i would like to clarify the comments made by the proposed applicants. we did meet with them, we were very disturbed about what w they had to say. we saw their menu. it is like a bar snacks menu and they told us they would be reducing that and i do not know what they're going to serve that is less than what i have. it would be a bag of potato chips, maybe. president mazzucco: looking at the same menus i am looking at? >> these were presented to us. they never changed -- unless they changed. president mazzucco: i want to make sure we're on the same page. >> the largest item was a hamburger. president mazzucco: there is two pages there. >> right.

they would be reducing this. this is permitted as a full- service restaurant. not a bar, and it is not a nightclub. what we are requesting, we stand united in asking that this entertainment permit be limited in time until midnight. and 10:00 p.m. on weekdays. after year, we are happy to review that. we have not seen a lot of good faith from these fellows and we would like to see it happen. very few restaurants have entertainment until 2:00 a.m. we're asking them to do this for a year. if they are great neighbors and they're not operating as a bar or nightclub, let's revisit this. that is where we stand. >> thank you.

residential or merchants in the neighborhood. he has worked every thursday through saturday which is the big noise nights and he has kept everything quiet in the neighborhood. and he knows without the support of the neighborhood you cannot run a successful business. i have no doubt he will do the same thing at tupelo. i know the other gentlemen as well. the sort of nightclub everyone fears is the last thing we want to do at that location. if there is any questions, i am glad to answer. president mazzucco: thank you. >> good evening. i am a business broker in san francisco, i still small businesses and i have been working with these gentlemen putting this together. i am familiar with joselyn and the entertainment commission and the roles and what you are looking to accomplish.

i can say from my point of view, they have been extremely responsive to any of the concerns that have been brought to them and realize that they have to be good neighbors as well as a successful business. it will be important for their concept when you are looking for entertainment, especially when you are dealing with live magicians. it does not start until 10:00 p.m. i am a musician myself. it is a very difficult field to be in. there's not a lot of money in it. in order to have a vibrant, live music scene in san francisco, there has to be time and time is between 10:00 p.m. and 1:30 a.m. that is one part of the entertainment portion of this business. i understand the concerns of the neighborhood, i understand the concerns of the police department. i think you have an extremely

>> i am a born and raised in san francisco, moved away, and came back because i love the energy that san francisco has and the nightlife and restaurants and the whole neighborhood environment. lately it has been difficult to find good establishments with music and food for adults. i know there is a lot of night clubs out there. the fact that this establishment is going to have live music and cater to an adult crowd i think is a positive thing. i know that north beach has their issues with some of the nightclubs downtown columbus and broadway. this is a different energy, a different type of venue. i look forward to it being openly. i do not want to have to leave early when i am out on a date or going out with friends or

whenever. it is nice to be able to go to restaurants and have a drink and listen to music and not be rushed out at 11:30 p.m. because they close at 12:00 a.m. i am a proponent of having an establishment that focuses for adult entertainment -- not adult entertainment. want his continued success as a kid -- a business owner and as a musician, a local musician. he is a blues musician, just so you can know that. president mazzucco: thank you. >> evening. i am an attorney here in san francisco. i also live several blocks from the buccaneer. i have known teague for roughly 10 years. i lived in the neighborhood since 2006. i have represented several bars in the richmond district. it is my experience that teague and the other staff at the buccaneer have run an incredibly complex and operations with regard to their security, safety, and it is an incredibly responsible business. i have no reason to believe

that teague and his partners would sully their reputation. i would expect this to bar to bar restaurants to [unintelligible] and i lend my support to his future endeavors. thank you. president mazzucco: thank you. >> i do not want to speak so much to the recommendation coming from our station but i did want to speak to a comment that the commissioner made that might be something you might want to think about. listening to this business plan, the one part that i am struggling with and is consistent with some of the earlier comments is why is food services ending at 9:00 p.m.? i am speaking from 13 years of

experience. the big thing right now is late night dining. i am at a loss on white business with stops serving food at 9:00 p.m. when anyone in this industry knows the city is coming alive on weekends. most people are making reservations at 7 or 8:00 p.m. that night and if you make -- what i am trying to figure out is how many seating will we have? if you are serving at 9, i do not think they can turntables over twice. people are not going to eat dinner at 4:00 p.m., it is not the way our city operates. i would encourage you to consider that in your determination. thank you. >> thank you. we will hear from the owners after public comment. i want to read into the record item nine has been agreed to by the owners.

sales shall not exceed the sales of food. they still maintain records that reflect the gross sale of food and rosales of alcoholic beverages. the record should be kept no less frequently than a monthly basis and will be made to the sfpd 8. and the entertainment commission. i think that addresses those concerns but we will hear from the honors. >> i have heart -- been hired to be the executive chef. our plan is to serve from opening until 10:00 p.m. our menu and from 10:00 p.m. to 1:00 a.m. survey lesser menu of food items that will not require as much staff to produce. the idea being in the first couple months we will watch our budget and our time. we will still have food available until 1:00 a.m. if not 1:30 a.m., it will be a limited

menu that i believe you have a copy in front of you. i would not have ever considered taking this job if it was supposed to be and nightclubs that have food. i have been a chef in the city for 10 years and doing my internship at aqua and i ran the kitchen at fillmore which is where i got into the soul food aspect and there would be no interest for me to be the side show, we have to have food so let's bring someone in. i have been looking forward to the opportunity of presenting my food to the public in a restaurant setting. we had our tables put in and we have seating for about 52 with the bar seating. to answer the question, we would be willing to turn the tables three times a night as well as doing additional food in the night with a late-night menu. i wanted to say that and i appreciate the opportunity. >> i have the menu.

