3:01 am
but right now we are all paid in full. >> obviously, putting band-aids on, let's go over operations. what is your capacity? >> 380. >> how many security guards? >> which day? >> in general. on average, how many guards did you have on duty? >> 50. >> you said you had four, and then you went to seven. when did you go to seven?
3:02 am
>> when troubles started to occur. >> two floors have four. i am not telling you how to do your business. we usually have three in the front, to on the inside and -- two on the inside. you should have been running seven already. a set of numbers does not mean we are only going to get the bare minimum. there is a responsibility. your responsibility as an owner and all clubs right now are doing well because they are responsible. they are reaching out to the neighbors. they are making changes.
3:03 am
it is obvious to the police are offering help, so my things is who is a booking these eminent -- who is looking these -- booking these bands? >> we have a head booker. >> is it whoever walks in the door? >> the format has been changing. we always learn from our experiences and change it. >> have you thought about changing the format to fit what the neighborhood is salmo? i am just saying, this thing has gone so bad you are on an
3:04 am
island, but they gave you plenty of opportunity. right now the item is do we trust you as a responsible owner? >> how has the format changed? >> before we would give the booking agent full responsibility. all of them together can work as a team, and i think the bears really going to help -- i think that is really going to help your gu > when it comes to researching

dembands and who they are goingo attract, it is hard for one person. they are going to do this together. >> have you read these permits? >> i have not gotten a copy. >> i do not see how we can i ask if he is going to go along with these if we have not seen them. >> we gave them not necessarily as a set of 14. there were 14 for you to consider as you see fit. they are not super complicated. goonor are they surprising end

anyway because they relate to operations on a day today faces. >> has the police department's seen this? >> yes, the captain made his presentation that they embrace all of them. >> there are many on the list that we are doing. good >> what i want to know is are you willing to conform to all 14 items on this list? >> hours of operation are from 5:00 until 1:00 a.m. i think that is kind of early. >> entertainment operation. what kind of entertainment you have iman -- do you have?
3:07 am
>> live music. gooaxe what you want it to be? >> 1:30. >> this is not let's make a deal. >> we could make it midnight. >> if you want in the slack from this commission, you are going to have to earn it. you do not ask for it from what we have heard. basically, you shut the music down at 1:00. you can still keep the bar is open, but you cannot play live music. >> if i were going to support any of these recommendations, i would ask that all of your employees to remain sober. no alcohol, and if they are sick and they have to smoke, they do not work that night. i do not think you should employ people who are drinking or doing anything else to inhibit their
3:08 am
ability to operate your venue, so i would include that, that your employees must remain sober, and it would be a condition of your permit. >> they have everything off at 1:35 recess -- 1:30 at recess. \ i do not understand why we do not add 1:30 flights on agreement to this as well. >> that is fine with me. >> i think there may be some public comments, and there is a representative from supervisor mar's office as well.
3:09 am
depending on how you want to do this, you might want to give some time to look these over as well. >> why don't you take a seat, a look these over, and consider there is also a proposal to have the lights on at 1:30. public comments, should we read all these off so everyone has an idea? >> if you want to do that, if it is relevant to the possible conditions, or if you want to hear general public testimony, i do not know how many people are here. >> let's start by asking the supervisor to come forward. welcome. >> my name is victor. i am here on behalf of the supervisors commo, and we have a
3:10 am
statement i am going to read on behalf of the supervisor. as for the public concerns, this provides an opportunity to improve the safety of our district as awful. it is my understanding the owners of the rocket room have had a pattern of allowing a legal behavior to occur on and around their businesses and have not showed an ability to learn from past mistakes. in light of ongoing concerns from the police department and neighboring businesses, i am asking you adopt a resolution set forth. it is also important to recognize these incidents do not occur in a vacuum and that we need to continue moving forward with our proposal which the richmond police station. we have been focusing on area of

jack in the box in the last few months, and our approach is to look at all of the areas that contain nightlife and investigate how they interact and how we can improve all of the areas that are problematic. i want to thank our colleagues, especially true nicolas and everyone else, for being extremely helpful in providing inside. i also want to invite the neighbors who have concerns and insights to join us. and we are going to have a town hall at the richmond public library. we will begin at 5:30, and everyone here is invited, and we want to thank everyone here.
3:12 am
>> what is the topic? >> the town hall is on public safety. we want to invite sfpd. the commissioners are invited. we are going to discuss issues that are ongoing, and we want the public to have a chance to give some feedback you're a good >> are there members of the public who would like to address this issue? thank you for coming. >> i own and dirty tricks, the neighboring business. from the police reports, there has been an escalating pattern of violence over the last two years, particularly on reggae tuesday night, but that is only the half of it. from october, 2009, gay bashing

