1:01 pm
. when he started this presentation there was sound on say roof and sidewalk and sound leaking from an office door. so the problem hadn't been fixed. thanks >> state your name. i'm tom. any other public comment? >> good evening commissioner i'm michael o'connor i'm jason's partner. i've dwelt with sound problems in the past.
1:02 pm
i've listened to everyone's comments the only addition there was a lot of sound professional down on the building by that's a small point. there's no significant neighborhood group for this part of the mission we could be the members of c mac but there are not addressing this area. a lot of areas have mission groups maybe we should start one. i know when we first opened i addressed that first issue and did the outreach but she had a neighborhood outreach for that
1:03 pm
area. furthermore when i looked into the venue when it closed and people asked me why is it that people keep having these venues clos clos close? we've done a lot of city events and we care. sound proving is not a specific thing we have not been able to solve this but we'll keep doing more. if this doesn't work we'll close and we'll sell to a restaurants. and i'm not saying this
1:04 pm
disrespect fully because that's where the river is going. that's not a criticism of what's going on it's just a fact. we'll continue to try and try and try but at a certainty time i don't want to be here in a year where people can't sleep >> can i ask a question? when you bring the abandons do the musicians bring their own back lines? >> this lady pointed at monitor board for the input and basis meaning they were at zero and
1:05 pm
they were fully being driveng from the apps on stage. sometime we're not - it at any time - i asked her to go up to the next abandon and ask them to turn it down for the next act >> okay. thank you very much. that's it thanks >> any other further public comment? can we hear from you on this, please? >> thank you. >> good evening commissioners this is officer from the police department. being fairly new to the permit
1:06 pm
position at mission station only since you sent i think this issue had gone before my tenure and at this point the folks who were involved expressed the nuisances have gone beyond sf p.d. and come straight to us. that being said i had interaction today with mr. perkins regarding an event to be held at brick and mortar expressing the fact that the promoters were promoting an 18 and over show when their applications states clearly that it would be a 21 and over venue past the hour of 930.
1:07 pm
and furthermore, their capacity is such that the number of artists that were being uncertain the capacity was overflow and possible gang affiliation with the artists. mr. perkins was very open about the conversation and that's my only experience. i'm hearing information and this is certainly new to me and enlighten and i look forward to having open door conversation with brick and mortar and folks.
1:08 pm
and i mentioned to them entree on my part to form a mission street and lindsey corridor alliance where we would meet and have an open forum to discuss those issues >> thank you very much. okay commissioners what is before us is the reconditioning of the permit. if you look on the second page of the timeline they've made some suggestions. i have some other suggestions. it is in in my opinion that one of the reasons this venue can't control it's sound is because it doesn't control it's back line. one musician will bring in a
1:09 pm
kind of equipment and they produce different sounds. so maybe he condition their permits to designate what the back line can be and restrict the sound >> either that or issue it through the board. >> some base can go through the sound. >> obviously their second sunday people they're playing dj music but when you have a live abandon you've got base and
1:10 pm
guitars and drums it's up to the operator that is doing it a certainty level he goes deaf and such you if the microphones they go through the board if you turn the microphones off you've got just the drums and such. >> looking at the photos on the roof i mean sound does go up. i failed when my city lights were there when we had music. as you know i had the neighbors in wall street alleyway that are
1:11 pm
in line with my roofline. i don't have those complaints anymore. so he's got to fix his structure. he said most venues 90 d vs 0 acceptable but no, not in every building. in this case and i go back do the recommendation that was supposedly done in the report and to find the leaks should be eased. and i think if he can do those things that will be a better solution especially the back line and all that it will help. i think an eliminateer will help. if someone has to go to the
1:12 pm
bathroom the eliminateor will push it back down >> you can't control a drum kit it's a drum kits. i was going to ask in the commissioner in their deliberation can we we enforce and consider the time and resources that the staff has and the time already put in with respect to what direction plantations are? >> what i mean it give us the instruction in terms of timeline for this solution. it's not necessarily that it permit be changed. you can, you know, direct us in a creativity a way you can think
1:13 pm
of so long as it's going to get us to a place we all want a resolution >> i'm thinking commissioners they need to contract this sound approving committee and show us this contract. the staff has recommended that we limit the operation between 12:00 p.m. and 5:00 a.m. that's what staff is recommending. and 80 d b in the center of their dance floor and they'll send the sf p.d. an updated plan. permit holder will submit a timeline with when all the sound approving will be done and
1:14 pm
that's the contract to do that. permit holder will suspend all shows until this is may be ated. the permit i holder will install a phenomenon line to be contracted dribble. and will sound proof front door >> and the phone line i would like to end it there instead of sound like booth directly. i think others have a phone and when there's a fun and there are needs to be a phone at the venue
1:15 pm
for that specifically. so if there's a phone in the venue it would be great >> number 2 how are we going to monitor their cap without an eliminateor? >> i will go to what director came in said about sheer resources. i, you know, it's a touchy subject for us we don't have the resources to show up every time a brick and mortar is open >> do they have a limiter? >> no, but really we're looking for compliance so security is not -- we had some security
1:16 pm
issues but it's not been an issue. we have had crowd control problems but it's been resolved. again, we throw out these recommendations to get you guys to think about this but ultimately we're looking for compliance. the neighbors have been rolling for this for two years ago. we're just looking for pa resolution >> have the citations been paid? >> no, not that i know of. so far as i know we haven't received any >> anyone else? >> i want to make a statement about vubz in this area.
