romney down to the ground and cut and styled his hair. [laughter] [applause] >> that remarks should go viral. [laughter] patrick was kline -- kind enough to identify members of the board of supervisors and the other electorate of san francisco. i do not think you have got a chance to see them. to see them together for a much greater picture. i am not going ask anyone of them -- everyone of them to say anything. [laughter]
5:01 pm
i am going ask if they would. obviously, the president of the board of supervisors, david chiu. get a good photo. supervisor campos, supervisor cohen, supervisor wiener, where are you? the man who collects surtaxes. where is phil? this is part of the official family of the city and county of san francisco. all of them would like to speak, but i have the mic. what you are going to your next is the band and then the

public comment will be taken on each item. speaker cards are available. we would like to thank for continued support of our meetings. [roll-call] commissioner white is excused. we have a quorum. item two, public comment. it allows members of the public comment to suggest new items for future consideration. do we have anyone here for public comment for items not on the agenda? seeing none, next item.
5:04 pm
>> we are on item 3, discussion of possible action to make a recommendation on the board of supervisors police code, an appeal second-hand dealer and permit requirements. we are repealing 852, 1276, 1279, 1288, 1281, and 1282 and amending section 26 and 2.67 to eliminate requirements and other regulations. in your binder is the word silenfile. >> good evening, supervisors. goothank you for having me.
5:05 pm
is there any chance we could call both items, given they are related? >> item #4, discussion of recommendation allowing dogs to be fastened to lampposts, hybrids, or trees region -- lampposts, hydrants or trees, 1279.1, 1279.2, 1281, 1282, and a monday other sections -- and amending other sections. there is a file along with the guy just. region -- along with the digest.
5:06 pm
>> supervisors were unable to attend, but we want to thank you for the opportunity and look forward to your feedback. the first piece of legislation focuses on the sea and licensing requirements for secondhand dealers and used bookstores. this is something many of our business constituents have been asking for. some businesses have been threatened recently with sales arm -- with jail time, so this removes the second hand provisions from the police code, allowing used furniture dealers and used bookstore owners to be considered the same under the laws businesses selling new
5:07 pm
products. it removes acquirement that they pay more than $1,200 for a particular licence but have little proven benefit. it removes the requirement that new business owners go to haul of justice and get fingerprinted, waiting in line with those charged with crimes. the legislation does not change in the state requirement particular to any types of secondhand dealers, jewelry, coins, a precious-metals, things that are likely to be stolen and resold. there are state requirements, and this does not change any of that. this legislation will further support our business community, and we look forward to your support.
5:08 pm
we issued a section that repeal various aspects of the police code, which pretty much everyone considers antiquated and obsolete. this includes things like regulations defining how much someone can charge to pick up a piece of luggage from one part of town to another, and it gets three descriptive about different zones. the legislation repeals the requirement for someone carrying an airplane ticket to buy and carry on with the city. it repeals the requirement that makes it a misdemeanor for a moving company to move items from one addressed to another. it makes it a misdemeanor is the moving company does not notify the property owner in writing prior to the move, and it is the
5:09 pm
most modern agreement that the burden is placed on the tenant and not on the moving company. it repeals a section of the code that makes it a misdemeanor for a business to serve food to allow someone else to come on to their promises to sell food. this has been talked about before, but the tamale lady, prior to whether or not she had the proper permits, the current code is written such of the owner of the establishment is the zeitgeist. the zeitgeist is committing a misdemeanor by allowing her to sell food on the premises, so this repeals that code section 0 goo. it also repeals a section that makes it a misdemeanor for someone walking a dog to try that dog to a tree or a call if
5:10 pm
they want to go in side of the business to make a purchase. we see this as common legislation that modernizes the way the code is written to reflect how we live our lives. i am happy to answer any questions you may have. >> first, i want to thank you for this great legislation, obviously much needed, and i have a question about an antique dealers. i see the sea is scratched out. -- the fee is scratched out. >> by removing the code, it also removes the fee. they have not been considered any different from someone who wants to open a new furniture store, so there would be no second hand permit fees.
