here in the chambers with all the diverse perspectives and even in her accomodation come to follow that. i'm grateful for her work and life so much good happened. and we're all here to decade her journey that she's started and a thank you very much (clapping) thank you very much. madam clerk why don't we precede with the regular business of the board and if we could move to items 17 and 18 related to sequa. if we could give a moment for the room to clear. folks are able to take their conversations outside i want to

thank everyone for being here. thank you. with that madam clerk why don't you call items 17 and 18 >> there from the land as you and economic committee there's the ordinances charter 31 the equal it act. >> supervisor wiener. >> thank you mr. chairman. colleagues before us today it is a long overdue by about a decade ordinance establishing clear procedures and deadlines and noticing rules for the sequa environment quality act. 10 years the law was changed they could be both appealable to

the board of supervisors. however, for any sequa organizations particularly for smaller projects san francisco never got around to codifying the procedures and deadlines for the board of supervisors. when i introduced this legislation last november i was the figure out supervisor to codify the appeal procedures after several others. never before have we gotten this far and now it the time after so many years to pass this legislation. the lack of clear procedures means in san francisco sequa appeals are like the wide west. we have no defined deadlines for filing appeals. in fact, before piling filing an appeal it's not possible to know whether your appeal is timely or

not. we cannot call the planning department and ask because i won't get an answer. you usually need to hire american people lawyer to tell you something that simple. colleagues as you know, we operate under the so-called interim procedures promulgated it's a lengthy and convoluted mobile home of a procedure we need to appeal to the city attorney and now that's to determine whether or not the appeal is timely. and a significant number of sequa appeals to the boards are untimely and sometimes i've spoken to the city attorney why the explanation is so convoluted that 10 minutes later i can't repeat with the city attorney told me. our inpredict process leads to

appeals filed mid construction as opposed to handing appeals before they go into construction. this is government at its worse unpredictable and unknowable by the citizens. last november i introduced legislation to address it problematic legislation. the legislation i introduced did two things first, the clear procedures including a clear deadline to file an appeal triggered by the first approval the project and second it approved and enhanced public noticing so people will know when to file an appeal if they wish to do so. and a colleagues i'm happy to report it's legislation it does just that that sets a clear prier including a clear deadline

and that approves noticing. those key proirgsz were in the legislation then and today. this legislation will approve our process and treat everyone fairly. for both support elders and opponents of the project they'll know when to file and it has padded. and no multiple appeals under those the significant change has considered. colleagues to get here this legislation has gown through the most extensive process. we had 6 hearing in the land use committee and 3 hearings at the preference commission and 2 hearings and planning commission and 3 round table meetings and

many, many smaller meetings with supporters and poernts arrest as a result of this important legislation i made of amendments very positive amendments even before this legislation ever came to the land use committee amendments that were largely focused on the process. this has garden everyday great support it has been recommended it be approved. the legislation has been endorsed by the bicycle coalition and half a dozen housing organizations and several neighborhood organizations the greenbelt alliance and conspire. organization which understand the volume of a fair,

predictable and a fair process. i want to acknowledge and thank our board president. sometimes during the legislation process it's easy only to vote. president chiu was very active in proposing a number of amendments. and those amendments some which will be over and over today will be around approving our process which has always been a goal of our legislation. i support the maximums but the core of this legislation is the same as it was when i introduced it set a clear deadline triggered by the approval to not

have the you want appeals and improve the notice. this hastening tailed an numerous amount of work over a year before i introduced it and a lot of people have poured blood, sweat, and tears. i want to acknowledge my legislative aid who has done numerous work. this is like food trucks a few weeks ago. my previous legislative i'd she was in my office and we does a lot of the preintroduction work. i want to thank the lady from the city attorney's office. but she's really done a tremendous job and no one knows sequa like elaine.

and our environmental officer and she was still the planning department personnel person. i want to thank everyone who put summoning so much time and energy. colleagues this legislation is ready to be passed it's under gone troublesome work and collaboration i urge your support >> thank you mr. chairman and thank you supervisor wiener. colleagues today, i hope we'll be able to finally make your you may answer the question i didn't process for transparent for all san franciscans. i think we all know that the ordinance is not going to fundamentally change the decision making here in our city nor change our highly engaged

political procedure. we is codify the sequa declarations. i don't think this ordnance is going to cause us to stop disagreeing but we'll be much closer to agreeing on key saek ground rules. we've heard this legislation many times and we've made 8 amendments in april and a 9 in may and colleagues i've circulated to you dozens of changes in the ordinance. now let me state at the most basic level i would be comfortable with supervisor wiener's ordinance and i would vote on it without changes but that being said a number of motion to strike i thought that my office folks go i was

hopefully those legislations would be having a consensus measure. i'm not going to go through the entire packet but i'll point out that my staff has copies of the amendment that have been passed out and for any members of the public you can have a one. i'm not going to go through all the details but i'm going to mention the peefkz. we have an operation system that kicks in and we reviolator back to the practice of not waiting for a approval. we finalize bicyclist and pedestrian safety in the sequa

process. we codify exist procedures how the planning department authority to other departments we codify the content for all determinations. i want to thank all the stakeholders. so there's much clearer direction which when a sequa decision t is required. we have provisions of when online posting is required we have codified the drafting procedures and this crafts a compromise after an appeal. in supervisors wiener's first revision they stopped completely when an appeal was filed and under my legislation it keeps on

