[applause] commissioner newlin: welcome. all right, we are going to continue until the end of the meeting to review and approve the minutes and continue item three, report of the executive director and call item number 4, police department comments and questions. >> richard carrea and i wanted to introduce to you inspector richard van cole who will be taking over the duties formerly handled by another officer. it's good we have dave downstairs at southern and rich is 31 years in the police department. a lot of experience in financial crimes.

and i think you will enjoy working with him and he will be available to the commission. any questions? commissioner newlin: welcome. >> and i think you will find working with nick and the rest of the staff very good experience. >> he has been here for two days and both days he was on the phone with the entertainment commission. commissioner newlin: thank you. >> another officer is here. commissioner newlin: sure. >> good evening. steve mathias from central station. going over a couple of things, new year's eve. went over pretty well. we had a few snepts, but relatively speaking, -- a few incidents but relatively speaking, it was calm. the clubs had a nice security

and safety inside the clubs and outside for the most part. we did 25 inspections at various clubs in our district. so we trite to go around to -- we tried to go around to all of them and do a meet and greet. different things that have been going on in the central district. december 18 at club recess and i'm going to read a short narrative. this is at club recess. they said they were -- she and her boyfriend were at the club and fighting was all around her and she get caught up in the crush of bodies and there was a big huge fight and in the middle of the fight, all her items from her purse were taken. on 12/24 at 12:45, lil darlings,

someone was groped and ejected. on december 24 at 473 at club recess, a party was on the bus and they were dropped off. and there were three of them and the bus driver looked over and thought what he saw was a handgun being put in one of the bags. when they got off the bus and he looked there was a loaded handgun in a shopping bag with some vodka and some chips. but they left it on the bus. the people were subsequently arrested and then a small -- a large group came out and started to go after the police. one person was arrested. i think it's really important for the commission to know, here's a person -- he did not take the gun into the club. and i really think that's based on a lot of the recommendations and requirements that this commission is requiring, doing

searches, if it's appropriate, for clubs. the only reason i can think of that the person left this gun on the party bus was because he was going to get frisked or a metal detector and that was a point that i wanted the commissioners to hear. on december 24, 12:56 a.m., club officer had a drunk patron and arrested by police. on december 24, cigar bar had a stolen purse. on december 30 at 1:50 a.m. a victim left an unknown club on grant street where he had been drinking heavily and stopped to urine ate in an alley and punched and robbed and the three suspects were arrested for the robbery as well as drug charges. on new year's day at 12:25 and 495 gary street, they were

having a large party. a female was punched in the face from behind by an unknown male suspect. on new year's day, 1:50 day, a fight on the southeast corner of broadway and columbus. this is one that we don't necessarily tie to a club, but there are a lot of things going on in the broadway corridor, it's the clubs and they are dealing with the patrons and get a whole lot of people up there, either alcohol before or find a liquor store and the clubs are one of the many issues that we have on the broadway corridor. on january 8 at 1:30 a.m. at the ambassador club, stolen purse from the club. on january 8 at 12:55 a.m. at 420 mason street, a battery case, victim was inside the club sitting with his group. a member of another group called

his friend, female friend -- i'm not go to go repeat the word, but the victim replied, what did you say and a large fight broke out where he was pushed from behind and assaulted. the suspects fled the area but the police department have some leads on the investigation. and last one here is on january 9 at 2:30 in the morning, victim was standing outside club horizon at 498 broadway and robbed of his phone at knife point. 2:30 in the morning, i would say the club definitely close ded up by that time and we aren't saying the club should have done. the last thing i wanted to mention, ms. stewart was going to give copies of some photos. one of the big ones on new year's eve that we are looking at and relatively speaking, you know, when you see the injuries

there, but it could have been avoided. i was with entertainment investigator and we were looking over and saw the huge lines at 1:45 at 443 broadway which is club recess, completely packed. barricades on the street and you have that area completely packed where nobody can go anywhere. so we were saying how poorly managed that area was as we were going to go over and address that issue, this person jumped over the bar i don't remember to get a-- barrier to get away from this huge mass of people. there were cars going back and forth. and he was so intoxicated that he fell over and struck his head against the gate and as you can see, it was pretty good injuries. a lot of times on new year's eve, we look at the mass of people that we have. we give some consideration to

the clubs as far as them dealing with these crowds. one thing they pointed out, look at club atmosphere, which is right next door to it, having the same hours, they had people, but wasn't as jammed packed situation. so i think club recess really needs to work on -- it's not just closing time, we get you out the door and see you. they have to work the front so we don't have any situations like this. any questions or comments? >> i had a question about the party bus incident. i have been looking into party buses and the problems that they are creating, how big of a problem on broadway do you think these party buses are? >> it's a little -- to answer your question, it is a problem, because, number one, on one side, you think, well, we don't want people drinking and driving, so now we have a bus

