closed from 2:00, we have not had any complaints. >> my name is tracy west. i live around the corner from jack in the box. my bedroom window is pretty much overlooks the parking lot. i would say that pretty much every weekend, if not every night, there is some type of activity, screaming, yelling, around 2:00 a.m. it wakes us up. that is half the problem. the other part is that the patrons are not at jack in the box, they are on my stoop. they are on my neighbor's the stairs. both of us have victorians that
1:49 am
have these beautiful staircases. every morning, i am picking up the jack in the box later. i have confidence in the marble. -- condiments in the marble. that is a problem. but then they also go around my stairs and urinate on the side of my house. it is a public nuisance. i have lived there for 16 years. has gotten worse. i raised three children in that neighborhood and i have told my kids, stay away from that area. the neighborhood has changed. president newlin: thank you for your comments. >> hello, commissioners. i am a resident on the 10th
1:50 am
avenue and a property owner since 1974. i am also a member of the sea pact -- cpap. i am a patron since it was doggie diner. i am a patron of jack in the box now but not at night. i will not walk my dog over there. when i interact with patrons, even when i'm with my husband, there are inappropriate comments. someone panhandles and we offer to buy them food instead of money, we are treated abusively. if my husband is out of town on business, there are fights in front of my home. the escalation of violence has culminated in incidents. i think it is a wake-up call. despite what the representative says, the newspaper has reported
1:51 am
that he is in a, as a result of the incident. if he dies, it will be a homicide. i want to encourage you to decline this permit. i think it brings an element into this area that is consumed -- conducive to-things happening. appreciate your time and consideration. >> good evening, i have lived in the district since 1979. i would like to frame this problem differently. i do not disagree with any of the comments about -- he has met with the neighborhood and has cooperated in every way. i think we have a different problem which is not anything
1:52 am
under his control. i have been in the neighborhood for more than 30 years. i know that has always been a problem, and that the jack in the box. the problem is that when the bars close, and different groups who are fine on their own, may be of different ethnicities, are of finding new bars. the head two jack in the box. if you have seen that building, is tiny. you have people who have been drinking. it is a powder keg. 20 years ago people might have taken a swing at each other. now people are armed. everyone has said this is a public safety hazard. i cannot stress that enough. we had 1500 people in the neighborhood. her neighborhood is diverse.
1:53 am
people do not speak the same language. it is hard to get them together. i hope he would consider the fact that 1500 people has gotten together on this issue. president newlin: did you want to speak? >> good evening. my name is marie brooks. i did not live in the neighborhood but i feel like you are talking about a different jack in the box that i stopped in at 9:00 in the morning. i have not been there at 2:00 in the morning. but i have young people around me who said, where can you go after 2:00 to eat? i think it is important that we have this place in san francisco.
1:54 am
i think the tragedy of the incident, i wonder how jack in the box can be blamed for that. i would rather blame the bar across the street. maybe they are the ones who should have the guards. thank you for your time. president newlin: yes, sir. >> i have got to sleep for the first time in the last month and 15 years. i live around the corner from the jack in the box. it is like an alarm every night. the parking lot is so small, they cannot serve all of these patrons of the park on the adjacent streets. just of the trunk chatter and occasional fights. -- the drunk chatter and
1:55 am
occasional fights. the severity of the incidents need to be taken into consideration. people are not blaming jack in the box, it is just the situation. it is too much for the public's safety. i think to ask one or two police guards to patrol, the police are not always available because of cutbacks and everything else going on. to ask the security guards to handle 20, 30 people coming and, it is too much. they are out in the parking lot and how is jack in the box going
1:56 am
to control that? the cannot stop that. they can shut down for a couple of hours. >> thank you. >> we do not do that. you have had your opportunity. commissioners, any questions or comments? >> i am -- have not been given any information that provides me with a nexus to police calls in the area two jack in the box. the only one i have seen it was when a firefighter was in the fight and he laughed and got runover at a gas station several blocks away. it does not mean it does not exist. i want to say i have not seen any police calls that have a direct nexus two jack in the box. having said that, i could speak to -- i will let my supervisor to the right of me speak to a late-night food in the city and its importance or lack thereof.
1:57 am
i'm curious. if jack the the box was not open and was not there, and the bourse closed, do you think people would not go on your steps? do you think they would just leave? i would like to defer to commissioner tan. commissioner tan: i am honored to be here. and to hear other voices on this issue. if i could say one thing, i appreciate the comments about what kind of late night facilities do exist in the san francisco. as a patron of many of the bars and clubs that exist in the city, 2 a.m., 1:30 a.m. is the time to get out and figure out how we will sober up. jack in the box serves at.
