[unintelligible] supervisor farrell: this is an item we continued a couple weeks ago while budget negotiations were going on in committee. we will do the thanks later, and we will be hearing it in a little bit. as part of the contemplated a budget, it is an extension for small businesses that applies citywide. the goal here is for hundreds of jobs a year, to really send a signal as we continue to debate the gross receipts transition that we support our small business community. i want to thank my co-sponsors

who worked very closely with me on that. we hope to have your support to their again. >> colleagues, i want to thank you for your consideration of this ordinance over the past few weeks. i want to thank you for your patience. while we have this discussion, i thought was important that we consider the tax break in relation to our decisions on the budget, that is exactly what we did. i am probably one of 10 to vote against this. i think the best thing we can do is support small businesses, looking at fees and how they rise every year. our exercise on small businesses. i will be voting no, but thank you for your consideration the past three weeks.

supervisor campos: i want to thank supervisor farrell for his work and i thought it was appropriate for us to consider this once we had taken preliminary action on the budget. i will be supporting this. i don't believe that what we do it exists in a vacuum. at some point, this board decided to provide a payroll tax exemption on stock options for millionaires who, because of that, were able to save millions of dollars that would otherwise go to the city. if we had not done that, i would

not be supporting this. but i think it makes sense to make sure that we send a clear message that we value our small businesses. there are a minority on to businesses that would like to expand and this provides an opportunity to do that. i think that we have an obligation to do the same for small businesses, keeping the local economy going. i will be supporting this. supervisor olague: to be brief, i will be supporting it, this tax exclusion. what i hear from members of the

public and small-business owners is that they go through a lot during the permit process, so there is a lot of process they have to go through, it is a very convoluted process could get started in business here in the city. in addition to fees, i hope we can look the other things to expedite the process so they can move forward with their attempts to establish things here in the city. supervisor kim: i also wanted to appreciate the additional time that we took to evaluate this budget process. since this appropriation came after the mayor's budget had been introduced, i thought it was a good discussion. it forced a larger question of how we reform how we tax businesses, and i wanted to take a moment to appreciate something

that was included that have not been in other tax exclusions. for violating some of the labor standards and labor laws in san francisco, would not be eligible for a tax exclusion. i wanted to appreciate that this was part of the discourse. supervisor campos: i forgot to note that on that point, i wanted to think the progressive workers alliance for working with us on that, because it was important that we be consistent. if we are going to provide a tax benefit, we need to make sure there is willful compliance with all the laws that govern. president chiu: with that, roll call vote. >> there are 10 aye's, one no. item three is an ordinance amending the building code to record -- reduce the square footage requirement for dwelling units. supervisor wiener: colleagues, you recall that this item was continued from several weeks ago to provide some more time for collaboration and dialogue that would reduce the minimum living area square footage for

efficiencies from 220 square feet to 150 square feet exclusive of kitchen, bathroom, and closet. it would conform with the statement from other cities -- a couple things have happened. they were extremely positive. as i indicated at the last meeting, i am offering an amendment that would limit this building code amendment to new construction only. there was a concern that was re

is that some landlords might be tempted to chop up apartments to create smaller units, having rent control implications that was never the intent of this legislation. the amendment i am offering today to limit this to new construction only to help that concern. there is another amendment that reinstates a sentence that had been stricken previously clarify that the two occupant limit of the smaller efficiency and it only applies to the smaller efficiency unit in does not apply to a larger efficiency and it. we don't want to reduce the number of people that can live in already illegal efficiency and it. i am offering an amendment today that i have and distributed to you. the planning department has had to make a technical adjustment

to clearance for the legislation that was done last week and requires 20-day noticing. i am asking the board to continue this item for two weeks. my motion is to adopt the amendment and continue the item for july 24. president chiu: supervisor wiener has made a motion, is there a second? colleagues, and the objection? why don't we have a discussion on that. supervisor campos: i welcome the amendment and i look forward to learning about how the amendment addresses some of the concerns that have been raised. i am not sure this is enough for me to support this legislation, but i appreciate having the time between now and when it comes back to the board to look into it further. president chiu: can we take the

motion to amend and to continue this whole two weeks from today, the twenty fourth? without objection, that will be the case. can you please call an item for? >> amending the a ministry of code to establish an urban and agricultural program to oversee all of the urban and agricultural activities and adopt goals related to urban agriculture. president chiu: a few weeks ago, we have a little bit of discussion on this legislation. i want to thank the supervisor for her amendments to this legislation. let me briefly describe what those amendments are. they are to the goals established in the legislation, the first listed in subsection 5, to change the date at which he 10 locations for urban agriculture.

in neighborhoods across the city, garden resource locations. in subsection 7 of that goal, it would read that the city would adopt a goal of analyzing and developing by january of 2013 to reduce the weightless for san francisco residents seeking access to a community garden plot. the first of these amendments are to make sure that they are eminently achievable. i support them and ask for your support for the amendments as well. supervisor chu: i will second of

the modification between the city at the children's council of san francisco. item 21, retroactively approving the contract between the city and the house. an episcopal community services. item 24, a resolution authorizing the acceptance and expenditure of state grant funds by the department of public health. resolution approving expenditures from the budget savings fund for one-time purchases. approving the unified school district expenditure plan for the enrichment fund and a

resolution approving the children and families expenditure plan for the public education enrichment fund. >> i also want to thank the moment -- to take a moment for thinking the chairwoman. supervisor chu: i wanted to know items 6-27 represented the annual appropriation ordinance and the annual salary ordinance of the city's budget for fiscal year 13 and 14 as well as treasure island. i ask that we have the budget set with all drilling legislation, i make a motion to continue the item 6-27 for one week. i will share my opening comments at that point in time. items 20-23 our legislative items that follow the budget. we will be entertaining some

language to be amended next week that we don't think is substantive in nature. president chiu: supervisor chu has made a motion to extend for one week as we historic plea do. the budget items will be continued to july 17. what don't we go to item 28. >> the city operations and neighborhood services committee without recommendation determining the transfer of an existing off sell beer and wine license. it will serve the public convenience. >> i would like to offer a very technical amendment, page two, line 10, condition member for for the sale of beer and malt beverages, it should say the sale of single beer or malt

beverages. if i can make a motion to amend by including the words in goal. -- single. president chiu: any discussion on this motion? supervisor olague: [inaudible] i'm concerned i don't have enough information yet to give me some insight to the impact big box retailers have to take on the lion's share of products. they are moving into areas where they are selling grocery items or flicker like they do in some instances now, i believe it has

come up with a planning commission. alcohol isn't allowed in the park. supervisor kim: supervisor olague brought up some of the concerns i have around this liquor license.

i appreciate some of the organizing efforts that have been a, particularly the alliance for a better district 6 to reduce the amount of region while i have less concerns with this approval of the liquor license transfer, we have a major one coming up at walgreen's. i did have some questions about why the hours were extended from 10:00 p.m. to 11:00 p.m. given that the store will be located, including visiting the site to ensure that alcohol is not taken in by miners. and the potential public safety issue that can arise with the proximity.

the grocery store similar, i think the location does raise what needs to be addressed. i would like to request the continuance of this item to be able to know what the appropriate hours might be. had to get a clear sense of the precautions. i think i can propose july 31 as a reasonable amount of time. the target did reach out to us. i wasn't able to take that time to get those. president chiu: a motion to

it has come back from the planning commission and there has been a thorough and thoughtful public discourse about the legislation. the substantive legislation reflects a lot of that dialogue. i am also submitting an in memoriam for scott cho that memoriam for scott cho that passed away on may 3.
