[speaker not understood]. but they denied it. they said it couldn't be done. [speaker not understood]. one car totally destroyed by people speeding. [speaker not understood] thank you. >> thank you very much. are there any other members of the public who wish to comment today on item number 4? seeing none, public comment is closed. mr. fong, would you like to respond to some of the comments we've heard? >> supervisors, john kwong for department of public works again. i'd like to thank the neighbors and citizens for providing that video. the video actually provided more clarity i think to the members of the board in this case. if you notice, they're showing the rainwater is actually running down along the retaining wall where the gutter line is and it continues to run down. and at the very end when they were showing upstream, there was a driveway cut immediately above it. so, if there was rainwater that
8:31 pm
was jumping and it would jump theoretically as they suggested, jumping over the sidewalk, jumping over the curb onto the sidewalk, it would have happened previously. the picture doesn't show that. the video didn't show that. also they showed the sidewalk that's running down behind the retaining wall. while it was wet, there was no runoff. there was no rainwater that was noticeable running in a stream like a [speaker not understood] in this case. so, there's nothing that was happening that we can demonstrate that can be clearly demonstrated even on the rainstorm that they're suggesting. finally, there was a previous video that showed rainwater running along the yard at the front yard area further down on a previous video on the last presentation that we provided. well, one thing we recognize. with the construction of the building as proposed, the footprint of the building, all that rainwater that would normally run down the hill as rain would be capture and had brought into the rainwater leader that would be discharged
8:32 pm
into the sewer line. that would actually reduce the amount of runoff that would run down the street. there was a suggestion also by an applicant, by one of the citizens here, that disability access was not considered. the department did as part of the evaluation the design to the disability access coordinator who evaluated the existing condition and the modified condition and determined that in this case it was an improvement over the existing condition and satisfied all the requirements as identified under book title 24 in a-d-a. >> can you address the issue of does it change -- in term of the change of the grade in the sidewalk? one of the public commenters mentioned that. >> yes, supervisor. it did change the grade, and actually in one instance it improved it. previously the property uphill of this site reconfigured a silo to show a 35% slope through the sidewalk area. this design reduced that 35%
8:33 pm
slope to approximately 16%, which improved the configuration of it and also made it a little less steep specifically. so, there were some improvements made to improve the walk ability of the sidewalk. >> thank you. anything else? * >> those are all the comments. the suggestion to continue the evaluation, we do not believe is appropriate only because in this case the reviewing engineer stating that there were concerns, but from a factual perspective stating that [speaker not understood] this satisfied the requirements. the concern was mostly over a quick software analysis, not necessarily detail of the design specifically. so, we believe the design was appropriate. its was evaluated correctly, and we don't see a reason to
8:34 pm
continue it even further as requested by some of the citizens who don't want this to move forward. >> thank you. colleagues, any questions? >> if i could ask one question. the rainstorm thats depicted looked like a typical rainstorm. if we had a significant event, 20, 50 year rainstorm event, would that change your analysis? >> no. actually in this case, the analysis that was done was for the hundred-year storm, which is for every rainstorm is a 1% chance of happening, which is very rare in this case. and given the height of the curb, which is between 4 to 6 inches, given how steep that street is, as you can see how quickly the water is running down the street and entering the catch basin, it would actually be -- the height of the water that would go down on a major rainstorm would also be very low in this case. because you're in essence, the gravity is going to pull it down the street instead of having overflow and jump onto the sidewalk. >> okay, thank you. >> thank you. >> colleagues, any other
8:35 pm
questions? president chiu, at least nominal -- >> colleagues, obviously there have been some questions raised by the neighborhood, but we have heard from our department of public works their position to the contrary. big suggest that we move this item forward but without recommendation given the issues that have arisen. i know the district supervisor will likely be weighing in on this issue at the full board. but given how long this issue has been out there, in order for us to make a decision my suggestion is we move this forward without, again, the necessarily the support, but moving it through the process so that we can have a final vote on this at the full board. so, that would be my motion. >> thank you. further comment? >> i was going to say the same. i'm happy to second that motion to move it forward with no recommendation and also give our district supervisor an opportunity to weigh in as well. i know [speaker not understood] is watching this hearing. regarding the public comment about traffic cowving work that can be done on peralta, i'm sure they have taken that into
8:36 pm
account. thank you. >> i do agree that it's appropriate to put this forward with no recommendation because i think it is important for the district supervisor who is most familiar with all the surrounding circumstances to weigh in at the full board. last time this was at the full board, supervisor campos did send it back to committee, and i think we vote -- the board unanimously supported that request. given the holiday next week, we have two weeks between now and the february 25th board meeting. so, ample time for discussion. so, colleagues, if there is no further discussion, can we take that motion without objection? that will be the order. is there any more business before the committee, mr. clerk? >> this completes the agenda for today. >> thank you. we are adjourned. [adjourned] it's test, test, te,

project. >> item 17 is an ordinance to require all public works pay subcontractors within 7 days from the city. >> this ordinance is passed. item 18 >> this is a budget item for the housing authority as a priority. >> this motion is approved. colleagues let's skip over this next item and call roll >> thank you madam clerk today, i am happy to introduce with our mayor and supervisor scott wiener and we're going to talk about earthquakes. today would include soft
