mixed project of 1 hundred and 90 units dedicated public parking spaces and importantly as a importantly of this fundamental donation of the package affordable housing facilities we negotiated as part of that millennium d n a a housing project. based on today before you 1 hundred and 90 units 20 percent plus 8 percent would be a total of $18 million and 5 million from the additional. so we don't have the ability anymore from the housing trust
6:31 am
fund that was proved by the taxpayers this additional housing fee is significant because we have more work to do for seniors. that also provided for fundamentally a facility a home a permanent home for the mexican museum. the developers are to provide a shell contribution once they agree agreeing gate this site and the permanent home for the mexican museum is $18 million. in addition we're very concerned with ongoing sustainability. we see other culture facilities across the nation and as a
6:32 am
result we negotiated with the city a dedication to the mexican museum. top of that there is a annual contribution for maintenance and security at a rate of $1.25 of netted secret this is a permanent ongoing fee that lasts for perpetually. and again i can't emphasis enough this is a permanent impact fee that goes to the gardens but free programming you see in our gardens for 9 months out of the year. and grant funding for the center
6:33 am
for the arts the creativity museum that substance goes toward the childcare center as well as the capital needed. again those museums sit on top of moscone and large partitioned of moscone are still owned by the agency. to put this in context the project would be the only residential project in the area to pay this ongoing fee to support the gardens. the other commercial place they transcribe, however, other residential developments in the area see parliament and, of course, the 14 hundred affordable apartments don't contribute. top of that they require the
6:34 am
restoration of the building that value is approximately $11 million. in addition the jessie square garage the developer is to take care of the outstanding bonds but we entered so what a tax situation. primarily we are paying for this by taxes but it's a hit to the city's gentle fund it's $18 million the developer will not only defeasor the bonds of $20 million but will reimburse the city of $18 million this see
6:35 am
freed up money for other intended purposes. and that's appropriate in our winding down activities. timing does matter for all those projects and the components and he benefits i transcribed we're under a ticking clock the state expects us to wind down. there's approval through the community investment and infrastructure. the state oversight board as well as is the state depends of finance and we need to show progress on those varies entitlements otherwise the contract and the contributions for the mexican museum will be at risk. i thank you for your time >> excuse me. for excuse me.
6:36 am
members of the audience your creating a fire situation for us. we have established a room to 408 and your welcome to b be there and you will have an opportunity to speak on this. there's a handful of seats available in the audience. okay there are no recessed seats here. find a space in 408 or move to the other side of the room. i'm sorry, i can't move to the other side of the room you'll have to go to room 408. so unfortunately, we can't proceed with this hearing until
6:37 am
we figure out those spatial issues. again room 408 is an overflow room you will have an opportunity to submit our commitment. thank you very much. unfortunately those of you on the wall standing over there find a seat or go to room 4089 i apologize for the invention and the project before you would rehabilitate the arson building and it reaches a maximum roof

height. the two buildings will continue 4 hundred dwefl units it will house a home for the mexican museum and later space. it will refigure to include new spaces for parking spaces for one dwelling. so the following things both commissions would have to approve the california quality act and the planning commission upon recommendation of the park commission would find that the shadow on the project is not adverse to the planning of that
6:39 am
park and plan consistence with the following plan and the board of supervisors would have to adapt a height limit and adopt a special proposed district and final they have to find it consistent with the downtown corporation. and residential parking quantity and to allow curb cuts on missions street. in the time allotted i won't cover everything. the board of supervisors was - it upheld the eir, however, it included concerns about
6:40 am
pedestrian safety and shadows. it is modified from the staff report incorporates to the shadow impacts. the height of the project was reduced from 40 feet and the maximum number of units has been reduced. the roof and agricultural appreciation hadn't changed. the staff report reflected the project. the appeal of everyer to the board of supervisors the commission would need to adopt finding under the mitigation and monitoring program. by reference to the sequa findings that were adopted by the planning commission. in addition the shadows will be reduced so i won't discuss those
6:41 am
approval actions. planning code section 295 the shadow impacts are to be considered under the jurisdiction of the parks committee. this included adopting shadowing around the downtown corridor. and an additional 1.1 point was adopted. with shadows about adopted it is shadowing the area around 38 percent of area. from april 11th to november 8th to february 2nd to march 2nd and the new shadowing would occur
6:42 am
but not past 9:00 a.m. i should note if the staff has received on upgrade the height the in the project reduced the shadowing by 9 percent. in october of 2012 the commission adopted new shadowing provisions and required those newly adopted

. and existing transit service. the promise provides other benefits. and this concludes my presentation. i'm available for questions i want to acknowledge the parks depth and we're here to answer any questions regarding the rec park and the 295 actions thank you >> opening up to public comment (calling names)
6:45 am
if you want to line up on your right side of the room it will be easy. (calling names) >> good morning commissioners my name is steven and i'm the represent of the local 6 in san francisco the electric union. many of our members live in the surrounding area and take advantage of the initiative the city. we'll like for you to consider moving >> excuse me. we hadn't to over look the sponsors presentation. >> you mean i'll have to do
6:46 am
this again? >> i apologize. >> project sponsor. >> good morning commissioners. i'm shawn i'm with the developer. and i'm here to introduce you to the project and to the project design team but first i want to give you a little introduction. the gentleman did a wonderful description on this process. but the millennium partners do have a great history. we've been involved in several projects and continuously we
6:47 am
program the project to the city jessie square and we look at again as an ongoing commitment with the redevelopment as we transition into other promotions. the comment we received on the eir process and particularly to the two areas concerned that have been raised and highlighted continuously. the first is the mitigation to the shadow on union square of which we've been working with the planning staff to try to understand the impacts so we can work win the stretch of the overall project.
