deal. i do not really see that happen very often. there are very clear guidelines in terms of how you can interact with different parties. i imagine the parties are looking into the legal questions raised by that. in any event, i think there is basis for denial, but i also think there is a benefit to that, and if we do go down the road of continuing, that there is truly an effort and willingness to negotiate and to deal with the community in good faith. i think that is all the community is asking for. thank you. supervisor wiener: thank you. i of a few comments. i think one of the issues i have worked on very extensively is preserving and improving san

francisco; righ's night life. i worked very hard on this. i was part of the study that showed what it contributes to the economy. i have been very vocal and raising questions about the western some of plan, because i think it will undermine night life around 11th street, so i am absolutely passant about having great night life. as a gay guy who has been going to get barsay bars, before i wa, i am completely passionate. i also -- all of these different bidders and suitors who wanted to take this over and keep it as the eagle, i stepped up and tried to help each and every one of them.

i spoke with them on the phone and try to help them. i do not know why it did not work. i tried to help mike lee on, as did supervisor kim. it did not work. i did it. i have worked very hard to keep it open, and to give it to stay as the eagle, and sometimes we want to view ourselves so powerful that we can make things happen, and this is one of the frustrating experiences where you try and think you have influence, but you end up having a lot less influence that you actually have. with that said, we are in the situation we're in, and i will support the motion to continue the motion to september 10. we will give the new owners time to do our reach for the information that has to be

gathered and come back to the committee so the committee and board can make an intelligent decision about the liquor license transfer. i want to know that as the new owners, and i said this last week, i stepped and a little bit of a cow pie here, because there is a history, and people have been very angry at property owners. they actually took their liquor license out of the premises with them. i think they have not done anything wrong. there were timing issues, and there have been comments today that i think have been unfair. community are reached is extremely important. i am confident and request that that start happening immediately. we will work closely with them on this. i also want to note that even though there have been a number

of comments today about gay vs straight ownership, and believe me, i am a huge bolivaeliever i owners of bars and nightclubs, but that is not before the board, and nor would it be legal before it to be before the board. we can cannot -- we cannot condition a liquor license based on whether their oy're gay or straight. there are very defined standards around transferring a liquor license. i think there has been some unrealistic expectations in the community about what is within the parameters of the board's determination about that. i just want to make sure this license is held to the same standard, and that includes community outreach. i think it makes sense to have

more time to do that. it should be the same standards. with that, i will support supervisor kim's motion. supervisor olague: i will support supervisor kim's motion also. september 10 is right after the august break. i am not convinced there will be a lot of time for the things that need to happen. supervisor kim: i am happy to amend the motion to september 24. supervisor wiener: without objection, the man is amended. supervisor kim: i think the process is incredibly important, especially in a neighborhood that is already saturated with a

group license, and there are a number of things i will consider as we move forward as the type of businesses that are intended to be as part of the neighborhood. just for a little bit of context, and any census tract it is suggested there are only seven alcohol-serving but years, but there are 33 here. i think there are a number of questions that i will have certainly in terms of what the clientele and security plan and the type of business you plan to move forward, just so you also know in terms of the area, this part of the city has more than doubled the crime that is considered a high crime area. it is considered high crime with 215 crimes. this area has 559 reported crimes. i think i will really need to see a strong security plan, and also, an important part of safety is absolutely community outreach. you want to know the neighbors

that you will be residing with. want to have good relationships with them. that is part of preventing crimes as well, knowing the community will be a part of, so i think that is absolutely essential. i want to confer with supervisor wiener. i have a number of concerns regarding the transfer it solves. we're more than happy to provide a list of folks that you can do support to to get feedback from, and i am looking forward to what may become before us in september. super wiener: thank you. one quick follow-up on the saturation issue, which is always an important concern. it is my understanding the people always had a 48 liquor license for decades and decades, and as we have continued dialogue, i just want to

picture people understand that the saturation argument. it is challenging to say that it is saturated show we should not have a 48 for these owners, but we should bring the ankle facea. i want to make sure we have that in mind. supervisor kim: i am not saying i would not approve because of saturation. i represent a district that is saturated. i do not think that is a saturation itself, but when there is liquor-serving businesses in the neighborhood, there is a higher level of standard, and you want to ensure that there has been a lot of outreach and security plan. supervisor campos: i totally agree with you, and i completely agree with what supervisor kim as saying. i think saturation is a

consideration, in the context of looking at how the proposed operators are interacting and connected with the community is a key consideration in terms of looking at the overall public welfare. unless they are committed to actually working with the neighborhood and community, i think that we could very well decide it is not in the public welfare to provide a licence in one instance. i do think, connected the players are to the committee is an important consideration, and i am sure the something that all of us will look into. supervisor elsbernd: seeing the weather and on the list, with a motion by supervisor kim to continue this matter to september 24, 2012 meeting of this committee. can we take that without objection? that will be the order. any other items on the agenda? we are turned.

