>> that's correct. the light well is 3 feet deep by 10 feet wide and that abuts one of the light wells on the dr requester and that extends to the 4th level. >> the windows on the side of the building aren't those property line. >> those are property line windows. you can't have any operable windows beyond 3 feet under previous building codes. >> all right. looking at the plans there is a matching light well maybe it's not as long as you like it to be on windows on the side of the building are not protected on the planning code. i think this is a great story that we heard of a wonderful family being able to stay in the neighborhood and locate very short distance of a well established business and well loved by many and now they

move a business and own it but also additional real estate in the mission which has been noted which is a problematic thing with a lot of business loses with latinos. i'm thrilled that this moving project you will be realized this before your other lease expires. there is nothing exceptional or extra ordinary. i don't see what they can do more to be more responsive. with that i would move to not take dr and approve as proposed. >> second. >> i think it's a great project and does all what has been said in fact improves upon the three units will be better than the two units there and allows the owner to move his wonderful

restaurant a block further and i was there and i met mr. gonzalez; a wonderful man and he began his business at the same time i began mine approximately 40 years ago. i heard the whole story. as far as the land use parts of this, i don't see any problems. they are putting in matching light wells although they are not required to because it's a property line windows, but they are doing that as a gesture to the adjoining business and the other things i don't think rise to the level of being extraordinary impacts. the parking down there, i happened to arrive by cab, i looked around and there were plenty of places where someone could have parked there. if someone goes there with cars where most of
6:03 pm
the traffic is people walking or taking public transit there any way. i don't think it's going to be a big problem. it's a community, a very diverse of people coming into the restaurant and enjoying themselves. i think it's going to be a great project. i'm very much in support. >> commissioner sugaya? >> yes. i'm in support. i have one suggestion. the trash is in an enclosure in the rear yard. is it possible, i don't see any reason why to move that enclosure towards the street and away from her building? >> we would not have any problem with that. >> okay. that might help. i know enclosures and garbage are supposed to keep the odors down. depending on the kind of enclosure, sometimes it isn't that helpful. maybe a letters

distance -- little distance if you can move it to the other side. >> closer to the cap street there is a door that closes outside. i don't think they will be able to move the trach -- trash all the way over. >> the middle of the building maybe but set off there. >> as far as away that you can get it from the building that would be preferable. >> absolutely. >> is that acceptable to the -- >> that's fine to me. >> i would like to have them consider moving it. >> he can if you want to add that in. >> you are not taking dr. >> the motion on the floor is to not take dr. >> we'll just have an

understanding with mr. marquez and his client. i have to say this, there was a lot of emotional testimony and really good support for the owner of the property and owner of the restaurant, but i have to say that the comment from the democratic club hit me a little wrong. because there was a statement in there directed to the d r requester in a kind of with my impression was a little bit of a racial statement to the extent that they were saying something about someone moved into neighborhood and now opposed a latino business person. it's with the way it was said or written. in any case i know it was in the spirit of supporting the owner, but i that in that kind
6:06 pm
of support, we should try to refrain from accusations like someone was invading my territory sorry something like that. i think you understand what i'm saying. >> commissioner moore? >> i would like to express my support for the project including the process of how the building has been modified by staff to really come across as something which is responsive to reasonably express the dr concerns. i would like to talk to mr. sanchez and ask why is the dr requester is using the wrong drawing to state his case because it seems to me the dr requester has not been fully brought to the loop about the modification the owner has
6:07 pm
made. the dr requester has a moment of anxiety about change, where the absence of the conversation if you have the wrong drawing while all the changes have been made in the spirit of the dr requester concerns. could you clarify that please? >> the following day after the rdt suggestions to provide the matching light well on the side setback with the prompt consent from the project sponsor, i e-mailed, unfortunately i don't have that with me, but e-mailed the dr requester and letting her know about the proposed and asked if it was sufficient and she stated she had other issues with the project. staff went out of it's way and complied with it's duty to inform the d r requester.
6:08 pm
>> thank you for explaining that and we see that there is still the possibility for loss in translation. there will be neighbors, if the d r requester lives someplace else, she still owns the house and hope you see what is being presented and approved today that the applicant made every attempt to sense actively respond to your request and concerns including the minor modification and codes . i look forward to seeing a good project and look forward to you being good neighbors as you all move forward together. >> there is a motion and second to not take dr and prove the project as proposed. commissioner hillis, moore, sugaya, fong. ayes. >> the variance to grant the
6:09 pm
requested variance with the revisions that have been made to the project. if anyone would like a copy of that decision letter please see mr. sanchez. thank you. >> commissioners, the last item on your calendar is public comment. i have no speaker cards. >> is there any general public comment today? >> okay. seeing none meeting is adjourned. >>

their /kpeupbts span history from dramatic moments in time to modern milestones showcasing religious world leaders and super stars and legends in sports. most recently obama and rodney funk. we congratulate them on celebrating 50 years. i believe they'll have a public celebration during this summer so we'll share more about that. and if you see commissioner fong, please wish him happy birthday. this saturday there are a couple events i want you to know about. first is a community meeting to discuss
6:14 pm
pier 70 park. that workshop will take place this saturday, may 18 at 9:45 at 645 illinois street. everybody is welcome to attend. a second event happening is the farmers market is celebrating its 20th birthday. at the time this [inaudible] farmers market there were only three farmers markets at the time. they've

