out of line to get their staff so he is right there on the service. and it is otherwise, there, and so no one is going to set up shop to be full time because it is only needed two times a week, that is a case where it is mobile and this has to be one of the things that is probably on your list and it is an important service for the people that are there during the limited time and imagine the financial services in a place where there is an emerging service and dog patch has no financial services today other than an atm at the liquor store and so it might be something where someone would come down and give us financial services a couple of days a week until there was an opportunity to put in the full service and these are form law retailers in many cases, but, even they are not ready to put down roots yet in certain neighborhood. and so i can see where this will be important for a whole bunch of different sort of classes and things and not just

opportunistic cools tips through retail which i think is interesting to me but also the vital services for community that are under served or emerging. >> that sort of ties in from what we are seeing, the program focus to balance the needs of neighborhoods that are not being met. >> it is exciting and a lot to it and it is very interesting and a nuance area. so we have a lot to get your arms around >> great. >> commissioner o'brien? >> very quickly, you made me have a thought there that you may know about the soft story initiative where they are trying to go into these soft story building and one of the big logical challenges that we have been contending with is how do the businesses operate while the retrofitting is taking place? and i just had a thought as you were saying that they could get the facility of getting a mobile vehicle to continue their business during the operation of the soft story retrofit.

on-line businesses. there was the futurists saying that brick and mortar is dead. now a lot of on-line businesses are saying that we would like to have a pop up presence, you see a lot of pop up stores or a mobile presence, so that we can just dip our toe in the water of retail. and maybe not even want to have a full time retail ultimately, but have it seasonal or geographically temporary. so, i think that this is an interesting time where it is sort of a hybrid business model to drive some of these that is the other, you know, it is just another facet to this multifaceted interesting area, so. >> exactly, it is not one problem, or one issue for each person, or business, it is very complex. >> it will be the leader, and the thought leader in this area. >> i hope so. >> commissioner riley? >> i was just thinking, maybe, go back and take a look at how the street artists permits were, you know, processed? and take a look at that and see whether or not we can learn

we have public comment on item number eight? >> good evening, steven cornel small business advocate and council district merchant. >> obviously there are very complex and there are good parts and bad parts. being an established retailer over the years, one thing that i think got to constantly remember on this thing is equality. if we have to, all of our business had to go through a bunch of things and do a bunch of things then they should be equal here. for instance, their argument about okay, we pay gas tax and these different things, just putting a sign on my building i went through a lot of permits to get that. electrical, i had to have it okayed by the city and looked like and everything else.

>> do they have to get a second permit for the sign? >> i don't know. >> how are you going to regulate this stuff if >> we have had these companies out there, since i was a kid. have you heard of snap-on tools, they have a truck and go up to professional garage and sell all kinds of tools out of that truck. no permit and they have been for years and still there and i think that they just changed their name to a different name and they go out there and do this all of the time. i have tried to call the city over the years saying, here is this guy out here selling, i can't find anybody who is going to go out there and regulate them and do this. >> whatever this is, it is very hard to regulate. >> it is brought up it is brought up the ada stuff and it is a nightmare and if you give them an exception, do i get an exception? i am thinking of a lot of push back out there. >> thank you.

>> thank you. >> any other public comment on item number 8? >> seeing none, public comment is closed. director? >> since the ada was brought up a couple of times just to sort of be clear on the orientation we are taking a look at that structure, and it is not so much, whether it is made part of a criteria of permitting or not. i doubt that any business would be exempt. they are a business of public accommodation in terms of being subject to lawsuits. so, we are really looking at it from a perspective of you know, if we are, if we are going to be permitting in on the public right-of-way, you know, i think that it is, it is sort of like what are the ada requirements and also, we don't want to be, we don't want to... if we don't

take in the ada into consideration, and we don't have any discussion around that and we do do a permitting process for these trucks to be on the street and they start to being subject to the lawsuits, we are back in the same place of the businesses not feeling like they have been informed. and so we just, you know, we are taking a look at it from the sole perspective of making sure that the business is informed to what degree are we going to be permitting on the public right-of-way? the businesses and dealing with ada compliance. and so, taking a look at it from the full perspective. nothing, in the way that the law is written, nothing is a blanket approval in terms of what we decide or not decide to do. >> okay. >> great. >> well there is no vote on this, so thank you, again, christian that was a great job and thank you it was very informative. >> next item.

