topic class needs to be implemented. a stand-alone class to review california vehicle code and traffic codes as related to bicycling is essential to training and also stresses to officers the importance of this issue. the jury would like to acknowledge the sfpd and their commitment to update it's safety video modeled on chicago's traffic enforcement for bicycle safety. it is crucial that this version include all california vehicle codes and traffic codes related to bicycles. the sfpd expects to complete and include this video in existing officer training program with a completion date of january 2014. since this injury --

jury has completed it's termed, we expect this to be fulfilled. we respectfully request that you perform this program as well as give bike lights during the campaign. the jury also recommended that bicycle education extend to private san francisco businesses and is pleased to learn that the sfmta and in conjunction with the bicycle coalition with a new bike program that will reach out to employers and employees. it is set to launch now. with the goal of targeting motorist

and a broader audience, the jury recommended that the sfmta insert flyers and promote bicycle education into sfmta renewal residential parking packets. unfortunately due to add ministrative and financial challenge this will not be implemented. the jury understand that you are looking to fund and target all roadway users and the jury request that you find cost-effective ways to reach out to all users and the share the road message and urges the mayor to prioritize it's funding. lastly the jury has followed up with the 2009-2010 recommendation that

the city establish a traveng school for bicyclist. at the time the report was written, the jury was told that the city would launch a diverse bicycle program this past summer. the jury has learned this program will not be established if the foreseeable future. it is due to primarily due to procedural difficulties with state superior court citation processes. we understand this program has been placed on hold but would like to be implemented once feasible. as the city encourages bicycling for residents, it must ensure safety for all users. the city must insert safety goals. let us not wait until the next bicycle related accident makes

introductions. >> i know you can speak louder than that. just so everyone and folks at home. >> following me sfmta will follow by p.d.. first we thank the jury in their interest. it is in incumbent on us to ensure their safety. we acknowledge that the mode of transportation comes into conflict and sometimes result in injuries or tragedy. the traffic enforcement safety are welcome. we agree with the jury that more can be done and address the response based on the report. i'm going to jump ahead to finding four and recommendation 4.1 and 4.2 since the mayor's office has asked us to respond to those

items. in regards to finding 4, sfpd needs laws. we agree. mayor supports all sfpd efforts in law. for example they used mobile devices for traffic citations and reports. the sfpd can quickly analyze where bicycle collisions are occurring. this is a way to analyze and improve traffic enforce many and we are fully supporti. recommendation 4.1. the mayor and board of supervisors should successfully enforce roadway laws by establishing a safety agreement that will pursue the goals of zero bicycle fatalities and annual reduction in bicycle collision. we the mayor's

office sfmta and p.d. acknowledge that this requires further analysis. we think the goals are laudable. in fact the recent complete safety task force was in response to a directive to reduce pedestrian injuries and fatalities. our idea is to the steering committee as well as recommended locations aengd nearing counter measures. this committee was previously led by sfmta and we understand they are willing to add this scope of work. recommendation 4.2 through collaboration of the sfpd, the dac and sfmta, the city shall build an enforcement and alert the plan that will follow. we believe this is already partially implemented.

the sfpd routinely implements traffic safety campaigns and plans on further traffic and safety enforcement. requiring further analysis would buy a campaign on bicycle safety. we have asked sfpd to work with the steering committee to see what campaign if any is necessary. in conclusion i want to thank the jury for their hard work and i'm happy to answer any questions. thank you. >> good morning. my name is patrick neale liaison with livable streets. i want to thank the civil grand jury and the mayor's office and the

advisory committee for their support in collaboration in improving safety for people biking. as the number of people biking in the last 5 years has grown dramatically, so has our effort increased to provide safe streets as well as our efforts to increase and diversify our bicycle safety education program. i'm going to speak to the civil grand jury report. no. 1, recommended expanding to non-cyclist and motorist. i'm very happy to report that we have added bike safety trainings for taxi drivers and munis operators for 2013. in terms of expanding bicycle safety for bike riders, we have launched a number of initiatives. we have a new bike safety initiation guide which is a much easier to read format printed in languages in

english, spanish and chinese and we have bike safety information, bike lights and promote safe lighting through our various social media channels. point no. 1, the civil grand jury recommends materials be placed in parking renewal paktd. it's the we recommend not implementing this. at the time we send out renewels for the permit. inserting anymore items would be cumbersome and difficult. we are working to expand the bike safety beyond the traditional by riders including having information at our community meetings relating to bike safety and bike share which is very visible downtown and there is information safety on the billboard this something that is very visible to all the