1:58 am
-- a bat. -- that. we need to make sure there are facilities open. if people remain strong on the sidewalk, -- a drunk on the sidewalk, we need to do more investigation and research. this business owner is doing everything he can to ensure the security and safety takes place within his limits. what happens a block away or two blocks away is out of any one person's control. if anything, in my time here, i hope to ensure that we continue to have safe facilities in terms of nightclubs and bars and those that are ancillary. we need to have 24-hour facilities open. what i am saying is that there
1:59 am
is lots of concerns about the immediate issue here. someone is in a coma and could be murdered. i cannot blame anyone business but the larger concern is there needs to be facilities out there for people to sober up. i will leave it at that. >> thank you. we will revisit this in a couple of weeks. >> thanks to supervisor mar. i like to request invited to that. myself and commissioner hyde so we can apply this to other neighborhoods. i hope the applicant will agree to extending or continuing iraq applications so that you can
2:00 am
have time to talk to the neighbors and come up with a comprehensive community safety plan. >> to have a motion to continue? >> the community patrol would be a great starting point. it worked really well in the castro. i will make the motion to continue. >> second. >> thank you for coming in. feel free to come back in two weeks to re-express your feelings. we will stay with the jack in the box items. item l. 400 geary, extended hours permit. >> you are familiar with jack in
2:01 am
the box. a permit to operate between 2 and 6. president newlin: you do not have anything to add. >> there is no -- we do not serve alcohol, there is no loud music or entertainment. newtonther -- there is hamburges and curly fries. >president newlin: do you have something to say? >> entertainment commission has received a request for jack in the box to address a plumbing issue. from biscuit and blues. they are being flooded after to ram from jack in the box bathrooms. i do not know why the flooding
2:02 am
begins at 2:00 a.m. and stop sometime later. possibly someone is using your bathroom other than its intended use. i am making the request to look into that. and remedy the situation and to contact them. and hear their concerns of our your plumbing. >> this is a very recent request. just brought up, mentioned to us 48 hours ago. plumbing issues have been regardless of what kind of business our residents to have and we will address it and see what is going on. president newlin: thank you. anybody from the public wish to respond to the application of 400 geary? seeing none, do we have a motion? >> motion to approve. >> second.
2:03 am
>> commissioner press, aye. commissioner newlin, aye. president newlin: extended hours permits, no issues. >> bayview station has let us know they support this. >> you have no further issues. any questions? seeing none, anyone from the public wish to comment on the application for 366 bayshore? the issue is with the commission. do we have a motion? >> a move to approve. >> second. >> same house, same call? president newlin: ok. item h. dane, dba sloane, amendment to existing place of entertainment
2:04 am
permit. >> you have a lot of paper in front of you on this. it is only a fraction of what we have. >> they expand their footprint. you're here to consider if there is any concerns or conditions you'd like to place. one of the reasons there is so much paper is our residential units behind sloane. the applicant has been good about communicating with the people there. wthat is where we have so many letters. i will let mr. zaccaro sum up what steps he has taken. last thing is sfpd has anot asked -- has not asked you to
2:05 am
add specific conditions but this is what i would like you to consider. -- what they would like you to consider. there is a back door. i suppose that is where the trouble comes from. whether it is conversational noise or trash been emptied or whatever. that is the main concern. i do not know how the applicant plans to address that. >> good evening. i am here seeking an amendment to an existing place of entertainment. we have had issues with sound mitigation and use of our rear doors which are three in number. we have agreed with the neighborhood to use those for
2:06 am
only emergencies. we have also alarmed this exit. so they may be possible if they are used. as far as noise mitigation, i have -- we have invested over $300,000 in noise mitigation measurements. we're trying to become a successful part of our neighborhood. and so what nicklaus was speaking of is there is a communication with ourselves and our neighbors. this is a thread with myself and one neighbor. he happens to be somewhat of a liaison between myself and the lmn. president newlin: thank you. nothing? i can't believe it. >> is a new year. -- is the new year. -- it is a new year.
2:07 am
president newlin: commissioners, do you have questions? >> you have been having problems with people going out the back door and looks like a long history of problems with neighbors on the street. can i ask you how that is mitigated, what you do at night, what it is like when you close down, could you go through that with me? >> mostly it was being direct exits were being used during the day by contractors performing sound mitigation and there were employees that were using the rear exits in hopes of creating a safe escape from the nightclub to their respective vehicles. what we have done is we have disallowed the use and as i said, there is a push bar for panic hardware and that has an alarm. that thwarts any use. we have until 10:30 p.m. until
2:08 am
2:30 a.m. a posted security guard at the exits. president newlin: anybody else? members of the public? >> i did have one more question. do you accept party bosses? >> we do not. -- do except partyou accept par? >> we do not. >> i live nearby. we are not about trying to kill fund. we're not trying to make it hard on sloan partners, we want to make it right. it has been a long story. you know the background. you know where they have been and where they are now. we are real close. they have invested a lot.
