i appreciate staff and mrs. joseph into their history of late tonight food and other issues. i am here because i am supportive of a my neighborhood and i am proud that they have raised their voices to save there are frustrations and issues around late night places like the jack in the box. it is also that several bars and massage parlors. i am supportive of the concerns that my residents have raised with a petition that has hundreds of signatures from around the city. i wanted to to thank his staff and managers and others for sitting down with us when we shared our concerns. many of them were similar to the residence. i am thankful they agreed to make his business safer and to address the concerns.

i should say this is about item number n. not about the other franchises. he is a small business honor that i want to make sure he is treated fairly. i'm going to be urging you to continue this item while we work with neighborhood stakeholders, merchants and others to create a much stronger safety plan for the whole area. if you continue this item that allows him and his staff to meet face-to-face with neighbors, which they need to be able to express frustration. it is not just the thanksgiving tragedy but a history. i eat late night tacos and the gesture, -- i just admitted i eat fast food. the late night coffee jesters important but if the staff heard more directly from neighbors it

would give them better ideas. i also will continue to work with the police station, especially the community liaison who has great ideas. besides the safety conditions laid out, i think it needs to go further. i urge you to consider these extra recommendations. he has agreed to increasing security. i also think that seven days a week is a great improvement and i wanted to say that friday and saturday are that he days where the incidents go way up. we also know that it is around new year's time that our police station knows it goes out. for friday and saturday, i would urge considering two security guards.

adjacent. there are to massage parlors. i am not sure what they're ours are. there is also a motel and a number of late tonight to curry and restaurants. to look at the contributing factors of other businesses. so s.f. save has agreed to do workshops with neighbors. what i like about them as they do block by block organizing so you know your neighbors name and you could watch out for them. if you see something happening, they could help with that. meeting with neighbors, and the richmond police station. i will work with captain sanford and advisory groups to think about how we can have better patrols in the area during key danger times alike when there is graduation night or the high school. that might be some danger time. super bowl sunday partying and

stuff like that. i am appreciative that vice chair joseph has agreed to work with me and to neighbors and businesses and bar owners and late-night food places to convene a summit so we can put our heads together to create a better plan. i wanted to thank the neighbors for organizing themselves for a safer neighborhood and helping me and my staff develop this plan. i urge a continuance so we can have time to hold the jack in the box accountable and develop a better plan. >> it seems that the jack in the box is responsive to any recommendations. i can understand that there may be a few that have not been incorporated. i have a feeling they will not be a problem. my concern is this neighborhood

that he mentioned "like the jack in the box." i feel like we are being drawn into everybody else when, in fact, we're trying to sober people up and be a good neighbor. we do not have any problem with complying with whatever recommendations so long as they are reasonable. i feel like we could get at least a conditional permit of some type. this is costing revenue. president newlin: i think the supervisor made it clear. he is not up holding you. he was looking at the broader base. he said there were some specific things that the police and the supervisor and a some comments,

they would like to see enhanced. we think that a two week time period to meet with the police department and facilitate some kind of community input and go over it and come back in two weeks. you made a strong presentation. a cannot project any problems based on your level of cooperation. i think two weeks would be time of spent. >> i appreciate that. i would like to say, as part of our good neighbor policy, we have brought salad and water which is outside. thank you very much. >> i just wanted to thank the entertainment commission.

approved a homeless shelter for homeless women. we support that and my company has made a donation to support that process. this is right next door to us. the issue with jack in the box goes beyond the incident on thanksgiving morning. in 2010, there were an average of almost one police car per night at the intersection of 11th. we were told that by the police staff. as recently as one week ago when the crisis was provided to the group, this is an issue of public safety. we feel there has been a lot of information and data that has been collected. just in the matter of weeks, 1500 signatures on line and

threw volunteers of residence. if you look at these signatures, they are all in the same as it coats, and the zip codes in the richmond district. this is a longstanding problem. we feel that the after our service between 2:00 a.m. and 4:00 a.m. are problematic. the restaurant has been closed since december 5 and we have a month of peace and quiet. president newlin: thank you. yes, sir. >> my name is a chalk lance -- chuck lance. i heard these people talk about the jack in the box. it is not the jack in the box i have seen. i work nights. sometimes i come to grab a

sandwich. the same one, and between midnight and 5:00 a.m. i have never once seen any problems there. if you have two guards it is going to be a crowd. it is usually just one or two people. once in a while you see somebody who has had too much to drink but there is no problem. i am over 65. never once have i had a problem there. it has always been clean. the staff is courteous. the managers are great. it is a great place. i do not know what to the deal is with the one police car and night. it is common out there. anybody drops a hat, some because the police. that is the way it is. i want to support the place. as far as i'm concerned, it is

safe. president newlin: what is your favorite meal there? [laughter] >> my name is stuart williams. i am a resident of the richmond district. as my colleague mentioned, this is more of a public safety issue. the restaurant is a magnet for a rowdy group of individuals. there has been a long, documented history of problems in the area. talking to residents, they feel the same way as our petitions show. the jack in the box does not seem to be able to control their environment, inside the restaurant or in the parking lot. they have not demonstrated they can do that.

