up to a responsible operator. you have to control your volume and also when the door opens, you know, you're going to have impacting the neighbors across the street, i went to your place today to take a look and you have quite a big window there and i don't know what sound curtain you're thinking about having, but obviously a fireproof one is good but i'm suggesting you do an extra one like have an extra layer there. so that it doesn't become a problem. and the location of your restaurant luckily is a lot of the hostiles in the area are all thai students. -- hostels in the area are all thai students. when we do thai events we promote, half the time they're all in those hotels there and in the academy and they all live in the area. so as far as parking goes, they don't have to drive because they don't have cars. and they can just walk there. so i don't think the situation

about the car is going to be an issue because they're within the neighborhood. my only concern is as a responsible operator and, you know, that you would do the things that the good neighborhood policy says and also whoever your security is, that they are well trained for the smoking and also the neighbors in the area, respecting, you know, don't block the sidewalks, the whole things that a night club does. with that, you know, i don't think we would have a problem because it's so small. it's so small. >> if two parties come for each table, that's only 20 people in the room. >> he's planning to get his own guard card. >> ok.

>> it makes it look like a club so much. i talked to the greater bay security. i want to have the guards to be more like, i don't want to put a line out front or anything to make it look like a club. so the guard would be there, say hi, check i.d. and stuff. >> they have to pass a sound test, right? >> yes. this is for p.o.e. so they will have to pass a sound test. >> so far as as -- so as far as the neighborhood is concerned they're tested by us and they're not allowed to complete their permit application until they show that they can contain the noise within their premises and the other question with your vast knowledge as a city nightlife, how many party buses do you think this is going to be a destination for? >> i would probably say about zero. >> that's what i thought. >> party buses in that area are going other places. ok. >> i just wanted to confirm that.

principle of blue ice interattainment l.l.c. s which is the proposed licensee and they are currently transferring a type 47 abc license from on the current location. this location is located just past cesar chavez boulevard on the right-hand side as you're going out. it has been a large entertain venue primarily focusing on latino live music and entertainment. since approximately 45 years ago that i know of. it was sort of an infamous place. cesar's latin palace. there were some problems with that. luna took it over eight years ago and actually brought in somebody that she sold it to,

hector antonio orilio -- oriliana. anyway, he is -- >> hector. >> hector, yeah. we call him toney. tony unfortunately is not here today. he's at the night club show in las vegas. duc just flew in, got off the plane at about 6:15 tonight and cut his visit out there short in order to be here tonight. this is a slightly interesting situation where tony, hector-tony, is the seller and current manager and will remain the general manager. he had a large note due on it so he came to duc and duc is purchasing the place but he's leaving it basically exactly how it was. we did meet with -- on the first of may we met with the northwest journal alliance with officer mccarthy who is the

perimeter officer out at engleside station and what i took from that meeting was, they really like this guy, tony. tony had been a very responsible owner, what was testified to at that meeting was that when he took over five years ago all the problems out there ceased and they were very happy and they were extremely happy when they found out that he was going remain as the general manager. on outreach, besides the northwest alliance, we've contacted the outer mission residence association and mission economic development association on this one. there are some police recommendations, i don't know if we want to go through those right now. some of the stuff that we did work out with the neighbors and

do we have this one, the recommendations for the p.o.e.? >> i put them up on the screen. that's what they looked like. >> i'm prepared to go through those one by one. we're ok with most of them. however somebody forgot to get the memo that the entertainment -- nighttime entertainment ecter is an extremely important -- sector is an extremely important economic driver of our set and -- city and because we put on the application that we're only going to be open from wednesday to saturday, from 5:00 p.m. until -- or 9:00 p.m. until 2:00 a.m., they put in a recommendation that our hours bely the limited to that but i think that's tying my client's hands behind his back if somebody wants to do a party on monday night or have a

corporate event. so i would request that that condition, one, be modified to open every day from 12:00 noon until 2:00 a.m.. there's no extended hours application and i believe this is a conditional use situation anyway. we are not applying for an after-hours permit. we are ok with number three which is the good neighborhood policy, number four, we're ok with. that's fairly long. on 4-f. the digital video surveillance system, we would just request, because we have such high definition monitors and cameras, that that be changed to 14-day storage because otherwise we're going to have a monster system in order to keep that many cameras going. but we fully intend to have it out on the street in both directions, have it available for police department and use it to try to make the neighborhood safer, by providing for the san francisco

