t the additional motion you have received. it would not replace as tenant to the neighborhood will not cause unutilized buildings and meets the planning code. i'll be happy to answer any questions >> good afternoon. i'm holly. i brought my entire teem from andrew offices representing the project. we're proud to be in front of

you for your consideration with significant input in from the community. we've worked over the last two years that both enhances the functionality. you'll hear more about the design as well as for about the hours with mta and other community groups. the ground floor of the thought new space that was vacant for 6 years will be designed for a pharmacy as well as a lobby to serve the second floor space. previously it was tower records so we see that from working with the community and the building owner we're creating a valuable
5:02 pm
by using the second floor. additionally by working closely with those folks we've amended the new conditions in front of you limiting the hours as to not disturb residents and bike safety was accommodated from the front of the store along market. we also as you heard i recall on concerns with an additional alcohol and we've decided not use alcohol apparently in the last moments before the hearing we worked out some of the conditions it really clarify that was brought forward by the
5:03 pm
community. we worked closely with the leadership to make sure we're supporting our commitments we made and we fully support what's in front of you. at this point, i'll ask the architect to come forward and talk about the functionality of the building >> turn on the overhead please. we were retained - we were retained to provide a design to balance the needs of the csi and the planning staff. it's a simple design. the first was to create a quiet conceptual design and to have a design that has a time stamp.
5:04 pm
in fact, the stamp was built in the 1980s. it's been vacant over 6 years. so if you may have known it for the obama headquarters. the buildings were built at different times but their mostly 3 stories and narrow. this building breaks that pattern. so we've broke it into 3 part and the remaining 1/3rd will remain with radio shack as it's
5:05 pm
tenant. - the center bay will serve entrance the building including the second floor and it connects the rooftop to the 2 floor and street. the center bay is dark green or dark in color. this is swiss parallel cut into horizontal stripes is the interest dprv will remain and will cut off the existing concrete base and make the windows larger were we did find out by survey that the existing building was built over by a few
5:06 pm
inches. this is why the project is seek on variance. we looked at this building toward the bay as a precedent and this is certainly a design stamp and it has the same clad as we're proposing. we've destined the sign it's hallow with l d lights. it will look like this in the daylight and your passage has a long time the night time. this particular - this is our proposed design it may be a bit
5:07 pm
smaller than what's in our passage. 15 feet to be piecing. we have another something like that it will be black are dark green letters not illuminated. we know that the triangle association has been concerned about the scales of the signs and they're concerned about the blade sign. our design has under gone a lot of revisions >> good afternoon, commissioners and - i'm lewis
5:08 pm
with public affairs. for two years i've managed this project. a variety of outreach tools were used to engage the community including the meetings and the key perhaps events. additionally other triangle associations and merchant meetings. we began in 2011 to discuss those projects. the discussions have been on going to day. some thought you changes no alcohol being sold at the store
5:09 pm
and leaving parking on the roof assessable to other tenants and businesses and leaving store windows clear and unobstructed. cbs helped a meeting and approximately 15 neighbors attended the meeting. prior to that we held a walk and offered project information. the community was enthusiastic. the proposed cbs project has received ensdrments. cbs has been a for the

christmas lighting. thank you for your time this concludes your presentation >> opening it up for public comment (calling names) >> i'm working and live in the neighborhood i have a small cafe directly next door to the project. i'm in support. i've talked to a lot of the folks and their supportive. thank you very much >> thank you.
5:11 pm
>> good afternoon. i'm terry i'm the president of the upper market. we represent over 2 hundred and 50 paid members. cv a has been responsive to the needs of the neighborhood. we're in full support of them going into this space. it's a much needed update to our neighborhood. it's all being pushed into the upper corridor and by acting aviating this space that will help improve the area >> i apologize i called you
5:12 pm
tony bennet. i'm coming as a private resident but i'm the president of the boats association. i sit on various committees. i want to comment on the scope of this project and the form retail tenant that's going on. in terms of the building size and scope of the building i think that the cvs a good use of the area. there are some storage areas along the street. i think one retailer in there make sense. we forcefully advocated for in
5:13 pm
april this is under 20 percent. cvs has d done a lot of outreach. they worked really well with us. had the prior trader joe's done that we would be working with them. we asked those folks for no alcohol there was no alcohol and we asked inform less than 24 hours and we asked for open parking they did that. we asked for loading in the front street and they did that. and we asked for a sign more in line that the neighborhood and they did that. i would hope you approve this
5:14 pm
and welcome them as a good neighbor. thank you >> good afternoon you i live within a few blocks since 1987. i have friends that have stores in that area. tower records have a humanely amount of pedestrians in that area. the card store that was vanity there was a lot of folks wanting something in there. so often you hear landlord are not this cooperate active.

