also a place to deal with the issues before they get out of hand. so this puts another layer without having to go to the police department and other entities to deal with the issues as they arise in the neighborhood. so speaking on behalf of the tenants association coalition of san francisco, we support this cbd in this proposal and we hope that the committee will support this and that the property owners will support the cbd. thank you very much. >> hi. my name is michael can knulte. a lot of times we deal with
2:01 am
issues that are very important to us, which has always been safety concerns and obviously cleanliness inside our buildings, but also out in the you beened community. one of the things that the community benefit district have provided, in particular the citizen of san francisco is an additional layer of the safety and cleanliness in the communities that the districts are formed at. ehr time every time i listen to the current stats from the police, they talk about the problems that they have with the promoters and businesses that have problems in the area. so this is a way to hold accountable what goes on in a
2:02 am
certain area as a layer of more assistance. i think is important. so having another entity there, that could be speaking for the community is helpful, because it brings all the stakeholders as a group to try to deal with the concerns of the community. so we are in support and we would like to see this pushed through recommendation to the full board and look forward to it passing as an actual entity. again, thank you supervisor chiu's office for its outreach and all of that to the community. bye, thank you. >> thank you very much, any other members of the public who wish to speak on this item? seeing none, public comment is closed. supervisor chiu, any closing comments? >> as we all know the story of this portion of broadway, while it's a short stretch has involved a fairly long and windy road and i really want to
2:03 am
thank everyone's patience and persistence during that time. we all know it wasn't too long ago our various community stakeholders couldn't come together to agree on where we are today and the fact of the matter our club owners, our restaurateurs, our business owners and in particular law enforcement, everybody is final loin the on the same page and i want to thank catherine, who has worked tirelessly in recent years to make this happen as well in my late 20z almost every weekend i would go to north beach and broadway and it was too long a time to convince my friends from around the city to come on weekend nights to broadway and it's my hope as we allude to super bowl bid and as we allude to the incoming
2:04 am
america's cup, all the events that we will offer, i really hope we will in very short order we're turning around broadway. we're going to make sure that broadway is a top night-time distance not only for the world, but in particular for san franciscans and thank you for working on this and colleagues i ask you for your support. >> all right. is there a motion? >> so moved. >> seeing there is no objection, there we go. [ gavel ] . this item passes. [ applause ] >> great, thank you. supervisor chiu. madame clerk, could you call item no. 3. >> hearing on the san francisco public utilities commission tap water outreach campaign. >> colleagues a quick update the sponsor of this update supervisor mar has requested that we continue this item. motion made by supervisor tang. >> just a reminder to take public comment before you vote on the motion. >> thank you very much.
2:05 am
thank you for that reminder. is there public comment on item 3? this is the item to continue to the call of the chair. >> i looked back in the room and i rest my case. how many people are here? but i think they were all here for other items, including myself. this item, obviously, obviously has been misplaced here. so i say for the record, it can be challenged later on, because i feel that all three items in today's agenda were put here for political expediency and not for proper placement and as i quote "government audit and oversight committee." i challenge this committee, if you want to be meaningful, why don't you call a public hearing open to all city employees, in
2:06 am
writing, advertising through every city department and i guarantee you, i guaranty you will feel room 250 full of employees that have stories to tell about retaliation, harassment, misuse of funds, et cetera, et cetera. it is an embarrassment for my colleagues to point out these things -- you have a school district that nothing has been done. why is san jose taking the lead on child pornography and yet your city does nothing on child pornography? does that mean that you leaders turn a blind face to something like child pornography? so they kick me in the butt and say get back to
2:07 am
city hall and do something. obviously your leaders haven't been listening to what you have to say. so you better put it on the record, so this way in the future, they cannot say we weren't warned before the crackdown begins in san francisco. thank you. >> thank you very much. any other public comment? seeing none, public comment is closed. mr. city attorney, before we adjourn, could can you briefly tell the members of the public the reasons or -- not the reasons, but the type of items that are heard in this committee? i think there is a little bit of a misunderstanding. >> sure. let me pull out the board's rules of orders on that. the board rule 3.25.2, provides that the government audit and oversight committee handles labor agreements, civil grand jury reports, audits of city departments and agencies, oversees management audits, audit schedules, approval of
2:08 am
audit schedules and it's a fiscal committee and the items on today's agenda were properly referred to this committee by the president. >> thank you. there was a motion by supervisor tang and seconded by supervisor campos and seeing there is no objection, that item passes. madame clerk, any other items on the calendar. >> there are no further items. >> fantastic, this meeting is adjourned. thank you everyone. [ gavel ] test,

(calling names) >> and now for the recreation and park commission (calling names) >> please note that the joint commissions will hold one here we go for the pickup public to hold testimony. following the hearing we will adopt the finding under the california act. we will have the union square park issue. we will consider the action and the recreation and park commission will consider making
2:12 am
a recommendation of the adverse shadow on union square park. we will adjourn and the planning commission b will remain in session and separately consider others actions. that places us under the following issues for the consideration of the adoption of the california quality action and possibly joint action by reeshg and park commission to raise the shadow limit for union square and discussion and possible action to recommend to the planning commission that the net shadow casts b will not be adverse to the park as code