6:48 am
we want to be able to work alongside the other planned development. in the other areas the pedestrian and automobile ingress safety we continue to work with the opponents with the project as well and we continue to make the pledge that we will do a pedestrian survey prior to building permit and we'll continue to work with those concerns. just wanted to make that commitment today. and to echo some of the comments today we've been working with the planning staff and been working a number of years and it's collaborative work.
6:49 am
and i'm going to turn it over to the planning architect to walk you throw the particulars of the project >> thank you. good morning commissioners. i've been a resident born and raised in san francisco and i've been working in the area for over 20 years now. part of what i want to talk about is you're very familiar with the site. but what's important s here it the site itself
6:50 am
one thing i want to mention is i've been involved in many projects on this area i i was the lead designer on the four seasons hotel and the jessie foundation as well as jessie square. i understand the complex of the project. this parcel is the last remaining parcel that we came up with with 28 years ago. what's also important is the area and all the different how this project fits in. it's consistent with the area it brings residential product to
6:51 am
the area it establishes the mexican museum in the area and looks at doing something very good with the area. it's an under utilized facility. it's also important to see what's around it. i think our building fits into the fabric. it's a residential project it's an institutional project it conforms to all the other buildings around it and those are aspects of the building. in terms of the agricultural components the cumulation.
6:52 am
and we spoke will earlier, you have all the information you need but i want to talk about the agriculture. we have the tower in the eulogy we're in keeping with all the other institutions around it will bring new life and really enhance the area much more and i think that's an important aspect. it's not just about the programming but the agricultural. we're trying to work on this building skumg the top of the
6:53 am
building and provide materials that are in other buildings around it. as you can see from the section of the building the museum plays a very important part it becomes another entrance to the other projects the tower itself at the top of the tower and again in the spirit of trying to keep the shadows minimal on union square we are working the east side of the building and it's the side that casts the most amount of shadow so we reduced that by thirty percent. and from a ground floor plan i think it's important to understand this this building the footprint is 50 thousand
6:54 am
square feet. the top is approximately 12 though 9 hundred square feet. as we've evolved i've been here 20 years working on buildings. where we're in the mindset of doing for slender buildings and that's primarily why this building has been redone. that's an important aspect in terms of trying to create an active skyline is to create those slimmer towers. also what's important will the ground floor plan unlike other buildings this is on the corner and we've been able to landscape
6:55 am
around the mission street light trees and again, the enhance on the plazas a side. so it is not plugged into the middle of a block. there's a lot of surfaces. we revitalized the arresting - also to keep in mind we have utilized the enhance spots and we're relie down. this is a picture looking east and we'll be taking off the 1980
6:56 am
version of the old building. and this is the scale of the contemporary museum building. we're presenting the jessie plaza with the front door. as one sits at that front door you will see the jessie building and prostrate this type of agricultural on the plazas a it's good for the environment and attractive. keep in mind we've been working with the h pc and we have to do some work on the place. this is a place holder the massing has worked out with the wind analysis and we're going to be going back that the mexican
6:57 am
wind team. again, this is a section at the base of the museum it taxes up the first four floors of the project. and the retail on third and mission it's important. here you have a picture of the old arson building we're going to be rehabilitating that whole building but excess any questionsly we're going to be redoing the whole floor. so i think the building in itself will be very activated on the first floor. this is some details of the
6:58 am
overall structure of the building. what i want to point out here i know we're short on time but we started this building several years ago with a tremendous amount of shadowing impact. we've worked with the planning vice president to work to start to orient that building south so it will reduce the shadowing. as you can see we've reduced the height of the building but we've reduced the shadowing impacts significantly. and as you heard earlier basically, there's 4 weeks of shadow that by want 15 there be no more shadowing and two weeks
6:59 am
at 8 fourteen. it's early morning shadow before retails open and not midday shadows. this is the future of san francisco. we've got quite a few of the of buildings coming up. i want to reemphasis this site is important the skyline of san francisco is important. we think and we're working with the planning department of public health we feel the building is just right. we feel that when buildings become all the same heights it becomes a very stagnant skyline and that's why the buildings surrounding that area have extra height to make it look
7:00 am
different. our building is slirnd and elegant and it will be a tremendous asset to this area. if you have any questions i'll answer them >> thank you. we may have questions for you later. >> public sponsor. >> okay. let's try this again. opening up to public comment (calling names) thank you (calling names) >> i'm a representative from the i b w local
