10:30 am
priority. and there are many reasons why the community feels that the license will not service the convenience of the community and the list is 22, reasons that have been given to you. and i just a brief list. and the community is saying enough is enough. you know, when could i have the overhead? >> when walgreens posted back in march of 2012, they notified the community that they were going to have a liquor license at 135 powell. the reality is not just there but also 149 powell because they are taking over lories. the neighbors did not know that there was going to be a super store at the time of posting. we also question the proper posting of the notice.
10:31 am
walgreens says in the packet that you have gotten from them that they are only going to be getting three percent of their sales will be coming from alcohol. well, do they really need three percent extra income from alcohol? so. there is just many concerns, they were not addressed in the community out reach meetings that took place long after the post this posting took place at on the window so the community did not know at the time that was going to happen at the site and it is time for the citizens to are heard and enough is enough as far as alcohol licenses. okay? thank you. >> thank you very much. >> is there any other member of the public who would like to speak? seeing none, public comment is closed. and let me just go back to a
10:32 am
comment that i made earlier. i just realized that the item that we are talking about is a district three item and so my reference was involved in six and so i apologize to the applicant for any negative inference in my comments. my understanding is that a request for a continuance, i have not heard anything from the district supervisor in terms of you know being against the request. i understand from public comment that there is, you know, there are some legitimate concerns here. so, colleagues? i don't know if there is any motion? >> i just have a question and i appreciate the letter from the alliance for a better district six and mr. nolty, both their comments and i share concerns about the over abundance of
10:33 am
liquor licenses in that area of the city especially around the tender loin and i see that in the abc record that there is a number of other letters of protest and i am wondering if we could have a summary of if they are smaller businesses. do we have a sense of the letters of protest? i think that there are 14 letters of support and a handful of letters of protest. but do you have a gist of what those protests were? >> as you corrected stated
10:34 am
there are recorded 14 letters of support for abc and for recorded letters of opposition to the abc. i don't have those letters in front of me, but they all seem to have the same theme as you brought up as the over saturation as well as a high crime plot area. >> and i do see the conditions recommended by you and and the department, that limits the hours required for clean up and minimizing the nuisance and i sigh those as well and your recommendation is to approve so this is very helpful. is there a way for us to access those letters of protest before
10:35 am
those hearing happen? if they could be placed in the packet or a way for us to easily scan them before these meetings? >> yes, i will have those for you at the next meeting. >> thank you. >> okay. great. colleagues? any comments or any other questions? i know that there has been a request by the applicant to continue, and my understanding is that the district supervisor does not have an issue with that, and in light of that i think that probably makes sense. i have to say though, that the comments and concerns from the public are you know, very legitimate concerns and i certainly look forward to a resolution of those concerns. so colleagues, if we could have a motion to continue to the call of the chair? >> motioned by supervisor mar. >> we could do that without
10:36 am
objection? >> thank you, if you could please call item number four. >> item number four is a hearing to consider the issue ans of type 42 on-sale beer and wine public premises license to jordan lewis and case lewis for the folsom street foundry, located at 1425 folsom street. >> thank you, now we will hear from the applicants. >> good morning, supervisors and members of the public, i am case lewis and i am here with my brother jordan lewis and we are here to answer any questions that you may have. >> good morning, supervisors my name is jordan and a overview of what is the place is going to be. we believe that we have a novel idea for a art gallery in the solma area, and the type of art that we are going to be show casing is concept artwork and
10:37 am
it is an under served style of artwork that is primarily used for the creation of video games, movies, fashion and industry. it is drawn on computers, photoshop, corel painter and thus, l is not a hard copy of it. what we have done is put an array of monitors that can slide show and show this artwork which is very eye catching and i think that it speaks to a lot of people in the san francisco area that are involved in you know creation of these video games, movies, high-tech and we are hoping to serve that market by having a interesting area where creative professionals can come and enjoy this artwork and relax with a glass of wine or a cold beer or a cup of coffee. and that is just the basic overview of our venue. and we are getting a good