and mission bay as well as other conceptual gligs plaintiff's we're stewards of the assets of the city. as part of the overall context the area plan was adopted redevelopment area plan in 1966. that really he expired in 2011. the community based process were to create a mixed use you culture development for the city that's moscone this exists today was facilitated and partnership with the city.
2:15 am
affordable housing as well as mixed use how's 3 thousand units are see create for the seniors in those 80 plus acres. and importantly the investment of the culture facilities for the san franciscans. in total in partnership are the city involvement in the area we have $200 million in those central blocks that includes the museum of african-american and the children's creativity museum, the public benefits of the skate ring and the gardens itself is a culture jewel. as part of that context it was
2:16 am
envisioned on myths street there would be a facility for the mexican museum. in 1993 that he entered into all the time and through a long process of 20 years moving forward to 2008 as well as 2010 we in partnership with the mexican museum entered into an exclusive negotiation agreement for the investment 6 a mixed use project on that site that includes the arson building and the mexico museum and other facilities. that 2010 exclusive negotiation agreement with ma limb provided for the exchange of the
2:17 am
conveyance of the parking garage facilities and all that is $40 million. in canal with our contribution where millennium would have a mixed project of 1 hundred and 90 units dedicated public parking spaces and importantly as a importantly of this fundamental donation of the package affordable housing facilities we negotiated as part of that millennium d n a a housing project. based on today before you 1
2:18 am
hundred and 90 units 20 percent plus 8 percent would be a total of $18 million and 5 million from the additional. so we don't have the ability anymore from the housing trust fund that was proved by the taxpayers this additional housing fee is significant because we have more work to do for seniors. that also provided for fundamentally a facility a home a permanent home for the mexican museum. the developers are to provide a shell contribution once they agree agreeing gate this site
2:19 am
and the permanent home for the mexican museum is $18 million. in addition we're very concerned with ongoing sustainability. we see other culture facilities across the nation and as a result we negotiated with the city a dedication to the mexican museum. top of that there is a annual contribution for maintenance and security at a rate of $1.25 of netted secret this is a permanent ongoing fee that lasts for perpetually.
2:20 am
and again i can't emphasis enough this is a permanent impact fee that goes to the gardens but free programming you see in our gardens for 9 months out of the year. and grant funding for the center for the arts the creativity museum that substance goes toward the childcare center as well as the capital needed. again those museums sit on top of moscone and large partitioned of moscone are still owned by the agency. to put this in context the project would be the only residential project in the area to pay this ongoing fee to support the gardens. the other commercial place they
2:21 am
transcribe, however, other residential developments in the area see parliament and, of course, the 14 hundred affordable apartments don't contribute. top of that they require the restoration of the building that value is approximately $11 million. in addition the jessie square garage the developer is to take care of the outstanding bonds but we entered so what a tax situation. primarily we are paying for this by taxes but it's a hit to the
2:22 am
city's gentle fund it's $18 million the developer will not only defeasor the bonds of $20 million but will reimburse the city of $18 million this see freed up money for other intended purposes. and that's appropriate in our winding down activities. timing does matter for all those projects and the components and he benefits i transcribed we're under a ticking clock the state expects us to wind down. there's approval through the community investment and infrastructure. the state oversight board as
2:23 am
well as is the state depends of finance and we need to show progress on those varies entitlements otherwise the contract and the contributions for the mexican museum will be at risk. i thank you for your time >> excuse me. for excuse me. members of the audience your creating a fire situation for us. we have established a room to 408 and your welcome to b be there and you will have an opportunity to speak on this. there's a handful of seats available in the audience. okay there are no recessed seats
2:24 am
here. find a space in 408 or move to the other side of the room. i'm sorry, i can't move to the other side of the room you'll have to go to room 408. so unfortunately, we can't proceed with this hearing until we figure out those spatial issues. again room 408 is an overflow room you will have an opportunity to submit our commitment. thank you very much. unfortunately those of you on the wall standing over there find a seat or go to room 4089 i

apologize for the invention and the project before you would rehabilitate the arson building and it reaches a maximum roof height. the two buildings will continue 4 hundred dwefl units it will house a home for the mexican museum and later space. it will refigure to include new spaces for parking spaces for one dwelling. so the following things both
2:26 am
commissions would have to approve the california quality act and the planning commission upon recommendation of the park commission would find that the shadow on the project is not adverse to the planning of that park and plan consistence with the following plan and the board of supervisors would have to adapt a height limit and adopt a special proposed district and final they have to find it consistent with the downtown corporation. and residential parking quantity and to allow curb cuts on missions street. in the time allotted i won't

cover everything. the board of supervisors was - it upheld the eir, however, it included concerns about pedestrian safety and shadows. it is modified from the staff report incorporates to the shadow impacts. the height of the project was reduced from 40 feet and the maximum number of units has been reduced. the roof and agricultural appreciation hadn't changed. the staff report reflected the project. the appeal of everyer to the

board of supervisors the commission would need to adopt finding under the mitigation and monitoring program. by reference to the sequa findings that were adopted by the planning commission. in addition the shadows will be reduced so i won't discuss those approval actions. planning code section 295 the shadow impacts are to be considered under the jurisdiction of the parks committee. this included adopting shadowing around the downtown corridor. and an additional 1.1 point was adopted. with shadows about adopted it is

shadowing the area around 38 percent of area. from april 11th to november 8th to february 2nd to march 2nd and the new shadowing would occur but not past 9:00 a.m. i should note if the staff has received on upgrade the height the in the project reduced the shadowing by 9 percent. in october of 2012 the commission adopted new shadowing provisions and required those newly adopted