ken jeffrey's has been the manager on that property and he's lent that property out for several folks. for for example, they've raised tens of thousands of dollars completely free of charge. he's loaned it to the sister of non-profit and the imperial service of non-profit always at no cost to them. for the first time i'm proud to meet his mother mrs. jeffrey's. a wonderful story of the history
5:16 pm
of this property. they deserve this. it is considered anchor on that block we're supportive >> any additional comments? seeing none none conspires moore >> this is a favk - fascinating project. too bad you weren't here last week we discussed this. however, this project is apparently doing exactly the opposite because it seems to be responding to those
5:17 pm
observations. i'm very happy to see this. i'm pleased with the architect spending time on are i'm very pleased one that the neighborhood indeed could develop enough dialog. and this is if indeed a former

retail in addition to meet all the other richlts this commission i should speak for myself. thank you for the work and i am expressing my
5:19 pm
>> i think in urban environments it might work but in the city you don't need that sort of visual attraction that people try to create when they are walking down the street. the retail establishments can understand the different ways people discover a business in a city environment versus a suburban environment that they
5:20 pm
are driving through will be better. it sounds like a really amazing story and commitment. so thank you for all that you have done for san francisco and the various community groups and for working and finding a great tenant. with that i will move. >> commissioner sugaya? >> i think it's interesting to have this hearing from last week. however one of the differences i think is that the last hearing there was a staff recommendation for disapproval. based on the adopted rules that we had just taken action about a month earlier. so, i think in this case, there is an approval because it does fit within the criteria that we had established and it's interesting to me that the two projects are only about a block
5:21 pm
apart. to have the analysis on two opposite sides on two projects that are a block apart was an interesting situation for me when i started to read it. in any case that works in your favor. i would like to extend a couple more thoughts. one i think that signage has been an issue in the upper market area. on previous approvals and we don't directly have control over signs. so i think that's a matter of negotiating with the neighborhood and with the planning department because i don't think we can impose the 15 foot whatever dimension you are agreeing to at this point. but we've had other cases where the neighborhood has pointed out that some others have not lived up to their initial commitment. we would hope that you would follow through on that. i have to say this because in this case, cvs has
5:22 pm
taken a very, has responded very well to neighbors concerns. perhaps you can go back to the corporate people and discuss that same kind of thing with some of your other locations especially in the financial district. so, i'm in support. >> commissioner moore? >> i want to add one quick comment. i think we rarely have the cvs pharmacy to take the time into the passionate of architect which in most large buildings that is the case. the previous cvs we had they took a sign and stick it on no matter what. here we have an architectural development which not only plays with the facade type but with the sign as well. the neighborhood organizations will help bring this through because they are in the market
5:23 pm
of the plan spending a lot of time talking about this. i think there is credit due to everybody. there is another thing to mention, the sensitive thing is that cvs has modified their business model and is not selling alcohol to me. we have been told we need this for the financials to work. i think to stand in a community and make an active contribution to help is a message of the pharmacy. i recommend the community as well as your own ability to work with that. >> commissioner antonini. single family -- yes. i'm in support and with the modifying of this store. they were
5:24 pm
between 21 percent which doesn't make that much different to me. there is a competitive nature with cvs, there is other retail probably. this is a fine project and hopefully we can see more along this line that are supported overwhelmingly by the community. >> commissioner hill is? >> i want to add to the form you have. it's important. if starbucks was here and it wasn't hitting 20 percent. i don't know if i would be supportive. i think they have
5:25 pm
made the adjustment as to how it looks and feels. that's why we are not here with the hundred of gone are the days in
5:26 pm
the pharmacies. the only one in town is wall green's. >> commissioners there is an order to approve with conditions. commissioner antonini, hillis, moore, sugaya? yes. fong, aye. that motion passes unanimously. >> on the variance of closing. >> commissioners that places you on your final itemno. 14 a

and b for case no. 1155 d and v for property 249, 17 street discretionary review. >> good afternoon. we request discretionary review. that proposes to add three stories, one dwelling unit and a limited corner to a one story building. the proposed project is at the southeast corner within the r t o m. the residential mission neighborhood zoengs -- zoning district. those letters are on your case report. the individual requested the review cite the following concerns. one that it will adversely
5:28 pm
affect the dr requester. that the restaurant will create noise and the light is unsufficient size. the planning department has received -- reviewed the project and recommended the project match a lighting well as well as a setback at the rear. the sponsor complied with this recommendation. the proposed residential adds one unit to an existing two unit building that is the development potential of the site. and represents the
5:29 pm
valuable for the proposed area. it's a family restaurant. a cultural destination and not a formal retail use. the proposed project on balance with the intention of the general plan including the relevant section of the commerce and industry elements the missionary plan. given these reasons it's approved the project as proposed. the project proposes the rear yard of 25 feet while the planning code requires 33 feet. this concludes my presentation and i'm available for questions. >> thank you. dr requester? >> just go ahead and put it
5:30 pm
face up. >> thank you for the commissioners and my name is jackie. this is the first time i come to this kind of situation. basically my neighbor their project is on 3249 street. i'm the next door neighbor. i have several major concerns. no. 1 is the extension of the building is eight feet into the encroachment of the rear yard and which block a major part of our deck. in addition, there is a very small rear yard
