better streets. but i will say that it's difficult because i respect people on both sides but i'm doing my best to listen. i think i will be respectful of the voters as a referendum comes to the ballot in 2013 but giving my rationale about being consistent on my vote on this project. thank you. >> president chiu: supervisor kim. >> supervisor kim: i wanted to concur that i voted on this project, that i voted to approve this project two months ago. i think over all, as with any project development that comes to on the board of supervisors, we often have benefits and of course we have aspects of the project that are detracting. but i think over all, through the lengthy process that i think our board engaged with, i think that, as supervisor else bernard said the positives outweigh the negatives. i want to highlight significant
5:01 pm
benefits from this applican proe are seeing the highest inclusionary fee in san francisco and i think that's important to mention. this is money that could potentially go to another waterfront parcel that could be dedicated towards affordable housing. i think that we have talke talka lot about who this waterfront is for and i agree with the water mark and potentially with the washington project we've approved two luxury developments on the waterfront and i'm excited that the port is moving forward with a parcel on seawall lot 22-1 that can be dedicated toward affordable housing also for the city. unfortunately for us to get funding to move these projects forward we often depend on market rate developments in san francisco. we saw it with the millennium, with the water mark, with st. regis, all passed with a super majority vote of the board of supervisors. i think with the calculations that were made with this
5:02 pm
project, we found that we were able to raise significant benefits, whether they were the parking fee which for the very first time was negotiated to be in perpetuity to go toward streetscape and also again the highest inclusionary off site housing that was offered as part thf negotiation. i do agree though with supervisor wiener, this will be moving forward on to the voters. i think that it is important that voters get a chance to weigh in on this project as long as the signatures threshold was met for this to be put to a vote. and i look forward to hearing from voters as this comes before us in the upcoming election. >> president chiu: thank you, colleagues. unless there is additional discussion let's take a roll call vote on the question of whether the ordinance shall be repealed. >> the clerk: supervisor mar, no. supervisor olague, no. supervisor wiener, no. supervisor avalos, aye.
5:03 pm
supervisor campos, aye. president chiu, aye. supervisor chu, no. supervisor cohen, no. supervisor else bernard, no. supervisor farrell, no. supervisor kim, no. there are three ayes and eight nos. mr. president, this ordinance has not been repealed and i will notify the department of elections. >> president chiu: that is the vote. if i could ask members of the public if you could leave quietly because we have a little more business to conduct today. colleagues, i had one additional 3:30 proclamation i wanted to offer. i'll give a moment for folks to cleave thclear the chamber. if i could ask members of the public if you could please take your conversations outside.
5:04 pm
>> president chiu: again, if i could ask members of the public if you could please take your conversations outside. so we can finish our business today. thank you. colleagues, i didn't want to interrupt the eight washington hearings with this final proclamation. but it is for someone who i know is not expecting it, who has been sitting in this chamber for the entire time, and we are now going to look at her. someone who has worked very closely with every single one of
5:05 pm
us and our staff, our deputy city attorney, sheryl adams, who was just told by our city attorney dennis herrera that she will head up our city's trial team which is one of the best trial teams in the country. congratulations for that. but i have circulated a proclamation signed by all of us and figured it might be worthwhile to read some portions. whereas deputy city attorney sheryl adams has served as general counsel since 2005 during which time she's consistently demonstrated her grasp of the law as well as her dignified public presence, whereas she's always had the difficult task of working with 11 public officials when do not always disagree and occasionally remind her that many of them are also attorneys. whereas despite the challenges of her new role at head of the trial team ms. adams is sure to be relieved that certain supervisors and aids will no
5:06 pm
longer call her in evenings and weekends. whereas deputy city attorney adams has demonstrated incredible capacity to answer the same questions over and over often from the same individuals and whereas she knows she will no longer have to decide if an amendment is substantive or not let it be resolved in recognition of her years of service to the legislative branch of the government, the board of supervisors does hereby proclaim september 4, 2012 to be sheryl adams day in san francisco. congratulations, sheryl. >> [applause.] >> president chiu: i know there are a couple of folks that
5:07 pm
may have some things to say. supervisor wiener. >> supervisor wiener: she trieses to avoid me because i joined the trial team and she left and went elsewhere and now i come to the board of supervisors and she promptly goes back to the trial team but i won't take it personally. seriously i know not just in the year that we were on the trial team but what i heard from people in terms of the many years before that, that you had spent on the trial team, is -- although i think people here generally see you in a certain role, what people don't always know is that your really just a very superb and widely respected trial lawyer and the trial team is an amazing place and i just think they're incredibly lucky to have you as their leader. and i know we're going to miss you but our loss is the trial team's gain. i will say that although dealing
5:08 pm