police department high-lres video 24 hours a day, 100 feet down that stretch of mission strees. we're ok with number five. number six, this is going to be on the abc application about the structural changes and we would request that that not be put in. cooldown period number seven, we're ok with. monthly calendar events, yes. we'll put that out every month. no third party promoters. we would request that that be stricken and obviously we are going to abide by our abc conditions and anything in m.p.c. section 1060. so, mr. luu is here to answer any questions you might have. this is a large night club, 499 occupancy. and it's a beautiful spot. i haven't been there in 20 years but it's really nice and they did a great job on it. we would request a conditional

grant. president newlin: do we have any questions? >> how many other places of entertainment do you own? >> i have one on broadway, verizon and apartment 24. >> i just was wondering, and there are -- just because of -- there's been some issues around those, correct, recently, just a few here and there, right? so i'm just wondering why a third place would be a good idea for you to manage if you're having these issues at another place? >> i'm starting to form a group so that i can get stronger and be able to move everyone around in the city. just so that i can build my team. so that we can turn to

basically help the nightlife in san francisco. >> i have a question. it says here that in the letter of intent, you'll sometimes run until 4:00 a.m. but you're not asking for an extended hours permit? >> i guess at some point when we finally looked at it, we had -- this had been a 4:00 a.m. place and i think about five years ago they had some issues and the after hours was dropped. we were thinking about doing it again however in looking at the conditional use and the neighborhood groups and everything, we think at this point, let's, you know, get a little time under our belt and see what happens. right now it's hard to get a one-night new year's eve after hours, but that might be nice if we could get that. other than that, that's all we're contemplating at this point. >> ok. i know you said for the

conditions, that you wanted number nine to be struck for third-party promoters. obviously i understand that there's greater business can you get by third-party promoters, but why would you? >> well, personally i think that the government ought to stay out of people's business plans, frankly. and that's what they're doing. now, obviously promoters was sort of like the antichrist here about two years ago and there were certainly a bunch of bad promoters but if you look at a lot of my clients, duc for one of them is probably one of the most successful operators in town. he is also probably the most successful asian party promoter in town. gus bean in the gay community owns 550 barnville, one of the most successful gay promoters. promoters are good and promoters are bad. night club owners are good and night club owners are bad and i think to say that you can't

have promoters is crazy. and probably unconstitutional. but, you know, does duc plan on having promoters? i don't think so, to be honest with you. i think it's like we don't feel that we should be conditioned that we can't do it. >> ok. commissioner perez: you mentioned that you also owned apartment 24 and we've heard from our sound technicians just today that there are several problems with that particular place. good neighbor policy violations, sidewalk completely blocked, it's a hazard because people have to go around, because people are in front of the club. there was a drug arrest for a promoter that was from l.a. that was dealing illegal drugs at that venue. that kind sophomore a red flag, if you can't -- that kind of is a red flag. how can you assure us that that same problem is not going to

happen at this location? >> i'm not so good at speaking. >> can you speak in the microphone? >> i'm not too good at speaking in front of everyone. >> you're doing fine. >> i think apartment 24 came to me very troubled. it was a very troubled -- broadway is a very tough block. i try my best to screen out all of the different type of promoters. i don't take party buses on broadway at all. i'm a promoter myself. so, it's just one of those things that is out of our control. i try our best to make sure we run a really good operation and i guess it's one of those times i'm just getting hit left and

right from different things. i don't plan to have those promoters back ever at any of my spaces. i met with the permit officer, abc, and we talked it all out. commissioner perez: it is in your control and you are responsible for these. you can screen promoters better and you can have a stronger security plan. these are things can you do and you are responsible for doing that. so it's not like you can say it's out of my control and can't do anything about it. >> i'm work on everything to make it bet -- i'm working on everything to make it better. i let got security staff so i brought in my horizon group into apartment 24 to make sure we won't have that problem again. i just came back from vegas, i bought the i.d. scanners just because they asked for it. so i'm being proactive.

whenever there's an issue, i want to be on top of it. >> i think people are being a little unfair here. the problem i think we have with nightlife now is -- >> could you clarify who's being unfair? >> i think the charging apartment 24 with being responsible for somebody doing an independent third party criminal act, i.e., dealing drugs wherks two people, independent people, look through the videotapes and apartment 24 has one of the best surveillance systems and except for a period of about 20 seconds where somebody was watching it, there was nothing that a security person or somebody watching a video system would have seen that they were dealing drugs. now the police somehow had a tip, maybe from l.a., but everybody doesn't want so-called urban events, hip-hop events, up on broadway because there's a big problem on broadway.

