12:30 pm
engineers although west coast sounds is. that was a good company. you've done 4 sound like levels and put space between the sheetrock did you use some other kind of jerry that might actually inhibit the sound you put up sheet go rock and that's all? >> this is a very bear open space. there's two parts one is we double the sheetrock on behalf of the ceiling and we had another floating level away from it >> so you do have an air space.
12:31 pm
>> we're going to have to go back and do it again. we did it on behalf of the stage but we have to do the rest of the sidelining >> so you have a sound traffic and it will traffic and possibly not hit the neighbor who shares your wall. but it will hit the wall you may not hear it but it will travel through the wall and hit the wall and the people in the building will hear it. and so what is your project on when you're going to complete the work? >> i would say win the next 4 weeks that will be completely done. >> you said this can't happen
12:32 pm
overnight? it has to. you have to invest the money and get the people in there and do it because the neighborhood have had it >> commissioner hide. >> hey, i was wondering if, if you you could tell me about the neighborhood meetings you've been to talk with the neighbors and yes, we sent out noticed. >> so you expected them to come to you? >> i asked them to e-mail me. >> have you gone do any businesses meetings in the neighborhood? >> so if you're going to change the neighborhood how are you going to do that? >> rather having buildings
12:33 pm
boarded up. >> stuff like that are they part of the neighborhood how it's going to change. >> absolutely we've talked about with folks. >> and do you have any proof of the one hundred people you talked to. >> i can printout the e-mails. >> it would have been nice. >> how many hours has the entertainment commission been working on sound calculates? >> how many hours? >> yeah. how many hours have they spent working on this sound issue. >> i'm not sure. i've seen the inspector there twice. and the other thing you said
12:34 pm
europe - you were insulating. so why didn't you just sound proof the whole place why have the neighbors been hearing the sound for two years ago >> we would start the process and then all of a sudden we had to go back again. we've tried to be pro activity and i'm sure the people that on the commission can say i asked do you want to come down and give us some ideas >> just the clarity i'm sorry to interrupt you but when the
12:35 pm
talked with south coast did they recommend the whole plays or just pieces of it. >> well, they said we can do this and that. >> did they take a sound test? >> yes. >> and the recommendation to you was to do what? >> they said this would solve the problem and i told them it has to be airtight. >> well sound tight. >> i've been working with several plays that happen to have the same problem. and seems like the ones who spend the money don't have to
12:36 pm
come back and talk to us time after time. there's also those who go to the neighborhoods meetings. and from what i see it's not just in february, march, april it, it's two years of complaints. and then to see from your organization something like this that it's insulting the neighbors it's hard for me to believe you're listening to their concerns >> i think i have been more than serious i've offered to come in and do sound tests. i don't want to turn my building into residential i do like the music business >> i'm going to stop you there
12:37 pm
you didn't try very hard in two years ago if you have not been to any neighbors business meetings that doesn't fly with me. >> so in trying to mitigate the sound have you tried to turning down the music? >> we're not actually a very loud venue we're running to 81, 92, 93. we did sound proving i do think there - we just have to find a better acoustic solution for the corner of our believe >> even though you could turn it do you think you still -
12:38 pm
>> we're not a heavy metal venue. we've had a couple of heavy metal events we do acoustic events we do traditional irish music. anyone who looks at our venue we do jazz. that's one of the reasons we won best new club in 2013 by the san francisco weekly. we're trying to be on a good booking business >> so part of our program is the good neighbors policy. so if a neighbor calls you with a complaints you're supposed to turn down the music. have you gotten any calls? >> every time we turn down the
12:39 pm
music and every time? >> every time. >> so i'm looking you've got $2,500,000 of tickets here did you pay those? >> yes, we received 3 of the complaints last month the ends of may and we send a check out. >> well, i'm saying for the amount of money you get fined and does west coast ever put anything in writing? if you had legitimate sound folks in there reading and they make calculated suggestions just like for
12:40 pm
example, an engineer tests the load of your roof they have to say how much it would be to support a beam. obviously those reports are annoying to you is to solve this issue and apply that money even though we'd love to have that money did you correct the sound situation. or did you just put things up and say oh, that's fine >> not my buddy are sensitive and they don't do that. >> can you forward that to the commission? >> my attorney - well we will brought a package.
