everyone who is going to be participating in america's cup whether you are a resident, a visitor, a tourist from a bar, we will be using this. and this is is going to be an ex- potential medium for the rest of the world to see it. anyone who is carrying this becomes their own narrative, their own newscasters, their own magazine for own narration of what's going on here in san francisco. that to me is very exciting. i know that san francisco will deliver in its golden way that it always does and in the muld -- middle of that golden platter is a cup and that is called america's cup. thank you and good evening.
1:31 pm
>> good evening commissioners. we are with security and we are working with live nation as well. before i start i want to point out that we do a lot of different events and different venues. this is really a sailing event. so the type of crowd that we are attracting is a mellow crowd. it makes this event more enjoyable for all kinds of ages. also live nation has done a great job of picking out the type of talent does greatly with this type of event from a security standpoint our job is not going to be that difficult. we are dealing with a great crowd and everything seems to be okay. a few things real quick, i would like to commend and acknowledge the
1:32 pm
live nation organization. they have gotten everything down to detail. there is no surprises and we don't have anything unexpected happen and we are one step ahead of the game. this event definitely has enough space. pier 27, 29 is newly renovated and up to code so we don't have to worry about other things that come with old property or old land. the capacity plans seem to be great. they are estimate the capacity low for the stadium and the whole pier 27 and 29. we have identified bench points and assigned crowd control. and prevent any issues from happening. we have plans for crowd overflow and we are going to specifically focus on the side effects of those events. we are working with live event,
1:33 pm
they are going to contract us out to patrol the area surrounding the overflow as well. thank you. >> good evening commissioners. my name is bob, and i'm with the community which is established by the community. i want to commend for the way in which they have reached out to the community and facilitated a process that has good communication and constructed dialogue and it's been a very good process. the comment now on the amendments that you have received from live nation that came in an hour-and-a-half ago.
1:34 pm
i think those comments in general were responsive to the concerns that the neighborhood steering committee had raised several days ago however there is one concern that is outstanding and that is no. 5 with the possible use of pier 27 and 29 as a concert venue in the long-term. we understand the contract situation with live nation and understand what is supposed to happen under the contract and certainly will happen at the end of october. there is a number of residents in the neighborhood who do not want to see any concerts at all, not this summer, not next year, whatever. they are not in that category. so we think there does need to be an amendment on item no. 5 and
1:35 pm
recommend on a 3rd line in the end striking within the foreseeable future and strikeing the phrase proximate in size. with those amendments that would remove my concerns and give the citizens of the northeast water front comfort. in the end we want a successful america's can -- cup for local residents. >> hi, i'm in marketing manager for the restaurant. i'm here on behalf of our manager. i have a letter from him. i'm so glad that i attended last week's meeting in support of the america's cup concert series. while we understand there are concerns about the concert series and having the america as cup concert in san francisco
1:36 pm
along the historic water front is a gift to our neighborhood. as a business near the water front we are thrilled to have the concert series to our backyard and that is just what our neighborhood needs to remind tourist that this is what we need. we have a partnership between the america's cup and san francisco and feel assured that the traffic precautions will be tolerable on our guest behalf. we are appreciative of the challenges and know you will make everything possible for this experience positive for everyone as a whole. additionally we are thrilled to host in our restaurant and before and after the concerts. we are looking forward to having your guest begin and hope to add to their over all america's cup concert experience. would he like to be
1:37 pm
more involved in any support possible. cheers. thank you. >> thank you. >> yes, sir, welcome. >> good evening. i also live at the landing. i'm totally supportive of what they are planning to do. i think having music in the evenings is perfectly acceptable. it may not be my type of music, but it's not something we can't handle. i have lived on and off the hill since 1962 and i find
1:38 pm
the whole event building and it's really going to be sensational success in the city. thank you. >> good evening, i'm with bower transportation. we are in a world class city with a world class opportunity t city sometimes lacks the opportunity to bring artist to our city. with a company like live nation. we do work with companies all over the companies. we have done carnival and coach and they are on their game and they dot their i's and cross their t's.
