were still unable to contact him, and this went from friday through sunday. i also have of a problem with the foliage in the front of the house, which has narrowed the sidewalk, where only two people can walk past, and until last week, the wrought iron -- it is not a fence, but surrounding his plans, it is a safety hazard. they had someone cut off appointed a portion -- the pointed portion that is surrounding the foliage, and it is causing cracks on the sidewalk on the property i live on. thank you. >> thank you.
6:31 am
>> my name is deborah, and i'll live in an apartment building. some of my concerns are about the mechanical grosarage. the mechanical rooftop, a lot of people being on their roof, the noise from putting some equipment as well. he says he is going to soundproofing it, but there is no guarantee this is going to be done very good he says a lot of things. previously i have problems with people dropping cigarette butts
6:32 am
and pushing them under the door. i had an incident where people were flicking cigarettes out an open window on the second floor, and how do we address these things, because david is not very approachable when there is a problem, and he is usually not a round. other concerns aren' i will file the appeal, and i was the one who brought attention to the board of appeals that there was a tourist hotel. i saw the progression of that throws hotel -- progression of the tourist hotel when he started having people stay there and there were attendance on the lower flat but was renovated. people were staying there, and
6:33 am
when other tenants were forced out, the same thing happened. he never admitted to having 0 centa hotel. i do not think there is really an effective way. i do not think a memorandum were having somebody sign some restrictions is going to be enforceable and if things start going the same way they were before and then it is a week and then nightly. i do not think it is affordable
6:34 am
housing. i think it is a way to increase prices. >> are there at additional speakers? we were evicted, and he claimed he wanted to move his mother and father into the building. we were threatened with a lawsuit. we ended up being sued and settled out of court. i can go on the record saying he did not live there. yet he was running an illegal hotel, and what i understand now, he was also collecting a
6:35 am
hotel sales tax. this might be if here say, but now our roommate had her parents visiting from germany, and they stayed there for a week. as far as i know, he never lived there. he had several residents and now he was occupying. any questions? >> not at this time. are there additional speakers? seeing none, the project sponsor. >> my name is david. i am the project sponsor. i am the owner of the building,
6:36 am
and i live at the building except when i am at my boyfriend's house. i want you to know how i worked out commitments with my attorneys to respect the neighborhood and to let you know i am very serious about those commitments. >> good evening. it would be great if the overhead went on and stayed on. it would be great if each party could have a three minute rebuttal. you may remember david was here last year. one of the community leaders has expressed support of his project. i can tell you david has not rented this week to week.
6:37 am
you have seen a week to week ad. you have seen unknightly i've. now has indicated, she has an e- mail from a company that said it was not renewed once placed in 2006. everything you have seen our old website ads. when something goes on, it is hard to get it off, and that is what you are seeing. david has lived there since 2007. he spends nights with his boyfriend. all i can say is there are no weekly or month-to-month leases here. we present ceo a number of month-to-month wheezes.
6:38 am
-- we present a number of month- to-month leases. you will hear how they like not a promise seas. there have been some unruly tenants in the past. there have been some code violations, but there are no current code violations. 1/3 indicate no problems, and we have here a number of complaints where attendance mention things to the building inspector and the building inspectors stated no violence and -- no violation issues. why does my clients want to release by the week or the month and not by the year? this is the only currently allows that if you live in a place and subleased to your roommates, that is the only way you can have a lease buy their rooms.
6:39 am
david would like to least two people on floors he does not live on on a month-to-month basis for a weekly basis. there are many people who come in the city. my friend had to get treatment at kaiser. he did not know if he would stay there five weeks or six weeks or seven, and he wanted to rent her weekly. many people do not want to sign the lease most landlords have today. many people come on relocations from corporate headquarters. they are moving to the city. they do not want to permanently commit to a year lease. these are working people whose needs are not being met by the requirement that there are 1- year leases. they have to go to roommate's
6:40 am
services to live with strangers. that is problematic. they do not want that. they want week to week and month-to-month, and they want their own lease with the landlord. if david has a lease individually with people who rent rooms, it means he has more control. roommate situations and not often mean involving people who come and go during good david -- new people who come and go. david wants to have a relationship with people who come to live in the in the building. he can enforce rules of the building against them. other residents will tell you how they want that to happen. i will talk about the declaration we recorded.
