8:30 am
i wonder if we can come together and bring the two parts together to have that conversation. >> absolutely. we started that conversation with ms. lam, trying to think creatively around how we can make something work. because of the space is still tight there, this is exactly the kind of conversation we want to continue to have. we utilize volunteers for all stages of development. it is a terrific idea frankly to incorporate maybe some of the landscaping and including him in that process. >> ms. lam? do you think your father would be interested in volunteering his services? >> my dad would be interested. the problem is that he has a tough time getting around.
8:31 am
the way that it is now, there is the fence back there, and we have created a door to give them access to that area within the fence. he does not have to leave the house in order to be able to do this. they're going to put a retaining wall and a shrub, the shrub will be about the same size as the garden. i am not asking to own the property. i am happy to buy it; willing to sign waivers of liability a what have you to make it to where they will not be liable for anything that could possibly happen. is really just for my dad to have access to the area to garden. if there will be a shrub behind the wall,
8:32 am
why not just move it up? they just don't want to because it could potentially delay the project. >> that's it for my questions mr. chair, mr. president. i would like to go on record and ask that habitat for humanity reconsider their position. sound like a small request. you are in the business of building communities and hopefully you will work with ms. lam and her family, to where her father can help with the landscape or the property. out of the many problems we see, this is a nice one to put it nicely. thank you very much. >> supervisor avalos.
8:33 am
>> supervisor avalos: before the board meeting today i was in my office with the appellant, ms. lam and with habitat for humanity, trying to see what we could do a negotiate some kind of settlement separate from this appeal. i really feel that the appeal does not have strong merit. i will not be supporting or upholding the appeal. having said that i still believe that there is some agreement, some negotiation that can continue on access not necessarily access to property for gardening for ms. lam's 83-year old father, but habitat is made an offer to help build the growing areas within ms. lam's yard with
8:34 am
volunteers and that is significant. we are seeing 28 new units of affordable housing. we have not seen anything like that. we are talking about a program about how to make low income families economically viable to on their own homes. those are significant things. the best accommodation is to build something worthwhile in ms. lam's backyard or finding other resources than the neighborhood that can assist her grandfather. i will not be supporting the appeal. and would like to motion to table item 27.
8:35 am
and approve -- actually approve item 28 and table items 29 and 30. >> president: let me close the hearing. are there questions? supervisor chiu. >> supervisor chiu: not a question but i'm hearing from habitat if you're willing to resolve the issue. i appreciate hearing that from habitat directly. i will second supervisor avalos's motion; the merits of the appeal, they have not been significant changes to grant the appeal on the parcel map. that is the right motion to make. as he also mentioned, the opportunity to build
8:36 am
single-family affordable units is something that is rare in the city. it is an opportunity for homeownership for individuals of the different income level that typically have not had the opportunity to purchase homes. when i first read it, it is one of the amazing projects rarely see, heartened by the fact that habitat is willing to work with ms. lam to resolve the issue. >> president: the hearing is final. supervisor avalos has made a motion that we approve the decision of dbw, second it by supervisor chiu. any further discussion? roll call vote. madam clerk. >> >> supervisor breed: aye
8:37 am
>> supervisor cohen: aye >> supervisor farrell: aye >> supervisor kim: aye >> supervisor mar: aye >> supervisor wiener: aye >> supervisor yee: aye >> supervisor avalos: aye >> president: motion approved. tentative map is approved. let's go back to item 20. >> can we do this same house same call. , ordinance passed first reading . item 21. >> supervisor wiener. >> supervisor wiener: this is an exciting item to landmark twin peaks tavern, on castor street. an exciting day for the castro
8:38 am
and lgbt community. the bar has recently celebrated its fortieth anniversary. twin peaks was the first gay bar to be open and visible from the street in terms of windows where you could see inside the bar. that was a huge step. and a coming up for our community for so many years gay bars have been hidden away so you cannot see inside. it was very secretive. as our community cannot, twin peaks helped lead the way by having a bar. you could see who was inside. it welcomes all ages. we have a continuing challenge in the lgbt community of
8:39 am
celebrating youth to the point that sometimes older lgbt people don't feel welcome in the community. in twin peaks you see young people and old people and everyone in between together and building community. i want to thank the planning staff. tim bryant, mayor brown i hear from planning and the department has done a lot of great work on this land marking and i am fully supportive. i ask for your support. >> president: supervisor campos. >> supervisor campos: i would like to thank supervisor wiener and would like to be added as a cosponsor. >> president: without objection this is past on first reading. item 22.
