3:00 pm
i wanted to give you an opportunity to stand so we can see all the individuals that are here in support of our appointees. if you'd like to. if you would like to. okay. thank you. i just wanted to recognize that and also thank you for being here, to show your support. colleagues, we do have three reappointments before us. just so you know, some house cleaning, we do have to make some minor amendments to item no. 2. there was language that has been miswritten. and i've handed out copies before us. the motion is just to add that seat no. 3 must be a member with experience in project finance, and to delete water systems, power systems, or public utility management which was not actually part of the seat requirement. do we have a motion, and we do that without opposition.
3:01 pm
thank you. can we take a motion on items 2, 3, and 4. we can do them separately. we have to amend them before we send them to the full board. supervisor -- i'm sorry, supervisor campos. >> co-chair campos: thank you. i'm happy to make a motion to approve the mayor's reappointments of commissioner caen for seat no. 3, commissioner vietor for seat no. 1, and commissioner courtney for seat no. 5. i'm happy to make the motion. very proud to do that. i just wanted to make a couple of points. first of all i'm disappointed that ms. courtney couldn't bring out more people to speak on his behalf. but i guess this will do for today. you know, i think that the word here is continuity, and i really believe that the work that has been done by the public
3:02 pm
utilities commission has been exemplary. and i think it was supervisor wiener who said this to me at some point, which i think is really true, which is that the puc has demonstrated how government can work. and when you look at the massive projects that they have taken on, whether it's the water improvement system, or talking about billions of dollars, it's an agency that has, you know, perform better, that not only most government agencies but most private companies, and it's something that we should be very proud of. i think the makeup of this commission is a big part of it. i see commissioner moran who is the president of the commission right now. one of the things that is hard to do sometimes in this role is to admit when you make a mistake. i remember when commissioner
3:03 pm
moran was first nominated and i voted against his nomination, and i do think that was a mistake. and i think that it's important to recognize the good work that people do. and i think that keeping this team together is really important. but it's not just a commission. i think it's also the staff. and i see that we have our soon-to-be general manager here. and i think that some of the issues that have been raised around outreach to certain communities, diverse communities, i can't think of someone who will do a better job on that than mr. kellie. but i also think that it's not just keeping this commission, but also the talent that ed harrington has been able to build over the years, whether it's the cfo, people like juliet ellis -- fox, you name it. so long as those people continue in those positions i think a lot of these things will be taken
3:04 pm
care of. and i'm just very excited. i think that we have -- it's a new day, in that sense. and i think that we, as a board of supervisors, working closely with the mayor, need to continue to support this agency, which i think, again, continues to be an example of how government should work. thank you. >> chair kim: thank you. supervisor farrell. >> supervisor farrell: thank you, chair kim. i've been relatively silent during these items, really just because i'm really thankful for the commissioners for being willing to serve again. ms. caen, ms. vietor, mr. courtney, i really had no questions of them, other than what was being asked. your service has been incredible to the puc. i think even more broadly, all three of you to the city of san francisco in so many fashions. i really want to thank you for your service. i'm more than happy and delighted that you're willing to serve again, and that i will be
3:05 pm
happy to support it. and also to the comments supervisor campos made, i think especially because the laborers are to the puc, it's so important that we have labor being represented here, couldn't support them more fully. vince, you are a great representative of your union. you should be proud of what you do. thank you for your willingness to come back. i will make a motion to amend supervisor campos' motion to do this, we're going to make a motion to amend item no. 2, to -- for ms. cae, make the motion approving the the mayor's appointment, make a motion -- do them separately or together? >> chair kim: do them together, just a motion to amend -- >> supervisor farrell: amend 2, 3 and 4 to approve the mayor's selection of ms. caen, ms. vietor and mr. courtney. >> chair kim: we have a motion to approve and strike rejecting from 2, 3, and 4, and without
3:06 pm
opposition. supervisor campos has made a motion to move forward all three with recommendation. also, i had stated that i would entertain a motion to refer this item to the full board as a committee report so it can be considered next tuesday, september 25. do we have a motion to move this forward as a committee report? i do want to thank our three commissioners who are currently serving, and will continue to serve, as we guide our new puc director, which i am personally very excited about, mr. harlan kelly. i think it makes sense to have that continuity. sometimes it makes sense to have new blood and sometimes it makes sense to have that continuity. i think with new leadership -- also as we embark as a complicated but innovative program in san francisco providing 100% renewable energy to our ratepayers, which is exciting, i would like to see those with the experience, the history, and the expertise to continue to lead us through that
3:07 pm