8:43 pm
buildings. in 2010 as some of you will remember i want to thank all of you who supported the earthquake and provision structure. this is to prepare for the big one. a lot of buildings were destroyed and the next one is expected to be more than 3 times the size of the average quake >> the most vulnerable 3 stories buildings will be renovated. i want to take a moment and thank the worker safrt group as
8:44 pm
well as the banging community that make the financial loans available. in the coming most there will be a separate bill coming up. wile we are asking tour owners to tackle this big project i look forward to working with the mayor and other. i want to take a moment to recognize 3 other supervisors >> mr. president, we're fast forwarding to supervisor farrell, supervisor kim. okay >> thank you madam clerk today, i'm calling for a special hearing for storm presentness. we're looking forward to working
8:45 pm
with the public utilities commission on our cities preparedness as you remember there was a storm that occurred and the out flow brew off a manhole cover and sent sewage water onto the beach and it went through 3 feet of sand and it resulted in bacteria leveled levels into the ocean. it resulted from heavy rain combined with other waters in the neighboring streets. as the reality of climate change it make sense to - that our city
8:46 pm
a taking care of of this. this winter symptom we will be prepared to meet the changes of the coming years. as i member of the air pollution board we've been looking at data on earthquake preparedness and also there maybe storms hitting other parts of the country with the same issues. i'm looking forward to working with the pb c on this. and a little bit later today, we'll be honoring our district school and i want to thank the reality hardworking teachers and
8:47 pm
site administrator for their 70 years of keeping your children save and closing the opportunity gap for many children over the many years. i'll be celebrating with them on friday and i urge you all to join us. >> thank you supervisor. >> thank you madam clerk i want to associate myself with president change of venues remarks. i want to stress with a significant step this has been. we've been talking about addressed the soft buildings and
8:48 pm
we know this is a top priority. in terms of actually making these soft stories a reality we've relied on others things that have not think successful. this legislation will set us on the path protecting the buildings and the resident who live in those buildings because we will be in a world of hurt if we have a significant earthquake and a significant number of these buildings are damaged or collapsed. it says a lot about the relationship of this board and the mayor. whether it's creating a affordable house fund or go
8:49 pm
passing bonds a lot of things we've talked about for years that have not happened and are now happening. it's very exciting. i look forward to moving this legislation forward. in addition to that i'm addressing another issue to talk about the efforts and strategies to reduce unnecessary stuff on our situation. our situations are the most important spaces it's important to have a free flow of pedestrians on that sidewalk. our sidewalks are clustered with a lot of news racks.
8:50 pm
the new mini bus shelter take up so much of our sidewalks it's hard for pedestrians to walk around them. i think it's a good time to take a step back and perhaps reduces the number of objects on our sidewalks >> see how much space they're taking up. and let's take a look at some the other things on the situation like chairs. >> thank you supervisor wiener and supervisor weighing?
8:51 pm
>> thank you madam clerk just a few items for introduction. first, i'm introducing two reductions urging the board to take care of firearm resolution. the firearm resolution is part of a national movement trying to control guns at the national level. we need to show support after all over the country including our city and countys. and it mansion that we remove the extra fund that were set aside for firearms >> especially, after what's happened in newtown connecticut we have to push while the fire is hot and keep the mood going.
8:52 pm
actually build the pressure. the other thing is we have about a billion there's in fossil file companies. we're making investments in those companies and we're not using our investments in a wise way. i think it mansion we divest from those companies and put our money in classes where we can make real change. so those are urging - those issues are important and it make
8:53 pm
sense we have a good dialog about it. the other i item i have is a hearing request and it's from supervisor wiener. last night we were urged to look at the mandates of training for lgb q youth. it was a law passed years ago about how lgb q effects the youth in the memory programs. and now we understand their noting taking care of the youth how they're to be trained and to
8:54 pm
be sure we understand about this issue which sexual orientation. so our hearing is geared to how the city is meeting this goal and how we can meet our 12 end arrangements >> thank you supervisor coming possess. >> thank you very much good afternoon everyone. thank you for joining us today, i want to bring to our attention that february 4th was the 1 hundred birthday of rosa parks. and i think we will be voting on a reduction today to recognize
8:55 pm
rosa parks. the other thing i want to speak today, i am the board representative for the retirement system when is dedicated to the trust act as well as distributing benefits. i want to shed some light on this process. first it is the policy it's a long-standing policy of this board to engage within a company and our ability to use our proxy to appeal to their human night and second to promote social rights and interests and third being investment restrictions and that's the selling off of
8:56 pm
8:57 pm
on firearms. it looks like the board is on the same track of thinking as the members of this chamber. thank you very much for your time >> mr. president, seeing no other names on the roster that concludes the call. >> i want to ask if you'd like to go to accommodations right now. >> now is the opportunity for supervisors to present honors and recommendations to members of public or those of their choice. >> thank you president chiu. let me start by saying there's some incredible administrators and site administrators and accident chief of the education department and i'd like to ask
8:58 pm
in chief and other supervisors (naming names) please come forward as we honor our department on the 75th anniversa anniversary. thank you so much for being here. today, i'm asking all my colleagues on the board in recognizing the education department open it's 75th anniversary. in the past 70 decades we've provided education opportunity for thousand or so of youth and this closing the gap for a lot of children's education. now we have over 10 education