1:39 pm
we've already been talking about transportation options to get people to and from the park and back to the areas. we'll make sure it's a smooth transition and you couldn't find a better partner and team to make it happen. i think it's a great opportunity for the city. thank you. >> thank you. >> good afternoon commission. i'm norman pierce. i want to speak about what do you do when you are in america's cup? you watch the boat race. that's about 3-4 hours. after that you have to find something to do. i think that the biggest disappointment i had in other america's cup's that i attended was there was nothing to do after the races. but san diego, there was very little to do. i
1:40 pm
think america's cup for the last 3-4 years have been putting together an event that is just premier. so as a pedestrian and sailor i think it's important to have this venue work. these people have put a lot of effort and learned a lot in the last two years to make it work. they have brought on local people and live nation and people to help them out during this event and we are all talking the same language and i think it's a wonderful thing for our population of our city and what this previous speaker talked about is the media is going to bring worldwide recognition. i do appreciate your support for this particular event. >> thank you. >> good evening. i'm with the
1:41 pm
association. some folks have painted the city tonight as a dreary, boring, lack of places and things to do the reason i live in north beach and the reason most of you are here is that this is an exciting city with a plethora of things to do. it's going to be great and after the america's cup ends at 4:00. our neighborhood certainly the cafes and restaurant expect and hope people will come use them. i wish to say this is about the details of this plan and residents elsewhere are very reasonably concerned that this is a plan that fell out of the sky. personally, i organization has been following america's cup since day 1. in november of
1:42 pm
2010 i helped draft a letter that we were excited that the venue was moved from pier 32 to pier 27 and 29. what we were focusing on was the races. we are prepared to deal with the trash and noise associated with the races. people were excited for the most part, but the concerts did really fall out of the sky. so that said, we are happy that the america's cup and live nation have put some meat on the bones of some of the promises to make sure noise doesn't exceed certain levels and they agreed to pay a mandatory fine of $5,000. we hope they keep their promises and confident they will.
1:43 pm
>> okay. next speaker. >> my ma'am -- name is gary. resident of lombardy i'm against the concerts. an invasion of the quiet in enjoyment of our hoement. -- homes. if i might present a different angle that was given. if i recall the america's cup event is not as it was dreamed of by the city fathers. there was a funding shortage that live nation came into the scene, perhaps i need better education on this, to raise money and the cross is going to be born by the people in my neighborhood, by the invasion of our homes with noise, the traffic problems, there was no
1:44 pm
mention of this in the environmental impact report that the significant change under california environmental quality act must be addressed and it has not been. it has been nothing but platitudes from live nation about how they are going to mitigate sound. i get you mitigate after you have already made it too loud or made too many people troubled by it. you yourself say that most of the complaints you hear are noise and this noise is going to be unbearable. i wish i had better prepared my speech but i would be glad to embellish on that >> thank you for your thoughts. >> good evening. my name is
1:45 pm
chuck bernard. i have the last family member that has lived on the hill since the 1890. we've gone through great fire after the earthquake. we've survived the depression, world war ii shhh ipg to both the theatres and army and the korean war. the great dust from the construction of the quake tower. we have lived through a lot of things. i could not be happier that the america's cup is here. i have bought tickets to almost every show. i'm really excited. i really hope this gets approved. i have friends in sweden who are
1:46 pm
coming to visit because they are all sailors and everybody is coming out to visit. they are staying in hotels. i wish i could have them at my place but i can't. there is a lot of excitement from this all over the world. thank you. >> yes, sir. >> hello, my name is joe babble. a san francisco resident and small business owner in the downtown area. i'm here to show my support for the america's cup pavilion mostly the concert series because i'm not a sailor but i have learned a lot more about sailing because of the concerts. as a small business owner i'm not affected directly by the people that are coming to the city, but we are in the downtown area, and anything we can do to push people towards the union square area and downtown and surrounding areas is a positive for me. i definitely see the
1:47 pm
positives much more out weighing the negatives and by the time everybody can get their arms up in air, it's over and gone. so i hope we can keep this going and for the sake of this city and job and for the people coming, keep on rocking. >> i'm kathleen daily from the land home owners association. i have had the pleasure of working with them since they came to town and most recently r live nation. their amazing couple of groups to work with. i can't think of anybody we are better off with. as regards the constant comments about the
1:48 pm
boats dropping out and at the end of the day this is always going to come down to 2 votes. we have a great summer ahead of us and i urge you and respectfully request that you grant the permit for the script. >> thank you. >> good evening. my name is max well. i live on telegraph hill for over 25 years. my concern with this entire event has to do with the noise. i have been to some of the community meetings and have been told that measurements will be taken of ambient noise and on evening of the concerts that someone will respond to a compliant by coming to my resident which is an old building, it doesn't have triple glazed wind ows.
