construction begins, the society and the wrecks and park department will -- the rec and park department will enter into an agreement. i will watch for that lease agreement. it will replace the existing nursery facilities that were built in the 1960's as a temporary structure and currently provides extremely substandard working conditions for the dedicated employees and volunteers who spent many hours there each week. on november 29, 2011, the planning department issued a negative declaration, finding all environmental impact associated with the project would be mitigated to less than significant measures and the final declaration. the rec and park commission recommended the board to accept the gift in place at the march 15, 2012 rec and park commission

meeting. the gift is a welcome improvement to golden gate park and will provide a learning environment for students and i urge you to support us in a stick sentence. the last item i have is an announcement. i am posting along with members of the san francisco entertainment commission, the san francisco police department, a richmond station and san francisco safety and awareness for everyone, a town hall on nightlife and public safety. we are calling this after a number of incidents have happened, after the jack in the box tragic killing on things given evening -- thanksgiving evening. and there were number of incidents of violence over the years. we are inviting them -- members of the community to voice their opinion and concerns regarding community relations, entertainment, night life, and public safety in the richmond district on wednesday, march 28

school district as general counsel, i know how difficult that job can be and i think that we are grateful for the service he provided to the city and county of san francisco. it is a tough, demanding job. i think that we can be very proud of what he has accomplished, especially in making sure that we do everything we can to close the achievement gap. on behalf of my constituents in district 9, i want to thank superintendent garcia for his tenure. i wish he and his -- him and his family the best of luck and i hope he gets to enjoy his retirement. a wanted to take this opportunity to acknowledge his service. supervisor kim: thank you for recognizing superintendent carlos garcia. i know supervisor mar and i were involved in the hiring process

in 2007 when we took on superintendent carlos garcia and i want to commend him for his years of service to this -- the district and education. he was a principal at horace mann middle school. under his leadership, for the first time, for three years in a row, we were able to narrow the achievement gap rather than widen the gap as had been what the data had been showing previously. i think a lot of that was due to his leadership but also due to a strong team of educators that he has been able to strengthen and bolster their work and i do appreciate his service. i am sad to see carlos leave but i am confident that our deputy superintendent will be able to continue that work and that decision and hopefully, we can continue to narrow the gap.

next speaker. >> stop the public rape of the public finance -- public library. as i said last week, the careers of politicians based on vanity and abuse of power disappear as fast as they arise. where is the progress of democracy comes from the sacrifice of many nameless individuals, it is built up slowly over decades. national sunshine week was last week, but it needs to be emphasized because it is no secret that open government is under attack in san francisco. you give someone a title and already he thinks he is an aristocrat who should be able to make his self-serving deals at the expense of the public without interference or annoyance from democracy. you will notice that in san francisco, no one recognized note -- national sunshine week. there was a time when open government and open records laws and the public library were involved in serving the right to know and empowering the people. that was before the library and

government decided that serving the interests of the so-called aristocrats could be turned into a private income stream. you have become so enslaved to private money you have decided to -- that the right to know and the power of democracy is a place where you should save money. if we want a democracy, we need open institutions of knowledge that allow access to the trees. saving money on those institutions of knowledge is like selling our children. it is no accident the san francisco public library is the most egregious sunshine violation -- violator in the city. once it is a private income stream, the philanthropists want power and exclusivity. the destruction of democracy is what they expect for their money. and corporate influence can destroy the public library, it will destroy what you care about next. the destruction of -- destruction of the truth is the destruction of democracy itself and that is why the lies cost

more than the money. thank you. president chiu: thank you. next speaker. >> members of the board of supervisors, i would like the displayed to remain on the overhead items because i have a number two projects during my presentation. right now i am going to talk about the friends of the san francisco public library presentation to the library commission they did on march 1 and the source for the document i will show you now is this document which was the document the friends itself presented to the public and to the board of the library commission. here are the accounting figures. they said they raised 3.7 $5 million. they gave some -- $750,000 to support programs which leaves $3

million unaccounted for. what they did not include in this was the additional figure there of $2.20 million which i got from this, the friends and foundation of the san francisco public library. that is an audited statement they are required to submit to the city librarian but which the library commission takes no interest. in addition to spending $3 million, they spent $2.2 million more out of their reserves. in fact, over the last five years, they have spent over 32 -- the have raised over $32 million and each year they come before the library commission and say look, we did programs for $750,000. are we not wonderful? liebreich commission goes, oh yes, your wonderful. -- you are wonderful.

