11:30 am
time on this. the builder understands this and we have no prior experience with the planning department or other folks involved. we've been open and cooperative and we've had 350 face to face discussions. this process has taken a toil on us and more comes to light to see this is an exceptional and extraordinary circumstances. we've noticed a lot of strangers coming and going to our neighbor's house. they've been renting out their top floors. this has been going on since
11:31 am
2011. those are being rent by 5 days increments for 1 thousand there's a day. as your aware short-term ridges or rentals maybe prohibited without a conditional use permit. given the profit in residential neighborhoods is introducing the zoning designation and infringe on the square parking and they impact the residential community. i love our neighborhood and i serve on the neighborhood board. it smells this exposes us to
11:32 am
unnecessary risk by transient and shouldn't be loud. in summary i'm respectfully asking you to a discretionary review with a few things in mind the nature impact to the light we receive and the issues brought up to the gentleman and the use of the neighbors homes for improper preferences >> thank you. oh, is this a 3 minute part >> i'm about to ask if there's speakers in favor of the drs proposal. >> good evening. several months ago i was asked to look at the documents for the
11:33 am
remodel for 2425. the proposal presented we're going to identify any project adjusts. we look at the guidelines with regards to the light well, it's an understandable revision and you're relating the modifications that in my experienced in san francisco typically smaller lots are for smaller projects and the oppose for larger ones. this structure can lead to over building the site. we came to the following conclusions first, the impact on
11:34 am
the clients light well. and second the impact on the other light wells individually may have seemed small but taken as a whole it has a substantial impact on the quality of light and air. there's some things to be discussed and items that are incorporated into the addendum process and including the roof hatches that will have an impact. in summary this is a large project for the lot and my clients expenses are mounting everyday for the drywall cracking. it's unfortunate that the
11:35 am
sponsor is expanding his property that mitigation couldn't be arrested to. we request that you match the light we will to not allowing any additional construction that may further impact my client and my clients risk is limited to the damage of foundation. i want to close by looking at the building session that the building spokesperson has provided. note although this project can impact walls on my clients residence we're only asking inform the light well, to be matched. it's not a big task. thank you. now calling the project sponsor
11:36 am
>> good evening president fong and commissioners. my parents john and emily and myself own 2445. my wife and i reside there with our two children and my parents are on larkin street and other families stay close by who is our good friends. over the course of the last two years we've he crafted a project
11:37 am
that the neighborhood is comfort with and also the planning department. we've come up with planning designs that incorporated concessions there were presented to us by the building department and so on. started working diligently with the planning department to achieve a project that was sponsored by the planning department we were unable to satisfy your neighbors. as you are aware we submit the information the planning department overlooked the light well, and kate will attest to you pointed out this was a light well. and in the light of understanding kate and the planning department changed
11:38 am
their recommendations for us to match the standard procedure that was on july 2nd. and what we agreed to generally, the light well, some preserve the light and air in our dense environment and in this constant there's a circumstance that doesn't apply to other prospers. the 2001 renovation project as you can see the light well, doesn't run the entire length of the building. the recommendation to match this light well removed our right to builds in the neighborhood. we have the rights shifted you
11:39 am
thought the process is it's been the preservation of property. we've made many concessions pie concern is having to match the light well, our view will be directly into the neighbors master bedroom. this is a quick sketch you can see where the light window will be and that's the outline of the neighbors building. it's also interesting to me this light well has become such an issue we've agreed to all the demands except for one. however, i was very sure with our structural engineer we
11:40 am
designed to out to the neighbors last week and i haven't heard from them. i redesigned the floors several times and lower the levels that further lowered the need of t thees vacation line. so they said we've come to an agreement we've spent a lot of money. and we're willing to pay for the shoring but found it a little bit of unnerving. but in the hopes to make them feel comfortable we offered to put him on the wrap up policy and taking care of of any litigation financial and we went
11:41 am
ahead with our engineer team to restructure the design. and once again the light well, was never their issue it was privacy andes vacation and they brought up the light well during the operation of our previous meeting that was never an issue >> thank you. calling speakers in support of the project sponsor > >>. are there any speakers 90 in support of the project sponsor >> i'm the mom. i mean this is my husband. we have 6 kids and my son married a gal from usa trail so
11:42 am
when we travel my son will rent the place out. i want to see my children but they also come to visit a lot so we're happy to have a place in san francisco for them to stay. i have nothing else to say, john you want to speak? >> okay. thank you. are there any other speakers in support of the project sponsor. requester you have a two minute rebuttal >> thank you. regarding the one point that latin-american was never a
11:43 am
concern of ourselves you'll see a memo in our packet that states the concern and it states that the project sponsor said he'll get back to the architect about the changes. he was not willing to change his design unless required to because he, he simply ignored us. we focused to come to terms on others issues since this was ignored >> can i add. >> one minute. i want to point out a couple of of the photographs in our packet. my client purchased unique home. a lot of the enclosure about
