1:00 am
the building, the fact that would-be fine. what i would love to do is trade you that. sloping in front of the building to 8 feet. i would love to say -- take this down and add on this part or nobody sees it. >> that is the straight side? there's no dispute about that, i do not think. that would probably work for me. >> it squeezes out of there. >> it will look the same as from the front. >> i can take it. here is the street view. it is hard to find that addition in this review. commissioner antonini: thank you.
1:01 am
we will see what the other commissioners have to say but i am inclined to go in that direction. >> great. thank you. commissioner borden: i am fine with the direction. i do not think it is my place to redesigned interiors of people's homes. i do not care what your ceiling heights are. i care about the box. that is my purview. i get uncomfortable when we say we could shave off a torula there. i do not think that is our role. that is just me. commissioner miguel: i was going to ask that -- any comment about moving the top box 1 foot? >> increasing the height at the front? that is one solution. it is nice they're offering
1:02 am
solution. that would mitigate the impact we're concerned about. commissioner antonini: if there is no other comments i could take a motion to take d.r. and we would propose to change the third floor -- second floor remains the same in the rear. third four moves two -- floor moves two feet away from the d.r. requestor's home to the setback. and then we are following an additional foot on the front. architect will have to spell that out with more detail. it is the ceiling height toward the front.
1:03 am
we're taking diminishing the one floor in the back over the bathroom, we had decided it would be six in ches in height. it was a foot there, too. a foot off the bank. that is complicated but we can repeat that again. >> my understanding is that the 3 foot setback that staff is requesting at the second and third levels becomes a 5 foot setback on the third level. the roof, ceiling height at the back of the third level is being dropped 1 foot but you are gaining that in the front of the third level. you are getting that foot back. is that it?
1:04 am
>> that is the motion. president fong: on the second floor, set back 3 feet from ms. beale's property. the third floor would be set back 5 feet. the height of the bathroom area would be reduced by 1 foot. that height could be added to the front of the building. >> i do not think there is a problem with the height. i am concerned about neighborhood notification. if the commission located -- ok'd it. >> we could assume that would go in that direction. >> an increase in that building and blow triggers 311.
1:05 am
we're shifting one spot to another. i think we can agree that no new notice would be required for the minimum shift. if the commission is agreeable with that. commissioner antonini: can i clarify the death -- when we are reducing the back by 1 foot over the bathroom, is it that we're believe we are going any further. we're allowing them to go up another foot on the rest of the upper floor? if you could clarify. >> if you could bring -- i can't. >> here is a side view of the
1:06 am
building. this is the east side. let's look at the west side. this back area will lower by one foot where the lines are and where this slope will be flat. it will not grow where it is high. it will grow as it is sloped down low. >> it does nothing for me. one foot in the back is not going to affect that much of the sunlight. if it came all the way up to the clause that where her -- it might do something.
1:07 am
it is ok. never mind. >> are we clear on the motion? >> we are clear. >> who seconded? >> on the motion to take discretionary review and approve project, per staff recommendation with some slight modification. the 3 foot setback becomes a 5 foot setback as it faces the property. and the rare third floor ceiling height is -- for the bathroom area is reduced by 1 foot. to pick that up in the of -- front. the sloping part, the third floor area that slopes inmotion?
1:08 am
[calling votes] thank you, commissioners. that motion have unanimously. commissioners, and you are now at general public comment. but is there any general public comment? seeing none, the meeting is adjourned today.