and gives them the gene light and i'm going to slam beers and all sorts of stuff on the bus and they'll get off the bus intoxicated in large amounts. a bus might be able to hold 55 people. and so to inundate a club with 55 drumping and rowdy people that want to get into your club, it is a temptation. they will see 55 people, even if they drop the cover charge to get them in, but you have to look at what they are accepting into their club. there are some clubs that absolutely do not have party buses. if they think you are from a party bus, they won't let you in because they have been burned in the past. some answer your question, it is an issue. and it's a little bit easier now from the standpoint that buses can't stop on broadway. we usually have a little bit more of a notice, a large group

coming up rather than somebody pulling in front of a club and all of a sudden they are right there. >> i have a question for staff. recess in for mediation or talking to or? >> whatever the commission's pleasure is. do you want them to have them in front of the commission, we can bring them at the next meeting to you. >> as you know, i saw an incident in front of this recess and maybe we should start with staff talking to staff and we'll bring them before the commission if you deem it necessary. >> i deem it necessary. >> ok, i'm asking you to bring recess before the commission. >> the incident that the officer described and as you stated to, i was a witness to and later on, i'll describe it more, but they

were cited on that particular incident. >> i was also a witness to an incident that never even got reported to us, which was concerning to me. and i think it's because the officers that dealt with it were not from central station but from a specialized task force. and i don't know if the commander is still here, but is there any way you can arrange for us to get -- when it involves entertainment, for us to get reports from the violence reduction task force, because we don't get anything from them and when they handle a situation, there's no -- we don't have any records or get police reports from them, because i know they are a separate unit. >> they are a separate unit but the incident reports go through the same system. inspector van cole, i'll talk with him and no reason we can't track those incidents as well as any other. it's convenient if they are made at the station and someone

leaves a copy there, but this means we have to go into the system and get them. but we can track those. >> i appreciate that. >> recess is often a complaint from the neighbors i have been dealing with as well over on broadway. commissioner newlin: any public comment on the police presentation? seeing none, we'll go through the -- almost got away. >> i'm going to be brief because you have a full line-up but i have been doing research on the party buses and i'll share information with you. it's not just broadway corridor but union square and overall, just the assessment is, it's not a positive experience. i'll bring some information in and maybe we can share a data and get our arms around this. thank you. commissioner newlin: thank you. before we go on, a little housekeeping issue. the fire marshall will allow you

to stand in the room but do it on the wall opposite the exit doors. people standing inside the room would line up on the other side of the room, we'll be in compliance. >> find a seat. commissioner newlin: ok, we are now going to go into something new and exciting for the city, the limited live performance permits. before we start calling, i know staff has worked real hard to implement this, and i think it will be a real benefit to the city and hopefully a boone to local small business, but i would caution all of those that are seeking these permits that there are some in the community that don't want to see this. so hopefully if you are granted a permit, you'll be a good neighbor and not let this affect

neighborhood association and we are very much in favor of this. we have presented over 600 signatures from customers at the cafe. in addition, we submitted 50 signatures of people who live within one block including the upstairs neighbor. the institution has helped change the neighborhood and create a place for gathering and maintain its economic vitality and we would urge approval. >> i'm the owner of the cafe and i think this will be good for the neighbors. and all i'm asking for is to have jazz for saturday and sunday so people can come in and hang out and end their week with beautiful music. commissioner newlin: any questions from the commission? seeing none, is there anybody opposed to this permit? ok.

[ commissioner newlin: it's approved. quaintane, chris, e.p.a.y center cafe, 764 harrison street, limited live performance permit. >> and again, pretty straightforward, they would like to have live performances as well. the staff recommends approval for this permit. we haven't had final word from planning, so any grant of this would be pending planning approval, but the map suggests that it would be fine.

harrison street. i had a relationship with chris and mark for the past couple of years and i think they are a couple of great guys and they are the right type of people to run this type of business below our residential community. as soon as they apply for the permit, they reached out to the community to find out what they could do to make the situation work. the question -- i have a couple of questions. the time period, is it live entertainment up until 10:00 p.m.? >> yes. >> is that set in stone for like the next year or two or -- no? >> it is set in stone. it could be up to 10:00 p.m., not after. >> ok. >> fantastic.

>> mark and chris, they have also agreed to work out like staffing issues, keeping the drinking and the smoking inside the cafe. keeping people away from the residential entrance. we tried this once before with music in the cafe and we did have a small issue with loud -- with music from loud bands going up the ventilation shaft into the residential units. i think the music that is allowed, if it's like folk music or light entertainment, then it could work. but what if it doesn't work? >> then you call and complain and they go out and do a sound test and if they're not in compliance then they get cited. if they continue, they'll be

commissioner newlin: now it's item d, mccorkle, jui, dell'uva, 565 green street, limited live performance permit. >> this is a small wine bar in north beach, serving medter ran food. that might be the other dell'uva. but either way, the staff recommends conditional approval for this permit. >> i'm juri mccorkle and owner of the dell'uva. looking to do few nights a week, jazz, blues, ambient music to give something back to the community and patrons and bring class back to north beach and just offer some pleasant options.
