>> patrick -- i'm surprised in the minutes that you are about to adopt that you didn't note that it is customary in court orders to include motions that are sustained and motions that are denied by the court and to that except i think david wagner was absolutely correct ten minutes ago when he recommended to you that the summary report that you are giving to the board of supervisors should specifically state what you denied in finding regarding the mayor's charges. and to that extent, your previous minutes should have alerted the public that you were going to get to the point that you weren't going to include in the recommendation going to the board of

supervisors what you threw out because most courts will tell you what they sustained and what they denied. you should have told us about that in your earlier meetings. it's the kind of unethical behavior that san franciscans have grown accustomed to seeing from this ethical body. >> three minute intervals, how great. still paula caney and now i'm not talking as me. i am talking as eliana's lawyer and what she is question me to communicate to each of you is her dismay of the commission's finding that her testimony was not credible. i know that you each have reasons why you are going to

say that. but my client wants you to know that you are flat out wrong. and that what she said to you and what she testified to at this hearing in her heart of hearts is her truth. and that granted mr. wagner and another made a decision not to cross-examine ivy wilson, but in terms of how you view her testimony leer being uncredible, she is upset and frankly as her attorney, i'm upset. you took a snippet of what you want to see and i'm worried that that is what it is is that rather than view something as true, the same with your dismissal of linnette peralta.

and it has to be that elaina is not credible to sustain your findings here. as far the whole attorney-client privilege, i'm not eliana's first attorney. sheryl wallace was, but you have to know the first time sheryl ballas had contact with the police, within a day and a half of the video being taken from -- ivory madison, miss wallace asserted it's an attorney-client privilege and i know some of you are lawyers and in terms of attorney-client stuff i have tons of people tell me stuff that i would not disclose to somebody.

it's the belief that i tell somebody something in confidence and if you are going to believe the video, you need to also believe that the only reason eliana made that video was to be used in a custody dispute, not to report anything other than she was afraid that she would lose theo. you also have to remember that at that time she hadn't received her paperwork from ice yet and there were concerns and anybody who is not an american citizen has to worry about ice in this day and age and what is going to happen. that is my three minutes. >> is there a motion to approve the minutes that we have identified? >> so moved. >> is there a second? >> second. >> all in favor? >> aye. >> opposed? hearing none, the motion

to you delay delivering the record to the board of supervisors until such time as the board may consider the case after the november 6th election due to the political pressure on each member of the board. did you receive that and are you going to take aside that question? >> i have received it. i think was it sent to all the commissioners? i believe it was. my understanding is that a decision like that has been delegated to the chair. if any commissioner feels it should be a decision rendered by the commission, perhaps we should calendar it for another meeting. it strikes me as the sort of procedural type of issue that you all have delegated to me, but if i have that incorrect, i suggest that we calendar it for a meeting in the near future.

does any commissioner object? does any commissioner believe that that authority was not delegated to the chair to adjudicate a request such as provided? |ái decided forth worth. >> wagner. >> wagner, i apologize. >> although i'm honored. [ laughter ] >> one final question i have for you, there was a legal analysis of this case that was submitted and i just wanted to confirm you have received it? i can't be more specific really because it was submitted anonymously, but i felt quite compelling and i believe it was conveyed to mr. emblig and make sure it's a part of the record? >> well, >> well, one thing i want to

say about submissions that come in, if parties make submissions we may consider them, we may ignore them. they will likely be part of the record in any event. when people who are not parties or witnesses to the commission submit things, it's not part of the record. we may or may not read them. we certainly have no requirement to read them. a lot of us are curious and do read them and maybe don't, but one thing is clear it will not be part of the record. i think things that are sent to mr. emblig are typically forwarded to us. if that was your question. >> thank you, commission. >> anything else from the parties? from the commissioners? okay. the meeting is adjourned.