11:44 am
mitigated so as opposed to fighting this whole project. and to address the project sponsors comments about the light with window not put a window there against the back wall. thank you. >> okay project sponsor you have a two minute rebuttal. >> so i'd like to make a couple of follow-up points. as you can tell by the sun study there's very little impact upon the property throughout the course of the year. you know, we're looking at march 21st there you're seeing a little bit of impact but
11:45 am
importing and exporting nothing in the building and here in june something minimal. and it's the worse time of the year the sun is low we did that study and regarding working with the folks i met - tried to meet with them twice before i submitted this project in august. both times when i knocked on the door and spoke with the gentleman he was too busy >> i said i'd like to get our comments first, we set back the roof-deck for privacy purposes in all honesty, i tried to work with raul but it was also
11:46 am
foundation and privacy. and that's pretty much it. i wish he'd express f that from the get go but it's hard when i try to meet with someone and they can't find the time and making me wait and wait 1 hundred and 32 days to the planning part. thank you >> the public hearing is closed and opening up to commissioner comments. >> well, i think i have to pretty much go with what staff recommended although it's not be been discovered it's only good to match the height and dakota take the dr and approve it with
11:47 am
the dr to provide a matching light wall. >> second. >> open that motion commissioners to take the dr and take the modification proposed by staff so move forward commissioners that motion passes unanimously 6 to zero and places you under a public comment i have no speaker cards arrest any public comment? if none the meeting is
11:48 am
11:49 am
11:50 am
>> being a pedestrian in san francisco is not easy for anybody. >> [inaudible] people push tables and chairs outside the sidewalk. >> i have to be careful not to walk the sidewalk. it is very hard. >> sometimes people get half
11:51 am
way across the intersection. >> you have to be alert because there is always something coming up that you need to know about. >> i learned to listen to the traffic patterns. sometimes i notice the other pedestrians, they are crossing, on occasion, i have decided i'm going to cross, too. i get to the middle of the intersection, and i find out that the light has changed. >> we need to be able to work and go from one place to the other and have public transportation. the world needs to be open. >> people on disability has the task of addressing all the disability. when we are talk about the
11:52 am
sidewalks, ramps, we have very specific issues. for people blind and low vision, we have the issue of knowing where they are and when the cross. it can be hit or miss. >> at hulk and grove, that sound the the automatic -- it helps people cross the street safely. >> now we have a successful pedestrian signal. >> i push the button, i get an audible message letting me know that i need to wait. when it is safe to cross, not only am i going to get an audible indicator, this button is going to vibrate.
11:53 am
so it tells me it is safe. there is the driller sound and this trigger is vibrating. i am not relying on anything but the actual light change, the light cycle built into it. >> it brings san francisco from one of the major cities in the u.s. to what is going to be the lead city in the country. >> city working on all sorts of things. we are trying to be new and
11:54 am
innovative and go beyond the ada says and make life more successful for people. >> disability rights movement, the city has the overall legal obligation to manage and maintain the accessibility and right of way. with regards to the curb ramps, bounded by a groove border, 12-inch wide border. for people with low vision to get the same information. the shape of the domes, flush transition between the bolt bottom of the ramp and gutter.
11:55 am
>> we have a beveled transition on the change in level, tape on the surfaces, temporary asphalt to fill in level changes, flush transition to temporary wood platform and ramp down into the street under the scaffoldinging. detectable ramps. they are all detectable. nothing down below or protruding that people are going to get snagged up on. smooth clean that nobody is going get caught up on. >> our no. 1 issue is what we see here, the uplifting and shreufting to concrete due too
11:56 am
street tree roots. here is another problem we have with street trees. if i have i was a person blind, this would be an uncomfortable way to find out. >> we don't want to create hazards. >> sometimes vendors put sidewalk cafes where people push the chairs too far out. >> sometimes it can be impassable. so much foot traffic that there is no room for a wheelchair or walker to go by. >> san francisco is a lively street life, it can be an issue
11:57 am
with people with visual disabilities as well. they have these diverting barriers on other side of this tables and chairs area. if people can find thraeur way around it without getting tangled up, it is still fully accessible. >> we don't want anything special. we want people to basically adhere to the regulations and laws as they are on the books now. people can also, just be cognizant if they have stuff on the street, they thaoed to have 48 inches so we can pass, think outside your own spectrum of yourself that there are other people you need to share the sidewalk with. we will all get along better.
11:58 am
>> although san francisco is a hilly place for a whraoel chair user, we seem to be better at most. that doesn't mean we can't continue to improve upon ourselves. >> the public has a clear are -- of travel. we can't be every to make sure that is the place. we have to rely on the place. call 311. give them your name. that goes into a data base. >> it is difficult, still, um to make the case that the disabled community isn't being represented. in some ways we are not. we have a long way to go. >> the city of san francisco is
11:59 am
using the most innovative technology available. these devices allow people to remain out in their communities, doing things like shopping. it is great to be able to walk as a pedestrian in this city and cross streets safely. test,
12:00 pm
test, test, test, test, test, test, test okay i'd like to call this meeting to order.
