come back to this commission under any
4:57 pm
circumstances, so we are trying to make sure that you succeed. i want to give you that precursor. >> thank you. >> ok, i will entertain a motion. >> my motion is this, i move to bifurcate the permit application and approve the billiard tables. at the applicant's request, continue a place of entertainment permit to the first meeting that we are going to have in september from whatever that date is. that's it. i think that is everything. >> second.
4:58 pm
4:59 pm
for some time. this is a bar in the lower 8 neighborhood. -- lower haight neighborhood. >> don't touch it. >> i have a really good relationship with the seller who has been facilitating the transfer of the business. he is here with me today. i am happy to answer any questions you have regarding my application for my neighborhood outreach. we are keeping the name the same come this jury staff the same, the bartender's the same. i really stepping in to replace sean's role. i