process. and i was incredibly impressed by all three of our commissioners. your depth of knowledge and your passion around the issues that the puc does is not something that the average citizen i think knows about. i think we often take for granted the work the puc does but it's great to have three citizens who are very passionate, dedicated and knowledgable. thank you all for your service and your continued service on the puc commission and i'm happy to support that and we can pass those motions without objection. thank you, and thank you to all the members of the public. we still have more agenda items so if you could please exit quietly and take conversations outside. madam clerk, item 5. >> linda wong: hearing to consider member to the child -- and advisory council. there is one seat and one applicant. >> chair kim: is ms. a alli
3:08 pm
cuentos here? being that the applicant is not here, i just want to recognize that this is an say pointee of supervisor david campos and represents the district 9 seat. i just want to give supervisor campos a moment to speak on this item. >> co-chair campos: thank you, colleagues. normally -- i don't know exactly what happened with alli cuentos. you want someone to be here, but i am pretty confident about the quality of this appointment. i think this individual will represent the district well. and i would ask that we move this forward. >> chair kim: okay. so before we make that motion, i'm going to open up -- do you mind -- can someone close the
3:09 pm
door. thank you. open up this item for public comment. are there any members of the public that would like to speak on item no. 5? childcare planning. ms. jackson. >> i don't know if i'm looking -- is this dealing with the successor agency? >> chair kim: no. this is the childcare planning and advisory council. this is supervisor campos. >> i don't have my glasses and i can't see with them on anyway. >> chair kim: thank you. is there any other public comment? seeing none, public comment is closed. supervisor campos made a motion to move his appointee out with recommendation. my only question was i didn't realize that there was an advisory committee to the secret garden but i'm excited to find out that there is. i'm happy to support that and without opposition. madam clerk, please call item 6. >> linda wong: hearing to consider appointing one member, term endin ending ending july 1e
3:10 pm
entertainment commission. there is one applicant. >> chair kim: i want to appreciate many of the members that came to speak on this item and also our applicants for are your patience as we move through our previous items. i will be calling you in the order that you are listed on the agenda. and i will ask you to speak for two minutes, both on your background and experience as it relates to the seat and the seat does represent the public health seat for the entertainment commission. and if there are any questions from community members, we will entertain those at that time. so first i'd like to call gilberto alexander and mario grillo. >> good afternoon, supervisor farrell, supervisor kim, campos, wiener. thank you for your invitation here. i'm applying for seat no. 3 and i will sa say a little bit about
3:11 pm
myself. i was born in venezuela. i'm a venezuela-american citizen. i've been residing in san francisco since 1985. i thought it would be a good idea to apply for the entertainment commission, being an artist. i'm a -- artist. i promote myself, but also other people in the arts, music, entertainment. but, also, i work for the city at the department of human services, and the department of public health, for about 12 years. so my health background as a health worker 3 i think will be quite useful for the entertainment commission. i was also a commissioner for the immigrant rights commission. and so i'm very familiar how the commission works, and how meetings, and meeting people. so i would like to offer my
3:12 pm
expertise, and do what is necessary to enhance the entertainment commission. you're welcome. >> chair kim: thank you, mr. alexander. just to clarify, i know that you have experience in public health through your work with -- and sha but specifically for the entertainment commission, could you name a couple of issues that you feel would be important for the entertainment commission to address within the public health arena. >> well, any issue in regards to the protection of the public. i am more than delighted to be involved in. i'm not sure exactly what all the details. but been having work in that area for so long, i think that i'm open to any of the recommendation that the board
3:13 pm
will come up with. >> chair kim: thank you. and have you attended an entertainment commission meeting? >> no. >> chair kim: thank you. >> you're welcome. >> chair kim: i'm sorry, supervisor wiener, did you have a question? >> supervisor wiener: i will speak later on. >> chair kim: next we have mario grillo and naomi akers. >> i am a nativ nate sunset dis. i am not really in the health area but i was, you know, asked to come. so i do -- i'm interested in the position of being an entertainment commissioner. i have some ideas for mid-market, and some ideas
3:14 pm
about -- i'm a professional musician, so i have ideas about the live music scene, and how to move on from the old standard of the 60's count. so i do have a lot of interest here. i've been who are all my life except when i was in the military, in the navy. i do have supervisory experience there. right now i'm working in the city and i'm vested in the city. i'm a preschool teacher and a professional musician. i've been here a long time. i have a lot of experience, public admin experience -- not a lot, but i've -- i'm vested in the city and i want what's good for the city. that's why i'm doing this. thank you. >> chair kim: have you attended an entertainment commission meeting? >> yes, i have. >> chair kim: thank you. next, we have ms. akers.