what will be the late-night menu? what are you going to offer? >> chicken wings, crispy pickles come of fried tomatoes, tupelo fries, boiled peanuts and three kinds of -- a couple different types of sausage sandwiches. >> this is actually substantial food. were you considering dining only until 10:00 p.m.? >> it was a staffing issue at the beginning. >> i do not think we said we were offering dining until 10:00 p.m. >> that was my and standing. >> i was curious where you got that from. >> i got that from the conversation we were having here. >> would allow minors into the

establishment until 9:00 p.m. >> it is a recipe for disaster. you have people under the age of 21 after 9:00 p.m. or 10:00 p.m., and you're looking for trouble. we're not going to allow people over 20 -- under 21. >> may i ask, is it true this menu has already gone to the state for the licensing? is the state involved in the licensing, have they looked at it and approved it? >> he is involved with what the abc requires in terms of approvals.

i am putting him on the spot a little bit. >> to speak to your question, i'm looking at the menu. i would suggest it is likely this is the menu that was submitted to the abc. i would also speak to the fact that the abc is not going to critique a menu based on food, especially mentioning what the president mentioned, a similar version of the condition about food service is also on liquor license. again, i think having the

condition that 51% of your sales comes from food, we are experienced enough to know that the feel of our restaurant changes once food service and and it does become more of a full-time farmer and entertainment environment. and that is a risk and something we need to accept and that is the consideration point tonight. that was my point i was making. it will end -- they're not letting minors in after 9:00 p.m., and dinner seating will end at 9 or 10 or whenever. we need to come to grips with if we take what we heard today from 10:00 p.m. on, this will become, what? >> an entertainment venue or nightclub. president newlin: i am hearing something differently.

we will get clarification on that. ok. any further public comment? >> commissioners, i am not a consultant to this project, but i have gone through the neighborhood to see and mostly here where people have to say. first and foremost, there is a letter in your packet that came from the telegraph hill dwellers which also includes the north beach business association and central station. that was concerning because the north beach business association does not formally exist. it is a conversation that took place between north beach merchants which has 30 or 40 members and the north beach chamber of commerce which i sat on the board for about five years which has 120 members. subsequently when that was discovered, there was a motion

by the directors to send a letter to the telegraph hill dweller and retract the north beach business association because it does not exist. the north beach merchant association made a motion and they are generally supportive of 12:00 a.m. and there are concerns because of prior ownership. here is what i am afraid of. i asked one of the members who abstained from that blow to and said -- vote, and i said, what did you abstain? he said i am facing the same conditions that could be imposed. what i will say, city's imposing mandates on businesses which are increasing their labor costs, we have to give these businesses every opportunity to further sustain their business model. if they are out of line, this

commission has the teeth now, thanks to david tchiu, for enforcement. we have to trust our commission. 1:00 a.m. president newlin: thank you. we do not do that. you have one opportunity and that is it. the do any of the commission members have any questions for the applicants ok. i would like to say that the two main issues is the time and the idea of the venue being restaurant or not. in the permit that we're considering granting and the permanent that the abc has

strictly lays out the food and if they want to sacrifice their license with the abc or sacrifice the wrath of the entertainment commission. i can expect they will comply with that. my feeling is that with the amount of work and the investment in this type of venue with that the 1:30 a.m. our for entertainment seem reasonable to me. do any commissioners have other comments? >> i would think that maybe 12:30 p.m. during the week for entertainment, sunday through thursday. >> yeah. president newlin: does the applicant have any input? is that doable? no? i am sorry.

>> i do not mean to be out of order. if you want to ask a question, that is fine. >> i would say when i am but on week nights with all the concerns coming from the neighborhood, we have to take that into consideration. we can revisit the hours at another time if there are not violations. i think that if there are this many concerns about whether it is a restaurant or an entertainment venue, i have questions about that. i think there should the some get back to the neighbors as well. i would suggest 12:30 p.m. or 1:00 a.m. during the week and i would say 1:30 a.m. on weekends is fine. president newlin: with the amount of investment here, possibly sunday through thursday would be 1:00 a.m. and on weekends, when 30 a.m. and if there is a holiday on monday,

it is that sixth -- at sixth and mission. there is a lot of investment and new names. and a period of closure between the old operator and a new one. >> a good evening, commissioners. it has been a long evening. with the consideration of time, we will be taking over the room located on 101 sixth street. we will be changing it from its current incarnation to a cocktail lounge and arnightclub. a fairly detailed business plan has been submitted which i think details and it explains what we're planning on doing. i think there may be some questions and i would be happy to answer any questions you have. with me are my partners, christopher smith and manny alvarez, both of whom are in the entertainment industry.