2:09 am
dane said $300,000. i wish i had not had to invest. the have to invest it, that is the way it is. that is the cost of doing business there. the noise issues are a lot better. thanks to the measurements. there are some labors -- neighbors here who are still hearing stuff and they will want to chat with you. the last thing we have to work on if it -- they could have their maintenance team do a sweep around the neighborhood. pick up stuff that neighbors would have to pick up. you know what it is. also having a hose in front of their place. they do wash down. -- it down. pick it up and put it in the trash can. we love sloan. they are trying to rebuild
2:10 am
trust. we will reserve the right to come back any issues pop up. that is the way it is. thank you guys . you know what i like about you guys? everything. >> i am another neighbor. we are directly next to them and our bedroom overlooks the intersecting parking lot. we get a history -- we get noise from patrons on mission street. there is other activity in the parking lot. they have done a lot of work. it is much better. we do not think it is fixed quite yet. they are still working on that and we think that is getting better. we do -- it is a quiet family
2:11 am
residential area. we have concerns about patrons of being in that area. being on mission street, it is a quiet stretch. it is empty. they are still working on that. president newlin: thank you. >> i live nearby. to give you background. once sloan expanded, we get woken of every friday night and saturday night with the noise. to the point where the walls were vibrating. we're working with dane and the club. we want to work with them. we want to voice our concerns
2:12 am
that in a month for two months that this issue is not fixed but we can come back and try to do something about it. we do appreciate what sloan has done. i cannot sleep on friday and saturday nights due to the noise that comes directly into our apartment. thank you. >> can i have a point of clarification? is it people noise or music? >> mixed. our walls vibrate. the inspector has been over twice. we had noise consultants come over and do noise ratings at our house and think twice. >> thank you. president newlin: anybody else? seeing none the matter is with the commission. yes? >> i have a question. two questions. with regard to the place and the vibration, what have you done to mitigate it?
2:13 am
>> we have had some measurements with the inspector and also a consultant to set a decibels global maximum so we have a limiter in place. it is set at two below the level. we have spent a lot of money on mitigation processes which include no less than lifting up the building from the post to separate and place i saw later -- isolaters. also isolation clips. i do have my general contractor if you'd like more detail. >> i appreciate the fact you have isolated your building. what have you done with your speakers? where are your speakers? >> the bass speakers --
2:14 am
>> are they on the floor? >> they are in the air. >> you have set a danceable on the high end? have you set one on low-end? it matters how low it is. >> i would defer to the inspector. >> they could have any decibels at 160 or 140 that enough? >you do not know. >> i am trying to remember. >> i would like you to do something. i would like you to go back to your club and i would like you to cut out all the frequency below 160. and see on the bass level of
2:15 am
your equalizer and see if that does not cut the preparation. unless you are really out there, your customers will not really notice it. i guarantee you all that dosub- bass will be gone. >> the technique the commissioner is referring to is known as frequency clipping. salters and associates did do frequency clipping. i believe there was some frequency clipping done. that is something i can look into to check my notes to see. commisioner joseph: if that was done, can you tell me the size of your bass drivers? >> they are 15 men's. commisioner joseph: how many do
2:16 am
you have? >> four. commisioner joseph: that should work and if they are on seismic isolaters, and they still vibrate, that is on. the other thing is the cleanup on the outside. when i had my nightclub, fires and everything went ever were. there is a service you could look into. they come along and you can have them come in on sunday night, sunday morning or whenever. they pick up everything and steamed the street. it really makes good neighbors. >> we have agreed to do that. >> my wife has a restaurant in that area. a lot of times i find myself walking up that alley in the morning. i can spot a lot of the problems are not coming from the club.
2:17 am
they're coming from homeless people. i see them there in the morning. and whether -- it may be a mixture. i do not want to ruin the evaluation we got earlier. it sounds like you are prepared to respond to the problem no matter who is creating it. that is the bottom line. it is with the commission. commisioner joseph: i move to approve. >> second. commisioner joseph: is there anything specific -- i made the suggestion he looks into it. it is not a commission -- a condition of the permit in my motion. >> i would like to make a comment that i am appreciative. i hardly have sat here and seen neighbors and thegh