people downtown..1 through 3, the biking workshops. we do not believe this should be implemented at this time, the biking coalition who operates these courses are that most of them are subscribed. anything we want to identify funds increase and expand that particular program..point 1.4, safe classes and roadway behaviors and right now the mta we are seeking funds to ensure this message. it's something we are working on and these could buy a combination of billboards and munis ads and other messages. these message could include to get people to go riding and assessment -- safety. the jury recommends

biking lessons to private businesses wechl a program in place, the commute by bike. our first year goal for this pilot program is to engage companies which encompasses 7500 employees and we are making progress to identify who those companies will be. we'll be reporting back on how that program is working. finally the jury recommends an important safety campaign. we have the steering committee something that is already in place to expand that work. hopefully -- i'm free to answer any questions. i would like to thank our friends who implements the programs and classes that we find in the

city. thank you. >> just a quick question for you and you might have said this in your presentation and i might not have heard it. did you talk about or in your series of recommends recommendations, is there a strategy to reach lower working class neighborhood usually in the southeast and around district 11, south west side of san francisco. i know you have material in three languages but what about on the ground reaching people? >> our courses as we understand are held in every district in san francisco. we have had courses in district 11 and 10. the outreach, the bicycle coalition utilizes their media and supervisors office to help promote that. these bike lanes are very knew and we'll be thinking about how to get these

in the hands of people that need it across the city. >> these courses that are held in every district are they fully funded? >> it is a contract that is fully funded, correct. it's a 2-year contract that i believe will end next year. >> thank you. >> commander alley? >> good morning, i'm alley with the bureau assigned to the administration transportation agency. i had the pleasure of escorting members and i'm very connected someway to this report. the police department regarding recommendation 2.2 to establish bicycle safety training program for new recruits as well as on going

training in the continued education program for police officers, we agree with this. with that said, our current recruit officers receive approximately 16 hours of traffic enforcement training in our basic academy. as part of that 16 hours there is a full 1 hour of training to bicycle enforcement. i understand it's not enough. those same recruit officers receive 40 hours of traffic and collision training. this is something that is new. now every single police officers coming out of our police academy is coming out of our training. this certified training component, certified by post. one of three components. you have your basic, you are and immediate and advanced collision. so they

are well on their way to having a grasp of properly investigating collision. case in point issues such as taking the lanes. these are things that are discussed within this training component and that is specific to bicycle enforcement. within that 40 hours, there are a number of issues that are specific to bicycles that are addressed. from 2001-present. approximately 320 members of the department have been certified in bicycle operations. this is a 3-day in-house rigorous training that i myself have been a part of in addition to the initial training there is a recertification that takes place. so we have additional 260 members who have been recertified in that course. in regards to recommendation 2.2, whereas the sfpd should create

a bicycle safety video and models traffic enforcement and bicycle safety in california vehicle code and traffic codes related to bicycles, we are also in agreement. the department has reviewed the bicycle training program currently used by the city of chicago. it's a series of videos that addresses certain topics and we've been asked to produce similar videos to employ all applicable laws. there are so many laws that are local and state than to have them in a single video might be a bit overwhelming. the goal is to create a series of issues as appropriate. we are hoping to have that completed by january 2014. in regards to recommendation 3.1, sfpd should update the citation form to

include a categories of bicycle infractions. i'm happy to say that too has been implemented as of january 2014. the electronic process citation as well as the handwritten citation. regarding recommendation 4.2 which is a request for the police department to collaborate with the bicycle va c in the sfmta in the city should build an enforcement safety campaign around the goals in 4.1 and alert the public in the plans that will follow. in many instances this is also implemented. the sfpd has already implemented numerous traffic safety campaigns. for example, recent efforts were aimed at reducing traffic

driving and dui infractions and back to school enforcement with the 15 miles an hour speed limit around the school. it was an incredible success for kids going back to school. through discussions with the bicycle safety steering committee, sfpd would determine if additional enforcement campaigns are important. as these develop we definitely take great efforts to inform the public and to have a very collaborative approach in both education and enforcement as the educational issues develop. thank you. >> i have a quick question. who developed the training course that you are implementing for your officers? >> the 16 hours or the 40 hours? in both case, the both