6:41 am
>> thank you. we will hear from the reporters of the project sponsor. >> good evening. i live about six blocks from the project, and i am in support of it. i see if they have come out against a wrong project. i do not know about the motivation, but there is an undercurrent to group housing. this neighborhood has experienced a mass conversion. these remain rent-controlled units. we are talking about three rent-
6:42 am
controlled units that can be divided into 15 moderately priced rent-controlled units. there is no net loss and arguably net gain. i am confused by the conflict he is running a tourist hotel. i would also say that i have filed claims against hotels that were renting nightly. if you are concerned about someone renting it nightly, you should be concerned. it is far easier to control . the city's half of much stronger tool under the hotel conversion ordinance -- the cities have
6:43 am
stronger tool under the hotel ordinance. you should allow the conversion to residential hotels, and someone should throw the book at it. it is not an argument for not allowing them to move forward, so i support the project. i think it is a good use in the neighborhood. i am disturbed by some rentals by the day. it does seem this project should move forward.
6:44 am
>> if i have called your name, you can start coming up to the microphone. that would be great. usually people, of automatically when their name is called. >> -- people come up automatically when their name is called. >> i am going to read two different e-mails. i currently live at 1257 in san francisco. in 2008 i moved back from china. i was in transition. the fillmore house perfectly suited my needs. most other properties have a 01- year lease. i moved in in october and stayed until to live.
6:45 am
my roommates were respectful, and i was not aware of any complaints. a few stayed for a long time, and the situation was not as transient as others may thing. -- others may think. single people like me have equal rights to access affordable housing. i would like to read another letter from a current tenants named nicholas. my girlfriend and i have been living at the house on a month- to-month contract. i have full time employment since september 1, and my girlfriend join me as a student. we decided to look at a place affordable for a couple with one salary that was affordable and
6:46 am
quiet and clean. quiet and clean are important to meet our lifestyle. we were pleased to find a place that met our requirements and more. they provide parking for our bikes. the place is very clean in a quiet neighborhood. our housemates are respectful and respectful of the spirit of the place by being clean and quiet. all of this set the fillmore house apart as the best place we have lived so far in quality and price. thank you. >> good evening, commissioners. i live on sanchez street roughly three blocks south of the fillmore house. i am in my bicycle clothing. i am a member of the bicycle coalition. i have toured the house. it is a nice neighborhood, but i
6:47 am
am here to talk about group housing and the problems i have experience trying to hurt people jointly under the master agreement. it is like herding cats, especially in this economy where suddenly you find one of your roommate's has a problem and suddenly you are short of funds to pay for a joint room, and i think the solution is sooto give each individual their own contract, and you really eliminate the fear and hassle of somebody backing out of their commitments, so i am very much in favor of that for those reasons, to make sure people can be there and not worry they are going to have our roommate hole out at the last minute, the --
6:48 am
pulling out at the last minute, so we solve those problems. thank you very much. >> i lived at the fillmore house from about august of 2008 until december. i had a month-to-month lease and was required to give notice. i believe all the other residents have the same
6:49 am
agreement, and i believe some of them have lived there for several years. i needed a temporary place to live in 2008. it was conveniently and not located -- it was conveniently located. any issues were taken care of immediately. i believe they provide service to the people of san francisco. i have a friend who recently moved in, and i know he finds it very practical, as he is often only in san francisco during the school year but often finds himself somewhere outside of san francisco. this is a convenient option to have available. i would like to attend the hearings, but unfortunately, i had a vacation already planned. if you need to reach me for an
6:50 am
additional information feel free to call me at 415 -- thank you. >> good evening, commissioners. my current address is 124 filmore st.. i signed a lease on february 23, 2011 and assumed occupancy on april 2, 2011. i continued to occupy the room on a month-to-month contract, which i understand is consistent with other residents. i have recently relocated from charlotte, north carolina, and i work from home roughly 80% of the time. the option to rent a room made my cross-country location
6:51 am
