thank you. next speaker. >> good afternoon. my name is colin gallagher. i am here to convey my strong support for this secure communities program. the obama administration made it clear the state governments have no authority to withdraw in the memorandum implementing the securities program. you are urging governor brown to take an action he has no power to perform. moreover, the resolution ignores the fact the obama administration has decided to review the cases of 300,000 illegal aliens to review those cases from deporting those persons who the obama administration deems not to pose a threat to public safety. this resolution is therefore superfluous. supervisor mirkarimi when introducing the resolution made

a suggestion illegal aliens are being denied due process to secured communities program. this is not the case. every person in deportation proceedings has a right to an attorney at his or her own expense. what's more, when the board voted to override mayor newsom's resolution, it only exempted juvenile detainees from being supported to the i.c.e. when you had approved the sanction chewary resolution as drafted, you had indicated your agreement that adult detainees in the city's jails could be deported without a guilty finding on the underlying charges. why now are you going after secure communities program which is one of the obama administration's rare success stories? most san franciscoians are glad the obama administration is carrying out a program that is removing illegal alien members of violent gangs from our city streets at a minimum of an

here in san francisco, you're very vulnerable. you're empowered to do something about that by upholding your oath to protect and defend the constitution. several of the house members have put forth a lawsuit on those grounds entirely, and i've given you that information that the complaint for relief, it calls for injunctive declaratory relief to protect the country that a president may unilaterally go to war in libya or any other country without a declaration of war by congress required by article 1, section 8 of the constitution. the policy a president may commit the united states to war under the authority of the nato under express conditions of -- president chiu: thank you very much.

and i'm here today because of the ugly situation that's risen its head in bay view hunter's point. i would first say i think most of you know me from seeing me but i'm a veteran of a war, better known as korean and vietnam war. and three days after i was overseas, my best friend was killed. and i came back home after being overseas 31 months, and tried to get in the teamster's union. at that point i was told niggers was not allowed in the teamsters union. and i fought this fight a long time. now i learn from one of our contractors that cahill nibby said they're not hiring niggers in bay view hunter's point. they have three or four jobs in hunter's point, no african-americans, not hardly, only flag men can work out

there and we have no skilled labor out there even though we have skilled labor. i'm saying this is the same identical thing that happened in the western addition is now taking place in hunter's point. most of the people want to sweep it under the rug but you can't sweep this mess under the rug any further. and as i told a group of young people the other day, that after i came home from overseas, i realized one thing, i had been shooting is at the wrong people. and our people as black people, we always find ourselves, and i'm sure all of you know about it, that every time you look up, something happens that sets us in such a position that it's just something that just happened, as they say. so i'm asking the board of supervisors to have an investigation into the fact that nibby construction and --

to let this thing continue on. just check your history. it's no mystery. now, i'm also here to say one thing about your support, we're going to have a big community meeting in the western addition called the roll call. we're going to call d.p.w., dcif, all the departments here at city hall under the immigration report that's institutionalized. department heads are supposed to be meeting and talking about it. nobody of -- none of that has taken place. violations. violations. and if this administration, if you all don't adhere to that yours truly is going to go elsewhere outside and get someone to investigate not only one department but everything here at city hall. i've never in my 20 years -- i've been here 20 years. the racism, the confusion -- you think it's -- how can i

justice advocates and survivors. to us this ward, to make a proactive -- to take a proactive stance about the killing here. we're actually pushing for the creation of a civil -- civilian review board as there is in oakland now for police. we need six of you to sign this motion and one of you to introduce it so we can introduce the civilian review word as -- board as a valid measure to be put out to to the electorate. richard brown could not attend since we were tabulated to speak at the very end of this session, richard brown of the san francisco 8, one of the founders of the black panther movement had to leave and many others had to leave because it

2121 at city college of san francisco to join the demand for an independent investigation into the shootings of kenneth harding and charles hill. there's a crucial distinction between the right of self defense and the reaction of undue force, and there are too many instances of police officers responding with deadly force. when their lives and the lives of others are not threatened to a point that would justify the deadly force. there's also a history of this kind of deadly response in poor or marginalized neighborhoods, especially communities of color. there should be more extensive training of police officers to deal with people who pose a threat to others including police officers without shooting to kill except under extreme and justifiable circumstances. we expect police authorities and elected officials, the honorable, distinguished people here today, to ensure that police officers like other members of society are subject to the same civil and criminal

penalties as the rest of us when they react with undue force and cause death or serious harm to others. when a significant number of people believe that police officers have caused the death of two other human beings without justification, it's in the interest of all the people to have a thorough and independent and impartial investigation of those tragic events. consequently on august 30 of this year, the ft 2121 delegate assembly passed unanimously a resolution supporting the demand for an independent investigation of the shootings of kenneth harding and charles hill. we hope you'll listen to the people. thank you. [applause] president chiu: thank you. next speaker. >> my name is daniel garcia. i'm one of the co-founders of october 22 that started 16 years ago. for 16 years we have been coming in front of the board, in front of everybody asking them to do something.