>> commissioners, you are now on item number 9. presentation and discussion by nicholas king of the entertainment commission on limited live performance permits and this is a discussion item only. >> welcome mr. king. >> good evening, everybody. >> i will mostly just be talking, and i will use the overhead at a couple of points and i will try to signal so we know to switch. i'm nicholas and i am the deputy director of the entertainment commission and i will give a brief overview of our limited live performance permit. which is relatively new permit to the city. and i am happy of course, to take questions at the end. as you probably know the entertainment commission regulates entertainment and night life in san francisco. everything from live performances of all sorts to circuses to food and beverage service after 2:00 a.m. and after 6:00 a.m.. but today i am just going to

talk about the llp. for short. it is what it is called. >> but, i will start by talking a little bit about the place of the entertainment permit which is probably something that you are all familiar with, specifically or you have been to places that are places of entertainment and for many years, until recently, that was the main performance permit for any venue with a fixed address. and it is the permit that allows the venues to have djs or live shows, just about any sort, theaters with live stage performances or night clubs as examples karaoke places as another. and from the perspective of some businesses, there are problems with getting at places of entertainment permit. first it is not cheap. the fee to the entertainment commission is about 1800 dollars. and then, there are assorted

inspection fees from the other departments that we work with, some fire, building, electrical, health. all of those are required to be approved before the permit is issues. and in the end, it is probably somewhere between 2100 and 2500 dollars and that is assuming that there is no conditional use that makes it more expensive. which brings me to the second reason that someone might not want the place of entertainment permit and you will see this on the overhead is the availability of it. and so, sfgov tv, if we could get the overhead please? >> there we go. >> so you don't need, it is not very, it is hard to see detail. but you get the idea. so if you look at this color here and this white, beige,

whatever. that is for the place of entertainment permits are not allowed. if you walk into our office and you say, your address is in one of those, and you want to apply for a place of entertainment permit you are out of luck it is not going to happen. >> if you look at the green, that is where the use is permitted as of right. so you can apply for it. and the orange color is conditional use land. so, that is where we would probably send you back to planning to go through the process before coming to the entertainment commission. >> yes? >> what about limited live performance? >> i will get to that. >> so, as you can see the point is that this is fairly restrictive in terms of availability just land-wise, and in terms of cost. and also, with hours, the default hours of the place of entertainment permit are until 2:00 a.m. and it starts at 6:00 a.m. and i don't know who starts at 6:00 a.m. but it goes to 2:00 which is pretty late.

and so, the idea behind the limited live performance permit is that there is a demand for places that are smaller and have entertainment that is a lower impact than what they have. and then we do often, want businesses, people, in the regulatory, fold, so that we can help to make sure there is no nuance or behavior that is bad. and so i will show you the other. so basically, the limited live performance permit is allowed everywhere in san francisco except for here. so those gray areas you are looking at south of market. so, right here, is market street. and then, just for reference, that is fulsom and this is 5th. but as you can see if i had a large map and this will be a tiny portion of it. so pretty much anyone who walks in and wants to apply for it

will allow them to move forward with the application, there have been a few sad cases for people who are right on the edge and have to say no. but that is what the map looks like. and just to go over the other basic of the permit and it is the low cost and $380 and it comes from fewer inspections instead of making them go through the inspections we ask for a demonstration that we have like their fire occupancy and whatever they have for the department of health. and we will ask for two from the other departments instead of seven, which is the other place of entertainment permit. we will make sure that we reach out to the planning department. and sfpd. and they are still made for out reach. and there is still a notice that goes in the window for 30 days, and in advance of the public hearing and there are other specific requirements just to make sure that it does

not drift into the entertainment permit. so, the primary purpose of the venue cannot be entertainment. and it has to be indoors, the performance area has to be 200 square feet or less and entertainment, must end by 10 p.m. by the first year and it can go up after that. right about now is about one year since our first permit. so no one has asked just yet. but in theory, they could start coming right about this month. and last the definition of performance does not include djs. so in practice since this passed in the fall, early, winter late fall of 2011, we have had 35, venues, get the permit, a couple unfortunately are already out of business, but remainder are doing well. i don't know the neighborhoods. i know a couple of you, i don't know where the rest of you

live, though. but some examples of places that have the permit are blush, wine bar between 18th and 19th. >> belaruge cafe. and the cafe divine and two jacks restaurant. and those are just a few of the venues, so the restaurants, cafes and there are other odd ducks in there, that are not restaurant and cafe but those are the types of places ta we are talking. so far it has been a program and we are excited to want more people to apply and we get good food back from the people that have it and have been able to solve some swabblewise a couple of neighbors. due to the out reach process. and in the future we hope that more people pursue it. so that is the basics and do you guys have any questions? >> commissioner questions? >> commissioner white,.

