aslam, jack in the box. extended hours permit. >> i will give a brief introduction how i got here sensed there are three -- sinse ce there are 3 jack in the boxes. all of these businesses have been in place for many years. i will let the applicant tell you when they started but we are talking decades of existing. i should say that all food or beverage service requires an extended hours permit after 2:00 a.m. and before 6:00 a.m. so even though it is not entertainment, even a pizza place needs a permit if they're

going to be open. of course a sometimes businesses do not have that permit. in this case there was a change of ownership and that is how it came to be that the permit was not applied for. we believe the new owners were acting in good faith in believing that the permit ran with the business instead of the operator because when it came to their attention that they had not renewed their extended hours permit, they immediately came into our office and paid all of the fees and begun all of the inspections associated with all of the different departments and working with the police and us and neighbors. i think everyone is familiar with the jack in the box. it is a 24 hour fast food

restaurant. they do not serve alcohol. they served dinner and they serve breakfast. it is worth noting for these applicants that a lot of the things we would have asked of them had applied, they already did before the evening came to see s including hiring security and having surveillance inside their space. the even used the services to walk through the business and provide them with any safety tips. this particular jack in the box, there are specific conditions that sfpd is proposing, including having security guards working from 10:00 p.m. until 4:00 a.m. seven days a week.

having employees pick up of many trash left by patrons around the exterior including the parking lot and sidewalks. making sure the alighting is sufficient to eliminate the outside area. making sure that the toilet facilities are available to patrons within the establishment of but making sure that the permit holders should take measures to ensure the sidewalk is not blocked or unnecessarily affected by patrons. security camera should be maintained in good working order. and abide by the posted occupancy. that is it. >> is the applicant here? >> good evening, members of the

my name is jennifer and i am a liaison to the franchise owner of the jack in the box. i have prepared a formal statement to address all the concerns that are out there. it is an unfortunate incident that occurred november 24. our thoughts are with the victim's. the incident is under investigation to rid the police report is not available to the public and any statements made to this far are speculation. jack in the box has been cooperative with the police department. they confirmed we are a good neighbor and gave us approval with recommendations. we have implemented security guards, lightning, cameras, and all other recommendations that they have stated and that the entertainment commission stated. jack in the box has been in

existence for a while. we have -- our stores open in 1988. then they transferred ownership in 2008. jack in the box has always paid the permit to a fee. somewhere there was a mistake and we were not notified until the end that it was missing. the following day we began working rtainment commission and follow their instructions. since july of this year, we have been working with safe with recommendations. they have been implemented. examples include security lighting, trimming back the trees, we have surveillance cameras, and we do have a private security guard on

patrol. since then, calls have decreased. we have also met with safe and they have no further concerns. we are working with cindy brandon to follow paved a security inspection. we will follow any further recommendations. public safety is a concern. that late night hours is not just happening to us but also the responsibility of all the bars, restaurants, gas stations in the neighborhood. all of us together should establish a plan of action to address the concerns. as you know, we do not serve alcohol and we do not have a loud music. we are a fast food restaurant. we serve the neighborhood and its restaurant with coffee, hot

meals, and a place to settle down after the bars close. we are one of the few 24 our places in the city that are open during the late night hours. we are an employer that contributes taxes to the city of san francisco and complies with [inaudible] >> good evening again. i would like to emphasize a few things in my closing remarks. the first inning, and these are individual franchisees'. these are individual businessmen. i am a businessman. i live in this city. we welcome the residents' concerns. people who live around our store. we're trying to be a good neighbor. one of the things we have implemented based on suggestions as we have improved to light in

-- tjhhe lighting, we're going o start offering a free coffee program between midnight. this is open to anybody who feels the need to have a cup of coffee to sober up. absolutely complementary. we're going to close the outside dining area because that is a place where people can congregate and problems may develop. in closing i would say that being a resident of the city, i understand the safety issues. i also understand these are respectable business owners, they contribute a lot of money to the city. we contribute to help the san francisco.

i would ask that we have a permit issued so that we may regain the operation of business between 2:00 a.m. and 6:00 a.m. president newlin: any questions? commissioner joseph: is your security guard going to be from a company? is he going to be carted and have proper training? >> that is a good question. the name of the company's california advanced patrol. i have spoken with the owner and operator. all of his security guards have the card. i failed to -- i also have comments about the the jack in the box.

i appreciate staff and mrs. joseph into their history of late tonight food and other issues. i am here because i am supportive of a my neighborhood and i am proud that they have raised their voices to save there are frustrations and issues around late night places like the jack in the box. it is also that several bars and massage parlors. i am supportive of the concerns that my residents have raised with a petition that has hundreds of signatures from around the city. i wanted to to thank his staff and managers and others for sitting down with us when we shared our concerns. many of them were similar to the residence. i am thankful they agreed to make his business safer and to

address the concerns. i should say this is about item number n. not about the other franchises. he is a small business honor that i want to make sure he is treated fairly. i'm going to be urging you to continue this item while we work with neighborhood stakeholders, merchants and others to create a much stronger safety plan for the whole area. if you continue this item that allows him and his staff to meet face-to-face with neighbors, which they need to be able to express frustration. it is not just the thanksgiving tragedy but a history. i eat late night tacos and the gesture, -- i just admitted i eat fast food. the late night coffee jesters

important but if the staff heard more directly from neighbors it would give them better ideas. i also will continue to work with the police station, especially the community liaison who has great ideas. besides the safety conditions laid out, i think it needs to go further. i urge you to consider these extra recommendations. he has agreed to increasing security. i also think that seven days a week is a great improvement and i wanted to say that friday and saturday are that he days where the incidents go way up. we also know that it is around new year's time that our police station knows it goes out. for friday and saturday, i would