going forward. this helps to not duplicate the efforts. i've circulated one document that simply has an earlier date. colleagues i do want to join supervisor wiener in thanking a number of folks starting first with supervisor weaning who has done work frankly over a year before there was any community debate over this issue. i want to thank supervisor wiener by comprising over a number of issues. while i didn't agree on every provision in his original ordinance i do believe in his go

government and his patience has been extraordinary and supervisor kim who worked hard to respond to concerns from many organizations around the community that were and the ordinance i'm over and over today reflects her best ideas. i want to join in the thanks to deputy attorney who spent an incredible amount of time and we're incredibly lucky to have an expert on this case as well as sarah jones. and who's been great to work with. i want to thank emily and i think i've spent more time on this topic more than any topic

on this year but the greatest thanks goes to my staff. thank you for all your we understand and evenings are i want to thank all the members of the community coalition the dozens of organizations we've had communicates with and in particular i want to thank paul who got up to speed very quickly we wouldn't be here without his efforts and as well as my predecessor who brought his considerable expertise. i want to give my support around

the determinations considering modifications and i've articulated my position & in the planning department last week. at this point, i'd like to move this package of amendments thank you all >> thank you supervisor chu. >> so we're coming to the end of a very robust supervisor wiener's key prospective's. the public deliberation on those important procedures have resulted in the two pieces of legislation color together. ultimately i think with the amendments that president chiu has brought together we have one cohesive legislation. someone joked that i should let

the labor of our work and - i want to be clear up that the supervisors we agreed with supervisor wiener that a clear process must take place. the one major change to sequa procedure that was introduced in both legislation what to establish a deadline of thirty days for smaller projects by the environmental officer or have no significant impact to the environment. it's comprise of those determination. approximately 5 thousand exemptions annual and 10 to 15

projects a year that goes to the impact report. the cornerstone was to institute a process by in spite of robust institutional process to make it easier for the public to get involved in projects in their community. it's important to the integrity of our community that we have a transparent process. the argument cabins the project constructed is that not the city rammed the project through to prevent them from giving input. people care in a city where people care about investment that happens and the parks are our living room of our community. is it doesn't mean they get everything they want by their voices and skernlz get heard.

notification is there and i'm pleased to see those office drafts with the coalitions sierra clubs and others have been incorporated. those pieces include the pieces by electronic mean and the notification and posting on the website based on the following indications. specific neighborhood as defined by the city and environmental impact reports. i also want to summarize other key victories that our coalition fought to insure and one is the authority of the board of supervisors to hear the environmental impact reviewers and this is to the full board we go believed has worked well.

second as i mentioned using technology to create a more transparent and open process by increasing the public's right to know and four is the affordable housing project. bicycle projects as advocated by supervisor avalos office and this would mean 1 hundred funded affordable housing project and bike and pet promotions that are to address safety issues that get the persistence over other projects and insure those projects are not mirandize in deadline processes. next it the exemption determination. this section is revised to identify the information and post it on the website lester

the public of the approval action of the appeal window. next is establishing deadlines that assists the board of supervisors in the peel hearing. and lastly, the potential significance prior to any approve the h t p authority was established and didn't have an established rule on the process. this legislation gives the commission the permission to comment on the the issues that are having an economical impact. last is modification having the environmental review officer notify the public of the environmental review. in closing, i want to say that many of us in this board promote

growth in this city. i worked on the outside and their support the legislation. we may not also agree but we agree there is a robust effort to allow the public to express their opinion. and if we didn't have this robust project i said probably support a lot less. this is also including projects that are - we're going to allow citizens to appeal the action. i want to recognize the dedicated work of the land use committee and their legislatively staff. i know that our legislative staff bet mirandize in the we'd

of the city attorney's office office and the planning staff so i want to recognize all of them and in particular danny. we've been fully vetted by the stakeholder and by the city attorney's office and stewards who are watching our environmental health while the city continues to grow i want to recognize the legislature staff of our co- sponsors. campos and others i want to thank another bunch of folks. and again to the neighborhood associations sierra club and labor entities that brought this to our office we want to thank you for drafting this and

working to compromise. i want to recognize there was an agreement that was made on first time approval vs. final approval this is a huge contention but at the end we went with the first proposal in channels for the robust process. i'd like to add my name as a co- sponsor >> thank you supervisor yee. >> thank you. when the residents from district 7 first approached me about sequa i understood how for this issue was to them. they talked about sequa as important to evaluate projects and have their impact on the neighborhoods. and a few months ago i was sitting down with the people

from district 7 you can imagine how interesting the discussions were in regards to the two pieces of legislation that were presented at the time and having it change every two days for me to have the discussion well, which version do you have today and so forth. it was a confusing discussion by the intend of the day with the hard work of supervisor wiener, chu and kim that we finally have come to a piece of legislation that the residents of my neighborhood can agree on. i'm happy to support this compromise and colleagues i'd like to say that noticing is the important that regardless of the size of the project the neighbors and people 3 are vivid in the neighborhood get timely

notice of projects that were my folks care about the neighborhoods and the additional noticing requirements in this legislative will insure their aware of any development. the second point i want to focus on it pedestrian safety. i'm very happy to see that the legislation includes proprietortion for citizens project. i have made pedestrian safety a priority and i'm happy to see this provision included in this legislative. i want to thank supervisor wiener and inspire kim for this compromise and supervisor chu for working real hard to introduce those amendments. colleagues i'm be supporting this today >> thank you