1:11 am
>> there is some -- a memo for another donation for our mounted police unit. are there any suggestions or questions regarding that? hearing no public comment, do right here a motion? >> second. >> line item #2, the general public comment. >> the public is welcome to address issues but are not in the agenda that aren't within the jurisdiction of the commission. speakers should address the commission at all whole and not independent commissioners. neither police or commissioners are required to respond but they
1:12 am
provide a brief response. please limit your comments to 3 minutes. >> good evening, mr. hart. goo>> good evening, sir. several years ago when i first came here, i made it clear that my primary purpose is to make it clear that any item that is not on the agenda, also that any documents but did not have a specific exemption for non- disclosure were given to people.
1:13 am
i appeared at library commission. she made direct threats but she knew 12 people who would very mean, that she grew up in the get-go region that would --12 people but would bury me. two days later she filed a complaint against me for making threats based on legitimate public comments. the inspector miranda visited me with another officer without prior announcement. they got into my building, not on my door, and i unexpectedly had to deal with this issue, and i thought that was
1:14 am
inappropriate. i asked the inspector what was going to happen, and he said we will complete the investigation, and you can get the information. i waited six weeks. the inspector refused to give me the e-mail address for the legal division. i then got a hold of someone who gave me the e-mail address. i sent it. i did not get a response, not even asking for an extension of time. finally, after waiting weeks, i've put in request with the department of records asking them to look into this.
1:15 am
they said there were no documents. good earlier this week i got an e-mail from the legal division saying there are additional documents, but they are part of an ongoing investigation. we have not decided whether we are going to prosecute. now they told me there were no documents. they should have told me they were withholding with reason. i guess we will sort it out in june. good >> i can relate to what you were saying. this is the end result. that is what handcuffs do when they are put on a really hard.
1:16 am
it was totally uncalled for. i believe in openness, that everyone gets along. but was totally wrong. that has been dealt west in another agreement. i read the report, over 200 pages. some of it was hilarious. gooi would like to commend you. the other night skthat madman -- you were there. he said being a leader is not always being there but knowing
1:17 am
when to be there, and i saw your at the press conference thank god for the press. the "l.a. times" is going to the supreme court. they want names of officers involved in shooting. it took the new york times to demand data. it was appalling. 73% of stop and frisk are minorities. when he invented that policy, he said if this is abused it will
1:18 am
lose the faith and trust of the community. this commission is doing that. >> please call line item #3. we're going to have a special presentation. >> line item 3, a certificate of appreciation. >> thank you, sir. >> good evening, commission, chief. tonight want to present the extraordinary efforts of an individual. would you come ofup? [applause] on the evening of march 9 a little after 8:00 p.m., she is

1:20 am
chase. he returned, not realizing he had been stabbed. he realized he had been stabbed by a desperately violent criminal. the suspect sprain the same caustic mixture at the two teenagers. as a result of the efforts that night we were able to capture a vicious and a separate criminal but is still in custody awaiting nine felony charges. had he not been captured, there is no doubt the suspect would have victimized others. i recommend it be presented with

a civilian commendation award. thank you. [applause] >> it is a great honor to have is given to me. the police department and many people do these things that you do not hear about every often. i am very grateful.

it was awarded the best police station. the most colorful posting, these officers work on some of the greediest streets -- grittiest streets. dealing with crime means picking and choosing and keeping civilians save. the tenderloin is a place for families and children as well as people struggling with poverty and homelessness. congratulations to capt. guaranteearrity and the tenderln

station. gappreciation for the recommendation. don'we have had a busy time sine the last meeting. did we did have two officer involved shootings. one was last wednesday night, a suspect being wanted for questioning regarding the bludgeoning death of his mother. it was in an apartment on post street. when officers went to engage the suspect he never came into a place where he was visible. youhe fired at the officers thrh the wall. this conjured up memories when the police officers were killed.
1:26 am
cat was called to try to establish communication and continued to fire through floors, ceilings, and walls, but the situation became a media -- immediate when the suspect with a fire. -- lit a fire. we did not know how many people have been secured in place. 180 people had been evacuated. goothe decision was made that if the opportunity would present itself are snipers should reduce the threat he radioed region --
1:27 am
snipers should reduce the threat. your they exercise research and found a makeshift bomb but the suspect made further mention of his intentions, so this is a person pushing the envelope until the officers knew what they were going to do. i think lives were saved. i just think they did a great job. king soleil no one was injured, and sunday night, officers were in control, and they came across a robbery in progress. the suspects were on top of a woman. she was screaming for help.
1:28 am
he immediately got off a woman. one officer fired one shot. he was booked on robbery charges, so that was a happy ending. we did suffer three homicides, and two last weekend and one last night. we are working on all three. this brings are incidents of homicides to one more than last year. although i think it is good we are not having a dramatic increase in incidents of homicide, it is disconcerting to have more than one homicides for me. we are working on that. we made the second arrest in the
1:29 am
golden gate park, where the victim was hit by a skateboard, and homicide officers made another arrested in march of this year. when i say we are following up on these leads, we are. may is a police officer memorial week. we never have any of our officers of their again, but i think it is a good chance to show how important they are. may 15 is texting and driving awareness, so be aware if you do it. it is a major
