appeal second-hand dealer and permit requirements. we are repealing 852, 1276, 1279, 1288, 1281, and 1282 and amending section 26 and 2.67 to eliminate requirements and other regulations. in your binder is the word silenfile. >> good evening, supervisors. goothank you for having me. is there any chance we could call both items, given they are related? >> item #4, discussion of

recommendation allowing dogs to be fastened to lampposts, hybrids, or trees region -- lampposts, hydrants or trees, 1279.1, 1279.2, 1281, 1282, and a monday other sections -- and amending other sections. there is a file along with the guy just. region -- along with the digest. >> supervisors were unable to attend, but we want to thank you for the opportunity and look forward to your feedback.

the first piece of legislation focuses on the sea and licensing requirements for secondhand dealers and used bookstores. this is something many of our business constituents have been asking for. some businesses have been threatened recently with sales arm -- with jail time, so this removes the second hand provisions from the police code, allowing used furniture dealers and used bookstore owners to be considered the same under the laws businesses selling new products. it removes acquirement that they pay more than $1,200 for a particular licence but have little proven benefit.

it removes the requirement that new business owners go to haul of justice and get fingerprinted, waiting in line with those charged with crimes. the legislation does not change in the state requirement particular to any types of secondhand dealers, jewelry, coins, a precious-metals, things that are likely to be stolen and resold. there are state requirements, and this does not change any of that. this legislation will further support our business community, and we look forward to your support. we issued a section that repeal various aspects of the police code, which pretty much everyone

considers antiquated and obsolete. this includes things like regulations defining how much someone can charge to pick up a piece of luggage from one part of town to another, and it gets three descriptive about different zones. the legislation repeals the requirement for someone carrying an airplane ticket to buy and carry on with the city. it repeals the requirement that makes it a misdemeanor for a moving company to move items from one addressed to another. it makes it a misdemeanor is the moving company does not notify the property owner in writing prior to the move, and it is the most modern agreement that the burden is placed on the tenant and not on the moving company. it repeals a section of the code

that makes it a misdemeanor for a business to serve food to allow someone else to come on to their promises to sell food. this has been talked about before, but the tamale lady, prior to whether or not she had the proper permits, the current code is written such of the owner of the establishment is the zeitgeist. the zeitgeist is committing a misdemeanor by allowing her to sell food on the premises, so this repeals that code section 0 goo. it also repeals a section that makes it a misdemeanor for someone walking a dog to try that dog to a tree or a call if they want to go in side of the business to make a purchase. we see this as common

legislation that modernizes the way the code is written to reflect how we live our lives. i am happy to answer any questions you may have. >> first, i want to thank you for this great legislation, obviously much needed, and i have a question about an antique dealers. i see the sea is scratched out. -- the fee is scratched out. >> by removing the code, it also removes the fee. they have not been considered any different from someone who wants to open a new furniture store, so there would be no second hand permit fees. >> i know the dealers slipped out when they suddenly got these threatening letters. they have been in business for

20 years, so i am happy to see this taken care of. thank you triggered strikes -- thank you. >> i sent an e-mail earlier today and wondered if the supervisor had a chance to think about it, and that narrow window of secondhand dealers is something we can have a further discussion on before doing anything final which the legislation? >> i am not sure if they have sent a letter, but basically the request was to consider secondhand dealers but cash out, so someone who comes with a bag of used clothes and wants to make a little money on that, the

request was to consider disaggregating that group of business from the larger pool of secondhand dealers, and the reason from the consideration is to insure we are not creating a vehicle, we are not making it easier to sell stolen merchandise, so i think the intent is not to do about, -- is not to do that. we are more than happy to take a look of fat and see if there is a way we can see that. in speaking with different constituencies and the police department, we are actually meeting with the police department again at the end of the week. in our opinion at this point, it seems we are selling for something that is not necessarily a problem

currently, but if we confine their is a concern, we are more than happy to entertain that. >> i think this is for businesses, clothing, music, books, things of that sort, so the requirement is that you need to do, based upon the state regulations in terms of the criteria of being applied at the local level, you need to ask for a valid id. business is required to offer the individual to be able to engage in the visitors', being able to look at their goods -- to engage in businesses, of being able to adapt their goods. this has been a good tool for them.

while there is not often a means for purchasing stolen grosoods,d a police report is filed and that individual being able to connect the dots, that does not happen often, but it would communicate with me this is a deterrent for those keeping those kinds of people to sell goods, so if the permit goes away, the requirement for the business to ask for that goes away, so i think there is more in terms of what that may mean in terms of senegal and they like it, but they will have a harder time if they retain about a business operation on their own, they will have a harder time defending it, but that is a

small group. it is not a majority of the businesses the purge inventory -- the purchase inventory somewhere else and bring it into cell, -- it in to sell, which is why we see the need to repeal the permits. if that makes any sense. commissioner riley: you mentioned there was a state requirement for second hand dealers on jewelry, coins, and gold and silver. what are they? a black eye and not 100% versed in state regulations, but it is a reporting requirement, and there is a fee.