we're tired of asking now, we're demanding and the demands that are that the san francisco board of supervisors conduct an independent investigation because the police cannot investigate themselves. in my brother's case of 1996 and also a family member of mark garcia. you probably heard about that case in 1996. he was murdered by the chief's group. now, also, we're asking for a prosecution of police officers responsible after that independent investigation shows that they are guilty because it's not going to show with them doing an investigation. and an end to the police occupation of bay view and hunter's point. no retaliation for people that come up and tell the truth. i am one of those victims many times. and i'll still tell the truth no matter who comes. have respect for your people

here. thank you. president chiu: thank you. next speaker. >> good afternoon. my name is larry felson and i'm with the coalition to stop police brutality and the criminalization of a generation. and i also have been a teacher in this area for many years and have seen the police shoot down, hassle youth across the whole bay area, including in particularly around the public transportation system. and we all know the general -- having a general understanding of the killings that just happened in this area but we really have to question, what was the original reason they even stopped kenneth harding. why? why did they stop him, for a fare transfer? do they stop people in other areas of san francisco for those reasons? to me it's basically racial profiling that's going on. we have to really see what's happening in terms of the bay

view. i'm not going to focus on the -- we've already talked about the independent investigation. i mean, we can't have's former chief gascon conduct an investigation or chief suer notorious at the bay station for his actions and ran out of a meeting a few weeks ago and we have to talk about the inspection of civil liberties involved with activists in the bay view who were actually charged and held in jail, you know, one for three days and then let out. these were people who spoke out on the killing of kenneth harding. i also want to talk about what happened with charles hill. charles hill, we have witnesses that show charles hill was actually killed unnecessarily when he could have easily have controlled another situation. also, this question, that's exactly what's happens to people who have spoken out in cases of police brutality in this area and we need to have really a full -- i don't know

how to go about it through the board of supervisors but the board of supervisors is a responsible body, you know, in this area and they need to take these issues quite seriously and conduct a public -- i don't know, a public forum on the question of police violence. but they have to take some action. thank you. president chiu: thank you. district. i was taken into custody for resisting arrest and i was released about three days later, four days later without the charges being filed. and i'm harassed every day. by police. it's a continuous harassment. the day after i was arrested, they actually came to my house, to my street on a sunday and told my family member -- towed my family members' cars from the street and they don't even tow cars on sunday. so i mean, if that's not being targeted, i don't know what is. and i just feel like a lot of times when i come to the supervisors' meetings and to a lot of these other meetings, my words go in one ear and out the other. last time i was at a supervisors' meeting i spoke on how children are criminalized on the t-train and a few days

later, kenneth harding was slain over a transfer. over not having enough for fare. and i just feel like it has to be a lot of changes and it's going to take support of the community and community members and not just police instead of putting so much money into police, we should put money in neighborhood programs that are going to give kids an alternative than hanging out, like i'm working on a program called i, too have a dream, entrepreneurship program which will help to eliminate social blithe and create -- blight and create opportunities for our youth and also people coming back from prisons and people coming back from war. "planet apes" just came out in san francisco, too. president chiu: thank you. next speaker, please. >> good afternoon w my name is ms. nicoleto and am an attorney and am here as a representative of many attorneys who i've spoken with recently regarding the police brutality and killings of kenneth harding and also, you know, basically what i'm here for is to call upon a supervisor to sponsor legislation. that's what we want. we want an independent investigation into these killings. you know, i remember back in january, i was able to help misha out at a protest we had

involving randall duncan who was a handicapped man shot in the back. as he was wheeling himself away from the sfpd he was shot several times. and you know, it's just over and over again. i feel that -- especially in a city like san francisco, this is an outrage. and we need to do something about it, so therefore i'm here in support of every organization that is calling out for reform, severe reform, significant reform in this area, and again, we want legislation. we want an independent investigation because the sfpd cannot independently investigate itself, obviously. it's not possible. so that is what i'm here for today, and i hope that we are able to get something done with regards to this. president chiu: thank you. next speaker. >> i'm riadakiama with

"revolution newspaper." i wanted to read something from basics. there would be no united states as we know it today without slavery and what we have, michelle alexander wrote a book and talked about after slavery, you had jim crow and lynching in this country, and now since the 1960's, you have mass incarceration. that is a new jim crow. what happened to edrus stelly and mark garcia, that is an epidemic. that happens thousands and thousands of times. and we are saying enough is enough. why we are coming here today, we're demanding an independent investigation and we're part of a movement to stop police brutality. this generation has to be the last generation that faces this. no more generations of our youth. here and around the world whose lives are over, whose fate has been sealed, who have been condemned to an early death or

life of misery and brutality, whom the system has taken for oppression and oblivion even before they're born. i say no more of that. that's what we're here about. we're demanding the board of supervisors do an independent investigation or otherwise you're complicit with this whole onslaught of criminalizing. now police are statistics of october 22, we have police tasering 8-year-olds. 8-year-olds. iana jones was 8 years old in detroit. kevin harding is a youth, 19-year-old youth. especially taking people of color. if people can say they banned slavery, this is a new form of slavery and we're saying that's one strike slavery, two strike the new jim crow and three strikes massive incarceration, strikes massive incarceration, time's up.