8:40 am
>> amends lower distribution of smoking residential rental units designate units a smoke-free or smoking optional. >> this ordinance is important to help increase the number of smoke-free apartment buildings in our city. it brings together landlords and tenants organizations to help inform prospective renters of possible sources of second hand smoking buildings. i will like to thank the san francisco department association and housing rights, and my legislative staff for doing hard work on this ordinance. the hazards of secondhand smoke as we heard earlier well documented. is a killer of 49,000 people each year, 3,000 from lung
8:41 am
cancer, 46,000 from heart disease. the smoke seeps into your unit. this can result in a prospective tenant finding out that they are exposed to secondhand smoke after they signed the lease. this policy will allow prospective tenants to make informed decision about the unit under consideration and if it meets their needs disclosure also benefits landlords. the smoke-free housing policy requires that owners designate units is either smoke-free or smoke, optional. no leases can be change midway. once the designations are made
8:42 am
owners must include the designation, and to any applicant prior to entering the lease agreement. this list will be updated and available to all tenants. for owners of 50 units or less in the city have one year to comply; orders of 50 units or more have two years. this ordinance would bring san francisco in line with other cities that have similar policies. it is meant to encourage disclosure. as such there is no enforcement mechanism built into it i strongly urge your support. >> supervisor yee.
8:43 am
>> supervisor yee: i will be supporting this. have not had an opportunity to discuss this with you or anyone else. one of my concerns - could be something that the department of health or whoever is going to enforce this. the fact that you have two categories. 50 or less, 50 or more. how do we educate those landlords that basically are mom and pop type landlords? the live on one flat and there is another flat. one of the issues with smaller homeowners, property owners,
8:44 am
they seem to be not as sophisticated and aware of all these new things that go on. i will like to see some education program do some outreach. and make sure that their tenants will have the benefits. >> supervisor mar. >> supervisor mar: that's a great suggestion. the department of health is working with tenant organizations. making sure that not only representative groups but smaller property owners have multilingual materials. the department of public health has been working at the small business level and other places and we need an outreach policy.
8:45 am
that's a great suggestion. >> i want to thank supervisor yee of raising the issue of small mom-and-pop landlords who may not always be aware of all the regulations and we need to outreach to them. in addition to the apartment association, -- >> i forgot to mention that supervisor malia cohen is a cosponsor. >> president: can we take this item same house, same call without objection this ordinance is passed first reading. >> item 23.
8:46 am
>> same house same call, ordinance passed in first reading. >> item 24. amending the campaign and government conduct code. >> president: same house, same call. passed on first reading. item 25. >> >> enforcement provision for clipper cove. >> president: same house same call. ordinance passed on first reading. item 26. >> supervisor wiener. >> supervisor wiener: thank you very much missed a president. this item is a long time in coming.
8:47 am
a number of us have been trying to find a good occupant i see. market octavia cac is critical in terms of providing guidance for finding an apartment and for us about development and public space and transportation issues in the market octavia plan area. i work closely with the cac and i know other colleagues do as well to make sure we have good community by ins for these improvements. i am supporting nick wolf. i would like to make a motion to remove mr. -- name and add mr. wolf. mr. wolf works at the lgbt
8:48 am
center almost to graphically at the center of the market octavia area, strongly connected to the cac is important. nick does economic development work at the center working for a number of different communities and the center does some excellent economic development work. he previously worked on the -- project in -- valley. he has my support. that is the motion i make. >> president: supervisor wiener has done a motion to substitute nick wolf by -- >> i second the motion by supervisor wiener. i too had the opportunity to work with nick wolf. he used to work at the -- a working-class neighborhood
8:49 am
and he organized the merchants. he is a phenomenal human being. i am excited to see him continuing to serve san francisco and we are lucky to have him. i hope that you will support nick wolf today. >> supervisor kim. >> supervisor kim: i had the opportunity to hear both from matthew steen and nick wolf. initially i did support matthew steen, -- someone who is very familiar with many of the issues that lower-income residents face in the area plan. after some of the discussions over the last several weeks i'm happy to support nick wolf today for the seat and look forward to seeing if there are other ways that we can give matthew steen voice and other committees here in seven cisco. >> president: supervisor wiener has made a motion to amend nick
8:50 am
wolf's name. without objection. on the underlying motion, if we could approve that without amendment. we can do the motion to amend without objection but we do need to roll call on the underlying motion. >> on item 26 is amended. >> supervisor campos: aye >> president: aye >> supervisor chiu: aye >> supervisor cohen: aye >> supervisor farrell: aye >> supervisor kim: aye >> supervisor mar: aye >> supervisor wiener: aye >> supervisor yee: aye >> supervisor avalos: aye
8:51 am
>> supervisor breed:aye >> the motion is approved. roll call for introductions. >> will start with supervisor campos. >> supervisor campos: i would like to an in memoriam for a special person that unfortunately passed away december 26, 2012, rebecca -- a beloved environmental activist, and the first person to lead the rain forest action network. rebecca died while vacationing with family in mexico with her husband and close friends. she spent her life traveling the world traveling the exploitation of rain forest, championing the preservation of natural resources and human
8:52 am
rights winning numerous battles in the ongoing fight for the help of our echo system. two months before her death, rebecca led the nonprofit that she headed to the most historic victory in the organizations history persuaded the disney company they use only paper that did not come from an endangered rainforest. rebecca said, we don't always know what creates social change. it takes everything from science to faith. it is that fertile place right in the middle we really exceptional campaigning happens. and that is why i strive to be.
