could you respond to that? >> yes. we did repurpose one of the digester's no. 5. we have not gone from 10 is to 9 and not done good planning to get back to 10. as i mentioned in my presentation we repurposed that for control given that the facility is 1940's technology and hasn't kept in part to what we believe we should be doing

for that community. we have purposely only had 9 digester's working. we've known that salt of that we needed to replace that which will be the next item for you for your consideration. but we did regular routine inspection which identified this particular emergency followed by more deat -- detailed inspection. we do not believe it's poor planning but we do believe we are dealing with a facility that is beyond it's life and particularly the operation staff are doing a great job given it's age and technology and really trying to be responsive to the neighborhood that is literally across the street from us. >> thank you. comments at this

time? >> okay. go to our annual report. to repair the storage tanks of not to exceed the cost of $9 million. to the bottom of the report, this resolution does not include a request for approval for emergency repairs to the southeast water pollution control plant digester two which was completed under an emergency contract with monitoring the mechanical company in march of 2013 . the resolution before you is $9 million. not $10.3 million. therefore our origination because we recognize this work and we agree with the department in that respect that we recommend that you amend the proposed

resolution authorize the puc's use to increase the authorized use with monitoring the mechanical company by 13425, for no to exceed for the repairs the total of 26 digesters instead of 5 and two solid bins. and that you approve the resolution as amended. i would be happy to respond to questions. >> you are now recommending increasing items, is that correct? >> we are recommending increase because the department has spent this money on an emergency basis which we agreed with but we point out the department failed to submit legislation for the first emergency. >> got you. colleagues, any other questions?

point community supports the resolution before you. i want to make it clear. we representing today the april, we want to make this clear. we don't want to smell those digesters any longer in the current condition they are in. we ask that you all take the liberty of moving this legislative piece forward because our community has suffered for many days. i don't know if any of you have been out there, but we have moments where you can barely deal with the smell. and this is an absolute result of those digesters not being covered. so i express to you all to please move quickly on this resolution that's before you and we all support the puc on this matter

francisco decosta? >> my name is francisco decosta. supervisors, the constituents have san francisco passed a proposition years ago to deal with the sewage treatment plant and the water system what is now called the water system improvement project. the san francisco public utilities commission dropped addressing the sewage treatment plant and went with the water system improvement project. this was years ago, around 12 years ago. because of the deferred maintenance, the digesters can no longer operate

and if there is a big one, hundreds of homes will be inundated with raw sewage. so simply put, whether we like it or not because the supervisors do not follow the trend or that proposition, you need to give your blessings because you represent the constituents and because the residents are suffering and this maintenance job has to be done. one of the reasons we have to do this right now is to capture sand and the aggregate that is going to further impact this treatment plant. i'm asking you

only that but other people's sewage is processed there. it's amazing what you can get used to. if you have never been there and you roll up on third and evans about 3:00, this makes you gag. i have gotten accustomed to it. that is ridiculous. everybody is talking about fixing the infrastructure of the city. no where do you have as much infrastructure that you have in the south district. you owe it to the residents from an environmental standpoint to take care of this now. this city's local hire laws apply there. which is also important because of the unemployment rates that are in that community. here is an opportunity to improve the city's overall infrastructure which needs to be done because

program. southeast plant not to $80 million and not to exceed 10 years. >> in order to treat waste water and improve the quality of life next to the facility. we need to rebuild the plant. this is part of the first phase over all sewer system that will modernize equipment at the plant and make sure it's sound and relocate the digesters further away from the neighboring homes. this is the first contract of what is almost a billion dollar project. from my perspective it's one of the most important. for any of you who have been in

the south east like some of the public speakers today you have had a memorable experience. several members of the families in this community have lived by this treatment plant. we've noticed the smell that lingers for blocks. the contract is for a plan in engineering to replace this. there is a team that that has been selected with the highest expertise on this project. in addition there is over $11 million on this project that is going to provide local participation. the project also

provides community benefits which is on-the-job training and will support local organizations. today we have mr. cruise frlt from the puc. >> thank you. as previously stated in the last item the current plant was commissioned in 1962. it processes 80 percent of the solid waste today. replacing it would be the best thing for the puc. to ensure the best available technology for the facility and a facility so proximate to residential neighbors, we need 2 years of planning and technology analysis which will

be followed by 2 years of environmental, 5 years of construction. while this is still a long way off, it's a 10-year program. it will be $800 million worth of construction. the facility itself is going to be towards the end of it's useful life and it's imperative that we move forward in order to replace this facility both for the immediate neighborhood that has been living with this for decades as well as the county and city of san francisco given the amount of the waste this facility processes. the puc design and planning services in april of 2013. we did receive one proposal from the brown and caldwell team for your

consideration today. this type of work is extremely specialized and the size of this particular is also important. there are not many built worldwide. we know there is a small group of professional services that can do this work. that coupled with the fact that we already have some of those firms under contract through our program manage and they were precluded from participating in this job. we anticipated there would be a small pool of qualified bidders. we received multiple bids and all of them were qualified. the contract is for $80 million. given the size of the actual construction. $800 million of construction. it's consistent with professional guidelines as the cost

associated with the design versus construction. additionally brown and caldwell has made a commitment in providing us with the highest quality of staff but they have also made a commitment for the community program of spending $1 million of their own money in the community to help benefit that community. that will be done by ways of mentoring, and scholarship education for the community throughout the active part of the contract. we believe that we have posed before you a highly qualified team, a team that has showed commitment to the puc and it's imperative that we continue to further

this project. i would be happy to answer any questions at this time. >> can we go to the budget report. >> on the bottom of page 10 of our report table 3, page 11, provided by the puc identifies specific planning and design services anticipate deliver dates and breakdown of the estimated cost on this subject agreement. on page 12 of our report, we note that the average rate to be paid on this $12 of our report, we note that the average rate to be paid on this contract is 18o for a total cost fof -- and subconsultant markup on table 3, on page 11 of this report.

size of our general electric capacity. we are going to use reclaimed water in order to preserve our portable water used by the residents. we are going to look the end tire plant and try to balance. >> and i just think it would be really great if the puc were cognizant were working around the plant. >> certainly. >> you mentioned lb participation. this contract is designed to have maximization?

>> yes, we worked with the contract in the city. slightly lower than many of our design contracts get because of the specialty of the biosolids technology that exist worldwide. we set a goal of 10 percent. brown and caldwell exceeded that by 35 percent. they are bringing men and women. $11 million of this contract was committed to lb firms. in addition to these firms brown and caldwell has men and women who have participated and graduated out of the lb programs. their residents doesn't allow them to provide this anymore. but they will continue to
