items that are acted upon today last year on the calendar. >> we have a relatively long meeting today. >> item one the health code to establish the health food and tax regulations code. >> okay. we have mr. lee here from the department of public health. >> good morning supervisors. richard lee with the department of public health environmental health. this is to codify fees that was passed through the state that went in the event january 31st. this allows people to make food

at the their home kitchen to be sold to the general public. before that never occurred actually, the environmental health directors were concerned but we worked with the industry and the councilmembers offices. there are two categories for the home kitchens. one of them is for direct sales where people can only sell directly to the general public for themselves. for those types of facilities there will be no inspection from us we'll just know what types of food they're selling and their certifying their homes will save. and then we have others who are selling to gorgeous.

we'll tell you do on annual inspection and actually permit them. and also the types of food they sell is limited you can only make those foods that are listed through the california department of human being health. so friends they can sell dried pastas and baked good days but not like meat pieces. things that don't need refrigeration. that is set by the california department of public health. anything else the department of public health will have to inspector that. there's a limit in the first year they can't sell more than

$35,000 worth of goods. so i think that's about it. ok and my understanding is this new ordinance would allow a lot of small micro businesses to flush in the city and the permit fee is relatively affordable but looks like the money goes to dp ws program to administer this? >> no, we actually have a new program name environmental health and sustainability. that goes into our regular public health and food fees >> but it's administered by the program within the dp h?

it's great to have an expert here from the department. the challenges of the outreach and i appreciate rec and parks outreach around the park. this is important that we accept the recommendation to keep future recommendations with the board of supervisors. we have to do diligent work. >> nick before you speak real quick we have another comment. >> thank you legislative aid i'll be brief. just to echo what the supervisor said supervisor reed is very supportive and believes this amendment is a collaborative

approach and we support the recommendationss of the trial period >> okay. thank you. we have a gentleman here from recreation and park >> this is an amendment to the at least for the park side bicycle rental for all of our parks in san francisco for a little bit of background park wide has been operating in a number of our park. currently golden gate park and the plazas a. it offers, you know, we think not only an amenity to city visitor who are looking for an additional mode of transportations but might not own their own bicycle.

we've seen steady growth in each of those locations with the expectation that tuesdays through thursdays are a little bit slow and the location on golden gate park has been redundant to the golden gate park activities. under separate permits we gunning began locating bicycle at the eastern entrance of the golden gate park we found it to be very successful we are be looking for a way to positively activate that space. the pilot program lasted two months in denomination but received omittance support from

law enforcement and other merry shall not in the community. the proposed leased amendment would add a location at ocean beach and a location at the end of 8th street. and working with the supervisors office we have outreach to the local merchant groups and we have a compromise. we originally proposed that the lake location would be operable 7 days a week but we found if we were out there 5 days a week then the tuesday, wednesday days it would not effect others

businesses. we are proposing some slight modifications to the hours of operations. and then for the ocean beach location it would be operational june through september 4th p.m. on saturday and sunday and then we would have less hours for discretion when the whether or not is inclement. there's not a tremendous financial benefit to the amendment. this amendment we've been look forward the park users and but we would see some modest revenue increases over the remaining years of the is lease ranging from $21,000 to $35,000.

throughout this process beginning in 2345079 for this opportunity all the way through the last few weeks we've received significant support and because supervisors staff mentioned there were some concerns from the merchants but we've address those >> thank you supervisor. >> yes. i was going to thank others from rec and park for working with the merchants. i know that some changes in golden gate park have carved some things in the district that have been in district one but all of us some be stewards of

the parks and be sure to we're in line with the project. also the golden gate park and neighborhoods around it that has crime and i appreciate the rec and park looking at the park wide site and it should be helpful and the neighbors are supportive of that. and there be more activity around the soccer fields but i'm looking forward to riding one of the rental bikes it should be an amazing ride but thanks to the rec and park department. >> thank you any other questions? so our budget analyst report

>> mr. chairman on summarizing basis rent would be 5 hundred and 78 thousand 6 hundred and 5 which is over the remaining term which is up. and percent rent would be determined in the same manner as the existing lease. we point out on page 89 the 6 month trial period for the other locations including the proposed lease amendment would not require board of supervisors approval only the approval subject to the 6 month period by the rtd wreaking manager. we ask you to amend the proposed

amendment to the term evaluation period and replace it would with the trial period of one year. if the board of supervisors wishes to authorize all the bike rentals at the city site location then it should be also stated that the management has the approval to have a six months proposal and this board of supervisors would have the final recollection and we ask you amend the proposal has amended >> any questions? i have a number of speaker card i'll call your name out.

needs more diverse activities. i want to thank evidently for working on this. thank you very much >> thank you thank you. next speaker. >> i'm the owner of bike and park skate from our avenue location. i don't know where the state has gotten help or noefks from you guys we didn't find out until people came in and told us. so we went in giz business? 1977. the board of supervisors gave us a license to do business in golden gate park. we were left hand there for awhile and that was cancelled

because the neighbors clamentd. we had several meetings with peter ash and joel robinson and i can't remember the name of the director. we had several meetings that golden gate park was not going to take our businesses and we could keep our bicycle businesses on the outside of the park. then at some point mayor lee and this large conglomerate of bicycle shops decided to form a bicycle for the parks. and they took overall the bicycles shops.

within weeks you opened directly a block directly across the street from me and i think it's i shameful of golden gate park, mayor lee to be bullying private businesses. i think it's just like some guy standing in front of you saying we've got the money i don't see the purpose of bullying >> i'm sorry madam your time is up. thank you thank you. next speaker. >> i'm a business owners.

i am here to voice my opinion and i thank supervisors reed's office in helping to broker a deal with a solution we could be happy with. initially bicycle rentals came to the association with a certain that the proposal was to have park wide operate at the lake and entrance to the golden gate park 8 days a week he felt this would put his business at risk so the merchants wrote me a letter and ask the city not to do that to endanger his

business. we were able to come up with a compromise with rob bicycle rentals said he was supportive of so the merchants association board has now agreed to support this proposal. i also was going to make a quick comments about the list of organizations that were listed that had had outreach. i think there was a couple of typos and we have a lot of organizations that represent the hate ash bureau association. it is a group that has representation from the hate ash burr association and this group also supports this proposal >> thanks very much.

but what we have found around the city that this type of industry the bicycle rental companies are located in the neighborhoods that's why there's an established bicycle routes that tourist are familiar with. so as we add for bicycle rental locations and as we make did tour books we'll tell you see that all the businesses will improve. currently all the bicycle tape recordings i trips go over the golden gate bridge. people have lunch in sal shred and also using this sort of ad hoc bicycle network we have