10:38 am
response from neighborhood and they are looking forward to us opening from everyone that we have heard and we just hope to move forward. >> a quick question, have you reached out to the district supervisor? >> we have not, spoken with her directly, accept for the letters that we sent. >> if you could speak into the mic. >> we have not spoken with our supervisor directly, simply the clerk and the letters that we sent explaining our operation. >> to be honest with you, the fact that this goes back to my prior point when i spoke about the wrong item, but the point is that it is always a concern for me when someone comes with this kind of a interest and they have not actually done the out reach to the district supervisor. and that is not a good way of
10:39 am
approaching these kinds of matters and it certainly does not leave us as members of this body. but i would imagine that members of the community with a great degree of confidence, when the elected representative for a particular part of the city has not you know, received the kind of out reach that normally you would expect. >> we apologize, and we had not spoken with her. most of our out reach has been to the local community surrounding us and we have been developing relationships with our neighbors all around and everyone that we have spoken with with the local business owners nearbies and the people that live in the nearby apartments and condos they have given us support. they like the idea. >> and so supervisor yee? >> campos, your previous statement and i just want to reinforce this that i would
10:40 am
like to see you reach out to your representative in the district. >> we will absolutely do that. >> great. >> do we have any comments from the police department? >> good morning, supervisors. cristina west on behalf of lewis k has filed an application with the department of alcohol beverage seeking an on sale beer and wine bar for folsom street, for the purpose of this hearing, the department, abc seeks a determination from the board of supervisors as to the approval or denial of this license. the police calls for service from 2011 to march for the entire year was one call as well as there was no records of
10:41 am
any police reports. >> this particular premises is located in plot 242. and the applicant premise is located in a high crime area. the premise is located in the census track 128. located in undue concentration area. and there were no letters of protests nor were there any letters of support. the department recommendation is based on there is no opposition from southern station. the alcohol licensing unit of the san francisco police department recommends approval. the following conditions have been recommended to the california department of alcohol beverage control. number one, sales, service and consumption of alcoholic beverages should be permitted between the hours of 4:00 p.m. and 12 a.m. every day of the week. off sale consumption is
10:42 am
prohibited >> loitering to stand about and linger without lawful business is prohibited on any side walks or property ajay sense to the premises. number four, no noise shall be audible beyond the area under the control of the licensee at this find on the abc form 8257. and finally, number five, the interior lighting there in shall be sufficient to make easily decertainable the appearance of the patron and that the portion of the premiseses where they are sold, delivered or consumed. thank you. >> thank you, very much. >> and colleagues, any questions? for any of the presenters? why don't we open to public comment, any member of the public who would like to speak, please come forward. you each have three minutes. >> hi, michael nolty of the
10:43 am
executive director for a better district sick. >> you receive a packet. and the alu, and it says no letters of support and no letters of protest. that will mean that the applicant did not do any real community out reach. right there, it will make it clear, and it is really did some community out reach and there would be some letters of support. people are made more aware of the establishment and possibly protesting it. normally how the alliance would handle this, the percentage of the food sale, that all food sales will have and that they will have to purchase food before purchasing drink if they were going to have alcohol, they have to purchase the food not just going in there and get the alcohol, so, that would be
10:44 am
our concern. and i think that the other that the police have put on it are acceptable. because that is normally some of the things that we normally ask as a community organization, it is just a shame that i have to come down every time that there is a liquor license multiple times, obviously, because they don't reach out to the community and this is on, this is volunteers. so, but, i appreciate a new business coming in. we do need new businesses. and hopefully, this one will thrive in district six and we welcome to the community. thank you. >> thank you, mr. nolty and any speaker? seeing none, the public comment is closed. colleagues? >> so i move this, item to be continued? >> so we have a motion to continue to the call of the chair?