urge considering two security guards. one to patrol the perimeter. that would be a suggestion. i support the suggestion that shift managers, so it is not just the security person, but the manager for patrolling the parking lot during the danger time of 10:00 p.m. to 4:00 a.m. he has also improved to improve the cyanates. -- signage. customer shipment -- should not be loitering. they have had concerns because of the noise and potential fights. better signs let people know they're not supposed to be there. i appreciate the owners not letting people eat outside. i think that has been one of the problems. the use to serve the food out of the window when not have indoor

seating. i think there is a problem when , people congregating in an outdoor area, especially for neighbors. the last point, increasing the exterior lighting and monitoring them better. i think there were some light bulbs that went out. a much better system is important. what i support, a continuous would help develop a plan and allow neighbors to meet face to face with the owner. that was one of the recommendations. and a comprehensive plan is what i see is a goal of and powering the residents, merchants and other businesses and the stakeholders. what i support is working with s.f. safe. they need to take a closer look on the inside of the facility

and acknowledge that the bar is adjacent. there are to massage parlors. i am not sure what they're ours are. there is also a motel and a number of late tonight to curry and restaurants. to look at the contributing factors of other businesses. so s.f. save has agreed to do workshops with neighbors. what i like about them as they do block by block organizing so you know your neighbors name and you could watch out for them. if you see something happening, they could help with that. meeting with neighbors, and the richmond police station. i will work with captain sanford and advisory groups to think about how we can have better patrols in the area during key danger times alike when there is graduation night or the high school. that might be some danger time.

super bowl sunday partying and stuff like that. i am appreciative that vice chair joseph has agreed to work with me and to neighbors and businesses and bar owners and late-night food places to convene a summit so we can put our heads together to create a better plan. i wanted to thank the neighbors for organizing themselves for a safer neighborhood and helping me and my staff develop this plan. i urge a continuance so we can have time to hold the jack in the box accountable and develop a better plan. >> it seems that the jack in the box is responsive to any recommendations. i can understand that there may be a few that have not been incorporated. i have a feeling they will not

be a problem. my concern is this neighborhood plan your having. the do you want them to hold off on all of this? i would like to see this come back into weeks. >> that is my understanding. my plan is within two or three months to try to convene a summit on other issues. my hope is you could move forward. if the residents and the owner are willing to not continue it, i think two weeks is a good thing. it helps to get us together and bring it back. president newlin: would you be amenable to that? >> thank you, a committee. the only comment i have, i noted

that he mentioned "like the jack in the box." i feel like we are being drawn into everybody else when, in fact, we're trying to sober people up and be a good neighbor. we do not have any problem with complying with whatever recommendations so long as they are reasonable. i feel like we could get at least a conditional permit of some type. this is costing revenue. president newlin: i think the supervisor made it clear. he is not up holding you. he was looking at the broader base. he said there were some specific

things that the police and the supervisor and a some comments, they would like to see enhanced. we think that a two week time period to meet with the police department and facilitate some kind of community input and go over it and come back in two weeks. you made a strong presentation. a cannot project any problems based on your level of cooperation. i think two weeks would be time of spent. >> i appreciate that. i would like to say, as part of our good neighbor policy, we have brought salad and water which is outside. thank you very much.

approved a homeless shelter for homeless women. we support that and my company has made a donation to support that process. this is right next door to us. the issue with jack in the box goes beyond the incident on thanksgiving morning. in 2010, there were an average of almost one police car per night at the intersection of 11th. we were told that by the police staff. as recently as one week ago when the crisis was provided to the group, this is an issue of public safety. we feel there has been a lot of information and data that has been collected. just in the matter of weeks,

1500 signatures on line and threw volunteers of residence. if you look at these signatures, they are all in the same as it coats, and the zip codes in the richmond district. this is a longstanding problem. we feel that the after our service between 2:00 a.m. and 4:00 a.m. are problematic. the restaurant has been closed since december 5 and we have a month of peace and quiet. president newlin: thank you. yes, sir. >> my name is a chalk lance -- chuck lance. i heard these people talk about the jack in the box. it is not the jack in the box i have seen.

i work nights. sometimes i come to grab a sandwich. the same one, and between midnight and 5:00 a.m. i have never once seen any problems there. if you have two guards it is going to be a crowd. it is usually just one or two people. once in a while you see somebody who has had too much to drink but there is no problem. i am over 65. never once have i had a problem there. it has always been clean. the staff is courteous. the managers are great. it is a great place. i do not know what to the deal is with the one police car and night. it is common out there. anybody drops a hat, some because the police. that is the way it is. i want to support the place.

as far as i'm concerned, it is safe. president newlin: what is your favorite meal there? [laughter] >> my name is stuart williams. i am a resident of the richmond district. as my colleague mentioned, this is more of a public safety issue. the restaurant is a magnet for a rowdy group of individuals. there has been a long, documented history of problems in the area. talking to residents, they feel the same way as our petitions show. the jack in the box does not seem to be able to control their environment, inside the restaurant or in the parking lot. they have not demonstrated they

can do that. the security is ineffective, posting signs, provided people could read them, have little impact. there is a mention that there are other establishments. president newlin: they could not read the signs? >> if the people could read a them or take the time. there are other in the area. mel's, lucky penny, 7/11, they do not have the complaints we are getting out of jack in the box. the only thing i will say in closing, it is a drain on our police department. extended hours has proven to be a drain of their resources.