this is an indonesian crowd, highly sophisticated and very, you know, very affluent. now, somebody came to the management and said, hey, we are party promoters, we're out of l.a., we do indonesian parties, you can check it's out, we checked out the website, we called some of the references and they checked out. so all of a sudden the police knew, did the police come to us and say, hey, these guys have a reputation of dealing drugs? no, they wanted to make a bust. so they come in, close the place down, run in the door, shut it down, shut it down. right? what's going on? and believe me, we have it all on video. we have like really good video. and if you would -- anybody here would like to watch it with me, i can tell you, you're going to be hard pressed to tell me who is dealing drugs and what's going on until they're arrested. so i think it's unfair. i have big night clubs myself. i own two night clubs.

let me tell you, drugs in night clubs have been something that i've known about since i've been 21 years old and that's quite a while ago. now, do we want this? no, we'll never have these people back. what do we do? we rolled some heads. what are we going to do? they didn't have a floater in there. i want a floater in there who they don't know is security who is watching for this kind of stuff, somebody's palming something off, somebody's standing around not paying attention to music, kind of looking shifty. there are signs and i think we're not making any excuses, we're really sorry this happened. but i think it's really unfair to say that somehow mr. luu is irresponsible. because -- >> he owns the club. he's responsible whether you think it's fair or not. that's the way it shakes down. you're the head guy, you're responsible. >> the buck stops here and it's strict liability and tort as they call it. >> basically the question is,

the existing roccapulco management is going to stay? >> yes. >> so they're still going to run the salsa and all the things going on over there. going back to being responsible. yeah, i mean, if there's -- if you do everything you can policywise, searching, you know, you do your due diligence and you do the best you can, you cannot get every single person, you know? i mean, i've got problems before 12 years ago, we have searching and everything. but they still manage to get it in. it was just mentioned about the small bottles of alcohol. as an owner, you know, the bottom line is, at the end of the day, you're still responsible. you're going to lose your license because your employees weren't trained properly. i think in this case, with horizon, i mean, i've known doug for a while. he's turned horizon around.

i haven't really turned any reports since i've been commissioner about how many horizon things have been on here. apartment 24 is a new thing you're trying to straighten out. i think it's ambitious to have so many places and i think what he's trying to say is he wants to have a variety of controlled venues. sometimes -- there's a good thing about having one person that kind of knows how to do it than having three different people who don't know how to do it. i get his point. but at the same time it's still a work in progress and maybe all of these things are coming up at the same time and he's still screening out his managers. again, i don't want to chastise somebody for making an attempt but at the same time he is responsible, there's no doubt about it. and what mr. rennie said is true. we really have to think about the venue right now, you know.

so, anyway. that's all i have to say about that. president newlin: anybody else? who owns the building? >> latisha luna. president newlin: ok. i for one think that we've brought up some really good points here and i think that we have every right to be concerned about where this is going. so i would recommend if the commissioners agree and want to make a motion to that extent that we grant a six-month trial and i would like to retain the recommended hours of operation from 9:00 a.m. to 2:00 a.m. wednesday through saturday and the applicant can apply for a special permit for a one-day permit of some special

has-to-have event appears and i also think that if he doesn't -- if he's a promoter himself, that he doesn't plan on using promoters for the six-month period, that we implement item number nine as well and not use third party promoters. >> i would like to amend that to pull the video for 14 days as was suggested because of the amount of video surveillance they would have. president newlin: ok. >> that was f. president newlin: ok. >> i have to say something. i have to recuse myself in this bid because doug does have shares in my club. so i don't want anything further. i made my comment of what my opinion is but as far as voting, he does have some shares in my club so i need to stand aside on this one. president newlin: thank you. all right.

so those who do not use outside security and they want to use inside security, they can also get that training and a certificate. >> is it free admission? >> no. you have to pay, you know, it's $100. it's training. it's like an education seminar. it costs $100 normally to get a guard card. if you're a member of c mac it's 85 -- it's $85. but it's basically education for the industry to get their people trained and even owners trained, too. they can get a guard card. march 24, saturday, from 10:00 a.m. until 6:00 p.m. president newlin: anybody else? commissioner hyde: i just wanted to say that i will be at -- on broadway at monroe for the voice of broadway meeting on the 21st to talk about the