training courses, the curriculum have been developed based upon the efforts of our own neighbors in collaboration with the existing best practice. for instance the 40-hour course is a standard investigative course offered throughout the state by other agencies in the topics of curriculum are the same. they are regulate in terms of the certification through the california commission on peace officer and standards. they approve the curriculum. >> you say the curriculum was certified by post. what does it stand for? >> post stands for california commission peace officers and training. >> thank you. supervisor tang? >> question for sfmta. the findings was that both agencies would launch an education

diverse program. i'm wondering if you would be willing to give more details on that. >> that was part of the discussion? >> the training? okay. >> the discussion is between sfpd, in courts in terms of developing a model that many instances in other counties that we can implement here. there have been some challenges typically the financial encouragement for bicyclist to participate in a diversion type program. for instance for cars, for operators of motor vehicles there is a series of financial incentives by state law. if you are operating a vehicle and given a citation, that violation is going to appear on your driving record. there is also substantial fine in many

instances in the tune of $300-400 depending on the violation and your insurance rates is going up. there is a serious incentive for you to go to traffic school within an 18-month period. for a bicyclist. any infraction, any citation you receive, there are no further consequence in terms of insurance. there is a fine, however. for instance a bicyclist going through a stop sign, they are looking at a fine that is just below $200. there is a cost associated which is a projected cost associated with the diversion plan. the big issue is how much wiggle room in many cases do courts have in reducing the fine in many instances that the state is mandated and there is certain elements to the fine that simply cannot be waved. there are some challenges

there. we are continuing the discussion and we are hoping to come up with an innovative approach to deal specifically with the bicyclist. part of that discussion also is potential legislation changes , state level in order to allow the courts to fully wave some elements of the fine. >> thank you. >> i have a question about responsibility. i'm driving a car and i hit someone either in a car or a pedestrian. i'm liable and i carry insurance and my insurance, i make the claim and the insurance pays out. when you are in a bicycle, and we've had several collisions in the past and that has resulted in fatalities particularly for bicyclist. what kind of legal remedy exist? >> the only legal remedy that appears is one civil process

between the person injured and the person responsible for that. obviously in the event of a death, you have a criminal proceeding potentially as well. anytime you have the loss of life coupled with a violation of traffic laws, you are looking at a potential at a minimum of -- the only remedy is a civil between the two parties. >> thank you. any other questions? seeing none, thank you commander. i believe the next presentation is the bicycle advisory committee. mr. hill. good to see you. >> good morning, supervisors,

cohen, katie tang and david campos. great to be here and appreciate the opportunity to be here this morning. i chair the bicycle committee as well as the current one. looking at this finding ahead i will review them quickly. finding no. 1, i won't repeat it again, but the bicycle safety committee grease with the finding on paragraph two and say that we have met with sfmta and sfpd and the representative of the bicycle coalition members and members of the superior court from 2011-2013. at this time there is little prospect for the same reasons the commander said that we have two particular problems with the citation diversion. the first of all is the amount of fines are defined by the state and i had asked at that time if we can look for relief through

our representative to perhaps move for modification in the law that actually deals and the reason for this is when we first started, every county in the state has their own system for bicycle citation diversion. this is only in a few states and counties had it. these days most counties have some forms for dealing with this and this time we should add a process. this is somewhere where it's justified with the vast increased associated with them. the other authentic -- thing is the process of the sworn officers. which is the administrative handling is extremely bulky and that's what they can do something in providing the funding to fund that part of the process. we

encourage something the board would be active and supportive with it. in 1.1, we are unaware of any expansion program for beyond munis operators and taxi programs. the munis operators were commented and the 1 hour training sessions that bicycle incidents after this meeting. 1.2, we recommended further analysis, the bac unaware of any plans. there is a relative consensus on that. recommendation 1.3, the vac is unaware of any incentives to provide bicyclist who committee a workshop. currently those who complete a course receive a

certify icate: i'm not sure we need to do a lot more in that area but we need to do a lot more in certainly promoting. 1.4 was publicized classes roadway behavior recommendation requires further analysis. i would comment because i teach those classes on the 4-hour ride that attendance has dropped off recently. the city has done a 1 hour course which is pretty good. it doesn't get into the detail handling in the road as well as getting the right type of bicycle and detail and that sort of authentic. -- thing. the 1 hour course is a great program. but the 4-hour is probably needed to build confidence as well as the ability to know how to handle yourself in
