if you would like to speak on public comment, you will have plenty of time. we will make sure that we wait for you. thank you very much, i appreciate it. nexts speaker. >> there are no more speaker cards. anyone else that wants to speak, please come up. >> i am a resident of western soma. i want to caution the entertainment commission for taking positions without making sure that the commissioners are well-informed about the details. without knowing what is in the plan and what problems it can address. planning is a complicatedtopic and the task force spent months and years getting to know the reasons for them. and the immovable parameters within whic changes can take place.

for example, the represented from cmac said that she did not want toee more housing that is something that we cannot avoid, so the question is where to put it and what kind of housing? if you want to get new housing of eleventh street, you have to have a new proposal for where it will go. what ever is coming up here will not get the same level of attention by the task force and in this case, it matters a great deal. some of the complaints are best -- based on misunderstandings. there are quite a number of provisions to protect entertainment. many concer and critics of the plan are addressed in the plan. measures for new residential cnstruction this was something that the representative just brought up.

there was language about this in the plan. another issue that came out last week was the residential construction near existing entertainment venues should have entry from the alley ways as opposed to the main thoroughfares to the people coming in and out of these uses what not to wander into one another unnecessarily. this is a great idea. it is already in the plan. some of the things that concern critics follow policies that apply throughout the city and are dictated by other jurisdictions and codes. one example is the sunset provision that follows applicable city codes. many other aspects are not unique to it. if there are concerns, they need to be taken up with the appropriate agencies. there are many problems facing

entertainment in the city a south of market. i don't think this discussion is addressing any of them. in the community plan is much ado for a little or no benefit, and considerable downside for everyone, including entertainmen a lot of energy is being expanded and unnecessary conflict is being generated. we ou be trying to get it adopted rather than arguing over things that are already addressed or have been discussed for the last five or six years. >> i am a business owner and a 10-year homeowner.

i agree that good planning requires just that, good planning. i do own home of a eleventh stree that is right across from the lounge. my wife and i looked in that neighborhood with the intention of finding ahome because the eighborhood appealed to us. we looked at a number of homes in units available at chose this one because of its construction. they chose double pane windows, significant insulation, and with the opening for ventilation not facing the street, it was a great home. the others were not quite so well constructed. my feeling is, i recommend the construction elements of the plan be smart construction and not be implemented.

changes to the proposal for adoption would require further environmental review. the eir has been underway for more than three years, the funding s run out and you will have to take that into account. this folder contains five reports which we call strategic analysis. the address fundamental questions that we needed to answer before we ever began to discuss policies and policy decision making. it includes housing, transportation, open space, and neighborhood economics. this also contains the first iteration of the community plan that was released in 2008.

there is another document called comments and responses document. it takes all comments and responses to the original draft for a citizens review. it provides a framework of answers and appointed a direction for the plan to adopt. this folder contains the proposal for adoption. that is the final draft of the plan. it was adopted by the task force in october of last year. the citizens planning task force has worked with hundreds of south of market neighbors including members of the entertainment community for more than six years to strike a balance between competing interests. we're the only planning process in the city to propose an actual expansion of the entertainment

opportunities. we are looking at entertainment in the context of an excuse community. it is the art of combining compatible uses him in close proximity to each other and finding other ways to accommodate the incompatible. housing and entertainment are not compatible uses. in our first year, we adopted a set of planning to the guard the work. the controversial law was land use development primarily serving the needs of existing residents and businesses. city-wide and regional needs are subordinate to the existing local needs. that is what the entertainment and zoning recommendations -- [chime] it goes on to make things better. thank you.

in 1974. i lived on the corner of eighth and howard from 1974 to 1990. right across the street from a sort of a disco and an interesting car on the corner of eighth and howard. a lot of these places are problematic today because they do leaked noise. and the sound systems are much stronger and much more powerful. specifically, the rawhide on seventh street, the former space that is just a tin shed next to what was a gas station and became a swimming pool. a lot of the venues need to be rebuilt. i would like to see the plan changed to allow a sunset on these entertainment and non- conforming uses. and also allow them to be torn

down and rebuilt. given the fact ti that they weren sheds, -- were tin sheds --given the fact that they were tin sheds, i would like to see something in the plan to allow that. once they are gone, if you don't allow this, if you look now, paradise lounge is dark, there are a lot of dark avenues south of market and we would like to see these rebuilt. >> i am a member of the taskforce.

i would like to immediately respond to -- i believe that we have put in a thing where essentially, what happened was the guy from rawhide came and said that we would like to build something new here. but we would like to put entertainment in the bottom. right now, we can't do that. once we tear it down, it goes away. i believe we put in a plan that we will allow, if they care this down and rebuilt, it can still be an entertainment use. my basic thing is that we really have talked about entertainment allot, and maybe some people have gotten a little bit frustrated because we have been doing this for six years and we talked about it, the 66 meetings and had discussions about entertainment in them.

at the same time, i think that it is important that we actually, for the people that came later, they should get their say, too. at the same time, hopefully make big changes to this, we will have to do a supplemental eir. as it is, it is an improvement. if you go south of harrison street, you can build entertainment there. we do loosen it up a bit. i think there is a the thing where if they want to tear it down and rebuild its or build something on top of it and have entertainment on the ground floor, they don't lose their entertainment permit. it is hard to keep track of this

fight hard enough for some of the biggest employer that was concerning the develoent an more stringent rules and regulations. some of it made it, some of it didn't. i would love to hear, for example, across from slim's, there is a big purple building. even if it wasn' ere, with 24 units were there that weren't built correctly, they would still have problems. there would be problems for sure, so what ever we can do and have smarter planning, smarter definitely try.hould i am sure we'll be talking about that tomorrow.

>> hello, commissioners, i represent the task force. i have had the honor of learning a tremendous amount on the background of the neighborhood and what has gone on in city planning. i believe most of us are satisfied with the plan. we're trying to have a few of the problems go ironed out. when it came to the issue of entertainment, i believe we reached an impasse where it was recommended that if there were any concerns around eleventh street, to approach them with the entertainment commission. this is the appropriate body as far as i was informed, as we had not been able to come up with a consensus about the best solutions to reach, specifically in regards to the eir. hearing that it means we can't

discuss them further would be contrary to the discussions that happened previously at the taskforce level. eleventh street is the hub of entertainment in the neighborhood and i don't believe it goes far enough to protect or acknowledge the usages that were there. the live performance permit, we have many restrictions that still remain in the plan concerning a permit that has been struck. i am hoping they will adopt the citywide implementation of the limits of live performance plan. i am looking forward to further discussions on this. i believe that we will be able to come up with the best solutions there. i would like to see the western plan continue, and i hope that the neighbors come back to the table. we will come up with the best solutions and hopefully everybody will be happy moving forward.

satisfied with outcomes and in this scenario, there are still grievances that are out there. i am looking forward to the subcommittee because i think it lets us investigate this further. i don't want to disrespect the years that have gone into this. planning is tough, you're talking about housing, entertainment, industry, transportation, and all of these competing -- competing interests. i am new to the commission, but not a planning. there are things we can agree on, wanting to sustain housing and support the growth of affordable housing. how that conflicts with entertainment i am not totally sure, i think there is a way that housing can live side by side with entertainment. i am looking forward to the subcommittee, we have maps here now that i am not sure how well equipped everyone was with the