3:15 pm
>> hi. good afternoon. thank you for having us. i am a bay area native. i spent several decades, clubbing in this wonderful city. north beach, south of market, the mission. and while the music and styles have changed, my passion for the clubs and specifically san francisco clubs, has not waived. i became interested in this position actually through hearing from terrence allen. i've worked with him for the last five years and his talk about -- his work as a former commissioner really inspired me. i think -- i've been in the public health field for over 15 years. i have a master's in public health. but where the intersection of entertainment and public health started to develop in me is, during the aids epidemic, and my
3:16 pm
association or passion with the lgbt community, when i started to see the benefit of using the entertainment commission as a vehicle for fundraising, and philanthropy work, and i have developed that over the years. for the last two years, i have worked as a consultant on a research project, looking at nightclub safety, where we've developed training materials, and have gone in and worked with the club staff and club management, on promoting a safer club environment for all patrons. 30 second. okay. also, five years ago, i worked on a health assessment of exotic dancers. i've spent many years going into strip clubs as an advocate for labor rights and safety for maj maj -- marginalized communities. i have been developing skills of evaluation, program planning and
3:17 pm
assessment, and having vision in my work. >> chair kim: thank you. thank you for making it within your time. appreciate you actually listing out some of the public health issues that you have experienced, and that you feel you can work on as a commissioner. same question, have you attended an entertainment commission meeting? >> yes. >> chair kim: i assume so because of your background and your work. >> yes. >> chair kim: also, given kind of the variety of work that you're currently doing, just wondering if you feel that you have the time to commit to this commission. >> yes. my work at st. james infirmary is part time. and i'm currently looking for another sort of big project. i do understand the work that is involved. i've been warned. >> chair kim: thank you. yes, we very much love our entertainment commissioners and they do spend quite a deal of time working as a commissioner. okay. thank you. >> thank you.
3:18 pm
>> chair kim: next, we do have veronika fimbres. so colleagues know, mr. stuart smith did decide to withdraw his application for this seat. veronika fimbres. i don't see her here. at this time, we will open it up for public comment on this item. if you'd like to speak, please do step up. >> hi. i'm dee leitner on the board of the harvey milk lgbt democratic club and we've been working hard this last year on night life and entertainment particularly with the entertainment commission. and we would like to support naomi for this -- because of her -- sorry, i have a little bit of written stuff, because she is a leader in public health and her -- and understands the issues facing pub health and her work with st. james infirmary
3:19 pm
has been stellar so we support her appointment to the entertainment commission. thank you. >> chair kim: thank you, ms. leitner. next speaker. >> chairwoman, supervisors, thank you. i'm terrence allen. yes, i did introduce naomi akers to the thought of being a commissioner at the entertainment commission because i had seen, in the past set of nominations, a deviation from what i felt was the original intent of the seating of the commissioners at that commission. when the commission was formed 10 years ago, there was a huge outcry and public debate about maintaining the stakeholder representation from neighbors, nightclubs, entertainment, planning, law enforcement, and public health. at the same table making policy decisions about entertainment in
3:20 pm
general, as well as specific decisions about each and every venue and event that happened. failing to look at the applicant's history and their experience that they bring to the seat, and failing to recognize the need to ensure that there is someone bringing speciality in each of those areas skews the commission, and causes the public to lose faith in its balanced approach. and we saw that, and we've been through that experience, and i would love to see us move beyond that. and so it's very hard to find someone outside of the traditional doctor role that can bring -- reduction approach and that can bring a public approach to a job like this. so with that i -- i'm behind naomi akers 100%. thank you. >> chair kim: thank you.
