relayed and started the farmers markets. it's not run by an outside vendor but is run by people in the neighborhood. it's a well attended farmer's market it's extremely well run. it's a town square for the neighborhood. there are no other places like this. a few years ago the ministry who owners the parking lot they decided to sell the parking lot. and that would mean this would be sold off as condominiums. the neighborhood relayed and decided we should try to turn this into a permanent park to

preserve this for noah valley. i think a lot of people were skeptical at the beginning but the folks were visionary and a have be able to move this project forward. await any commitment from the city to purchase the lot they've objected $500,000 from people in the neighborhood from 20 up to $15,000. because there's so much support 90 for this project in the neighborhood. this is very exciting to acquire this property to turn it into a permanent space in town square.

it's an opportunity we should sees because while it's i easy to lose open space for development you never get it back. i also want to say there are other opportunity and will be other opportunities to acquire open space. i know in supervisor cowen's district we have an opportunity along venice to complete a beautiful waterfront park. i'm extremely supportive of that. i know there's a desire to getting an acquisition in another supervisors park. we have a fund that biltsdz and we have opportunities to

bond and for supporting capital projects. for the northern waterfront restoration project. item 15 is authorizing a engineering and design services for the port cruise ship terminal not to exceed 11.9 million through 2014. and item 16 is not to exceed the port revenue bond for the purpose of funding the crews terminal project >> a colleagues can we take those items. >> thank you mr. chair i have a question about item 15 can someone from the port come and

answer this? ii certainly support, you know, the completion of the crews terminal. >> this is the original amount of the contract what was competitively bid was $2 million and we're talking about it was actually 2.4 million with this sixth amendment you're talking about it being 11.4 million our talking about a contract that was competitively bid now we're talking about 5 times the original amount. this is not how i want to do that?

>> the port originally bid the contract for the entire scope of project one and two and this reflects different phases of the project. we wanted to get through certainty phases of the process. this amendment before you today is true tow the original scope of phase two for the designer agricultural work. it looks like like it went higher >> could you tell me why you couldn't do a contract that covers the entirety of the whole contract because it you do it in

a piece meal why it could be more to from the beginning. >> i want to ask assistance from the project team, however, i'm answer my best understanding of that that is, we want to proceed the project and see how that scope of work needs to be evaluated over time. so it wouldn't necessarily reflect that work. and in regards to the funding we've been appropriating the funds rather in a piece meal way? one way to hold out on the final step of the appropriations >> anyone? >> port project director. one part of this project is we

really move forward n it ahead in stems. we had an original building that was an oil shed it was an opportunity to develop it into a new start of the art cruise terminal. it seems the old building was in the way of the imply building. so we went through this promise in various ways looking at the use of the old building and the conceptual design and we did this also through the port commission vooigdz them and taking their recommendation how to proceed with this step that's why it was done in pieces >> i would simply ask we take item it 15 separately.

>> this sort of triggers another question whether this is one project or several projects. and seeing, you know, having a different phase for each of those projects it makes me think and wonder why we don't develop it separately then rather than adding on things that in for the original contractor to reap the benefits. and we ask port staff to come back >> kim port project director. one of the parts of phasing this project was that we the

america's cup effort authority came into the picture and it became apparently this there was some issue about the entitlements to get the phase of the building completed for they're first special font. really the second part of the project phase two which is part of the request is to build out the two acre waterfront park and the in my fender system and the borders point of protection. so this is the first phase of the project >> that's sort of my point those projects shouldn't it be put out forbid separately. >> that was certainly an

option. the decision was made to bid it in phases and it's a construction management construction contract to our contractor receives the work that they do. >> maybe i need to ask the city attorney what you're opinion is in terms of how we put things out to bid. >> deputy city attorney john. i'm - i can't speak in any daily about this particular contract, however, our office is involved in the contracting decided. contracts - construction management contracts can be set up in different ways and put out

to bid at different phases or structured in such a way to have additional work but i defer to the project team how the decisions were made in this case. thank you. i appreciate the questions that supervisor yee raised. i think they go to the point which is that what's not entirely clear it if we're getting the best deal possible if you have a situation where maybe you had potentially multiple projects i could have gotten a better deal by bidding them separately. the fact that you're having a contract amended 6 times even if it's legal or it meets the legal

requirements doesn't necessarily plane it's the best decision. as a general rule i don't think you want to amend contracts this - this many times. i'm uncomfortable and i'll not be supporting the amendment >> the port if you'd like to respond to that. >> i would. i thought we'd move forward on. i was addressing the construction contract. referring back to the extension of the km d contract. those were our designers we brought in. there was another company that is a renounced cruise terminals. those people brought a contract