5:11 pm
>> i know the dealers slipped out when they suddenly got these threatening letters. they have been in business for 20 years, so i am happy to see this taken care of. thank you triggered strikes -- thank you. >> i sent an e-mail earlier today and wondered if the supervisor had a chance to think about it, and that narrow window of secondhand dealers is something we can have a further discussion on before doing anything final which the legislation? >> i am not sure if they have sent a letter, but basically the request was to consider
5:12 pm
secondhand dealers but cash out, so someone who comes with a bag of used clothes and wants to make a little money on that, the request was to consider disaggregating that group of business from the larger pool of secondhand dealers, and the reason from the consideration is to insure we are not creating a vehicle, we are not making it easier to sell stolen merchandise, so i think the intent is not to do about, -- is not to do that. we are more than happy to take a look of fat and see if there is a way we can see that. in speaking with different constituencies and the police department, we are actually meeting with the police department again at the end of the week. in our opinion at this point, it
5:13 pm
seems we are selling for something that is not necessarily a problem currently, but if we confine their is a concern, we are more than happy to entertain that. >> i think this is for businesses, clothing, music, books, things of that sort, so the requirement is that you need to do, based upon the state regulations in terms of the criteria of being applied at the local level, you need to ask for a valid id. business is required to offer the individual to be able to engage in the visitors', being able to look at their goods -- to engage in businesses, of
5:14 pm
being able to adapt their goods. this has been a good tool for them. while there is not often a means for purchasing stolen grosoods,d a police report is filed and that individual being able to connect the dots, that does not happen often, but it would communicate with me this is a deterrent for those keeping those kinds of people to sell goods, so if the permit goes away, the requirement for the business to ask for that goes away, so i think there is more in terms of what that may mean in terms of senegal and they like it, but they will have a harder time if they retain about
5:15 pm
a business operation on their own, they will have a harder time defending it, but that is a small group. it is not a majority of the businesses the purge inventory -- the purchase inventory somewhere else and bring it into cell, -- it in to sell, which is why we see the need to repeal the permits. if that makes any sense. commissioner riley: you mentioned there was a state requirement for second hand dealers on jewelry, coins, and gold and silver. what are they? a black eye and not 100% versed in state regulations, but it is
5:16 pm
a reporting requirement, and there is a fee. businesses but are identified would fluctuate over time. it is based on statewide crime patterns. the department of justice will issue memos that are regulated all the time, and the reporting requirement is a daily reported of all sold i did, -- sold items, including identification of to whom it was sold. i have not encountered anyone who does this, but it is a state law. the focus is on high-value items, so items that have a
5:17 pm
serial number that can be traced, it is on jewelry with serial numbers and precious metals. >> would that cover our concern? >> i do not know if the state is regulated, so i cannot speak to that. >> on the list of what are tangible goods, it is a higher value. it is the one with the serial numbers, the boom box with serial numbers, and your electronics, and there is the current spell of the state of all right non -- current bill at
5:18 pm
the state capitol right now, including some particular engraving on it, the proposal is as they have to be reported, so in talking to his aid, the intention is getting to the higher value and a list of tangible goods are not meant to been a pair of jeans, a cd. that is really about higher value. they are doing this legislation. there is on hold new industry of sell your goal to us and get cash. that needs little more regulating. i think for the antique shop,
5:19 pm
they do sell jewelry that might fall in this classification. with pawnshops, they have to do reporting on every single item, so one of the other elements is they are going to be moving into an electronic system because the department of justice is overwhelmed with the amount of documents they have received state wirede. they have storage as they have to rent out to keep paperwork, so they are looking at ways to reduce this, so i know which buffalo exchange we work on a modified tracking system, but the police department did not want us to send the volume of paperwork, so it was agreed upon
5:20 pm
to keep of the storer region ke -- to keep at the store, but using the state requirements in case there were in the stolen items to trace back to the individuals whose goal it triggered -- who stole it. >> some of it was very updated. i did have a question on food. gooi understand what you are creating, but what about create any loopholes? it does not speak to the selling
5:21 pm
of food. it speaks to restaurants. goothey are permitted to sell f. the misdemeanor is for them to invite people on to their promise to sell soofood. that would allow food establishments to open anywhere. goois really is a tailored law. we tried to figure out what the intent of this one is. no one knows about it, but it really is tailored out of business owner, inviting people to the promises to sell soofoodo a pop-up shop could potentially
5:22 pm
be not legal under the police code. >> going back to the antique and second-hand dealer, that is fairly significantly regulated out the state level. but there is another section that speaks to pawnbrokers. >> for those businesses, eliminating this permit if they fall within those criteria, they are still going to need to comply of the state level. >> i want to thank supervisor wiener for all of this theory your -- for all of this.
5:23 pm
i looked at some of the dates. this is 2012, not 1921. i want to thank him for that. there is no commissioner comments. i would like to call for public comments on item 3 and item 4. do we have public comment on item 3 and item 4? seeing none, public comment is closed. commissioner comments. >> i think this is pretty straightforward. i would like to make a motion to recommend both of these changes to the police coronde.
5:24 pm
>> second. >> could we take roll call on each item? cracks could buy out for one -- >> could i ask for one? >> i would like to recommend supervisor wiener's office for the first item, if you are ok with that. if they could work with office of small business on buy, sell, trade only in and work with our office on 51that, because that s a $1,300 permit that is ridiculous. some of those businesses to need some backup when asking for id.
5:25 pm
>> you mean on the direct buyer? >> yes. >> i do not know if this is common, but i have been to the hearings, and they are very harsh. i am concerned about what is going to happen to those who are not compliant. >> we have sent a letter of few weeks ago to the police chief who requesting that in light of the spending legislation to hold off on any additional reinforcement. we have been told they will do that. >> i would like to recommend we
5:26 pm
move forward with those police current -- goes police code with the additional recommendation that idb requested for certain categories. that is something we would like to work with our office ontari. >> commissioner dooley made the motion for both items. gooaxe commissioners, item numbr three, file number 1.2671, row appeals second-hand dealer and anti permit requirements. we have a motion to recommend
5:27 pm
approval with the request that they work with the staff to ensure appropriate and where regulations for best buy. gooon that motion -- [calling votes] that motion passes, 5-0. item #4, file no. 1.2672, a police code allowing dogs to be fastened to allow those, hydrant, or tree, revealing outdated recommendations. we have a motion. a second. roll-call -- [calling votes]
5:28 pm
that motion passes, 5-0. would you like to call the next items together? >> yes. five item to make possible recommendations to the board of supervisors on 120681, enacting gross receipts and phase out expend tax. item #6, discussion to make recommendations to the board of supervisors on file no. 1 to 0 6/8 to -- file 120682.
5:29 pm
item six was introduced by supervisor avalos. in your packet is those ordinances, and in item number five, we have a summary of the response of the proposals we sent to the board of supervisors, the mayor, and other stakeholders, and we have some detailed pages regarding your recommendation to allocate $700,000 to the office of small businesses. in the back pocket is a fact sheet for each ordinance along with a copy for the referral. both items on the discussion and action item.