me if you have an interest and couldn't catch that name /tkpwepbl. but -- again, but those are some pretty good tequilas. you may remember commissioners last fall we came and asked your permission to expand the foreign trade zone. it dates back a very long time now. there's well over 3000 such /hraoeupblss licenses and we were seeking to expand our foreign trade zone to include marin and so no ma counties.
6:17 pm
so on april -- a foreign trade zone really allows customers to defer or eliminate custom's duties /tkpepblding on what's happening with the goods they're bringing in. so if they're bringing in a component with this particular duty and they're marrying it with a combined component and that could be an advantage to them. we've got a lot of companies in the north bay that are interested in expanding their trade zones and this helps to create more jobs as they expand their operations. so my

congratulations to the staff. this is really an undate to our two year budget so we don't expect there to be a lot of new material presented. from adopting the budget, we stayed within the budget that we approved a year-and-a-half ago, but we will be heard by the mayor's budget commission, by the board committee and then will go on to the full board in the june, july timeframe and we'll report back to you. we encourage yo to join us and we hope it is encredibly boring. that's may 29, 1:00 pm. now i'd like to take a moment to say thank you to a tremendous group of people who have really helped the port to participate and celebrate it's 150th
6:19 pm
anniversary. interestingly enough what we decided to do for our 150th isn't all that different from what the port did so we held a big gala on the floor here and they held a big luncheon. they had something very similar. i guess great minds think alike for 150 years so that was gratifying for us. it happened mostly all internally. we had the support of many of our partners who were sponsors and kind do nations. i think some of the donations were a thrill for our petty cab rides to and from the event and things like that. but most of the work has been being done the last 100 days by port staff. we talked about the staff that worked on the banners which continued to
6:20 pm
be poplar, but there was a tremendous group of staff that helped get our birthday date done at the pier 39 done. i know many of you are here, if you would come forward i would appreciate that. from our actual birthday from april 24, we have april shaw, denice, manny, george, patricia, molly, marilyn, amy. you can kinda stand back so everybody can see you. so this is a partial list of the group and helped people to find their way or
6:21 pm
stuffed a million party bags for our guests or did clean up and fed up for our gala and we are really grateful to all of them. so i would really appreciate you joining me in thanking them for their tremendous efforts. and so i'm gonna have amy do it since she's up. we have memorial caps to recognize you. and if you wouldn't mind standing here 'cause i have a whole other group to recognize. then the staff that participated in the event itself. i don't think the port has ever had -- gorge,
6:22 pm
get back there. this is a test of how well you pay attention to me. as i was saying, ere was just a tremendous outpouring of port staff that donated their time and i'm going to call as many names as i have here. this is another big group of staff so there's david, roy ty, dave, manny, patricia, george, megan, /skwraepbl, krin, amy, carol, jerry, denice, shannon. if all of you would come forward. so ladies and gentlemen, this is

the group of people who were physically out touching the people at the water front. we had a lot of people who have not come to the water front before come down because they saw the advertisements on the buses or on tv and wanted to come experience it. the water front was just teaming with people. the park and the ecocenter was full of folks. thank you carol for that. the boat clubs down in the pier 48, 50 area were teaming with people who were curious to see what's behind all those private clubs. and up here was just an amazing amount of people. so please /skwroeupbl join me in thanking this group of port
6:24 pm
personnel. you guys get to be seated and i have one last group. my photographer was in the crowd so he couldn't take a picture. all right. so last, this could not have been possible at all without a huge volunteer group of folks who stuffed something known as the committee for the 150th and it took a lot of their time -- regular hours and overtime hours -- and i want to recognize the committee. come forward when i call your names -- megan, jane, dave, dan, damon, jerry, jay, vicki, tonya, carol, wendy and of course their fearless leader,
6:25 pm
rene. . we have a little something special for all of the committee members. this one's megans so bear with me while i open it. megan, it's very fitting. this one is the first one i pulled out. it is a beautiful [inaudible] cube with some water and it reads, megan stevenson, in recognition to your contribution in celebrating [inaudible] with their names on it and we'll pass them out shortly. now, every little thing that those of you that came to the gala

got to enjoy -- whether you fraternized with the chocolate girls or stilt walkers or enjoyed the flowers or whiskey or road a pedi cab, it was overseen by this group and was overseen by rene, who is the best party planner in the community. so we have a beautiful vase for her. ladies and gentlemen, one more time please. and so dave, will you take a picture even though

incredible young man visiting his wife and child. he's a multiolympic metalist. he was the team strategist and just an exemplary person and it is a huge loss to our community. i don't think the press has been as forthcoming about who he was and what a sacrifice it is for his family to have lost him. i think it's important of the community of san francisco that we recognize the sacrifice that's been made by this family and we give them our very best thoughts and i'd like to adjourn our meeting today in honor of mr. bart simpson. and that concludes my report. >> thank you. is there any public comment on executive