the security is ineffective, posting signs, provided people could read them, have little impact. there is a mention that there are other establishments. president newlin: they could not read the signs? >> if the people could read a them or take the time. there are other in the area. mel's, lucky penny, 7/11, they do not have the complaints we are getting out of jack in the box. the only thing i will say in closing, it is a drain on our police department. extended hours has proven to be a drain of their resources. in the month they have been closed from 2:00, we have not

had any complaints. >> my name is tracy west. i live around the corner from jack in the box. my bedroom window is pretty much overlooks the parking lot. i would say that pretty much every weekend, if not every night, there is some type of activity, screaming, yelling, around 2:00 a.m. it wakes us up. that is half the problem. the other part is that the patrons are not at jack in the box, they are on my stoop. they are on my neighbor's the stairs. both of us have victorians that have these beautiful staircases.

every morning, i am picking up the jack in the box later. i have confidence in the marble. -- condiments in the marble. that is a problem. but then they also go around my stairs and urinate on the side of my house. it is a public nuisance. i have lived there for 16 years. has gotten worse. i raised three children in that neighborhood and i have told my kids, stay away from that area. the neighborhood has changed. president newlin: thank you for your comments. >> hello, commissioners. i am a resident on the 10th avenue and a property owner

since 1974. i am also a member of the sea pact -- cpap. i am a patron since it was doggie diner. i am a patron of jack in the box now but not at night. i will not walk my dog over there. when i interact with patrons, even when i'm with my husband, there are inappropriate comments. someone panhandles and we offer to buy them food instead of money, we are treated abusively. if my husband is out of town on business, there are fights in front of my home. the escalation of violence has culminated in incidents. i think it is a wake-up call. despite what the representative says, the newspaper has reported that he is in a, as a result of

for more than 30 years. i know that has always been a problem, and that the jack in the box. the problem is that when the bars close, and different groups who are fine on their own, may be of different ethnicities, are of finding new bars. the head two jack in the box. if you have seen that building, is tiny. you have people who have been drinking. it is a powder keg. 20 years ago people might have taken a swing at each other. now people are armed. everyone has said this is a public safety hazard. i cannot stress that enough. we had 1500 people in the neighborhood. her neighborhood is diverse. people do not speak the same language.

incident, i wonder how jack in the box can be blamed for that. i would rather blame the bar across the street. maybe they are the ones who should have the guards. thank you for your time. president newlin: yes, sir. >> i have got to sleep for the first time in the last month and 15 years. i live around the corner from the jack in the box. it is like an alarm every night. the parking lot is so small, they cannot serve all of these patrons of the park on the adjacent streets. just of the trunk chatter and occasional fights. -- the drunk chatter and occasional fights.

the severity of the incidents need to be taken into consideration. people are not blaming jack in the box, it is just the situation. it is too much for the public's safety. i think to ask one or two police guards to patrol, the police are not always available because of cutbacks and everything else going on. to ask the security guards to handle 20, 30 people coming and, it is too much. they are out in the parking lot and how is jack in the box going to control that? the cannot stop that. they can shut down for a couple of hours.

>> thank you. >> we do not do that. you have had your opportunity. commissioners, any questions or comments? >> i am -- have not been given any information that provides me with a nexus to police calls in the area two jack in the box. the only one i have seen it was when a firefighter was in the fight and he laughed and got runover at a gas station several blocks away. it does not mean it does not exist. i want to say i have not seen any police calls that have a direct nexus two jack in the box. having said that, i could speak to -- i will let my supervisor to the right of me speak to a late-night food in the city and its importance or lack thereof.

i'm curious. if jack the the box was not open and was not there, and the bourse closed, do you think people would not go on your steps? do you think they would just leave? i would like to defer to commissioner tan. commissioner tan: i am honored to be here. and to hear other voices on this issue. if i could say one thing, i appreciate the comments about what kind of late night facilities do exist in the san francisco. as a patron of many of the bars and clubs that exist in the city, 2 a.m., 1:30 a.m. is the time to get out and figure out how we will sober up. jack in the box serves at. -- a bat.