show to the most recent headliner, filthy rich, when booking shows, the record room has ignorance for the well-being of merchants and residents alike. several police reports have been filed with regard to property damage over the last two years, including the cost of replacement of the front window when a standing ashtray was used to smash it after hours. and dirty tricks has earned a reputation as a place to unwind after a long hard shift, and crowds from the rock-and-roll make that impossible. the foundation from my business, the local regulators and -- the local irregulars, are afraid to step foot on my block. the staff at the dirty tricks
3:14 am
are also local residents. they are afraid to step outside and go home when a rocket room patrons refused to disperse. dirty tricks closes early due to police action and/or fights at least once every other week. the other businesses and open at night suffer as well. i have personally experienced hot smoke coming into the walls of my store room, watched hand- to-hand drug deals out front as well as people carrying open containers. in the past, police recommendations regarding the rocket room have been ignored. to repeat the same actions and expect a different outcome is the definition of insanity. do not let its suffer the same fate as fishermans wharf did not. please step in now and correct
3:15 am
this problem before someone is shot or killed. >> thank you for your time. is there anyone else?
3:16 am
ok, do you want to come back ok, you have a chance to look over those items. i have some more to add to this. how can you complain about forty to 50? you cannot handle it away if is. on a scale of one to 100, 100 being the worst compant, maybe e
3:17 am
ratcheted it down. they are obligated to meet in conjunction with a report back and a follow-up newsies -- to see what extent you have followed up. i also want to add #16, that your security staff have had any liquor or drugs while working, and no. 17 would be the recommendation that we have of lights on policy at 1:30, so any other commissioners have any input on that?
3:18 am
>> the item one entertainment hours are still at 1:00 or 1:30? >> it stops at 1:00, and lights go on at 1:30. >> so moved. >> second. >> call the roll. [calling votes] in addition to this, i would like to set of follow-up meeting for the commission, and i would like to refer to the police department on what they think would be a reasonable time period to have a good overview of what is going on since the enactment of these oversights and recommendations.
3:19 am
do you want to give us a time period? let me tell you, this is it. it is not like we forgot to pay the fine or we're going to pay the fine because we want the music going later. if you want to stay in operation, this is carved in granite. this is no we go vroom -- there is no wiggle room. three months? let's schedule some time back in three months. by then you will have " fully implemented and are compliant with all of these regulations. anyone else? very good. good luck. i hope you become an asset to the neighborhood. item number seven, discussion
3:20 am
and possible action to review entertainment commissions. >> sort of the same but sorts of different. this permit holder has come to the staff's attention on occasion but in this case not because of a violent incident, but more than anything on a consistent complaint from the neighbors on either side, and they have become very frustrated, and i know they have been in communication with the police department on the inglewood side, but they came to meet with staff from the entertainment commission three weeks or so ago, and we offered the opportunity to do something similar to what you have just done with their neighbor, so
3:21 am
hopefully they are here again, because the request was based on their need to be heard. i do not know if you want to elucidate the kinds of things we have seen lately, but there is not a litany of citations. i am not even sure if we have issued one, but from the neighbors, you will hear the stories for conditions. when we asked people to come to commission, we do it in writing, and we did offer an interpreter. we did not get their response in the affirmative, so i hope they are here, and i hope they are here with somebody that can understand you. are they? can you ask?
3:22 am
>> you are the man. do you have anything you want to add to this? >> i do. i met with ingleside station. on this matter you should have in your binder a recommendation from entertainment commission staff and also a recommendation i got. we were not able to combine those because we got there recommendation so late, so we do not have those? >> we have included them. this permit is as old as the hills. it is a valid permit.
3:23 am
this is a valid. >> in the days when these permits were issued. cabaret was after hours. was that in place of entertainment? do they have a place of entertainment as well hatoyama -- as well? >> it may just be age of this permit. they may issue the same permit with a different title on the top. what happened at the time, and when the decision was made of the dance hall keepers were
3:24 am
going to be placed in residence, you have two permits, and one sort of falls off, and the place of entertainment takes over. that did not happen in this case. they are acting as a place of entertainment for all intensive purposes. we will issue is to permit under the heading of playce of entertainment. it was the old definition of entertainment. it has been revised many times. >> there was a contaminant permit. >> there should have been, but this was 1988.
3:25 am
>> you have both liz. -- lists. you have a list from april 2, 2011 until january 3, 2012. you have 12 call to service. this is not a venue with a history of violence. there has not been a lot of allen's spirited -- a lot of balance. you are dealing with sound as gaping -- with sound. i can speak to instances i personally witnessed your goos.
3:26 am
the patron was left there until i instructed not security to take care of them. when security was predominantly inside and i watched patrons walk 15 or 20 feet to one of the garage doors, so giving you an idea of what we are talking about. crowd control is really an issue, so this is about quality of life. >> what has changed?
3:27 am
is it that just now othey are changing the music now? what has changed? us this has been an issue for a long term. -- this has been an issue for a long time. they were cited last year on february 7. there has been lots of notices going out. we have not gotten a lot of responses back. with lack of response, you are not sure if they did or did not. that is a valid question. this has been an issue a long time, and neighbors have reached the breaking point.
3:28 am
>> two other commissioners have questions? i was going to ask a question, but i can wait. >> i think it would pabe really valuable to listen to the neighbors discuss it etc. >> thank you. i need all the guidance i can get. have you had the occasion to take any sound test spars there. >> the sound escapes from the front to the buyer has improved -- to the back has improved. the sound going into neighbors residents on either side has not improved. i think it is important to make
3:29 am
one comment. this permit is older than the hills, so a big part of it is by bringing this permit modern and compliant, we will probably take care a lot -- of a lot of issues. there is no security plan. there has never been a sound test of the entire club. a lot of this has never happened, so it is almost like treating it like a brand new permanent and modernizing it and making it compliant, but it is very important to listen to what the neighbors have to say so you have that range of what conditions you want. >> i want to say something about the residents on the side. are they aac