3:21 pm
i'm sorry. mr. allen. >> hi. i'm stephanie anderson. i work with naomi akers and here to support her in the position of the public health seat. i've worked with her for eight years, honored to call her a friend, i respect her work immensely. i was on the board of directors with -- as well. she brings a multifaceted, integral approach to everything she does. she's very careful and mindful of who she's representing. and i think that she would be a great addition to the entertainment commission. >> chair kim: thank you. >> my name is mary mullen. i sent a quick e-mail before i left home. i don't know if you got it or
3:22 pm
not, by way of support, in case i didn't make it. but here i am. so i would like to say that i would like to recommend -- highly recommend naomi akers for this public health job because i have known her, her family background, and can only say good things about her, and i think she would be great for this city, and the people who are out there in dire need of her help. so that's just about what it means to me. and i would like to have you consider that. thank you. >> chair kim: thank you. is there any other public comment on this item? seeing none, public comment is now closed. supervisor wiener. >> supervisor wiener: thank
3:23 pm
you, madam chair, and thank you to all the applicants who applied. as i think you all know, night life and entertainment has been a particular interest of mine in that it is not only key to the cultural identity of the city, but is also one of the major economic drivers of the city. earlier this year at my request, city economist -- an economic impact report showing night life contributes 4.2 billion to our economy in addition to many jobs and tax revenue. and it is a sector that frankly struggles in san francisco because there are so many obstacles to having a great night life, and city hall has not always been a strong support for night life, as it should be. but i think that that is changing. and i think more and more people are realizing how important this is. and i think the entertainment commission plays a critical role in ensuring that we have a
3:24 pm
balance between having a very, very strong and vibrant night life and making sure that night life is safe and healthy for everyone involved, and for our community. and that is the balance that has to be struck on the intrailt entertainment commission. when it comes to public health in particular, sometimes we can go to extremes with a pure law enforcement focus on health, and can be another extreme where there's not enough of a focus on health. so for this seat, it's critical to have someone who brings those two perspectives and who takes a very balanced approach. i think naomi akers does that. if you look at her background -- by the way, we've had a couple of fights about entertainment commissioner appointments, in the last year, which were unfortunate because everyone on all sides i think was very committed to entertainment and night life. and when this seat came open i sort of committed to myself i
3:25 pm
didn't want to have that fight again. so i immediately reached out actually to the harvey milk club, that we don't always agree but this is one area where we're very much aligned and we brainstormed about who would be a great candidate for this seat and naomi's name came up and i met with her. and i believe she is someone who deeply understands the importance of night life and who has done enormous and terrific work around public health and harm reduction. so, colleagues, i hope you will recommend ms. akers. i think she would be a very powerful and effective voice on the commission. >> thank you. i will be very brief. i want to associate myself with the comments of supervisor wiener. and i think the fact that former commissioner terrence allen was here, i think speaks very highly of ms. akers. i do want to thank all of the applicants because i think that each and every one of you brings something to the table.
3:26 pm
and i want to thank you for your interest, in serving this city. i think it's greatly appreciated. i do think, though, that ms. akers has the unique set of qualities that we want to see in this appointment. and so i will be supporting her for the reasons that supervisor wiener outlined, really about striking that balance between promoting entertainment, but at the same time making sure that the needs and concerns of different communities and neighborhoods are taken into account. and the public health piece is so critical to this area. and i also think that ms. akers will also be the kind of commissioner, like terrence allen was, that is not only, you know, doing the homework and making sure that the work at the commission meetings is taking place, but also doing outreach in the community, and working within the community, which is a very important function of the entertainment commission. so i will be very happy and proud to make a motion to move
3:27 pm
forward with a positive recommendation, naomi akers to the entertainment commission. >> chair kim: thank you. we do have a motion to move forward naomi akers with recommendation to the full board. i also want to thank all the applicants who are here today. it's always great to have individuals that want to serve. this seat in particular is unique because it does represent the public health community. and we certainly want someone who has expertise both m public health but specifically the entertainment and night life industry. i think ms. akers, you've shown clearly -- you've demonstrated your dedication previously to working on these issues. i was really interested in learning more, in the future, about your assessment of exotic dancer in our night life industry. i think that's interesting. safety can be looked at from a public health perspective versus a police enforcement perspective
3:28 pm
and i think it would be really interesting to hear more on whoo we can do around that category. as a woman i think there's a lot that we can do around public health and night life, not just for women but all sorts of entertainment. so i would be excited to support you today. i do want to thank both mr. alexander and mr. grillo for coming before us. mr. alexander i know you served on the immigrant rights commission. i fortunately when you served on that and you're incredibly dedicated and knowledgable about immigrant communities. today my support stems from an applicant with specific experience in the arena that this seat is supposed to represent. thank you. we have a motion and we can do that without opposition. thank you. before i call the last three items, i did want to open up for public comment on items 7, 8, or 9. seeing no public comment for 7,
3:29 pm
8, and 9, public comment is now closed. may i take a motion to convene into closed session? >> so moved. hold on. >> when i got up before -- before you go into closed session, i know that will be over with, then i can leave and go home and get back in bed. i have a concern about the item, it says legislation under the 30 day rule. >> chair kim: yes. so we do have legislation under the 30 day rule but that's not being heard today. that's under the 30 day hold for the public to view legislation but it's not being heard at committee so we