10:45 am
>> yes. >> so, would i encourage the applicant to please reach out to the district supervisor, and i know that they want to have an opportunity to talk to you. and i would also encourage you to reach out to the rest of the community, i think that it is only that could only help you something that could only help you. so without objection, thank you. >> if you could please call item number five. thank you mr. chair, item number five is the hearing to consider the issue ans of the on sale beer license to angel davis and nguej lay for 7682. >> i am here to ask permission to open a beer and wine bar at
10:46 am
315 ivy in haze valley. i have been managing the building for at last ten years and my best friend and partner angle davis and i would like to open a wine bar there and i was born and raised in san francisco. i went to schools all in the richmond. >> yeah, the richmond district. >> the same as my father who went to all three schools. my father operated and ran a deli a couple of blocks away from here for 40 years. is he now working with my grandmother up on market and church. she also has a deli up there and she is 85 and still up there going strong. and as a native san franciscoan i have seen the city change a lot especially the haze valley, i have chosen the haze valley to want to continue my family's tradition of opening a small business and helping the neighborhood continue to grow,
10:47 am
and hopefully the people can come and have a glass of wine and beer for many years to come. for the past couple of months we have been doing a ton of out reach including talking to our supervisor and i am going to let angel come up and explain what we have done. >> great, thank you. >> good morning, supervisors, my name is angel davis and i am one of the owners of thstle and i am a third generation and we have lived in district 7 since 1954. and i guess about our space, we are a very small wine and beer bar we will focus on regional boozer as well as cheese and meats and so we can't to focus on the bay vendor and help out on the economy and getting the farmers across the bay and want to be able to know everybody that is brewing our beer and making our wine so we have a
10:48 am
direct connection with the community and be able to share that with our patrons and i am not sure what it shows in your packet and i brought in letters of support because i think that our original packet from the police and say that we have one letter of support and i brought in a packet to the clerk last week and it shows only 20 letters of support and the petition that we went around in the neighborhood and asking them if they would like to see a type of space like ours in the neighborhoods. so we have over 100 signature theres and i brought that with me in case you did not have that. but i did not make enough copies. >> actually i do find the strong letters of support from the merchant's association and even your e-mails where you adjust the hours. >> yeah, i did. >> and congratulations on working with the neighbor and the merchants as well. >> the reason why i like doing this type of work is because it is very come munal and it is very and you can reach out to people and i like that type of environment so i want to create
10:49 am
that with my space. and we joined the neighborhood association and the merchant's association and we have been going to all of the meetings and just hearing the different things and they want more non-alcoholic drinks and so that everybody can come in and have a good time and we want to be here for a long time and be able to support the community and the city that we live in. >> okay. thank you very much. >> we can now hear from the police department. >> representing san francisco, police. lay has filed an application with the california department of beverage control seeking a license for 313 ivy street and for the purpose of this hearing, the california department of alcohol befrage control seeks a determination to the board of supervisors as to the approval or denial. >> from the time period, july 2011 to july, 2 on 12, there is no calls for service at this
10:50 am
location or police reports. this is located in plot 558. and applicant premises is not located in a high crime area. >> it is located in the census track, 162.00. and the premises is currently located in an undue concentration area. there was no record of any letters of protests with the california department of alcohol beverage control and no record of letters p support and there is one letter of support that was registered with the northern police station. no opposition from northern station, and as long as they agree to the recommended conditions. alu recommends the following conditions. number one, sale, service, and consumption of alcohol, beverages will be permitted between the hours of 11 a.m. and 11 p.m. sunday through thursday and 11 a.m. to 12 a.m. midnight on friday and saturday
10:51 am
evenings. number two, the sale of alcoholic beverages for off-sale is strictly prohibited and no noise shall be atritable. >> angel davis one of the officers who just spoke was contacted and agreed with the above conditions. thank you. >> thank you very much. unless we have any questions or comments why don't we open it up to public comment. any member of the public who would like to speak on this item come forward >> seeing none the public comment is closed again we want to thank the applicant and you know, from my perspective you can see the contrast between the applicant who has done the kind of out reach that you want to see and someone who has not. the out reach is greatly appreciated. supervisor mar? >> i just wanted to say that this is probably a model effort to engage the neighborhood and even the petition to the haze valley farm and the merchant
10:52 am