-- the library commission goes, your wonderful. just fo-- you are wonderful. they raised meoney and they do not seem to care. the city librarian is in violation of the city or grants of withholding public records. i have made numerous requests to see what money they got, what the library actually received. the secretary has withheld every single document. he has not provided one audited document, not one report to the board of supervisors, not one report to the mayor's office, nothing to show the friends of

the san francisco public library had anybody overseeing them. i have been going for two years and the previous speaker has been going for 15 or 20 and it has been the same thing. they raised millions of dollars every year and in the last five years they spent down money they previously raised by another $10 million and yet, they go before the library commission and basically say, we did these feel little programs at the library commission says, that is wonderful. president chiu: thank you. next speaker, please. >> hello, good afternoon. ♪ i dug this bottle up, it is a 1915 coke bottle. the reason -- ♪ it is the real thing the city wants today ♪ ♪ after all these years, it is

a homeless person. -- sooner or later, we will become a homeless person. that is why it is shifting responsibility to the homeowner. but if our homeowner have financial burden, who will be shifted to? our higher property tax is already covered like this. i hope my voice can be passed to the mayor. i guess that is a response to a letter written to "the examiners," a letter -- whatever it was. i am glad everyone is paying attention instead of talking. i think the writer was very accurate. secondly, i thought the lady this afternoon during the noon hour spoke very briefly. it is a great spectacle seeing everybody gang up on a certain couple. we will make the odds a little more fair right now. where is the fairness? who do you really trust? we have the mayor that sacrificed his personal word of honor for political expediency. secondly, i would like to know what ever happened to their written -- the written

allegations against a certain supervisor sitting right here. why is there a dead gay man -- which city -- the city ignore since his mysterious death in 1999. in san francisco, is ok to sacrifice one dead game man. i am predicting his case will become another stonewall, especially if certain leaders on the east coast will have a say as to why the leaders in san francisco turned their back on a dead gay man. thank you. president chiu: thank you. next speaker. >> good afternoon. i am a member of americans for safe access, the nation's largest nonprofit advocacy

organization on medical cannabis. i represent patients, dispensary owners, other advocates and we're here to ask you to protect and defend safe access. while we appreciate the resolution, we would like to see something concrete and one of the strongest actions we think you could take is to re- permitting the dispenser is that have already been closed. this sends a message to the government that their tactics are a waste of our resources and hopefully, they will stop these tactics. we have others as well -- i hope you guys will all join us in this. i know you support medical cannabis here in san francisco. thank you for your time. >> i am also a medical cannabis patient. i wanted to ask you guys to help

continue to be a model for safe access on the national and statewide level. there is several things that you guys can do to help us achieve that. you can introduce and pass an ordinance to file an amicus brief in support. introduce and pass an ordinance directing the city attorney's office to join the petition to reschedule marijuana and this one is important because you could be that first city or county to sign on with that. i want to thank you guys for time and hope that you take some action. thank you. president chiu: next speaker. >> hello, i am a delegate to the san francisco labor council. i would like to speak in favor of -- i was looking, it may not be on the agenda today of the new ordinance, proposed

ordinance of foreclosures, calling for more -- a moratorium on foreclosures introduced by supervisor. the san francisco labor council is long in favor of a moratorium on foreclosures. in the 1930's, there was a moratorium on foreclosures enacted in the state of michigan and then several other states adopted it. i think this is a very important thing that we need to do today, and i think actually, there is the governor, the president of the united states, and possibly the mayor could declare a state of emergency because in many neighborhoods, it is truly a state of emergency affecting our cities. and rural areas. right now, 75% of mortgages are guaranteed by either fannie mae, freddie mac, or the federal

housing authority. president obama could declare a moratorium on foreclosures based on the emergency provisions that he is empowered to enact. i believe the state governor should do the same and the city of san francisco should do the same. i was out -- at a demonstration at the bayview on friday. it was very impressive. 100 people came out in the rain. a longshoreman, his home was being fraudulently taken from him. i believe i have seen the study in which 90% of the foreclosures being done in the u.s., there is one irregularity or fraudulent part of it. thank you. president chiu: thank you. next speaker. >> hi, i am morning star, a resident and voter.

i have lived in my apartment since 1985 during the aids epidemic. i lost all my neighbors through aids and i am the only one alive who is still there. a year ago i came to you because i needed help. i have not been slipping for a long time -- sleeping for a long time because it is too noisy. there are 22 restaurants, that is too many. there because of public health because -- they're not willing to give us information about what is going on. when we went -- there is 365 calls within one year, when paul -- one call per day. we had called the police department because of the noise. they put a [unintelligible] on my roof and i had to hear the