with 11 supervisors can be probably very frustrating and brain damaging and hard, dealing with opposing counsel in the city attorney's office dwarfs in terms of brain damage and being hard. so from the frying pan into the fire. but seriously, i know we all love you and we're going to miss you. >> president chiu: recognize another one of our colleagues who we occasionally heard as an attorney, supervisor campos. >> supervisor campos: i wasn't sure who the resolution was referring to with respect to that issue. but as an attorney, i do know that -- >> [laughter.] >> supervisor campos: that some of your worst clients can be attorneys. so -- and you have six of the 11 here. and i just want to take this opportunity to say that i think you have handled yourself brilliantly. i think that the very tough and complicated issues that come
5:09 pm
your way, and quite frankly in the last couple of years, we've had some pretty interesting and unique matters that have come before the board of supervisors. and i think that you have always, you know, approached it very professionally and very objectively, and have had the patience to deal with each and every one of us. so it's greatly appreciated. and i know that the trial team is lucky to have you. and we look forward to continuing to interact with you, and of course having john join the team, it's exciting. sheryl, as a colleague, as a friend, it's been a pleasure, and best of luck to you. >> president chiu: thank you, supervisor campos. i will quibble with one thing. you said there are seven attorneys, there are six. supervisor elsbernd. >> supervisor elsbernd: in 2005 when you came i think there were a lot of folks who thought
5:10 pm
there is no way anybody could replace ted lakey. i think we all knew within a couple of months you were the perfect person for this job, and that was a different time, but what has always remained consistent is your professionalism and your work. you've been fantastic. and what i will say to john, you have a very difficult person to follow. and when it comes to me, admittedly, you have a very short time left with me but one of sheryl's great skills i'm not sure everybody here is aware of, with me, whether i was sitting in supervisor kim's chair or sitting here, i have a tendency to be sarcastic every now and then and lose my temper. sheryl would have ability with just a look to let me know i was going over the edge. she and monique have a special place in that regard. john, you've got to find a way to communicate that to me. sheryl, thank you for keeping me
5:11 pm
in check on those times when you were able to. >> president chiu: supervisor avalos. >> supervisor avalos: thank you. i worked with you as a legislative aide and a supervisor. it's been really great to know you, outside of the office as well, your interests in that. and i just really appreciate your work over the years. i just hope that the trime team, that they -- trial team that they like gid tars, and music. if they haven't, you'll be very happy. john, welcome, and i look forward to working with you. we worked together great and i think you will be a great asset for the board. >> president chiu: supervisor farrell. >> supervisor farrell: thank you. i want to echo what i said earlier and to say thank you. someone who has been here a year and a half and new to the political system in san francisco, you have been an incredible guide.
5:12 pm
from my perspective, and, you know, you talk about professionalism, but you have really helped a ton. i mean that very personally. i want to thank you for that. i don't think anyone else could have done that. so many things -- i don't know what supervisor campos or wiener said, whether something is material or not, and having you on speed dial that is true for me. you are such a great person. our loss is their gain at the trial team but thank you for everything. john you have big shoes to fill but i love working with you already and love working with you in the future. sheryl, thanks a ton. >> president chiu: supervisor chu. >> supervisor chu: a lot has been said about how smart sheryl is and the decorum she has and how wonderful she is. i wanted to thank you because i remember when i was first appointed in 2007 as a supervisor, i had to come to you to ask you a really dumb question, a question as simple how to divide a file and what does that mean. i want you to know, no matter
5:13 pm
how stupid or dumb the question was you always answered it very nicely. also, i just always relate to there was never a question that was too silly, or never a question that reshouldn't ask. so i always wanted to thank you for that because it means a lot for us to have someone that we can always ask all of our most simple questions to. i want to thank you, wish you the best of luck. luckily for us you're not going away so you might find yourself here again and hope you will be back with us at some point. >> president chiu: one more person the clerk of the board. >> sheryl adams, thank you for holding my hand when i became the clerk. you were one of the handful of individuals who helped me acclimate to the job. i want to express the deep gratitude from my office and all the help that you've given us over the years. as supervisor campos said there were several high profile issues that occurred over the last five to six years. and it was because of your
5:14 pm
guidance, and your calm demeanor, and problem-solving skills that we were able to get through them. and i just want everyone to know that you were a great part of our success in each and every single one of those incidents. so thank you very much. we will miss you. and john, welcome. we're grateful that you're going to come on board and take her place but of course nobody can take sheryl adams place. as we've missed ted lakey but we quickly became acclimated for you and were grateful for you're assistance and will be grateful to you too, john. thank you. >> president chiu: deputy city attorney add himsel adams, any s or counsel you want to provide us? >> i'm very touched. thank you so much. and it's really been my pleasure, privilege, and honor to serve as your counsel. you're just a remarkable group of individuals from everyone sitting in this board, to your staff, to my friends in the clerk's office.
5:15 pm
this group is great. i mean it's every -- it's touching, it's cutting edge work. and everyone's got their finger on the pulse of really great new social policy. and that's just been an exciting thing to be able to be a part of. so i thank you. and really, this means a lot to me. i appreciate it very much. thanks. >> [applause.] >> president chiu: and with that, i think we're at the end of the agenda. madam clerk, could you read the memorial yams. >> the clerk: today's meeting will be adjourne adjourned on te following individuals, for president chiu for the late nancy blair, on behalf of supervisor elsbernd and supervisor chu for the late caghts lien backari, julian lowe