and the neighbors. it seems like that the community really wants this. >> and of course, supervisor yee would want it to be district that do it right >> very happy. >> i would say, i would make the same comments that i would like to comment the applicants for their out reach effort. i mean this is stark contrast compared to the other applicants that we have seen today. >> great, if we could have a motion to move this item forward? motion by supervisor yee? if we could take that without objection? >> thank you. >> mr. clerk, if you could please call item number 6. >> item number 6 is a hearing to consider the issue ans of a type 42 on sale beer and wine license to lyne carmichael for
10:53 am
eno saint francis for 310320 geary street. >> i am with the law firm and we have been working with saint francis to get a type 42 license of wine and beer, although it is mostly wine. and on the south side of geary in the building that houses the saint francis hotel. there is one other eno wine bar and two other bars in california, one of them is in half moon bay and the other down in san diego and they are kind of a nationwide effort to have a quiet place to have a glass of wine before your dinner or after your evening's activities we will not be opened late and we are right there near the theater and near union square where there are a lot of tourists and a lot of people from the region, as opposed to the neighborhood. so we intend to serve that
10:54 am
group of people with our very quiet and nice up scale wine bar it will have wines from all over the world, snacks, but not meals. and chocolates. the mix of alcoholic beverages to food items is about 7030, which is pretty good for a wine bar. we received no opposition, we have not spoken to the supervisor for quite some time, at the time they indicated that it was not an issue. so mostly i am here to answer any questions that you might ask about operations. thank you very much. and i don't know and i don't see any questions from we can hear from the police department? >> thank you. >> thank you very much. >> for the presentation. >> inspector rich van coal representing the san francisco police department, they have filed an application with the california department of
10:55 am
alcoholic beverage control seeking a type 42, which is an on-sale beer and wine public premises license for 310 to 320 geary street in san francisco. >> for the purpose of this hearing, the california department of alcoholic beverage control seeks for the approval or the denial of this license, from the time frame, july 2011 through july, 2012, there was ten police calls for service, no police reports. this premises is located in the plot 166, this plot had 372 police incidents recorded for 2011. located in the census track, 123-02. the premises currently located in the undue concentration area. there was no recorded letters of protests with the california department of alcoholic beverage control. and there was one recorded letter of support with the california department of
10:56 am
alcoholic beverage control, there is no opposition from central police stations as long as they agree with the recommended conditions. the alcohol licensing unit portion of the san francisco police department recommends approval. the following conditions have been recommended to the department of alcoholic beverage control. >> nufm one, sales and service off beverages shall be permitted only between the hours of 10 a.m. and 12 a.m. midnight daily. and number two, no noise shall be audible beyond the area of the control of the licensee as defined on the abc form 257. >> finally number three, the petitioner shall utilize the electronic surveillance as able to view the outside of the premises including all entrances and exits and that is monitored and recorded. this surveillance shall be utilized during the operating hours. said recording shall be kept at least 30 days and shall be made available to the department and
10:57 am
police department upon demand. and on 117, 2013, karin bau was contacted on behalf of the applicant who agrees on the recommended conditions. >> thank you, very much inspect or. >> seeing no more comments or questions, why don't we open it up to the public. >> any member of the public who would like to speak on this please come forward. >> yes, michael nolty. executive director of alliance for a better district six. i want to point out that both walgreens and the establishment was in district six during a redistricting process, they swiped us away and so any way, i want to point out that we did write a letter of support, but i also want to point out that they did no out reach. so, if you are shaming everybody for not doing the out reach, it starts here too.
10:58 am
when they posted it was not clear, if it was st francis hotel or if it was st francis hotel asking for a liquor license or a different entity, it was not until we get the packet for this meeting that we realized that it is actually an entity that has because they did not do the out reach to the community. and so we thought that it was the hotel opening up a bar, under its name. and in reality, it is a chain of bars that are opening up and they want to open up at this location. and we do agree with the conditions that are set out by the police department. but, again p the issue of out reach, i think that it should be pointed out that you know, these applicants need to do the community out reach so that everybody, and just assume that there is no organizations or no residents and all of that, well
10:59 am
that is hucky puck they have to work with everybody not just the merchants. and so, any way, i will say the same thing, welcome to the community and hopefully if you get it today, congratulations, but, shame on you for not doing out reach to the whole community. >> thank you. >> is there any other speaker on this item? >> seeing none, public comment is closed. and i thank everyone for their presentation and i think that hopefully, if there is one thing that is clear, following this meeting is that every member of this committee is interested in making sure that when you are applying for these kinds of licenses that you are doing out reach to the community as much as possible. so hopefully the message has gotten across. colleagues? we have a recommendation from the police department we, have a motion? >> so moved. to accept the recommendation by the police department. >> so we have a motion and if