12:41 pm
>> if we saw that we could address what you've done. >> do you not have the report from the april 30th? >> no, we don't your item wasn't heard we don't have a copy on april 30th. >> okay. so before we take public comment. here's the thing you've got to know that for me at least i know a lot about sound. and i don't believe that you have addressed the problem correctly. and rather than doing that i believe that you've done a delaying tactic when is really silly because your operating permit is where you make money
12:42 pm
off the bar. and if you don't have a permit you can put an ipad in and that's it. so the most valuable thing you have is your operating permit. rather than putting things off and finding excuses and allowing yourself to get fined if you are the manager to address the issue would be a much better idea. so seems to me that you possibly haven't addressed the issue. i want to tell you this commission is not the ending point. if you're neighbors get annoyed enough they can go to the city
12:43 pm
attorney code improvement and they can sue you. and then all the money you're saving by avoiding this is go to go to attorneys fees. and instead of just dealing with the problem be a big boy and take care of the problem. and you haven't done it. as much as you think you might have have done it you haven't. unless you have something else to say i'm going to have you sit down. >> all right. we're opening to public comment on brick and motoror. >> you have 3 minutes come on
12:44 pm
up. >> hi. i am a resident of wood ward street which is the area right behind brick and mortar. originally we tried to come up with amicable solutions i had a again relationship with them. so when i started to hear some music in brick and mortar i went over there and spoke with the sound technical. i we would him to the neighborhood and i said we were experiencing too much noise so they said they were working on a solution and it would take three weeks and they would turn it
12:45 pm
down in the meantime and i said fine don't worry about it and it went on inform 7 weeks. i met with someone who wouldn't tell me his name and said he didn't have to take the stuff and walked away from me. i never received any invites or any letters until making maybe a couple of months ago. i never received any letters inviting me over for any sound
12:46 pm
approving. it doesn't matter i can hear it i can hear drums and guitar the whole abandon inside my living room and at this point, i have not had any improvement. i'm actually, the person he was referring to when he said someone refused the sound test that's not the case i invite him over several times. we did set up a meeting and by sheer coincide there was not much enjoys the night he set up with me. but it did again get raised up and i e-mailed him and invited him back over. you said you heard varies
12:47 pm
instruments like the guitars and drums and socials? >> yes and have you ever been provided with an contacted number that you can call and complain? >> not directly he did give me a card at the meeting that was postponed but no, he never contacted me directly. >> i was wondering florida got a number to call whosoever in charge? >> no. >> thank you very much. any further comments? don't raise your hand come on up >> thank you very much it's an how were you to address this honorable commission today. i live in the wood ward
12:48 pm
neighborhood area father of the two children and two handicapped 80 years old parents in the building. we've been there in the neighborhood for 10 years. we noticed that the noise was when they had a heavier this and that. it w it was excess at points then over the last couple of months i actually noticed it because the stereo in my living room was loud. but my daughter said - she asked me if they stopped doing the loud music at night because she didn't -- she's not bothered by
12:49 pm
it. we notice on the high nights there's some sounds perhaps is escaping out of the roof area. my building is next but i'm getting it this way in in my opinion they've addressed the issue it's not that the sound issues can't be addressed. and on the compromising community participation i've been the the law firm and we know it compassion and community participation. and as i'm listening to this personally do go to bars or clubs my

12:51 pm
>> san francisco is the hub of music and i'm a professional musician. i turned down other schools to go to and over the course of the last few years this business has merged to take care of us musician. and this is the place that's be able to make things happen.
12:52 pm
i've been there when they shut down the club to install new things and i can see some disdain the way they've dealt with that but this seems to me like a place that's trying to a safe the neighborhood. we hope this can be installed overnight but from any prospective it really embraced what san francisco has to offer >> thank you next. >> my name is tim, i live on wood ward street on the bottom
12:53 pm
floor. first of all, we've been through here from the supper club i'll take brick and mortar overall of them. they installed a much larger sound system over the other clubs and i don't know why they wouldn't expect complaints. by the by the way, there were a lot of complaints about the other clubs if this were an interim issue but for every other night for two years with respect to the outreach. the flyers went out in the afternoon and the wood ward street is a tight commit street and we know that nobody from
12:54 pm
wood ward was at the meeting i don't know whatever 1 hundred folks we don't know where they came from. it was not the folks effected by it. despite what the flyers this is some type of fight for the mission i want the club to stay there. i've told them many times. we have some issues with one manager but i want the club there not the sound in my living room >> thank you next. >> hi. i live at 17 mission street next to bring and motor i share a wall with them.
12:55 pm
i want to reiterate that those of us in the neighborhood don't want the venue closed we just want them to go by the code. i can't get any sleep by i've lived there seven months i've had a problem. i've been working with them to see what we can do. so far as the community outreach mr. perkins was talking about again that flier got put on my door at 4:00 p.m. i know that nobody in my building was at that meeting. i don't know who he was talking about. i spoke with my landlord to see
12:56 pm
if he has gone over to see any improvements. and he said, yes physically he's seen improvements made. and i have seen physical improvements, however, the sound is actually in the past couple of weeks significantly louder than and my walls have i been probate. there are drums and vocals and the guitars >> can i ask you a question. so your floors rumble you feel have i been arbitrations? >> you said you hear everything
12:57 pm
t guitars and drums. >> but i'm one floor up. their ceiling is where my floor starts that's their roof. it is very loud so i've had to miss work and move to a different shift >> thank you next. >> hi i'm bruce. i actually owned cod a brown i know someone has mentioned it sound system was much louder and that's not true. i want to make that point clear >> yeah, that's something.
12:58 pm
is there a limit on that system >> it's the same system; correct. >> we had our sound guy take the sound rrldz a lot of - >> basically every night - >> so we're running around 90 a little bit under and i know what the how is about 70 - and. >> but that's not my question. >> thank you. >> good evening. i'm happy to be hereafter two years. >> i have a big spiel but i'm going to skip ahead and show you
12:59 pm
some photos. >> there you go. >> i don't know how you can see but this is an article view those are dots of people who live - >> talk into the microphone. >> all the dots are residents of wood ward street that that have been in our complaint. there are several folks that have had one problem in the form of another. this is a picture of brick and mortar s roof. here they've added a layer of 12