1:49 pm
it rattled during treasure island last year. i was told by the live nation fellows here that it was because the speakers pointed towards the city and i understand some of the noise dynamics going along with that. this is a very amplified venue. even the symphony, although i wouldn't mind fit were a few concerts handled. sailing seems to be a relevant silent sport. this is silence, this is tranquil. the seals down at pier 39 can be heard on the hill, church bells can be heard, sound carries up

1:51 pm
>> on behalf of the group that is used as a theatre, outdoor am theatre with concerts going on at night where right now it's a residential neighborhood with no concerts. we are concerned it's being run off through our door. it's been approved by the supervisors which i definitely support the america's cup. it's very quiet when they have the races but when it's picked as an entity called live nation, it's the most powerful group in the world, their growth sales is 5.9 billion. most of you know for the last three years they confronted the neighborhood on knob hill and the neighbors are
1:52 pm
required to spend $600,000 on their own money to not let them take over the auditorium. applauding people they are so powerful. i'm concerned about using this as an outdoor concert when it has not been vetd for any of the sequence of the timeframe. thank you for your patients. >> okay. if there is people that still want to speak, please lineup. i would like people to get out of here in a descent manner. >> i live on telegraph hill. i'm a solid believer in america's cup coming to san

francisco. my father was a shipbuilder here. we have been on the water for many many generations. i too an concerned and support fred and lewis hill cox and others. there is no question live nation is completely professional. steve and jane and everyone has been just top drawer. but the impact are going to be enormous. i'm talking about the concerts. only these concerts. not talking about the broadcast of the races and in fact but the noise will be and the traffic and the lights are going to be enormous impositions. hopefully you can continue this hearing that can be further discussions between the neighborhood, the
1:54 pm
steering community and america 's live cup and the nation. they are very nice people. this is not a criticism at all of the america's cup. thank you. okay. that completes the public testimony. the mayor is not with the commission. commissioners? you can go first. >> so, i have been following this very closely and have been reading about what live nation has done and i would like to say that i think live nation has shown good faith in working with neighborhood. i do understand there is going to be an inconvenience. a 5 month inconvenience. one of the big things that happens in our
1:55 pm
city, say janet jackson is going to perform, she spends her money in our hotel and all the residents conquer, we are a city currently strapped for money and i think what we have to look at since they have obviously, the concert is not going to 11:30. i have 10:30 and 11 p.m.. i understand it's an inconvenience i would rather see the neighborhood organization lobbying their mayor and supervisor for money to go from this inconvenience to go and tackle an inconvenience like the gang warfare that is happening on broadway. i don't think stopping these concerts is the answer. i think asking for the application for this revenue nor in convenience would be a
1:56 pm
smarter way to go in this conversation. >> okay. anybody else? >> as far as the industry is concerned, live nation, if anybody is going to be doing entertainment, live nation is probably the most professional and i have been to shoreline am theatre when there is a lot of traffic. ideal with 41 thousand people during day games and we deal with the noise as well. we have the world series giants. the situation where the location is there hasn't been much because it is close to telegraph hill and north beach, but it will also help. pier 39 is not doing that great. business is down. it will help your business, you will get people. there is quite a bit of
1:57 pm
traffic of people coming ahead of time for dinner before the concert or after fairly early as the lady said with the social media. we are on facebook all the time. we are broadcasting anything we do on social media with our pda. i just got back from asia and i couldn't stand the noise it was so loud. i understand we have a little bit of say on how loud things can be. my only, again traffic is obviously my thing and public safety, the security plan seems to be decent enough. i don't know if we can hear more, i think if -- >> we've heard everything.
1:58 pm
>> the traffic is going to be dealt with. the noise situation is going to be well maintained. the steering, they had an opportunity, i think there was a number of north beach neighbors who are part of this community that heard all of the proposed remedies. it's only temporary and i don't see where unless i got something wrong here that this is supposed to be a permanent spot. it's only for the summer, so again, what i was afraid with the american's cup there was no entertainment plan at all. i thought we were just going to be watching the boat races. so i encourage everybody to be patient with the situation and for the city this is very good and as a live nation to be a
1:59 pm
really good operator, if i was going to support anybody live nation certainly has the ability to do so. >> okay. i just have a few comments. i think that live nation and america's cup is extended and negotiation and reached an agreement with the neighborhood as far as i can see is overwhelmingly acceptable. the one thing that i would recommend and i don't even know if this is applicable during your schedule that it was determined that sunday was considered a week day and i would like to amend a motion to say that would hold with the exception with in this time period monday is a holiday then sunday is a weekend day and we do that with anybody that has restrictions on sundays and we lift them and make