1:17 pm
we need venues to come into compliance. i like punk rock but the neighbors behind the venue need to hear it that loud. the city is changing and there are people moving in here that's what urban living is about. and if you really are so concerned about keeping entertainment and special venues open you have to comply with the law and sound proof argue place. i had to say the same thing to the rose room and they had to close. but you can't have sound
1:18 pm
escaping your venue and you've had two years ago to do that and i resent the fact because i think i don't understand it but i do understand. so i don't think this is the issue it's about coming into compliance and stopping is annoyances of the neighbors >> so you make a motion? >> i would like to move to limit the operations of operation from 12:00 p.m. to 5:00 a.m. and the permit holders will be a b.a. and they will send an updated security plan and the permit holder will submit a timeline of hard dates of what
1:19 pm
sound roof approving will be done. 4/15 the permit holder will suspended all operations. the permit will have a phone line installed or a cell phone would be fine so the person who is managing that night will be able to public pickup at any time for for the neighbors >> and we want to see -- permit holder will better control the sound coming from the front door and especially the roof of the venue and we need to see a copy of that contact. if they don't have is a problem with security no issue there and
1:20 pm
all citations will be paid >> we have a motion and a second - >> commissioner? >> yes and i want to a clarification in your amendment. >> permit holder will suspended all shows until the sound approving is holding i do believe this is only during the shows so maybe we could limit their shows to the weekend or thursday, friday and saturday but to suspend all their shows would be a hardship. >> so can we limit their operations on weekend and from 5:00 p.m. to 11 thirty during
1:21 pm
the week. >> and take out the line where they suspend all their shows. >> yes. >> you you know that once it's with the commission it's all that. >> that is motion does the second accept the friendly amendment? >> yes. >> we have a motion and a second any further discussion? >> (calling names) . all right. >> next item on our agenda. the police department questions and comments?
1:22 pm
>> hello steven from the central station. i want to clarify part of the discussion we had earlier with two incidents. one specifically was tied to a poor one lady was struck and it caused lacerations. the other one was a disturbance on may 12th. in the report it doesn't specifically talk about the parlor, however, it talks about a large disturbance right out in front in the intersection and that occurs when a cabdriver hit
1:23 pm
the horn and somebody hit his car with their fist and he got out and was struck by a door. one of the officers was surround and called for more units and one period of time was arrested. there was an agency evaded assault on may 11th a woman was struck in the face and head and she went to help one of her friends when a fight started and she became one of the victims. the employee helped by the gufz a photo of the guilt party. now they had to be escorted back
1:24 pm
to their bus because there were cars circling around the bus. we checked that out and there was nothing about the party bus the victim was on the party bus that about there was disturbing the peace and the person was trying to start a fight and the officer was trying to get him to stop and the guilty party tried to get away and there was a situation involving the officers gun. on may 12th on south gary street and a wallet was stolen from jackson street.
1:25 pm
there was a coaxed arrest nothing affiliated with the club. i did is a notice of the violation on may 11th at 1235 for the violation. as soon as i got on the block could hear the doors and windows were wide open and the sidewalk was also blocked so in a notice of violation i put the good neighbor policy. i talked to the owner trying to lit them know how to comply and it's a work in progress. he didn't feel he had to keep the windows closes and i said i
1:26 pm
wouldn't be hear. and it was loud so that's a work in progress. the other was a lodge for a noise complaint. the cab reported loud music coming from a lodge they were advised to shut the door >> i was curious what the officer in that one report anyway related to that bar incident? >> no. >> i believe i've received neighbor complaints in the past. > in the past yes going back a while there hadn't been much lately in doing compliance checks. >> are they permitted through us?
1:27 pm
jocelyn? >> i'm not sure if canceling has a permit from us. >> i thought they did. >> and they might it's probably very, very old. it's possible there could be - a place of entertainment or maybe a pool table are something >> okay. thank you. >> sorry. >> i get that a lot from you. >> anyone else questions? >> the parlor it comes up a lot. i agree i know that in the past we've brought them in with staff and it generally helps quite a bit but now that the summer is coming here the service is coming more. >> have they changed their
1:28 pm
security? >> that would be interesting to know. >> if they changed their security. i mean, i still want to have dialog with them but i would like to see them come here. and let them know they shouldn't be going down there all the time >> anything else? >> item 6 hearing a permit number 6 a. now if i kill your name, please forgive me
1:29 pm
>> all right. you know, widely successful very close to city hall would like to have live music and they're thinking small-scale. i have been in business for several years debiting got a type of 41 and they've received all their letters of support. >> i'm a manager at the brenda's food. i reached out to the neighborhood we joined the first meeting. we received nothing but praises with that so we moved forward with the neighborhood. i received a letter from the motor coach thinking and we would like to move forward
1:30 pm
>> okay. questions commissioners? >> okay. why don't you have a seat i'm opening the floor to public comment. there a public comment? seeing none, public comment is closed. motion? >> i have a motion to approve. >> any questions. >> all right. we'll take a vote (calling names) >> okay. >> grits and shrimp. >> i'm sorry i'm sorry please