>> the renovation of balboa park, the oldest in the city of san francisco, and now it is the newest part in the city of san francisco. through our partnership, and because of public investment from the two thousand eight fund, we are celebrating a renewal and an awakening of this park. we have it safer, happier, more joyous. >> 3, 2, 1, [laughter]

=--[applause] >> it is a great resource for families, to have fun in the city, recreation. >> this is an amazing park. we have not revitalized it without public and private investment. the critical piece of the process of this renovation was that it was all about the community. we reached out to everyone in this community. we love this park dearly and they all had thoughts and ideas and they wanted to bring their own creativity and their personality to bear on the design. what you see is what the community wanted. these ideas all came from the residents of this community. as a result, there is a sense of

past week, i have been watching a certain convention. next week, we will have an even more exciting convention to watch. it is of course, in the spirit of the expected national, regional, and state elections we are preparing for. it is also a reminder of the importance of our civic duty and all the different departments we have created. public engagement is extremely important to the way we run government in san francisco. it has always been about public engagement. we need the last bodies come a different viewpoints, different economic classics -- classes, ethnicities, and regions of the city to be well-represented on

everything we do because that is what makes our city great. it is that the verse you point coming together to focus -- it is that diverse viewpoint coming together to focus and figure out with the public what it is that we should do, that it is time well, well thought out, and what we need to do to show the rest of the country that this city can work itself out of the economic doldrums and into presenting hope and economic opportunity for everybody, no matter their backgrounds. we also reflect our regional values in this city in many different ways. we want to continue selecting people who will make sure government and all of our programs are open to everybody. i want to thank each and every one of the people in front of me today representing the

different bodies we are about to make appointments to and thank you for your sacrifice, time, and energy. today we get to recognize you. tomorrow, people will start yelling at you. it is part of that process. it is one we cherish no matter what body we're on. i know former mayor willie brown is here. i want to thank him for constantly being a support to all of our commissions and for being here today. i want to recognize each and everyone of you today by asking you to stand and be recognized as i call your commission and name out. for the board of appeals, we have an lazarus. joshua, thank you for being

california carpenters regional council, thank you. laborers council. tim, thank you for being here. the film commission, patrick johnson, thank you for stepping up. an invaluable planning council that i will be working closely with as we move into the new health care challenges for our city and state and country, that is our hiv services planning council. gabriel ortega, thank you for stepping up. mark, thank you for being here. [applause] a very important commission, our immigrant rights commission, who

is constantly challenged by the need to reform our immigration policies, but to make sure that when people try to vote this year that they will not be intimidated. we've got to work harder for the rest of the country. we can show the way here. i know the leadership will come from sonia. thank you for stepping up. our state has presented, and our country has presented, a challenge to us for our seniors and the need for long-term care. we're going to be working closely with the long term care coordinating council. thank you, tracy. [applause] thank you for stepping up. and for teaching me how to pronounce your name. our mta newest member to the

board of directors and one that i know will be of great value to us as we are challenged with everybody being able to enjoy all the services our mta has. thank you, christina, for stepping up. [applause] as we move into the times when we want more people to come in, we want development to create jobs, we need to make sure we appropriately plan all areas of the city. i want to thank these two gentlemen for stepping up to come and spend hours of their personal time helping us with the planning of the city. michael, thank you for returning and stepping forward for the planning commission. richard, thank you very much for

stepping up as well. some say the most voluble land we have -- valuable land we have for people to live and enjoy is the waterfront. i want to thank our newest commissioner to the port commission, william adams. thank you, william, for stepping up. [applause] we have a very important task in front of us for this november. we have a very important bond i think most people in the city know will be invaluable to us for our kids and families. that is the open spaces part bond proposition b for this year. we also have a cherished commission and department that is charged with maintaining all

of the open space in the city from the parklets to the vast golden gate park, to the shared responsibilities we have with ocean beach and open spaces throughout the city. i want to thank phil for being here today. we have our returning commission. you have done a wonderful job so well. in my decision, it was appropriate to reappoint youtube this important commission, -- to reappoint you to this important commission, and keep the good work out. gloria, megan, thank you. tom harrison, thank you very much for your wonderful work there. we have challenges at our state level in the way we handle our incarcerated population.

we will be working closely with the realignment committee, with all of our public safety departments, many of them are represented here today. we will be working with the sentencing commission. stephen, thank you for stepping up and helping us with our sentencing commission. [applause] it is no surprise to you that i have been working with the board of supervisors on this very thema, and i am not afraid to keep repeating it. it is jobs, jobs, jobs for everybody. we can only do it if we have a more enlightened workforce investment board the works with us on all the policies we need to have, all the outrage, all of the communities need to be represented on our investment board. i want to thank everyone who is