possible. now furnishing is included. month-to-month rental agreement has allowed maine and new great flexibility to develop and grow my new life as a san francisco resident. i have found its maintains and clean. tenants are friendly and respectful, which translates to a quiet and private living situation. i do not have an intention of terminating my month-to-month agreement. >> good evening. my name is dr. thomas conroy. i'll live in the robert frost room. it is a convenient location to work. i am a professor at the scent francisco conservatory of music, and i also work -- at the san
6:52 am
francisco conservatory of music, and i work at the opera. a month-to-month lease for me is perfect because if is flexible. so morehouse is clean, friendly and inspiring for an artist -- the fillmore house's clean, friendly, and inspiring for an artist. in and around our school and work schedules, we greet each other and continue with privacy and comfort. at the end of the current academic year, in may i will departs to the desert to yosemite, and i would like to return to fill more house in the fall. thank you. >> i am chastens feinberg, a longtime resident of san

francisco -- jason feinberg, a longtime resident of san francisco. i have two statements i will be reading. "to whom it may concern, i am from israel. i am an i.t. engineer and a big machine configuration for among other platforms. in march of this year i was in san francisco for sightseeing. i was fortunate to find the fillmore house. my wife and i have fond memories of our time of the house. the level of housekeeping and upkeep is what i have come to expect at hotels. david was quick to reply and
6:54 am
was sufficient and helpful. when there were two-month leases, we chose to rent a storage space at a house, where we left our belongings while we went on vacation. i am back in the bay area, and if i am on able to attend it is because of my duty to my customers. i wish i kayhan be there. i was deeply saddened -- i wish i could be there. i was deeply saddened. this place offers an alternative to cold and impersonal hotels or binding contracts. i have met a large number of other occupants and had no problem with any of them. we have become friends and have dinner together.
6:55 am
they were gracious to offer to throw a party for our anniversary. i have never felt there was anything wrong with the house, the attendance, or the venice next -- or the management and recommend it to anyone who is considering visiting san francisco. my name is chris, and while i presently reside in germany, i have lived in fillmore house. as a young professional product manager with a job taking need between germany and san francisco, without professional responsibilities requiring me to settle down, this currently provides safety and convenience housing while in san francisco.
6:56 am
>> thank you. >> my name is william, and i am a current resident of the fillmore house. i am recent graduate from the engineering program, and i am getting going with my career. the fillmore house has provided a good starting place and more than that as i plan to stay there at least a year. it is a month-to-month lease in the contract. david has always been helpful to me. he has always been accessible. the house is very comfortable and peaceful. it is not a bunch of people causing mayhem, which i enjoy.
6:57 am
the neighborhood is peaceful and enjoyable. one other thing i would add is that coming from an environmental background, i heard the transportation sustainability stuff, and all these people if they were to live separately, they would have separate refrigerators, separate appliances, and there are several efficiencies i think the house of lords, and i enjoy that as well. good -- the house of lords, and i enjoy that as well. >> are there any additional comments? you have two minutes of rebuttal. >> i am going to split my time with the current president steve holtzman. what is notable about what was said by the project sponsor is a couple of things. firs, they claim they are not advertising by the week in a
6:58 am
more -- by the weak any more. that is not true. exhibit 6 is his own web site, and it is proof, and it says, we offer the best values in town for corporate rentals, short- term rentals, and weekly rentals and a fantastic location where san francisco thians realy live, so that is inconsistent with what the project sponsor is saying today. the project sponsor came here and said one reason he wants this is to have individual leases with the tenants. you heard all whole litany of tenants st. they have leases. it is troubling when someone is speaking out and saying things they know are not true, and even
6:59 am
their own witnesses contradict them. this is not a project sponsor that should be allowed this responsibility. >> thank you. >> could you hold the microphone down? >> i want to be brief and to the point. a concern we have had if we ãon this issue of the length of police -- of the lease. unfortunately, i can point to three instances in the last year tha when people have stayed from one week to two weeks. there was a family of three that were helping to enroll their students. >> thank you.