2013. in the back of the report is the initial draft of the commission retreat, and i just wanted and i will be speaking with each of you over the next week. and i met with president adams, and we are going to have a very similar format, in terms of the first half of the day, kind of an update review, interest, objectives that the commissioners would like to achieve over the next year. i always like to have the city attorney come and do a quick refresher. it will not be nearly as extensive as last year's retreats since last year we had new commissioners and so we needed a more extensive briefing but we will have a quick briefing and then after the break, we will get into taking a look at the committee work that we are doing and set out goals and objectives and take a look at other pro-active ways that the office can be

working such as we have demonstrated with the mobile retail being out front on items and then, of course, get into some discussions about the budget plans in relationship to the out reach for proposition e. and actually that is... i left that off. but we will have a presentation on property and the transition from property as per your request. and so there will be, there is information for you for that, but then, to take a look at what is the commission going to recommend and see needs to be done to help our small businesses transition from to the payroll tax to the gross receipts tax. if there are any questions to have the opportunity to have any discussion now, but also we will be talking with each of you individually of things that you might want to see and want to accomplish in the retreat,

working jointly with that commission to sort of outline just exactly what our, what is the intent, since they initiated to do the joint commission meeting, what are the interests of out comes that they would like and the areas and the presentation and the areas that what we would like to get the information on. so, i would like to work with the out reach and economic committee on just drafting up the specifics of that. do you have any comments on that at all? >> okay. i will not go through the... you can read the legislative updates. and in terms of some additional policy matters. the 415628 area code, the state lobbyists will be our city state lobbyists will keep the city apprised as to the developments, as to what is

happening at the california pec on this matter of which then they apprise the mayor's office and the mayor's office will keep us apprised and so we will provide you updates when we have them. and, then, the affordable care act, so at our last meeting, i mentioned that i was attending a briefing with tangerine bring am from the department of public health. and so it turns out that there are some funding, there is small pot of funding that is available to do out reach and education. there is a short turn around time to do, or to put together a grant proposal. and so, we are having some discussions about what that looks like in terms of out reach to our small business and exactly what small business populations we will be targeting. because we do have small businesses that are sole

proprieter and they fall in that pool to mandate to purchase their own health insurance and we have a small business that has a workforce that may qualify for medicare or medicaid and a partially insurance plan under covered california and covered california is the exchange program, so how do we do out reach education, let businesses know, and individuals know what is ahead? i just wanted to, what was very informative, was actually the time line, while we think 2014 is the implementation date, but actually, there is an out reach in consumer phase that is to start on in may first to run through the end of june, june 30th. and then, and this is part of the state program's schedule.

and then there is the get ready, get set and so from... so that is another sort of out reach and start getting small businesses ready and informed about enrolling. and then, actual enrollment starts in october first 2013. and so it is coming a lot quicker. and, there are certain enrollment periods that businesses and individuals have to be enrolled in. time frames, so, it is, it is employ understanding that 2014, you know that people would just kind of get enrolled. but, there is very specific time frames of which they are saying, you need to be enrolled in. so it is almost like working for an employer that, you know, you have your, you know when you are hired you have your sort of period of which you are

elible for enrollment and if you don't enroll at that point then you have to wait until the next open enrollment date. so, it is still, what is interesting to me, is the fact that even though this is coming up fairly quickly, there is still a lot of unknowns, from at the state level and even at the local level to be able po impart and start informing our business and individuals. but, which is why i have been working with dph and other departments have also too, and other entities in terms of how we are going to work with this grant and do out reach and education. so i just wanted to mention that because that information is coming, this will be part of one of the initiatives that i think will be part of our office in terms of education that we do with businesses, also, work with the invest in

neighborhoods and job squad folks since they are going to be out in the neighborhoods. and so, i would imagine by early early to mid march. we will have a better idea. but, i think that it is going to be complex and then, there is a certain amount of complexity to it. and then, how and then also, the in addition to out reach and education about the program, how is the covered california and the exchange program and the affordable care act, how is that going to intersect with the san francisco healthcare security ordinance? and you know, how are businesses going to comply and how does that effect businesses complying with the healthcare security ordinance? so, more to come on that. and then i just wanted to let you know that