8:53 am
i would like to do this in memoriam. may she rest in peace. the next item, a number of you have heard about. that is, a charter amendment that i am introducing today that is get the six votes we'll put a measure on the ballot before the voters of the city and county of san francisco to give the opportunity to rename our airport the harvey milk san francisco international airport. a lot of has been said about the renaming of the airport.
8:54 am
the one thing i'm committed to is to make sure that we have an open and transparent process. all of us as individuals, whether we think about it or not, have a special relationship with our city's airport. while it is important for me, and this approach was to make sure that whatever happened, at the end of the day we gave the voters of the city and county of san francisco, the ultimate say. i would like to thank my colleagues on the board who have signed on as cosponsors. beginning with my colleague from district 8, supervisor wiener. i want to thank you supervisor as the two openly lgbt members of this body. is truly an honor for me to bring this item forward, with your cosponsorship.
8:55 am
i want to thank supervisors avalos, mar and kim. between now and the time that this item goes to committee, and the item comes to the full board, i look forward to the opportunity of having conversations with all of my colleagues about this important item. i welcome any input and insight that people have about the process and the underlying substance of this proposal. i also want to take this opportunity to thank and number of individuals that have been helpful and supportive getting us to this place. i want to begin with stuart milk, and the immediate family of harvey milk, strong supporters of this item including the harvey milk foundation.
8:56 am
the family is a family that has gone through a lot. i know this is not something to take lightly i appreciate their support .i want to thank people who knew harvey, and were close to harvey, and gave me the guidance whether or not to proceed with this. including a seven member -- -- jones was another icon in the lgbt committee and former supervisor harry britt, who had the honor of being appointed to the seat following harvey's assassination. i want to thank other leaders of the lgbt community including
8:57 am
-- who represented district 8, now represented by supervisor wiener, as well as treasurer jose cisneros. i think there are many things to discuss in this process. there are many questions to be talk about including the question of whether or not an airport should be named after an individual to begin with, and if it is an individual, who that individual should be. i cannot sit here and say that there aren't and number of individuals who are deserving of this honor. the reality is that one of the amazing things about san francisco is that over the last couple of hundred years of our history we have had some pretty amazing people live in the city and county of san francisco. people from all walks of life who have made tremendous contribution to the city
8:58 am
and in the process not only made seven cisco better place and made the state and the country and the world a better place. the reason i moved forward - in a factor deputy attorney for his support and drafting this as well as city attorney. the reason is a very personal one. for me, coming to terms with my own sexuality, not on the density is not something that happened easily. unfortunately for many of us who are members of the lgbt community is a process that many of us have had to go through and many of us are going through. the one good thing happening is that the process of coming to
8:59 am
terms of who you are is becoming easier for a lot of people it is quite gratifying for me to see so many young people for homecoming out is a member of the lgbt community is no longer seen as a big deal. the fact remains that there are numerous airports in this country and in the world but in fact are named after individuals. there are in fact more than 80 airports in this country alone that have been named after individuals. it includes all whole range of people; includes presidents, aviators, military heroes, entertainers, people ranging from ronald reagan