the board needs to approve a gift from the baker street foundation to accept and expend this gift to hire one of the gardener for assistance in maintenance of the polo fields. because of budget cuts, they are only maintained on a part-time basis. staff determined adding gardening staff was a high priority to preserve the quality of the turf at the 16-acre sports and events complex. it is particularly critical with the upcoming large-scale events at golden gate park. without attention, gophers and heavy traffic will undermine the quality of the turf. the rec and park commission voted to accept this gift. i am recommending this resolution go out with the committee report in order to

>supervisor chiu: the legislation that we have in front of us is designed to encourage onsite water use and when the bill the. we opened a new puc building at 525 golden gate. this building is our real landmark. the building will use 60% less water due to a system that meets 100% of the toilet flushing- irrigation needs for water. it will be recycling 5,000 gallons a day of waste water. it will be storing rain water in a basement cistern. in recent years, it has been challenging for developers installing the systems in major buildings, but i want to take a moment and think the staff of the puc who have worked closely with the department of building inspection and the department of

public health to solve these challenges. the ordinance before us will developers install these water systems in new, large developments. it will streamline the process in maintaining great water, rain water, and blackwater. i also want to thank the puc for setting up the grant program for commercial developers who want to install the water testing process. it will save the of the environment -- save the environment and money. with that, i would like to recognize the staff of the san francisco puc and see if there is anything staff would like to add. i know they were here briefly. i want to thank you and your colleagues for all the work you have done on this. if there's anything we have missed -- colleagues.

>> we just want to appreciate your considering of this ordinance. just by way of context, we hear residents' use about 85 gallons of water a day compared to 150 gallons per day across the state, and that is because of many ordinance is that the board of supervisors have passed historic the, the many programs we have in place that really helps. as we look for new opportunities, we find it is on the commercial side. we appreciate the board leadership. we have a number of staff here from the puc to answer any technical questions. again, thank you. supervisor mar: thank you.

let's open this up for public comment. is there anyone from the public who would like to speak? please come forward. we're going to limit it to two minutes per person. >> two minutes, while. my name is scott. i represent a water machine system. the company provides waste water treatment management technology. i also want to think the committee for this opportunity to speak in support of the water reuse ordinance. through this ordinance, the puc has really provided visionary leadership by saving money, addressing regional water issues, and promoting development as well. in terms of the benefits, i will put them quickly into three categories. economic benefits, community wide benefits, as well as environmental. the economic benefits include reduced capital cost.

these on-site systems cost less than traditional systems. they create jobs, green jobs. they provide a clear path for developers. they also reduce the load on existing waste water infrastructure. community-wise, but these types of water reuse systems provide resilience for water shortages. the enhanced san francisco -- they enhance san francisco. the whole country is really watching what san francisco is doing as far as water. we are not the only technology. my time is almost up. thank you for the opportunity. thank you very much. >> thank you.

next speaker. >> good afternoon, supervisors. thank you. i am with spur. we have had the opportunity to consider this ordinance going back several months now. as you know, but such systems can factor in the reused water on the site. our reuse for non potable sources -- we really think we should be moving away from using our wonderful hetch hetchy water for these types of uses. in the process, the puc has been putting this in place to make it easier for developers to consider and hopefully to include on-site treatment systems in the new building san

francisco will be getting in future years. so, these treatments systems can generate significant amounts of water, as you of heard. about 25% of potable water. as president tchiu mentioned, they have created a system to help some of the system's. that is 40%. the significant. hopefully, we can get more significant types of systems going forward. i want to conclude that i recently got to see the living machine at 525 golden gate. i was encouraged. not only does this mean the sustainability goal, but these types of systems are really beautiful as well. i would like to conclude by saying that we support this

ordinance very strongly. thank you. supervisor mar: thank you. next speaker. >> my name is laura allen. i am here to speak in support of the non potable water use ordinance encouraging the use of non potable water towards a sustainable future. these water use projects in the past have impeded implementation of water systems -- water saving systems. in addition to this important first step, i believe that san francisco should plan to require these systems in the future. with climate change and an uncertain future water supply, we need to take new steps to

forward. public comment would be a little bit more from them as well. thank you. supervisor mar: thank you. next speaker? >> good afternoon. i am june, the senior epidemiologist at the health department here. i have been working with the puc and dbi on this ordinance. it has been a great experience to bring the family together to support the types of projects that we are going to be seeing more and more of. from the health department perspective, we're looking forward to having a formal mechanism by which all of these developments work together to make sure that these systems go in place in a way that ensure they are going to be a functioning according to our
